CALL TO ORDER
Mayor Hovland called the meeting to order at 5:32 p.m.
ROLL CALL
Answering roll call were Members Jackson, Pierce, Staunton, and Hovland.
Absent: Member Anderson.
Staff in attendance: Lisa Schaefer, Assistant City Manager; Emily Bodeker, Assistant Planner; Cary Teague,
Community Development Director; Ryan Browning, I.T. Director; and Sharon Allison, City Clerk.

JOINT MEETING: HERITAGE PRESERVATION COMMISSION
Chair Schilling updated the Council on their 2022 work plan.
Commissioners in attendance: Chair Annie Schilling, Vice Chair Sarah Nymo, Robert Cundy, and Jane Lonnquist.
HERITAGE PRESERVATION COMMISSION (HPC) ORDINANCE AND PRACTICES
Assistant City Manager Schaefer explained that there had been discussions regarding the City’s Code, Plan of
Treatment (POT), and processes around the Certificate of Appropriateness (COA) Checklist and how staff and
commissioners would like Council’s feedback on its philosophy and intent of these documents and processes so
that staff can make changes to bring them into alignment. Schaefer said how Boards and Commissions faced a
similar problem because they were allowed to adopt their own bylaws and eventually changes were made to
bring all into alignment. She noted that there were three current COAs that could not be discussed because
they are within the 10-day appeal period. City Attorney Dave Kendall added that staff is aware of inconsistency
in the COA Checklist and is revising them. Kendall said the Checklist is not legally required; therefore, discussion
should focus on providing guidance to staff that is consistent with how the HPC has operated for 19 years. He
recommended focusing on fixing inconsistencies rather than starting over.
Chair Schilling said she was confused about the POT because there were times when it was interpreted as
regulatory and other times as a guide. Assistant Planner Bodeker confirmed that some works were regulatory
in nature, and some were not. Commissioner Cundy shared that he did not believe the POT was legal in
Minnesota and that it would be if it was adopted in City Code rather than by resolution. Additional concerns
included teardowns from a specific builder, fair enforcement of the POT, clarity on tools available to address
certain exploitations, lack of response from staff or passing issues off to other departments.
The Council asked questions and provided feedback.

Mayor Hovland adjourned the meeting at 6:55 p.m.
