ORDINANCE NO. 1232
AN ORDINANCE REGULATING THE USE OF
MUNICIPAL PARKING FACILITIES AND
PROVIDING A PENALTY AND
REPEALING ORDINANCE NO. 1231
THE COUNCIL OF THE CITY OF EDINA, MINNESOTA, ORDAINS:

Section 1. Hours of-Parking Limited. No person shall park any vehicle
in any municipal parking facility for a period in excess of the time limits,
as berre4n establishe during business hours. Persons may park in any muni-
c pa p k1n acility for any length of time d -ing nonbusiness hours

(a) Municipal parking facility shall mean any lot or ramp, and the lanes
giving ingress thereto and egress therefrom, and all accessories thereof, owned
or operated by the City of Edina or the Housing and Redevelopment Authority
of Edina, Minnesota, herein called "H.R.A.," and made available to the public
for parking of private motor vehicles, whether for a fee or at no cost. It
shall not include parking spaces located along public streets and highways.
(b) Ramps shall mean the two municipal parking facilities located in
the 50th & France Commercial Area, one north of 50th Street and one south of
50th Street.
. (c) The 50th & France Commercial Area shall mean the area within the
City included within the plan prepared by the H.R.A. entitled "50th & France
Commercial Area Plan," dated December 3, 1974.
(d) Business hours shall be from 8:00 a.m. to 8:00 p.m. of each day,
except Sunday, or such other hours during such days as may be set from time
to time by resolution of the City Council for any one or more of the municipal
parking facilities. Any business hours hereafter set by the City Council shall
coincide, as closely as possible, with those hours during which any substantial
portion of the businesses in the business area of the particular municipal park-
ing facility shall� be e�� - y
(e) The City Council amby from time to time,
time 1i for all or certain portions of any one or more of the municipal
parking facilities. In setting the time limit, the City Council shall be guided
by the purpose of allowing maximum use of the municipal parking facilities by
patrons of businesses located in the business area of each municipal parking
facility. Time limits shall be posted in a conspicuous manner, as determined
by the City Manager, on the municipal parking facilities.
Sec. 3. Exceptions, Permits. Vehicles identified by a sticker issued
by the City under this section may be parked in the ramps in excess of t'.:n time
limits, but only in such locations in the ramps as shall be designated from
time to time by the City Manager. Locations designated by the City Manager
shall be those that are least convenient for patrons of businesses located

in the business area of the ramps, except that parking for physically handicapped
employees, as defined in Ordinance No. 1401, may be located in other places in
the ramps. Locations so designated for employees and for physically handicapped
employees shall be posted in a conspicuous manner, as determined by the City
Manager. The stickers shall be issued by such City department or City staff
personnel as the City Manager from time to time shall designate, and shall be
issued only to persons to be designated by the City Manager. The City Manager
may direct the issuance of up to 400 such permits to persons who are employed by
businesses in the 50th & France Commercial Area. Persons desiring a sticker
shall apply to the City Manager for a sticker on forms provided by the City Man-
ager. Upon issuance of each sticker, the recipient shall pay a fee of $12 for
the calendar year, or such part thereof then remaining, and furnish a description
of the make, year, body style, color, and license number of the vehicle to which
it is to be fastened. Stickers shall be numbered consecutively and shall be
valid only for the calendar year in which issued. The City shall keep a record
of the number of the sticker and the description of the vehicle. The sticker
shall be fastened to the left rear bumper of the vehicle and shall be visible
at all times when the vehicle is parked in the ramp. When the vehicle is sold
or traded and another vehicle is acquired, the City, upon application for a new
sticker for the remainder of the calendar year, accompanied by a description of
the new vehicle and its license number, shall issue such new sticker, without
charge, and show the old sticker as having been canceled. Whenever a person
to whom a sticker has been.issued shall cease to be regularly employed upon
the premises where he was employed at the time the sticker was issued, the
employer shall notify the City of such fact, and the City shall cancel the old
sticker. No person shall park a motor vehicle in parking spaces designated
and reserved for physically handicapped employees unless the permit required
by this ordinance be fastened to the vehicle as herein required, and unless
that person is physically handicapped or operating a vehicle under the direction
and for the use of a physically handicapped employee and such vehicle also has
displayed prominently upon it an identifying certificate issued to physically
handicapped persons by the Minnesota Department of Public Safety pursuant to
Minnesota Statutes, Section 169.345.

RESOLUTION OF CONGRATULATIONS
WHEREAS, on September 16, 1976, while delivering his morning paper
route, Thomas Tichawa observed three males removing furniture from the
lobby of The Lanterns Apartments into a van; and
WHEREAS, Thomas became suspicious of such activity inasmuch as he was
familiar with the furnishings in the lobby of The Lanterns; and
WHEREAS, Thomas Tichawa promptly reported his suspicions to the Edina
Police Department, giving them the license number and the description
of the van; and
WHEREAS, because of the alertness and the accuracy of the information
which Thomas Tichawa furnished to the Edina Police Department, the
vehicle was located in St. Paul, a suspect arrested, and all property
recovered within twenty -four hours;
NOW, THEREFORE, BE IT RESOLVED that the Edina City Council does hereby
express its congratullations and sincere appreciation to
THOMAS TICHAWA
for his astute observation and does express the thanks of the community
as a whole for his efforts toward the solving of this crime.

RESOLUTION OF APPRECIATION
WHEREAS, Howard W. Merriman has resigned as Director of Athletics for the
Edina Public School System; and
WHEREAS, Howard W. Merriman has served the Edina Public School System
since 1944, starting as a teacher and being promoted to the position of
- Athletic-Director in-1953; -and
WHEREAS, Howard W. Merriman served the City of Edina as its part -time Dir-
ector of Recreation from 1947 to 1955, during which time he organized and
developed an extensive youth program of.swimming, baseball and youth
hockey;
WHEREAS, Mr. Merriman pursuaded- theLthen Morningside Village Council to
develop Weber Field which was the first formal baseball field in Edina;
and
WHEREAS, over these many years, Howard W. Merriman has been instrumental
in the development of many young people of the City of Edina;
NOW, THEREFORE, BE IT RESOLVED that the Edina City Council does express, on
behalf of the citizenry of Edina, its sincere thanks and appreciation to
HOWARD W. MERRIMAN
for a job well done; and
BE IT FURTHER RESOLVED that the City Council extend to Howard W. Merriman
a permanent.pass for all Edina High School hockey games played at Braemar
Arena; and
BE IT RESOLVED FURTHER that a copy of this resolution be spread upon the
Minutes Book of the City of Edina and that a suitable copy be presented to
him upon his retirement.

APPROPRIATION OF MUNICIPAL STATE -AID FUNDS TO SUPPLEMENT
CITY OF EDINA HRA PROJECT
WHEREAS, it has been deemed advisable and necessary for the City
of Edina to supplement a construction project located on France
Avenue, within the
limits of the municipalities of Minneapolis and Edina by participation
in the construction of traffic signals on portions thereof; and -

RESOLUTION ADOPTING BUDGET FOR THE CITY OF EDINA
FOR THE YEAR 1977, AND ESTABLISHING TAX LEVY FOR
THE YEAR 1976 PAYABLE. IN 1977
CITY COUNCIL OF THE CITY OF EDINA, MINNESOTA, DOES RESOLVE AS FOLLOWS:
+Section 1. The Budget for the City of Edina for the calendar year 1977 is
hereby adopted as hereinafter set forth; and funds are hereby appropriated
therefor:

Some time ago I talked to Commissioner Arlen Erdahl concerning
the universal emergency telephone number resolution passed by
the City Council. Enclosed is a copy of a letter which I
received in response to my inquiry. I am not sure if this
communication is of any value to you as their letter would
indicate a lack of interest in your suggestion. It might be
advisable to contact Commissioner Erdahl personally,or the
staff person dealing with the issue.
I will be very happy to discuss this further with you, Warren,
or with the Council to see what further action might be possible.

This is in response to the resolution you sent me which had been
submitted by the City of Edina.
While most people endorse the concept of the 911 universal emergency
telephone number, there is not the same unanimity as to how it should best
be financed. The cost could be picked up by local governmental units, spread
as an operating cost among the telephone subscribers, or as the resolution
suggests be financed by a telephone user tax.
While a telephone user tax is a possibility the legislature can well
consider, I thinks some questions need to be answered. Because of potential
operational and administrative problems and costs, it may be as reasonable to
have the expense of this system paid by local governmental units via present tax
systems.
If you have additional questions about this matter, feel free to
contact me or call Jo Ann Hanson of our Utilities Division at 296 7132, who is
working with this specific issue.

RESOLUTION OF CONGRATULATIONS
WHEREAS, on September 16, 1976, while delivering his morning paper
route, Thomas Tichawa observed three males removing furniture from the
lobby of The Lanterns Apartments into a van; and
WHEREAS, Thomas became suspicious of such activity inasmuch as he was
familiar with the furnishings in the lobby of The Lanterns; and
WHEREAS, Thomas Tichawa promptly reported his suspicions to the Edina
Police Department, giving them the license number and the description
of the van; and
WHEREAS, because of the alertness and the accuracy of the information
which Thomas Tichawa furnished to the Edina Police Department, the
vehicle was located in St. Paul, a suspect arrested, and all property
recovered within twenty -four hours;
NOW, THEREFORE, BE IT RESOLVED that the Edina City Council does hereby
express its congratul 'at ions and sincere appreciation to
THOMAS TICHAWA
for his astute observation and does express the thanks of the community
as a whole for his efforts toward the solving of this crime.

The Planning Commission may recall that about one year ago the City of Edina.
requested a subdivision of an area which the City of Edina owns and which is
a remnant from the W. 77th Street interchange. Those properties were divided
into seven lots. Three - quarters of one of the lots is owned by a private
.party and is now zoned R -2. The property as zoned is buildable but to make
the.property more buildable, the area shown on the attached survey should also
be zoned R -2. The staff recommends approval.

Mr. Luce recalled the City of Edina acquired property several years ago for
the 77th Street interchange on Highway 100. Part of that land was transferred to the
State Highway Department for construction of that interchange; the remainder, how-
ever, was retained by the City with the intent that it would eventually be subdivided
and sold as single family or double bungalow lots.
Due to the street curve, there is a small triangular piece of land presently
zoned R -1 which is adjacent to an existing, privately owned R -2 lot on West Shore
Drive. The City of Edina is proposing to rezone and trade that small piece of land
for a portion 'of the existing R -2 lot which will be located on the other side of
the future road extension. No additional buildable R -2 lots would be created.
Mr. Luce recommended the requested rezoning to R -2 be approved so that the
remaining triangular piece of land can be added to the adjacent, privately -owned
R -2 lot on West Shore Drive.

this area, Mr. Hughes moved the requested rezoning to R -2 be approved. Mr. Kremer

Ordinance Amendment.Restricting One Dwelling to a Lot
or Plot in the R -1 and R.,2-Zoning Districts
Attached is an ordinance . which-we asked Tom Erickson to prepare
to correct a problem we identified in our zoning ordinance.
Our ordinance presently states that in residential districts a
person cannot have more than one building per site. This is a
proper interpretation whe.n.applied to single family and double
bungalow lots (R -1 and R -2) but - should not be applied to multiple
dwellings in the multiple residential district. 'For example,
Edina West has three buildings, Fountainwoods Apartments has four
buildings, and most other apartment developments, including in
Yorktown, have more than one multiple building per tract.
I would make a recommendation -that this ordinance -be- adopted but
that.R -2 districts be included so that they will also.be
restricted to one building per lot.

THE CITY COUNCIL OF THE CITY OF EDINA, MINNESOTA, ORDAINS`:
Section 1. Paragraph.5 of Sec. 12 (Administration) of Ordinance No.
811 is hereby amended to read -as follows:
"5. One Dwelling per Lot or Plot. Not more than one dwelling shall
be ere cted, %or placed on any one lot or plot within_the_Single Family Dwellinf,
District-(R--:1) unless:
"(a) a variance has been granted pursuant to paragraph 6, Sec. 12
of Ordinance No. 811, to allow more than one dwelling; or
"(b) the lot or plot is divided, without platting pursuant to
Ordinance No. 801, and each part thereof is at least five acres in area,
is not less than 300 feet in width, and otherwise complies, in all respects,
..with the requirements of this ordinance; or
"(c) the lot or plot is platted into two or more lots, pursuant to
Ordinance No. 801."
Sec. 2. This ordinance shall be in full force and effect upon its
passage and publication.

building per lot or plot in a residential district, most developments in the multiple
residential district have more than one building per lot. The ordinance should be
amended to clarify that only one building is allowed per lot or plot in the R -1 and
R -2 residential districts.
After brief discussion regarding the definition -of "building" versus
"dwelling ", Mr. G. Johnson moved the ordinance amendment restricting one dwelling
to a lot or plot be approved as presented for both the R -1 (single family) and
R -2 (double bungalow) residential zoning districts. Mr. Hughes seconded the motion.
All voted aye. Motion carried.

Re: Park Dedication Requirements in Connection
with Platting
Dear Warren:
The Minnesota Supreme Court recently decided the Bloomington case
in which the City of Edina filed an amicus brief in the District Court.
We did not, .however, file an. amicus brief in the Supreme Court. The Supreme
Court upheld the District Court. The Supreme Court stated, in essence,
that the Minnesota statute (Sec. 462.358, subd. 2) that authorized munici-
palities to require dedication of land or payment of fees for various purposes
is not, on its face, a taking of property - without just compensation contrary
to the United States and Minnesota Constitutions, and that the Bloomington
City. Code, implementing the state statute, is within the •scope of the state
statute and is not, on. its face, a taking of property without just compensa-
tion.
The Bloomington Code is very similar to Edina's Code in that it
provides for acquiring a flat percentage of the undeveloped land, or equivalent
value, which percentage, their ordinance states, is "reasonable,'" and uses
the undeveloped land value -,as the fbasis for determining the amount to be
given in cash by a developer, with the undeveloped land value being deter-
mined by the city assessor as of the date of approval of the, final plat.
The court, however, points out that the key language in the statute that
makes it constitutional is that a "reasonable portion" only is required from
a developer. It goes on to state that a IT 'reasonable portion' is construed
to mean that portion of land which the evidence reasonably establishes the
municipality -will need to acquire for the purposes stated as a result of
approval of the subdivision. This is, of necessity, a facts - and - circumstances
test, but it is the only kind of rest that will consider the myriad of factors
which may bear on a municipality's needs for certain kinds of facilities and
the relationship of a particular subdivision to those needs."

The court goes on to say, therefore, that the language of the
Bloomington ordinance, which requires, as a reasonable amount, 10% of un-
developed land value, may or may not be reasonable as applied to any given
circumstance. The plaintiff may yet, in further court proceedings, attack
the constitutionality of the ordinance as applied to plaintiff's property.
The court went on to say that the use of the city assessor and of the date
of final plat approval are appropriate.
Based on this statute, it would appear to me that some changes in
Edina's ordinance would be appropriate. I have prepared and enclose sug-
gested changes. You will note they consist only of deletion of the phrase
"but not less than 5% thereof in area" and making final approval, not pre-
liminary approval, as the time for valuation of the property.
These changes would impose upon the City the necessity of deter -
mining, in each case, what a "reasonable portion" would be of the specific
property being platted. In some cases this will' be zero. (as it has in the
past), and in some cac2s it might be more than 5 %. However, 5% can still
be user as a general guideline. It will also mean that the valuation will
have t• be made at a later date in tine, but this will, in most cases, result
in an increase in value and, therefore, be beneficial to the City.

residential, commercial, industrial, or other uses, or as a planned development

thereof, a reasonable portion of such land;- bat - net -less- than- 3- t�ieree € -ia
area; shall be set aside and dedicated -by the tract.; owner or owners to the
general public as open space for parks, playgrounds, public open space, or
storm water holding areas or ponds, or, at the option of the City,. the tract
owner or owners shall contribute to the City an amount of cash equal to the
fair market value of the undeveloped land otherwise required to be so set aside
and dedicated, or set aside and. dedicate a part of such land. and contribute the
balance of such undeveloped land value in cash. Land then set aside and dedi-
cated.for public park and playground purposes pursuant to Section 5 (Planned
Residential District) of Ordinance No. .811 may be considered as set aside and
dedicated under this Ordinance No. 801 to the extent required hereunder in con -
nection with such plat, replat, or subdivision, but then only to the extent
that such land is in excess of the open..space.then required by Ordinance No.
811. Any. money so paid to the City shall be placed in a special fund and used
only for the acquisition of land for parks, playgrounds, public open space,
and storm water holding areas or ponds, development of existing parks and
playground sites, public open space, and storm water holding areas or ponds,
and debt retirement in connection with land previously acquired for such public
purposes. For purposes of this ordinance, 'fair.market value of the undeveloped
land' is defined as the fair market value of the land within such plat, replat,
or subdivision as of the date the plat, replat, or subdivision is presented to

by the City Assessor in the same manner as he determines the fair market value'

and best use to which the land can be put under the-zoning district then exist-
ing or under that zoning district to which the land is then about to be
transferred."
Sec. 2. This ordinance shall be in full force and effect upon its passage
and publication and, when effective, shall be -filed with the office of the
Register of Deeds, Hennepin County, Minnesota.

2. Parkland dedication ordinance amendment..
Mr. Luce stated the proposed ordinance amendment would require that the ;
requisite.parkland dedication fees be calculated at the.time.of final platting instead }+
of at the time of preliminary platting. Noting that a similar ordinance in Bloomington

was found by the court to be constitutional, he recommended the proposed amendment
be approved as written by the City Attorney.
After brief discussion, Mr. Kremer moved that the proposed parkland
dedication ordinance amendment be approved. Mr. C. Johnson seconded the motion.
All voted aye. Motion carried.
