The meeting was convened pursuant to published Notice of Board of Review in the Edina Sun - Current and notices posted on City bulletin boards for the purpose of hearing those persons who considered themselves aggrieved by their property valuation for assessment purposes, or who were requesting homestead classification. Mayor Richards stated that no decision would be made at this meeting, but that property owners would be notified of the Board's decision within 20 days. Further appeal may be made to the Hennepin County Board of Review beginning June 15, 1992. W The market for double bungalows is extremely depressed. Financial lenders are not loaning funds for these purchases which means a buyer would have to come up with his own cash to make such a purchase. This does not happen except at a fire sale price because they are not good investments. Remember that market value is based upon what a buyer and seller believes the property is worth in money. My properties are 19 years old and in need of major repairs, such as driveways, roots, decks, even siding, which have never been replaced. Some units even have original carpeting. The properties are also only a few yards away from major State Highway #169, which is noisy and obtrusive. The buildings not only front on Highway 4169, but also an industrial park across from Highway #169. Based on 1991 valuations, I was already paying 25% of gross revenues for property taxes. The 1992 valuations would make it even worse. This is my business. What other business in Edina, or anywhere else, pays 25% of gross revenues for property taxes, Please do not compare my double bungalows with townhouses that have been split. Mine have not been divided and at least one could not be divided because it has a single sewer and water line hookup for both units. Please look at the market value of the properties as they exist today, not what they might or might not be in the future. Finally, over the past years I have repeatedly tried to sell my buildings. I have never had an offer of any kind. If you know of anyone that will take my four buildings off my hands for $600,000.00, cash of course, please have them contact me. I know that we lhave one of the best communities in the State. however I doubt that it is the only city in America where investment real estate actually increased in value. As a non - homesteaded property my buildings are already penalized by the tax code which assigns a higher tax rate and utilizies a higher percentage of property value in determining the actual tax assessed. Because of these facts, there is ;no justification for attempting to assign a market value which may or may not reflect the market value of a homesteaded property occupied by an owner occupant. Even in commercial /industrial real estate it is understood that an owner /occupant purchaser might pay more than a normal investor for a given property due to personal desires: that. does not establish a legitimate market value for that Particular property. This is also true for an investment property which is residential. We have received market value reductions of 10 %+ in 1990 and 1991 from Hennepin County for our other residential buildings and the 1992 Market Values are being reduced by an additional 6 %. Even these significant reductions do not acurately reflect the loss in value that occurred due to the 986 Federal Tax Act. These lossesJn market value are real even though most current owners are holding their properties rather than recognize the loss through a sale. My two buildings have an investment market value of less than their current mortgage balance making it impossible for me to sell them and recover any of my investment. The loss on such a sale is of limited value since federal regulations only allow a $3,000 write off per tax year of the loss. Thank you for listening. My property was visited last year because of my concern over a 10% increase over the previous year. Later, I received a report that the 1991 valuation would stand. Now, I question a 3% rise in market value for two reason: 1) If what I read in the papers is correct, market values have gone down, and 2) 1 found last Fall that the exterior of my house is deteriorating. I opened a storm window and the bottom fell off of it because of dry rot. On closer inspection around the house, I find that all my shutters have to be replaced, dry rot is prevalent on trim, siding, and window sills, and on most of the storm windows. These deficiencies I suspect would affect the market value of my home until they are replaced /repaired. I will not be able to have this repair work done until 1993 or 1994. It is our contention that this damage has caused a loss to the market value of this property. Based on this information, we request a reduction in the value placed on this property for 1992. Attention: Members of the Board of Reviewal I am writing this letter to protest the amount of value assessed to 4443 Garrison Ln. It is now at $105,000 and I would like it reduced by $10,000. About three years ago, an assessor named Kathy increased the amount of value to this property by about $31,000 because of an addition which cost us about $12,000 to build. After she looked at the addition and also the rest of the property, she lowered the value 6,000. I did not think that was enough of a decrease, but accepted it. She also agreed to reassess the rest of the block,within'the next year. She did not, and still has not. The following year the assessed value went up $6,000 or about 6%. I called to find out why and she said she thought this was fair. I did not. I missed the.Board of Reviewal by one day that year and I wasn't told I could write a letter stating my case. In my opinion, this block is still way out of proportion with the 93 percentile the assessors say they try for. ,1'he reason for asking for a decrease is.because this property is the only residence on the street with an unfinished basement. Contractors want between 5 and 10 thousand dollars to finish it. There is an area of flat roof in need of replacement of approximately 4 squares. The cost will be about four thousand dollars. The living area has a peaked ceiling, with 2 x 4's for rafters, not allowing enough for adequate insulation. This would be about $5,000 to repair. The thermopane in the sliding glass door is leaking causing dirt between the glass. To have a new one installed is one thousand dollars. ihere is about 400 square feet of cement that is eroding badly. To replace this i-xx _d be about $1200. Approximately 2 squares of siding need replacing at a cost of $600. The exterior trim is in much need of paint, costing about $1,000. The landscaping is old and many of the ties are in need of replacement, also much of the shrubbery needs replacing at a cost of approximately $5,000. The furnace, air conditioner, water heater and water softener are all 22 years - -or nore old.- These are -just some of the things -that need repair or replacement to make the,place saleable. Using contractor prices, it is considerably in excess of $25,000. This is a follow up to a letter to you from James Gillespie, dated March 5, 1992. To date, he has not heard from you concerning his request for your revision of the assessed valuation of the property for taxes payable in 1992. Since your deadline for making such an adjustment is fast approaching, it is important that we hear from you. We have now also gathered a considerable amount of market data in support of our position. I am enclosing a Schedule of Comparable Sales which I have compiled from information assembled by my staff from sales of similar properties and the records of the Hennepin County Assessor. Supporting information is also enclosed. We believe the enclosed market information supports the same conclusion reached by James Gillespie in his earlier letter to you -- as of January 2, 1991, the value of the Subject Property was $1,300,000. The assessor's estimated market value on that date of $2,252,000 is grossly excessive. The Subject Property is being assessed at a level which exceeds its true market value. It also is being assessed in a discriminatory manner because the ratio between its true value and the assessor's market value is much higher for the Subject Property than is the case for other comparable properties. It appears that most of the comparable properties are over - valued by the assessor, but the Subject Property is the most over - valued of all. Mr. Moreau Sankey April 13, 1992 Page 2 After comparing the Subject Property with the 7 comparable properties (Comparables 4 an 8 are the same property), we believe the following conclusions are justified: 1. Except for part of Comparable No. 1 (6600 -6800 France Avenue South), the Subject Property is the oldest of the properties being compared. 2. The Subject Property is currently assessed at the highest amount per square foot of net rentable building area. 3. The quality of construction of the Subject Property is inferior to all of the comparables. 4. The average sale price per square foot of net rentable building area declined dramatically between 1989 and 1991. The average sale price per square foot of the 1989 sales (Comparables 1, 4 and 7) was $39.29. The average sale price per square foot of the 1991 sales (Comparables 2, 3, 5 and 8) was $35.66... Thus, the average sale price per square foot fell $3.63 or 9% in the-'two years just preceding the valuation date. Furthermore, this analysis assumed the sale of Comparable 6, which was actually only a listing. That property was listed for $30.00 per square foot and had not sold. As a result, the bottom of value may not yet have been reached. This listing, alone would suggest that the Subject Property's assessed value should be reduced to $30 per square foot, approximately 1/2 of the current amount. 5. The only Comparable property for which there are paired sales within the enclosed information is 7601 E. Bush Lake Road. That property is relatively near -the Subject Property, and 8 years newer. It sold in 1989 (Comparable 4) for $37.93 per square ,foot NRA and in 1991 (Comparable 8) for $31.30 per square foot NRA. Thus, it declined in value by $6.63 per square foot, or 17% between December, 1989 and October, 1991 (a 22 month period). 6. As of January 1, 1991, the Assessed value of the Subject Property was $58.04. This was the highest assessed value per square foot of net rentable building area of all of the properties which were compared. The assessed value of Comparables 1, 3, 4, 5 and 7 averaged $45.81 per square foot of NRA, an amount which is $12.23 per square foot, or 21% less than the assessor's value for the Subject Property. This analysis excludes Comparable 2, 6 and 8, since Comparables 2 and 6 have such low assessed Mr. Moreau Sankey April 13, 1992 Page 3 values that I must not have all of the affected tax plates for inclusion in the analysis. Comparable 8 was excluded because it is the same as Comparable 4. 7. If the assessed value of the Subject Property were to be reduced to $30.00 per square foot of net rentable area, its aggregate value would be $1,164,000. If it were reduced to $1,300,000, this would equal $33.51 per square foot of NRA, or $2.21 per square foot of NRA more than Comparable 8 sold for in October, 1991. If the assessed value of the Subject Property were reduced to $31.30, the average sale price of the 1991 Comparables, the new assessed value of the Subject Property would be $1,214,440. We request that you reduce the property's value to $1,300,000 effective for taxes payable in 1992 and 1993. Our property I.D. # is 19- 028 -24 -22 -0011 and our address is 4703 Golf Terrace. Our objection is primarily to the valuation of the house and to a lesser extent to the valuation of the land as outlined below. Our objection is based on the fact tha similar properties have lower assessments whereas dissimilar proeerties are assessed similarly to ours, particularly insofar as the house is concerned. It is my understanding that an office review was done of property in our area for the 1992 assessment. Our property is assessed at $419,500 with $95,000 attributed to land and $324,500 to house. It has 1425 square feet * and a lot size of 101 by 149. The house was inspected by an assessor this winter. The following are properties I believe to be similar but they were not similarly assessed. No misrepresentation is intended, if, in fact, it occurred. f All the above houses are assessed at approximately $25,000 to $60,000 less than our house despite the fact that the square footage is similar. The land at 5505 Lakeview is most comparable to ours and is also assessed almost $25,000 lower than ours. While the other two properties on Golf Terrace have higher land valuations, they are both situated on the Edina Country Club and view Lake Harvey. In addition, 4802 Golf Terrace's lot is twice the width of our own. While outside our neighborhood, 4 Circle West was a recent sale for $404,000 in January, 1991, making it a good comparison property. Its squarge footage is slightly larger and the lot size is more than twice as large as ours yet the house assessment is $60,000 lower than ours. In addition, 4800 Golf Terrace views Lake Harvey. Both houses are considerably larger (by 250 to 365 square feet) than ours yet the house assessments are similar to ours. In fact, the house at 4800 Golf Terrace is assessed at almost $10,000 less the ours. Both 4700 and 4800 Golf Terrace have been exensively remodeled recently. We remodeled our kitchen ten years ago, brought the exterior up to neighborhood standards four years ago and last fall remodeled a small bath and a powder room. The only other bath in the house was remodeled four years ago. No additional space has been added with the exception of a sun room addition four years ago onto the living room where an existing slab and doorway already were built. Further, the quality of materials used in our house are inferior to those used in the two above listed properties which have higher quality cabinetry and flooring as do most of the properties listed on the first page of this letter as similar properties. The property we believe to be most similar to ours is 5505 Lakeview. It is more attractive architectually than our property and has also been extensively improved. This property is assessed at $369,900. Consequently, we believe that our property which is assessed at $419,500 is assessed $50,000 over its proper valuation. *At times I found the square footage difficult to determine accurately from your assessment records since there had been numerous changes on several propeerties.
