Unfortunately, we did not agree on the results. She informed me that the next step is to present my case to the Board of Equalization, and that your office would present my case with whatever materials I provided if I couldn't attend the 12 MAY 1986 - meeting. I wish to have this letter presented in my behalf. The first reappraisal of 5309 West Highwood Drive was in November, 1985. My wife, Lori, and I just purchased the home for $175,000 which was $3,800 less than the existing assessed market value. Ms. Koole reassessed the property and reduced the assessed market value to match the purchase price. We were not pleased with Ms. Koole's reassessment as few homes, sold on the open market, are taxed at a hundred percent of their actual purchase prices. On 03 JAN 86 I appealed the first reassessment. Ms. Koole was sent out to reassess her own assessment. She explained her formula for assessing, however, it failed to account for recent low infation rates or our area's declining market for mid to high priced resale homes. Ms. Koole did state that she had few reassessments this year as few properties had their assessed value raised because of low inflation rates. However, the assessed value of our property increased over ten percent in 1985 when inflation was about four percent. Illustration I shows the assessed value of two properties on our block with their 1983 purchase prices. These properties, like ours, have recently had their assessed values raised. However, unlike ours they are not assessed at a hundred percent of even their 1983 purchase prices. Realitors will tell you that this is true throughout the twin city area. On an average, the City of Edina's assessed market value is supposedly 92% of the actual market value. However, Ms. Koole said that we got a "good buy," and is implying, by assessing our property at $175,000, that our property is actually worth $1909000. In reality, I made a smart buy with a logical offer based on the current market. The seller, Mr. Rosenthal, accepted the best offer he received during the four months that the property was for sale. Ms. Koole critized the above argument for "comparing apples with oranges" since not all the homes are walk -out ramblers like ours. However, those properties are in the same area as ours and their are no interviening variables like lake shore or whatever. In any case, properties in the same area should be assessed at the same percentage of their actual market value regardless of their description. I believe that there is a demonstrated injustice here. Johnson at which time you made a thorough examina- tion of the house in connection with Mrs. Johnson's claim that the the market value as shown on the Property Tax Statement for taxes payable in 1986 was much too high. In one year the market value was increased -from approximately $285,000.00 to $327,000.00. Mrs. Johnson has requested me to represent her in protesting the valuation of the property. After you have examined the premises, you advised me that Mrs. Johnson would be hearing from your office when the statement for real estate taxes payable in 1986 would be mailed to her sometime in January; it would show the market value as determined by the City Assessor's office. According to this tax statement the value as reported.to Mrs. Johnson in 1985 was not changed and remains at $327,000.00. Please advise me the charge made by the City of Edina fora copy of its zoning map and ordinances and regulations applicable to Mrs. Johnson's property. The identification number for the property is 18- 028 -24 31 0002. The reason for my request for a zoning map and copy of the regulations is that although the property is 2 -4 acres the zoning regulations and set back restrictions would make it very difficult to build more.than one dwelling on the entire tract. In other words, it cannot be subdivided for another residence to be built on the property in question. When you examined the property at the time referred to earlier in this letter, you undoubtedly noticed that because of its age (it was built in the middle 1930s') a great deal of repair work would be necessary and certain rooms (particularly the kitchen) would have to be remodeled in order to make the property saleable. If the City Assessor has determined that no reduction in the market value of the property will be made, I have no choice but to file, in Mrs. Johnson's behalf, a petition with the Court claiming the property is greatly over valued. Johnson until several weeks later. According to the Notice, the 1986 market value for taxes payable in 1987 is $327,000.00, the same amount as the value determined as of January 2, 1985, for taxes payable in 1986. According to the Notice, the Board of Review will meet at 5:00 P.M., on May 12, 1986, and that its decision may be appealed to the County Board of Equalization on July 7. Presumably at the time the Notice was composed and sent to Mrs. Johnson it was understood that in.order to protest the valuation by Petition to the Tax Court it would be necessary to appear before the Board of Review and then appeal to the County Board of Equalization if the relief requested before the Board of Review is not granted, in the case of taxes payable in 1987. However, the 1986 Legislature amended Minnesota Statutes, 1985 Supple- ment, Section 278.01 eliminated the requirement that a O'CON NOR & HAN NAN ATTORNEYS AT LAW Ms. Diane Koole Page -2- May 9, 1986 property owner may not appear before the District Court or the Tax Court unless a timely appearance in person, by counsel or by written communication has been made before the County Board of Equalization. This Amendment is effec- tive for assessments in 1986 and thereafter. Therefore, printed notice about the State Tax Court's jurisdiction and the Notice referred to above is incorrect. A protest as to the market value of the property for taxes payable in 1986 has already been filed in the form of a Petition to the Tax Court and a similar Petition will be filed for the taxes payable in 1987 unless the market value of the property is correctly determined. To protect the owner of the property at 4933 East Sunnyslope Road, Mrs. Gladys P. Johnson, whom I represent, this letter may be taken as an appearance before the Board of Review, if such appearance is necessary. The protest is based on the fact that while the property is larger in area than residential property in Edina usually is, it is unsuitable for subdivision because of the topography of the property and because of the set -back requirements with respect to Minnehaha Creek. In addition, the improve- ments to the property consisting of a dwelling with a base- ment garage is more than 50 years old and will require extensive remodeling and repairing before it is saleable. You have visited the property and viewed both inside and outside of the building so you are familiar with it. At the time house the was built, 50th Street was not as heavily traveled as it is today and the heavy traffic going by the property both day and night adversely affects its desirability for residential purposes. Please let me know if the Board of Review makes any changes in the market value of the property for taxes payable in 1987 or if you think it is still necessary for me to appear before the County Board of Equalization which accord- ing to the Notice will meet on July 7th.
