RESOLUTION NO. 2022-74 VACATING PUBLIC RIGHT-OF-WAY EASEMENT 7001 FRANCE AVENUE WHEREAS, an application was received on July 12, 2022, requesting that the France Avenue public right-of-way easement be vacated; and WHEREAS, two weeks published and posted notice was given and the hearing was held on August 16, 2022, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, the City Council has determined that the right-of-way is not needed for public purposes; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edina, Hennepin County, Minnesota: I. That the following described right-of-way is hereby vacated; That part of the right of ways of France Avenue South and 70th Street West, as dedicated on the plat of A M N ADDITION, according to the recorded plat thereof, Hennepin County, Minnesota, lying southerly, southeasterly and easterly of the following described line: Commencing at the northeast corner of Lot I, Block I, A M N Addition; thence South 87 degrees 52 minutes 14 seconds West, assumed bearing, along the north line of said Lot I, a distance of 72.22 feet to an angle point in said north line; thence continuing along said north line South 89 degrees 50 minutes 44 seconds West, a distance of 84.67 feet to an angle point in said north line and the point of beginning of the line to be described; thence continuing South 89 degrees 50 minutes 44 seconds West, a distance of 30.87 feet; thence southwesterly 64.91 feet along a tangential curve, concave to the southeast, having a radius of 60.00 feet and a central angle of 61 degrees 59 minutes 06 seconds; thence South 00 degrees 11 minutes 54 seconds East, non-tangent to said curve, a distance of 20.90 feet to the northwesterly line of said Lot I and there terminating. 2. The vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, If any, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereto. 3. That the Mayor and the City Manager are authorized to execute all documents necessary, in the opinion of the City Attorney, to affect the transfer of this property.
