OTHER BUSINESS: 1. Ordinance No. 811 -A amending the zoning ordinance to permit certain additions to nonconforming single family dwellings. Attached is a proposed ordinance amendment which exempts single family homes from receiving a new variance each time the structure is altered if the present structure is nonconforming. The only exception is lot coverage. Presently, many homes built in the City were built with five foot side yard setbacks, and our ordinances now require that each time the owner wishes to alter the, present building he must receive a variance because.the present setback requirement is 10 feet. This requirement holds true whether or not the addition or alteration occurs within that setback area. 2. Ordinance No. 801 -All relative to subdivision financing agreements to delete the requirement to record an agreement to pay special assessments, to specify the kind of letter of credit that will be accepted, and to require written agreements on escrow deposits. a This is an amendment to the subdivision ordinance which allows a developer to submit security other than a performance bond and identifies how . letters of credit or escrow deposits for this purpose shall be. submitted. 3. Hennepin County Transportation Report. Attached please find a memorandum from Mr. Fran Hoffman, the Assistant City Engineer for Traffic and Transportation. This memorandum reviews the final draft report of the Hennepin County Transportation System Study which was submitted to the Planning Commission at their last meeting. Mr. Hoffman finds two exceptions to their study, which he has identified in his memorandum. The Planning Staff recommends that the Planning Commission accept the final draft report contingent on its being amended as suggested by Mr. Hoffman. Section 8 of Ordinance No. 801, as amended, is hereby amended to read as follows: "Sec. 8. Responsibility for Improvements; Subdivision Financing Agreements. When preliminary approval has been given to a plat, the person or persons who filed such plat (herein called the 'Developer' whether one or more) shall cause all street, water and sewer improvements required by the resolution granting such approval to be completed, at his own expense and under the supervision of the Village =s C_i_ty's Director of Public Works and Engineer- ing, or in lieu of making such improvements, he shall sign a subdivision- financing agreement (herein called the 'Agreement'). Mr. C. Johnson seconded the motion. All voted aye. Motion carried. IV. OTHER BUSINESS: 1. Ordinance No. 811 -A -- (Amending the Zoning Ordinance to Permit Certain Additions to Nonconforming Single Family Dwellings). Mr. Sand stated the current zoning ordinance requires that a variance be obtained for a nonconforming structure if an addition, conforming or nonconforming, is desired; in most cases approval of a variance is practically automatic if the proposed addition would conform to current ordinances. The variance process, however, costs $50 and often causes undue construction delays. The proposed ordinance amendment would allow additions to nonconforming single family homes without a variance if the addition will conform to the current codes and if the dwelling will not exceed the maximum lot coverage requirement. A variance would still be required if the proposed addition will be nonconforming or if the dwelling would exceed the maximum allowed lot coverage. Mr. Kremer moved the proposed zoning ordinance amendment permitting certain additions to nonconforming single family dwellings be approved as presented. Mr. C. Johnson seconded the motion. All voted aye. Motion carried. 2. Ordinance No. '801 -All (Relative to Subdivision Financing Agreements to Delete the Requirement to Record an Agreement to Pay Special Assessments, to Specify the Kind of Letter of Credit that will be Accepted, and to Require Written Agreements on Escrow Deposits). Mr. Sand explained the proposed subdivision ordinance amendment would allow developers to submit securities other than performance bonds, and identifies how other securities shall be submitted. He noted the ordinance amendment reflects the City's current policy and procedures. A motion approving the proposed ordinance amendment - relative to subdivision financing agreements was made by Mr. C. Johnson and seconded by Mr. Kremer. All voted aye. Motion carried. 3. Hennepin County Transportation Report. Mr. Hughes referenced a memo from Fran Hoffman, Assistant City Engineer for Traffic and Transportation, reviewing the final draft report of the Hennepin County Transportation System Study. Mr. Hoffman explained in his memo that "the study addressed transportation issues with major emphasis on existing and future roadway systems which have county (metropolitan) significance ". He recommended: 1. that the City retain control over W. 50th Street, proposed in the study to be changed (from France Avenue to Highway 100) from City to County jurisdiction; and 2. that Lincoln Drive north of Nine Mile Creek be excluded from a proposed "recommended year 2000 roadway network" since, the City Council has resolved that that roadway will not extend north of the creek. Mr. Hoffman concluded the draft report "appears to be a reasonable set of guidelines, in concept, for the County to follow as the recommendations relate to the City of Edina ". Discussion followed regarding the final draft report and Mr. Hoffman's comments. Mr. Dunn indicated that Hennepin County has asked that the Planning Commission make a recommendation to the City Council and that the Council transmit a resolution accpeting the report with their comments and concerns, if any. Mrs. McClelland reported the draft report is not final, and it must eventually be resub- mitted to the City in final form. Mrs. McDonald moved that the Planning Commission recommend the Council accept the Hennepin County Transportation System Study draft, with Mr. Hoffman's comments. Mr. C. Johnson seconded the motion. All voted aye except Mr. Kremer, who feels "it is a serious mistake not to run Lincoln Drive through to the north ". Motion carried. 4. Southdale Presentation by U of M Architecture Students. Mr. Sand explained that during winter quarter six teams of third and fourth year architecture students from the University of Minnesota reviewed the development CLARIFICATION OF ALLOWED MULTI - FAMILY DENSITIES IN THE SOUTH, SOUTHWEST, AND WESTERN EDINA PLAN AREAS All multi - family developments with more than two units per structure shall be zoned Planned Residenti4l District rather than R -3, R -4, or R -5. 2 The density of any parcel or tract of land shall be no greater than identified by the comprehensive plan governing that tract or parcel. �. The maximum allowed density governing any tract or parcel of land in the South, Southwest, and Western Edina Plan areas shall be reduced cumulatively (up to 500) by the following identified percentages if the following identified situations are applicable: THEN REDUCE DENSITY IF THE PARCEL OR TRACT: BY THIS PERCENT A. Is between 1500 feet and 3000 feet from an accessible freeway interchange 5% B., Is greater than 3000 feet from an accessible freeway interchange 10� NOTE: The distance from a freeway interchange shall be measured from the center of the overpass of the interchange along the centerline of the principal existing or proposed street or streets to the nearest point of property adjacent to the principal street. In cases of a partial interchange, the distance shall be halved. C. Is within 200 feet of an existing and developed R -1 or PRD -1 subdivision (nearest point to nearest point) 10% D. Contains land below a high water mark.identified 100% for that portion by the City affected E. Contains land designated as floodplain in Edina Ordinance No. 815 or defined as wetlands of Type 3, 50 %*for that portion 4, or 5 by U.S.F.W.S. Circular 39 affected F. Contains land within 100 feet of a 10 -acre water - body or of a creek but not in the floodplain or wetlands of Type 3, 4, or 5 as defined by U.S.F.W.S. Circular 39. 25% for that portion affected G. Modification of Densities in Comprehensive Plans. 7'L�pp v" i' Mr. Luce reported the City Council has from time to time discussed the densities proposed by the comprehensive plans and has noted that the majority of rezoning requests are for the maximum density shown. The Council has indicated their desire to reduce those densities and has asked for suggestions and direction from the Planning Commission. Discussion followed. It was generally agreed that reducing the maximum densities "across the board to 'x' units per acre" would not be a reasonable solution. Mr. Luce agreed to prepare a list of factors or criteria, such as the location of a site or certain characteristics of the site itself, for review at the next Planning Commission meeting which might be used by the developer to increase or decrease density accordingly. No action taken. LAND USE DENSITY MODIFICATION'S DISCUSSED. Mr. Luce advised that he had presented alternatives which the Planning Commission could use as a guide to reduce land use densities and said that the Planning Commission had requested that he furnish _them with a list of conditions that could be used as a basis to determine modifi- cations. No action was taken. -7--7--75— --7 ---7S C—C MAXIMUM DENSITIES IN COMPREHENSIVE PLANS DISCUSSED. Councilman Richards commented on the July 2., 1975 Planning Commission minutes in regard to the request by the Council to submit recommendations for lowering densities on rezoning requests. Mr. Luce explained variables such as traffic pattern, flood plains, interchanges, preserving natural resources, etc. Discussion followed with the request from the Council that the Planning Commission prepare density alternatives that are of i sound planning. V. OTHER BUSINESS: Z_ Modification of Densities in Comprehensive Plans. Continued from ►.Jso 7 -2 -75. 1 Mr. Luce recalled the Council's desire to reduce multi - family densities in comprehensively planned areas of Edina and the discussion held in that regard at the 7 -2 -75 Planning Commission meeting. He presented a formula prepared in response to that discussion whereby reductions in density would occur according to certain measurable site characteristics, such as greater than 6% slopes, the distance from an accessible freeway interchange, the amount of land below an established high water mark, or land located within or in proximity to a flood plain or certain wetlands. For comparison purposes, Mr. Luce presented a chart illustrating the effect of the proposed "clarification" of allowable densities on three properties in Western Edina and one in Southwest Edina. He noted this formula would not affect land which is already zoned. Discussion followed. Mr. Hughes suggested the present density.ranges be reduced so the low end of that range becomes the maximum density allowed on properties within a comprehensively planned area. Mr. G. Johnson suggested the proposed formula apply only to undeveloped properties in the Southwest or Western Edina Plan areas, as it has been generally accepted that properties in the South Edina Plan . area will be developed at higher densities, hopefully with buildings of Type 1 construction. It was generally agreed that reducing densities "across the board to 'x' units per acre" would not be a reasonable solution and would be arbitrary. Mr. G. Johnson moved the Planning Commission recommend approval of the staff's proposal for reducing allowable multi - family densities, but that the density clarification should be applicable only to land located within the Western Edina Plan and Southwest Edina Plan areas. Mr. C. Johnson seconded the motion. All voted aye. Motion carried. Luce reviewed a plan which had been requested by Council and had been reviewed by the Planning Commission which would reduce permitted multi - family densities in the Southwest and Western Edina Plan areas for properties which are five acres or greater. Under the plan, all proposed multi - family developments with more than two units per structure would be zoned Planned Residential Development, rather. than R -3, R -4 or R -5, the density of any parcel or tract of land shall be' no greater than identified by the comprehensive plan governing that tract or parcel, and the maximum allowed density governing any tract or parcel of land in the Southwest and Western Edina Plan areas shall be reduced cumulatively (up to 50%) by.the following identified percentages if the following identified situations are applicable: THEN reduce density IF the parcel or tract: by this percent A. In cases of a partial interchange, the dis- tance shall be halved. Under the formula, units per acre for the Lowry Hill property located on the Southwest corner of Dewey'Hill and Cahill Roads would be reduced by 452, the Hansen property North of Vernon Avenue would be reduced by 15% and the Hansen property South of Vernon Avenue would be reduced by 35%. Although under the formula Krahl Hill would be reduced by 65%, the 50% maximum reduction clause of the proposal would apply to this property. In response to questions of the Council, Mr. Luce explained that the original densities were based on existing traffic plans and sewer and water systems. He explained that he believed that some areas could handle greater densities and that it would be arbitrary to reduce densities across the board or to the current minimum density range figure. Mr. Erickson opined that the Council would be in a stronger position, if there should be arguments over the application of the formula, if the amendment is duly adopted in public hearings before the Planning Commission and the Council, as each plan war. originally adopted. In response to a question of Councilman Richards, llr. Erickson recalled that a "plan" sin,131y specifics that certain densities are desirable for a given area, lie said that Council could act to amend its zoning ordinance to cut dow n density.raages or establish a greater number of classifications into which property could be rezoned. Mr'. Luce said that he would prepare a list of existing major tracts of land which would indicate maximum densities permitted at the present time, along with densities permitted under the proposed guidelines. Council also directed that, although not legally required, mailed notices be sent to all affected pro- perty owners and neighborhood associations along with published and posted notices. II. PUBLIC HEARING on Clarification of Allowed Densities in the South, Southwest, and western Edina Plan Areas. � I Mr, Luce recalled that at the 7 -30 -75 Planning Commission meeting, the it rove a formula for reducing the allowed multi- Commission recommended the Counc app family densities in comprehensively planned areas of Edina, prepared by the staff at the Council's direction and in response to discussion held at the 7 -2 -75 Planning Commission meeting. The Planning Commission. indicated, however, that that formula should not apply to the South Edina Plan because that plan already contains extensive traffic and land use controls and the land in that plan area has no significant environmental characteristics. Mr. Luce indicated that at their last meeting the City Council asked that the Planning Commission hold a public hearing pursuant to -state statutes to formally amend the comprehensive plans, including the South Edina Plan, to reflect that density clarification. Mr. Luce presented and read the proposed staff formula for reducing densities vhich'provides that: all multiple family developments with more than two units per structure shall be zoned PRD; the density of any parcel shall not be greater than that allowed by the comprehensive plan; and the maximum allowed density shall be reduced cumulatively up to 506 according to certain measurable site characteristics such as the percentage of slopes, the proximity to an accessible freeway interchange and residential areas, and the amount of land below an established high water mark or within or in proximity to a flood plain or wetland. He noted this formula would not affect land which is already zoned. Mr. Luce stated that letters were received from Mr. John Hedberg of Hedberg . and Sons and from Mr. Bill Howard, spokesman of the Southwest Edina Homeowners Association, in response to the notice of public hearing mailed to the affected homeowner's associations and to the owners of property of -5 acres or more. Mr. Hedberg asked that the South Edina Plan be excluded from this clarification, and :Ir. Howard indicated he is in favor of the proposal and that he, too, had contacted the other homeowner's associations as well as the residents in his neighborhood. Emphasizing that the deductions illustrated are purely estimates and are by no means factual, Mr. Luce reviewed a chart identifying the affect of the proposed density formula on four sites chosen for illustrative purposes. He noted that a pending law suit was brought by Karl Krahl and the Gittleman Corporation against the City of Edina, and the plaintiffs have requested an injunction prohibiting Council action on the proposed density clarification. Mr. Rick Davies (5412 Malibu Drive), representing the Parkwood Knolls/ Malibu Heights Homeowners Association, and Mrs. Dick Seaberg, representing the i Viking Hills Homeowners Association, stated they support the adoption of the staff formula for reducing densities. Mr. Bill- Howard (5808 Dewey Hill Road) , spokesman for the Southwest Edina Homeowners Association, agreed, adding that he believes the i prospects for reducing traffic in Southwest Edina will be greatly enhanced if the proposed density clarification is approved and the comprehensive plans amended. Discussion followed. In reply to Mr. H. G. Haglund, Mr. Luce indicated he could not guarantee a reduction in,taxes if the proposed density clarification is adopted and the comprehensive plans are amended; however, any change in market value would be reflected by the City Assessor and may adjust the taxes. ' Mr. William Dale stated he has owned a 1/3 interest in the "Lowry Hill' property for 15 years. He recalled that "about two years ago we had a sale for i the property in which a developer was going to build a three and four story wood frame building with the appropriate number of units on it but it would cover quite L a bit of ground. That was passed by the Council but the money crunch came in and j the developer wasn't able to go ahead on it. Now we have a developer who wants to develop it at the allowed number of units in the plan, but in place of four stories wants to build five stories of concrete and steel; it would cover 24 percent of the land but the rest would be open space." He stated he has been paying taxes on the property for 15 years. "Now the City wants to cut the density in half and the value is determined by the density allowed. I don't agree with this at all and I am protesting this action." Mr. Harvey Hansen stated that he purchased a small parcel of land immediately, adjacent to the Braemar Oaks apartments based on the density allowed in the South- west Edina Plan and based on his experience with Braemar Oaks. He commented "for the record" that someone in a similar position may eventually cost the city a great deal of money in legal fees. Mr. Hughes, Mr. Lewis, and Mr. Runyan stated they are in favor of the proposed density clarification. Mr. Hughes and Mr. Lewis noted that the Planning Commission has been urging developers to reduce density for years. Mr. Runyan noted he supports the proposal because it responds to the wishes of a great many residents of Edina. Hr. Hughes moved the Planning Commission recommend the amendment of the Western Edina Plan and Southwest Edina Plan to incorporate the proposed density clarification formula, and, further, that the Planning Commission recommend the South Edina Plan not be amended because traffic and land use controls are already an integral part of that plan. Mr. Runyan seconded the motion. All voted aye. Motion carried. Mr. Luce recalled that Council had instructed the Planning Commission to consider the amendment of the comprehensive plans of South, Southwest and Western Edina, but that the Planning Commission had recommended that no modification be made in the South Edina Plan at this time. He explained that property zoned R -3, R -4 and R -5 before 1971 would be excluded from such restrictions. Mr. Rick Davies, spokesperson for Parkwood Knolls- Malibu Heights Residents' Association, spoke in support of the reduction of densities recommended by the staff and by the Planning Commission. Councilman Richards said that some people are of the opinion that the proposed modification does not go far enough and encouraged Mr. Davies to make additional requests for density reduction. Mrs. William Scott, 6613 Southerest Drive, expressed concern that the South Edina Plan is not proposed to be modified. Mr. Robert Hansen, owner of property on the South side of Krahl Hill, questioned the fact that, once the road is built on his property, the only property remaining would be on the hill and under severe restrictions. Mr. Luce told Mr. Hansen that his property would probably be allowed six units per acre under the proposed modifications. Mr. W. H. Howard, speaking for the Southwest Edina Homeowners Association, said that his group feels that they would support the modification as being a fair compromise to everyone concerned. Mr. Richard Seaberg, President of the Viking Hills Homeowners' Association, said for the record that "to maintain the high quality of Edina landscape, to protect what remains of the natural environment and to minimize the potential increase in both traffic and fire hazards that could result from increased density, we whole- heartedly, we agressively, we enthusiastically, and we joyously recommend as a minimal the adoption of the proposed density guidelines "'. Mrs. Alison Fuhr, 6609 Brittany Road, questioned the 0 - 12 density, the water table and the wet - lands, but said that she,. thinks that it is a commendable plan overall and that she wholeheartedly supported the reduced densities. Mr ..Luce responded by saying that established criteria had been used in making the recommendations and that many houses built below the water table. He said that consideration of the water table should be more the concern of the developer and that if the water table is to be considered at this point, it should also be pursued for all structures. A representative of Lowry Hill Enterprises objected to the modifi- cations, saying that they are trying to construct quality housing and have made their plans in compliance with the density requirements of the Southwest Edina • a Plan. A resident of Dewey Hill Road and Mrs. Charlotte Burns, 5820 Dewey Hill Road, expressed concern about existing densities and a proposed five story build- ing. firs. Helen McClelland of Continental Drive, asked how Western Edina density spreads could be further reduced. Mrs. Ann Overholt, 7 Overholt Pass, supported the proposal as a "first step" toward .reducing densities. Reference was made to a letter from Mr. John W. Hedberg of Hedberg & Sons, requesting that the South Edina Plan be deleted from the proposed clarification of permitted multi - family densities in Edina. In response to a question of Councilman Richards, City Attorney Erickson said that he believed that if the plan is applicable at all, it should be applicable for all properties covered and that he would not recommend that any action be taken at the present time on properties other than the Krahl property. As recommended by Mayor Van Valkenburg, Councilman Courtney's motion continuing the matter until September 15, 1975, so that-the Council will have an opportunity to read the restraining order, was seconded by Councilwoman Schmidt and carried. This last year sanitary sewer, :•rater and storm sewer lines were recently installed in York Avenue and ''Nest 76th Street. These facilities were sized to more than accomodate tide density and uses which are permitted under the South Edina Plan. We and other property owners will be paying special assessments for these utility services based on tae capacity to serve the densities and land uses permitted by the South Edina Plan. 4. Under the South Edina Plan there is proposed approximately 11 acres of park land and commuter trail to be established in the "exception area ". In addition, there are recent proposals by the City Council to increase further the amount of park land in the Southeast Edina area. The existence of considerable open space and park land is another reason for not lowering the density of the development. For the reasons I have set forth above, it would be my request that the South Edina Plan be deleted from the proposed clarification of allowed multi - family densities in Edina. Based on t;:e tvne of development occurring in the surroundinc, area, they concluded that the develonment of the "exception area" should not be tied down to definite land uses, but rather with certain specific x ez^_eptions the area could be developed for non - residential or resi- dential purposes with the density of such develcp::ients to be controlled`, e by traffic generation standards set forth in the report. These traffic controls are in accordance with the findings of the consulting firm of Daniel, Tarn, Johnson, & 1.1endennall (DP4J'ia). I would expect that this decision will be made in the next month. The staff will then begin immediately to prepare reports to the Planning Commission, and a plan modification should be available for Council's review sometime this spring or summer. The staff is also concerned that the new Mandatory Planning Act, which is expected to be passed by the legislature and signed before mid - April, will have a significant effect on whatever planning we may do (more on this later). L CITY OF EDINA Its............ _.......Pflit Clark_ 1 i f I f f AGREEMENT BETWEEN CITY OF EDINA AND CITY OF RICHFIELD FOR JOINT PARTICIPATION IN CONSTRUCTION OF STREET GRADING, "STREET SURFACING AND CURB AND GUTTER IMPROVEMENTS ON XERXES AVENUE THIS AGREEMENT is made and entered into as of the day of 1976. The parties to this agreement are the CITY OF EDINA, a Minnesota municipal corporation ( "Edina "), and the CITY OF RICHFIELD, a Minnesota municipal corporation ( "Richfield "). The purpose of this agreement is to provide the basis for joint participation by Edina and Richfield in the improvement of portions.of Xerxes Avenue (the boundary street between Edina and Richfield) ty,: regrading, resurfacing, curb, gutter and driveway improvements and incidental storm sewer construction. Such improvements are hereinafter collectively referred to as "the improvements." In consideration of•their mutual covenants and agreements, the parties hereto contract and agree as follows: Section 1. Richfield will construct the improvements in accordance with plans and specifications dated entitled Street Paving, Richfield, Minnesota, prepared by Orr- Schelen- Mayeron & Associates, Inc., and approved by Edina and Richfield, which plans and specifications are hereby made a part hereof by reference thereto. The total estimated cost of the improvements on Xerxes Avenue is $199,107, with which estimate Edina and Richfield hereby agree. .*Section 2. Richfield will advertise for bids for the construction of such project in conjunction with its 1976 street improvement program, which is designated as Richfield's "City Project No. 674." Richfield will, upon receipt of such bids, award a contract for the construction of such project to the lowest responsible bidder. Proceedings taken by Richfield in awarding the contract and making the improvements shall be in accordance with Minnesota Statutes, Chapter 429. In the contract Richfield shall provide that Edina shall have the right to enforce, as to any of the improvement work done within Edina, any bonds and also any warranties and guaranties given by the contractor pursuant to the contract. Edina and Richfield, and their respective officers, agents and employees, shall cooperate fully with each other in the construction of the project and in carrying through the provisions of this agreement and the provisions of the contract awarded by Richfield pursuant hereto, including enforcement of and recovering under any bonds or other security, and any warranties or guaranties, given by the contractor pursuant to the contract. Section 3. The costs of each type of construction work comprising ? part of the improvements shall be prorated between Edina and Richfield on the basis of the amount of such work which is performed in eachpf the two municipalities. Edina will pay its pro rata share of the costs of con - struction of such improvements when construction is completed. Prior to such payment, Richfield will provide Edina with a verified statement of all i costs incurred in connection with the making of the improvements with a j prorating of such costs showing the basis of prorating. Within one month t after receipt of such verified statement, Edina will pay its pro rata share of such costs to Richfield in a lump sum. l! Compensation paid and to be paid shall be $100 per month per participant subject to following: A. Must actually perform 80 hours service to City for pre- ceding year in order to qualify for retention as member of the Senior Police Reserve. (ii) If permanently residing within seven county metropolitan area and is able and willing to perform services, as requested, then participant qualified to remain as member of Senior Police Reserve even if 80 hours of work has not been performed by participant in that preceding calendar year. (iii) If not permanent resident of seven county metropolitan area, participant who returns to reside temporarily in area for a minimum of a total of ten days and makes known to the City Manager his willingness, availability and ability to perform services as requested by the City Manager shall be deemed to have met the service requirement set forth in this paragraph 2. V 3. In any event, compensation paid under the Plan shall cease when participant reaches the age of 75 unless the City Council of the City by majority vote determines that partici- pant shall be able to continue as a member in good standing of the Senior Police Reserve. A. In order for City Council to determine that partici- pant may continue to be member in good standing under the Plan, Council must make affirmative findings that participant is physically and mentally competent to perform those services any participant under Plan has been called upon in the paste perform. Hyde, City Manager From: Florence Hallberg Subject: Voting Machine Tune -up As I indicated to you at the time you heard the Votomatic presentation, we have experienced some difficulties with our voting machines. While most of the problems have been of a minor nature, voting machine custodians have been unable to determine the cause of difficulty with two of our machines. Attached is a copy of a letter describing a Tune -up Program which is available from the AVM Corporation. In addition to the cost of $50.00 per machine, there is a charge of $2.50 per machine to change the cords on the curtains from nylon to wire. (About half of the machines already have wires.) This would eliminate approximately 90% of our trouble calls on Election Day.. This item was not included in the 1976 budget. However, if funds are avail - able, -I would suggest the authorization of approximately $4,410.00 to over- haul and change the cords on our 86 old voting machines, with the under- standing that there may be an additional expenditure for any major problems which might be discovered during the tune -up. I have contacted six municipalities who have used this service and they have all indicated that they were satisfied with the results. Gary West, who has worked in setting up the voting machines in the past, concurs that servicing these machines at this time will be good insurance against any breakdowns that might occur when we will be having a heavy voter turn- out at the November 2 election. Hyde, City Manager FROM: Gary West, Administrative Services Coordinator DATE: April 29, 1976 SUBJECT: MOWER FOR GOLF COURSE The City Council in their approval of the 1976 Golf Course Capital Improvements Budget, approved the purchase of a grass mower to replace a 12 year old model. The amount budgeted was $4,800. This is for a large four - wheeled rotary mower to be used in the heavy rough and other areas not suitable for use of the reel type mowers. Unfortunately, there is only one manufacturer of such a mower with a liquid cooled engine, which the Park Department feels is necessary to insure a long operating life for the mower. Toro's Groundmaster 72 meets the needs of the golf course for a heavy duty mower and it is recommended that it be purchased from Minnesota Toro, 850 France Ave. S., St.. Louis Park, the only distributor. We have a quote from Minnesota Toro for $4,350 for the mower and $265 for a roll bar which meets OSHA standards. Mr. Luce recalled that, following preliminary approval by the Council, the Comprehensive Plan Amendment had been approved by the Metropolitan Council and is now before the City Council for final approval. Mr. Luce reviewed the clarification of allowed multi- family densities in the South, Southwest and Western Edina Plan Areas which pro - vided that all multi- family developments with more than two units per structure shall be zoned Planned Residential District, rather than R -3, R -4, or R -5, that the density of any parcel or tract of land shall.be no greater than identified by the comprehensive plan governing that tract or parcel and explained that maximum allowed density governing any tract or parcel of land in each Plan area shall be reduced cumulatively (up to 50 %) by certain identified percentages and certain identified situations. Mr. John Hedberg, representing Hedberg & Sons Company, protested that the Planning Commission had recommended that the South Edina Plan be deleted from the Comprehensive Plan Amendment. He referred to a letter dated August 28, 1975 which he had sent to the Council and to the Planning Commission. This letter had pointed out that Southeast Edina is considerably different than other vacant properties in Edina and, therefore, the proposed reduction of allowed multi - family densities should not apply to the South Edina Plan, and.particularly to the Southeast area for the following reasons: 1) that there are no environmental concerns in the area; 2) that land use and density are controlled by reference to traffic trip generation criteria and that the South Edina Plan sets forth a commuter trail between W. 70th and W. 76th Streets which is set up as a possible strip for transit facilities in.the area to handle the traffic which may be generated from.existing commercial developments and future. non- residential and residential development in that area; 3) that sanitary sewer, water and storm sewer lines were sized to accomodate the density and uses which are permitted under the South Edina Plan; and 4) that there is considerable open space and.park.land in the area. West, Administrative Services Coordinator SUBJECT: LABOR AGREEMENT WITH OPERATING ENGINEERS, LOCAL NO. 49 We have at last been successful in securing an Agreement with Operating Engineers, Local No. 49 for 1976. This provides for no changes from the 1975 contract with the exception of salaries for the Light and Heavy Equipment Operators. The Council approved the wage increases February 23 on the basis of a signed memorandum of understanding and pending the signing of a contract. Now that agreement has been reached, State statute requires the Council implement the agreement by resolution.
