TRUTH IN TAXATION PUBLIC EFARING HELD FOR PROPOSED 1995 CITY BUDGET Pursuant to
published notice given, a public hearing was conducted on the proposed property
tax increase in the 1995 Budget for the City of Edina, as mandated by Chapter
375, Laws of Minnesota 1993.
Mayor Richards stated that the hearing would focus on the proposed 1995 City of
Edina Budget relative to where the monies come from and how they are expended on
the various functions of the City. Residents with questions about the market
value of their homes should appear at the Board of Review which will meet in the
month of April, 1995. Mayor Richards explained that the tax rate structure on
residential property is determined by the state legislature. He said that the
City's final property tax levy and final budget must be adopted at a subsequent
hearing and citizen input is important in that process. _
Mayor Richards explained that the budget process began in the month of July with
a series of meetings at which budget assumptions were formulated and then the
Council directed staff to ,come back with a detailed draft budget broken down by
departments. He told the audience that the proposed 1995 Budget totals
$15,723,228 which represents an increase of $660,927 or 4.398 over the Budget for
1994. Mayor Richards then opened the hearing for public comment and discussion.
Public Comment
Lincoln B. Shea, 4815 Lakeview Drive, said he had received his estimate of
proposed tax increase based on the state's estimate of income increase of 4.58
for the year. Therefore, the City has felt justified in increasing its budget
accordingly which has nothing to do with the services received as a taxpayer.
He asked for justification for the proposed 4.398 increase in expenditures.
Mayor Richards responded that in considering the proposed 1995 Budget the Council
was not motivated by the state's estimate of income increase. He explained the
reasons for the following major increases in expenditures:
1. Wage adjustment of 2.58
2. $10.00 per month increase in employee health insurance package
3. $30,000 additional clerical position - Police Department
4. $35,000 crime prevention specialist
5. $40,000 additional Park maintenance position
Concerning revenue sources, Mayor Richards said the major components are 70.38
from real estate taxes, 9.78 from intergovernmental aids, 8.38 from fees and
charges, and 5.98 from licenses and permits.
Mr. Shea also questioned what the City employees contribute to their benefit
package, the line item for Police Department computer contract and the additional
clerical position. Assistant Manager Hughes answered that the person on family
coverage pays approximately $160.00 per month, single employee coverage is paid
entirely by the City. Chief Bernhjelm explained that in 1990 -91 the City entered
into a contract with a computer company for computerized dispatch which serves
the Police and Fire Departments. The company holding the contract was bought out
and due to that renegotiated situation there is an approximately $9,000.00
increase in the contract price. Because of the buyout, the City anticipates a
greater level of service because the buyout company will be improving the
software for the system. Regarding the additional clerical position, Chief
Bernhjelm said he now has police officers and investigators who are typing
reports. The more officers put on the road the less the response times.
Mayor Richards interjected that the crime prevention specialist position will be
fully funded by the Edina Crime Fund and the School District will pay $40,000 of
the cost of the Police School Liaison Officer position.
Frances Shea, 4815 Lakeview Drive, questioned the $75,000 increase in workers'
compensation insurance and asked if the City has a program for preventing
injuries. Assistant to Manager Smith responded that the increase is due to some
major losses in the area of public safety - one of which was the death of a
Police Officer and several heart attacks. Ms. Smith said the City does have a
program in which the losses are studied followed by the insurance company working
with the various departments. In addition, a wellness program will be instituted
in January which is designed to reduce losses. In the past the City has had some
outstanding good years with $898,000 in returned premiums. The City receives
risk management services through its insurer, the St. Paul Companies.
No further public comment being offered, Mayor Richards commented--that, although
citizen input at this hearing was minimal, he felt the community is involved and
aware of how the City operates.
Member Smith made a motion to close the public hearing on the proposed 1995 City
Budget and that adoption be on the Council Agenda for December 5, 1994. Motion
was seconded by Member Rice.

This letter is to request reconsideration of the action taken by the City Council on November 7,
1994 pertaining to the subject matter. For your reconsideration and to further support my
request, enclosed is a drawing of our client's proposed house on Lot 4 which shows protrusions
into the 100 feet conservation easement as follows:
On -grade patio area 185 square feet
Elevated wood deck area 320 square feet
Roofed area 185 square feet
Total 690 square feet
Please consider the following:
1. The total lot #4 area per the zoning ordinance is 33,501 square feet.
2. I dedicated to the city the conservation easement totaling 21,500 square feet which is
64% of the lot as conservation area.
3. My request to release 690 square feet represents 3.2% of the conservation area.
The client, the architect and I have worked hard designing and re- designing " this house
incorporating very unusual shapes and angles attempting to fit it within the buildable area. The
house elements that are now in the conservation area are very minimal and do not adversely
impact or affect the purpose of the conservation easement.
Please consider scheduling this matter on the city council agenda as soon as possible.

Member Smith made a motion to reconsider the request for partial release of the
conservation restriction on Lot 4, Mark Dalquist Addition, and that the matter be
placed on the December 4, 1994, Council Agenda to set a hearing date. Motion was
seconded by Member Kelly.

Not having thought that through, and on further investigation by asking Mr. Clark

easement. Member Smith explained that he thought he was dealing with three
percent of a building and on that basis he suggested that the Council review this
in light of the ocher three undeveloped lots in the subdivision.

RNESOTA D -DAY PROCLAIMED Motion of Member Paulus was seconded by Member Smith
~ unanimously animously for adoption of a Proclamation naming Thursday. November
17, _794, as Minnesota D -Day (no smoking) in the City of Edina.
Matthew Peterson and Douglas Lambert, Chair and Member respectively of the
Community Health Services Advisory Committee, accepted the proclamation along
with sixth grade students, Elizabeth Youngblood (Southview School) and Andy
Bertram (Valley View School). Thanks were extended to Tom Winn of FastFrame,
Diana Hedges, Edina Art Center Director, and Pam Hermanson of the Edina Middle
School for their efforts with the anti- tobacco poster project.

seconded by Member Smith and carried unanimously recognizing the Fairview
Foundation as benefactor and expressing appreciation for its interest and
contribution in sponsoring and promoting a healthier lifestyle for both students
and adults whose lives are touched by the Anti- Tobacco Poster Project. Mark.
Enger, accepted the resolution on behalf of the Fairview Foundation.
MINNESOTA CHEMICAL HEALTH WEEK PROCLAIMED Motion of Member Paulus was seconded
by Member Smith and carried unanimously for adoption of a Proclamation declaring
November 10 - 18, 1994, as Minnesota Chemical Health Week in Minnesota. Kathy
"-arson, Edina Chemical Awareness Committee Coordinator, accepted the
::amation on behalf of the Committee and presented each Council Member with a
yea ribbon as a symbol of individual and community efforts to reduce the demand
for drugs in the Edina community.

PUBLIC HEARING CONDUCTED APPLICATION FOR PARTIAL RELEASE OF CONSERVATION
RESTRICTION ON LOT 4 BLOCK lm MARY DAIOUIST ADDITION DENIED
Presentation by Planner
Planner Larsen recalled that at its meeting of September 7, 1994, the Council
continued the public hearing on the application for partial release of the
conservation restriction on Lot 4, Block 1, Mark Dalquist Addition to allow the
proponent time to come back with a redesigned proposed home. He advised that Ron
Clark, proponent, has returned with a proposal reflecting the exact footprint of
a home proposed for Lot 4. The release would affect only those areas under the
footprint of the dwelling. The proposed conservation restriction release for
Lot 5 has been withdrawn by the proponent. Planner Larsen explained that the
Findings have been revised to reflect comments by the Council at the September 7,
1994, Council hearing. The draft Findings contain two Decisions. The first
Decision would deny the application for release of 19 feet of the Conservation
Restriction on Lot 4, and 23 feet of the Conservation Restriction on Lot 5. The
second Decision would grant the release of portions of the Conservation
Restriction within the footprint area of the dwelling on Lot 4 as legally
described in Exhibit A of the Findings.
Presentation by Developer
Ron Clark, Ron Clark Construction, introduced the proposed homeowner, Diane
Dolginow and Michael Sharratt, the project architect. He presented a graphic
illustrating the footprint presented on September 7, 1994, with an overlay of the
new revised home footprint drawn to exact scale. Mr. Clark pointed out that on
the revised footprint the home has been pulled back to 90 feet from the ordinary
high water and the deck areas have been recessed into the home. He presented the
following comparative of the previous home versus the new proposed home:

Mr. Clark noted that most of the construction in the easement area constitutes
on -grade patio and open deck.
In response to questions of the Council, Mr. Clark answered that the proposed
home would have 3,045 square feet on the first floor and would be a rambler with
a full basement level walkout. The elevation from street level would be
approximately 23 feet. Member Smith asked for clarification on the enclosed
areas that would encroach on the conservation restriction. Mr. Clark pointed out
that only about half of the two enclosed bays would encroach on the easement.
Public Comment
Ed Glickman, 5217 Schaefer Road, said he was opposed to the proposed plan and
procedure. He said the Council is faced with a simple decision - should the City
give away a valuable conservation easement, required by City ordinances, solely
because the buyer of a one million dollar 6,000 square foot home wants two
separate decks, a patio and an additional 185 square feet. He submitted that
both the developer and buyer knew the lot restrictions before the proposed home
was designed. Mr. Glickman said that the Findings state that construction of a
home consistent with the neighborhood is not possible without the release of the
conservation easement. Also, the conservation easement presents a functional
building which would be in keeping with the size and scale of existing dwellings
in the neighborhood. Further, denial of the release will adversely impact the
character and symmetry of the neighborhood. He stated that none of these reasons
stands the test of logic. The developer and architect have just shown that a
6,000 square foot functional home could be built on this lot that does not
encroach on the conservation easement. As alternatives-, Mr. Glickman submitted:
1) that the home be decreased in size by three percent which would not require
release of the conservation easement, or 2) consideration be given to side deck
placement, or 3) why not consider placing this home on one of the three remaining
lots which are substantially larger. Failing all this, he suggested that Mr.
Clark carve the subdivision into three lots rather than four. Finally, the
Findings also include a statement that the objectives of the Comprehensive Plan
are served by releasing this conservation easement. He noted that in the
Comprehensive Plan it states that the City must protect and manage wetlands for
stormwater retention areas, wildlife areas, amenities and lessen the impacts of
nutrients and sediment input. Mr. Glickman reminded Council of the letter from
the DNR two years ago in which it was stated that the property in question lies
in an environmentally sensitive area and involves significant wetland and
floodplain encroachment issues. The DNR was concerned about the effect of
stormwater runoff on water quality of the wetlands. He presented recent photos
showing a historic high water level on Mirror Lakes with 20" trees under water.
He attributed this to an extraordinary amount of development which has gone on in
the surrounding area. Mr. Glickman urged the Council not to give away an
important conservation easement.
Ted Pier, 5021 Ridge Road, asked the Council to provide and enforce a single,
consistent law to all residents and citizens of Edina. He said that when Mr.
Clark submitted his plan for subdivision of this property a stipulation of the
Council was that there be no variances from the City's own regulations. Mr. Pier
said the wording has been changed to make it appear that this is not a variance
but a release of a conservation easement. Records leading to the decision to
grant approval of the subdivision indicate that the issues raised dealt
- ecifically with the conservation easement. It was the Council's judgement at
time that no alterations should be allowed for this developer or for any of
-her neighbors. He said that the Council should give the same consideration
to this request for variance as was given to area neighbors when they applied for
variances in the past and were denied.
Betsy Robinson, 5021 Ridge Road, stated she opposed granting a variance for any
building in this subdivision. She said when they proposed to add a screen porch
they were told that they could not ask for a variance and therefore redesigned it
to comply with City regulations. She referred to the history of this subdivision
-he agreement that there would be no variances. Ms. Robinson said she
•!ed Mr. Clark should be held responsible for his mistake and stay within the
guiaeiines of the City instead of hoping to break the code and use this possibly
as a precedent for future lot development in the area. If Council wants to look
at the option of a 50 feet conservation easement, she suggested that the Council
call a moratorium and set a public hearing on the issue, but as the law stands
now, it is 100 feet.
Helen McClelland, 5717 Continental Drive, explained the rationale used by the
Planning Commission in considering variances by relating briefly three previous
imilar variance proposals that were denied. Because Mr. Clark is a professional
developer and is aware of the laws regarding the development process, both the
state and local rules, a plea of hardship would clearly be self- imposed. A
comment following a Planning Commission meeting that the Dalquist Addition was
again before the Council raised some concern and three Commission members
attended the Council meeting of September 19, 1994. Ms. McClelland said their
concern was that issues are presented to the Planning Commission in one way and
to Council in another. She recalled that from May to December 1992, Mr. Clark
was closely questioned by members of the Planning Commission about his plans for
this site. He answered that any construction would have to maintain whatever
conservation easement was granted to the lot and would have to comply with the
Zoning Ordinance. At the meeting of October 29, 1992, a straw vote of the
Planning Commission indicated that a one plus three lot subdivision was favored
(5 to 2 vote). A subsequent poll by the Planning Commission for a four lot
subdivision with no variances was seven to zero. When Mr. Clark returned at the
December, 1992, Planning Commission meeting he presented a one plus four lot
subdivision that was accomplished by moving the storm sewer line. At that
meeting Mr. Clark was questioned extensively about whether there would be the
need for variances and it was made clear that the Commission was giving
consideration to the proposed subdivision without variances. The vote by the
Planning Commission was eight to three for the one plus four lot subdivision with
no variances. Ms. McClelland concluded that the Planning Commission does have
concern that Mr. Clark is now asking for a variance to the conservation
restriction.
Patrick Mantvh, 6413 Interlachen Boulevard, said he would like to reiterate what
his neighbors and the Planning Commission member have just said. He stated that
the neighbors have significant mistrust of what Mr. Clark says as he gave his
word when the subdivision was approved that there would be no variances and
everyone thought the matter was resolved. This issue is like a moving target as
Mr. Clark has come back repeatedly with variance requests. Mr. Mantyh submitted
that the land is not worthless without the variances as the lot is adequate to
build a very large home. He asked that the laws be applied equally and fairly to
all citizens of Edina and that the variance be denied.
Corky Carlson, 5025 Ridge Road, said she was a new resident to Edina and urged
that the rules and laws be followed.
John MacNeil, 5017 Schaefer Road, told Council he was also speaking for his
children that live at 5125 Schaefer Road. He said he wished the Council would
make the decision,to stay with the City standards so that the residents not need
keep coming back for the three additional lots that remain. Secondly, he
questioned why the developer has never considered moving the home closer to the
street. Thirdly, he voiced concern regarding the current level of the area
lakes. He said something is wrong in that area as over the past several months
the water is rising higher every week.
Mayor Pro -Tem Kelly asked Engineer Hoffman to comment on the lake level. He
agreed that the water level in Mirror Lakes and the two ponds to the northwest is
much higher than two years ago. They are landlocked so the water level cannot be
pumped down. Staff has looked at them and the DNR has come out and said the
water is two feet higher than normal even though nothing new has happened in that
immediate area.
Mr. Clark responded that they have worked very hard to reduce the size of the
dwelling and as now proposed it would be 200 SF smaller than the previously
proposed home. He told Council that the problem is that 64 percent of the
buildable lot area is within the conservation easement. He reminded Council that
the Department of Natural Resources guideline for pond setback is 50 feet - the
proposed dwelling footprint would be at 90 feet. Mr. Clark said the development
has been thoroughly engineered with the basement floors proposed at 942 feet
above sea level to provide a safety factor from high water. In addition, they
have paid for installation of an equalizing pipe between the two ponds with any
overflow to drain into a catch basin by Schaefer Road. For emergency situations,
a line has been installed over the hill towards Interlachen whereby water can be
pumped into Mirror Lakes. Engineer Hoffman clarified that Mr. Clark was required
to install a forced main as opposed to 'a gravity pipe. Further, that the two
ponds within the proposed development have no bearing on the water level of
Mirror Lakes.
Lisa Finsness, 4530 Tower Street, said it is her understanding that lakes are
connected, maybe not by human means, but are fed from underground.
Council Comment /Action
Member Paulus recalled difficult decisions on minute footages when she sat on the
Planning Commission and served on the Board of Appeals. Variances may establish
precedents and it is important that they not be granted easily. Variances are
granted for a true hardship that is not self- induced. During the whole process
with the Mark Dalquist Addition, she remembered the proponent stating that he
could live with the terms. In her opinion, this is a question of economic

feasibility as she felt a house can go on that lot without any variances. With
regard to the DNR guideline for• setback from ponds, the City does have the
privilege of being more restrictive. Member Paulus said she could not support
the requested release of the conservation restriction because she could see no
hardship that was not self imposed.
Member Smith said when he visited the site his understanding was that the
proposed protrusion into the conservation restriction would be deck areas and not
enclosed living space. He added that 185 SF interior space against a 6,000 SF"
home does not make the case for the requested release. Decks would be more
malleable than concrete patios or living space. Member Smith said in looking at
the building footprint available he felt it could be done without any release.
He said he did not recall voting on a square footage variance previously but on a
request to release a band of the restriction which he did not support and had
suggested if the developer needed a variance for a smaller part of the footprint
to come back with it. Now, in addition to decks, the request is for part of the
house with roof and foundation and he would have to say no to the proposal as

Member Rice said this is a situation that cries out for common sense and he would
support the proposal. He asked what would be the infringement percentage of the
footprint as proposed. Planner Larsen answered that the conservation easement is
approximately 21,000 SF and this would be an encroachment of approximately three
percent. Member Rice then made general comments as follows. Over the past many
months while this subdivision was being considered a line has been drawn in the
sand between the neighbors and the developer. Threats of going to court have
been suggested. People have said there ought to be a book and whatever the book
says should be done, with no exceptions. If that were the case, there would be
no need for a Council and a Planning Commission. The Council is elected to
?xercise reasonable judgement and many have differences of opinion as is evident.

Mr. Clark is asking for is a release of portions of the conservation restriction

says this is a reasonable proposal and he would support the request.
Ron Clark commented that he was at a total loss as to the Council's intent when
the previous request for release of the conservation restriction was denied. He
believed his marching orders were to go back and finalize the plan, in keeping
with the percentage of encroachment into the easement area by the previous
footprint. Mr. Clark argued that the footprint now presented has much less
encroachment. Mayor Pro -Tem Kelly interjected that it was her understanding as
well that Mr. Clark come back with a design footprint that would not encroach on
the conservation easement except for decks and not heated areas. Member Smith
said he thought it was made clear that the Council would look at some intrusion
if it were for decks.
Member Paulus made a motion to deny the request for partial release of the
conservation restriction on Lot 4. Block 1, Dalquist Addition as presented.
Motion was seconded by Member Smith.

REASONS
The above entitled matter was heard before the Edina City Council on June 20,
1994, August 15, 1994, September 7, 1994, November 7, 1994, and January 3,
1995. Mr. Ron Clark, the President of Ron Clark Construction, Inc. ( "Proponent ")
was present at all hearings. Mr. Tim Keane, attorney representing the Proponent, was
present at the August hearing. Property owners in the vicinity of the request were
also present at all hearings. The City Council having heard and reviewed all of the
facts and arguments presented by the Proponent, his representative, property owners
in the vicinity of the request and having heard and reviewed evidence and law
adduced by the Proponent, his representative, City Staff, and property owners and

being fully advised, after due consideration, hereby makes the following:
FINDINGS OF FACT:
1. The subject Conservation Restriction was required by the City pursuant
to Section 810.13, Subd. 2. of the City Code, (the "Subdivision
Ordinance "). The Conservation Restriction, dated May 14, 1993, was
placed of record with the Hennepin County Recorder as document
number 6167713. The Conservation Restriction was acquired by the
City pursuant to the authority contained in Minnesota Statutes, Section
2. Section 810.13, Subd. 2. of the City Code provides as follows:
Subd. 2 Lands Adjoining Lakes, Ponds or Streams. Where any plat or
subdivision adjoins a natural lake, pond, or stream, including streams
which flow only intermittently, a strip of land running along all sides
which are contiguous to such lake, pond or stream, which strip shall
extend from a line 100 feet upland from the lake or pond, as measured
from the ordinary high water mark, and 100 feet from the centerline of
the stream, shall be either (i) dedicated to the City for public use, or (ii)
subjected to a perpetual easement in favor of the City over and in said

land and the bed and water body of such lake, pond or stream, for the
purpose of protecting the hydraulic efficiency and the natural character
and beauty of such lake, pond or stream. The Commission shall
determine which of these options. is more appropriate and shall
recommend to the Council one of said options. In either case there shall
also then be granted to the City the right of ingress and egress from the
said strip of land with workers, equipment, and material. Also, where
the easement is determined to be in the best interest of the City, said
easement shall also provide that the owners of the areas as to which
such easement is granted shall not make, do or place any fill, grading,
improvement or development of any kind on or to such easement area,
or raise the level of the easement area in any way, but all such right to
fill, grade, improve and develop, and to raise the level of the easement
area, shall be granted by said easement to the City.
3. The Conservation Restriction does not allow buildings or other structures
within the area proposed to be released from the Conservation
Restriction without "the express prior written approval" of the City. The
Conservation Restriction provides that it may be released at any time or
from time to time by the sole act of the City.
4. The subject properties have the following dimensions and area, measured

5. The Zoning Ordinance requires a �ont street setback of 30
feet. The buildable area between the aback line and the
Conservation Restriction line establishes the buildable depth for a lot. On
Lot 4, the depth varies from approximately 25 feet on the westerly side
to 60 feet on the easterly side of the lot.
6. The proponent, on May 18, 1994, submitted a request to release 50 feet
of the Conservation Restriction affecting Lots 2, 3, 4, and 5, Block 1,
Mark Dalquist Addition. A public hearing date of June 20, 1994, was
set for the City Council to consider . tiiquest. Notice of the public
hearing was published in the Edina Sun - Current on June 1, and June 8,
1994. A mailed notice of the public hearing was sent to property
owners within 500 feet of the property on June 9, 1994. Notice of the
public hearing was posted at the three (3) official City bulletin boards on
June 10, 1994. The Proponent was present at the hearing. Interested
residents were also present at the hearing. The City Council, after
hearing the testimony of the Proponent and residents, voted to deny the

requested release.
7. The Proponent on July 13, 1994, submitted a new request to release
lesser portions of the Conservation Restriction, this time affecting only
Lots 4 and 5, Block 1, Mark Dalquist Addition. The proposed release
would remove the most upland 19 feet of the Conservation Restriction
affecting Lot 4, and the most upland 23 feet of the Conservation
Restriction affecting Lot 5.
8. On August 15, 1994, the City Council conducted a public hearing to
consider the July 13 request to release portions of the Conservation
Restriction. Notice of the hearing was published in the Edina Sun
Current on July 27, 1994, and on August 3, 1994. Notice of the public
hearing was also mailed to all property owners within 500 feet of the
subject property. On July 28, 1994, notice of the public hearing was
also posted at each of the three (3) official City bulletin boards. The
Proponent, and his attorney testified, using presentation boards, that the
requested releases were necessary to construct homes that were
consistent with the character and symmetry of the neighborhood.
Several property owners in the vicinity of the subject property testified
in opposition to the requested releases. The property owners also
submitted documents indicating their intent to challenge City approval of

the requested release in District Court. The Proponent agreed after
questions and comments by the Council, that the requested release was
in excess of the area necessary to construct dwellings in keeping with
the character of the neighborhood. The meeting was continued to
September 7, 1994, and staff was ordered to prepare Findings and
Reasons to support a decision to approve a partial release of the
Conservation Restriction.
9. On September 7, 1994, the City Council again considered the request to
release a portion of the Conservation Restriction. After receiving the
draft Findings, Decision, and Reasons prepared by staff, and after
hearing testimony by the Proponent and residents, continued the hearing
to the November 7, 1994, City Council meeting.
10. On November 7, 1994, the City Council conducted a public hearing to
consider a request to release a portion of the Conservation Restriction
affecting only Lot 4, Block 1, Mark Dalquist Addition. The Proponent,
using a presentation board, described a request which would release
approximately 690 square feet of the total area subject to the
Conservation Restriction. Property owners in the vicinity of the request
were present and testified in opposition to the proposed release. The
City Council, after hearing the testimony of the Proponent and residents,

voted to deny the requested release.
11. At the regularly scheduled City Council meeting of November 21, 1994,
Councilmember Smith, moved to reconsider the action taken at the
November 7, 1994, Council meeting. The motion was seconded by
Councilmember Kelly and was passed four votes to one.
12. The Minnesota Department of Natural Resources ( "DNR ") has established
guidelines for building setbacks for various waterbodies. The
recommended setback for the subject ponds is 50 feet for all buildings
and structures.
13. The Environmental Protection Element of the City of Edina
Comprehensive Plan contains the following objective and policies:
Objective: Protect and manage lakes, ponds and wetlands for storm water
retention areas, wildlife areas, and amenity areas, and lessen impacts from
nutrient and sediment input.
Policies: Utilize waterbodies and man -made ponding areas for the retention and
detention of storm water to reduce flooding potentials and stabilize lake and
pond levels.

Restrict encroachments below the ordinary high water marks of Type 3,4, and
5 wetlands.
Require the dedication of or the grant of a scenic and open space easement
over all land adjacent to and 100 feet upland of naturally occurring lakes and
ponds in conjunction with the subdivision or development of the property.
Require the dedication of or the grant of a scenic easement over Type 3, 4, and
5 wetlands in conjunction with the subdivision or dedication of property.
Encourage owners of property riparian to lakes and ponds to maintain emergent
aquatic vegetation and shoreline vegetation for filtering and wildlife benefits.
14. The City is authorized by the terms of the Conservation Restriction and
Minnesota Statutes, Section 84.65, to release portions of the
Conservation Restriction. The Conservation Restriction does not grant
to the City any right to use or improve the area subject to the
Conservation Restriction or permit the public to use or improve the area
subject to the Conservation Restriction. The City is only authorized to
enter onto the area subject to the Conservation Restriction to enforce the
terms of the Conservation Restriction. The release of the Conservation
Restriction is not governed by the provision of Minnesota law dealing

with the vacation of publicly owned easements and rights of way. The
release of the Conservation Restriction does not constitute a variance
under the Subdivision Ordinance or the Zoning Ordinance.
THEREFORE, based on the foregoing Findings of Fact, the City Council does
hereby make the following
DECISION:
The application for release of portions of the Conservation Restriction within the
footprint area of the dwelling as legally described in Exhibit A attached hereto on Lot
4, Block 1, Mark Dalquist Addition is hereby granted.
The decision is made for the following
REASONS:
A. The area subject to the Conservation Restriction following the release is of
a sufficient size and subject to the restrictions necessary to meet the objective
of the Environmental Protection Element of the City's Comprehensive Plan. The
25 foot "Natural Condition" Conservation Restriction area will not be altered by

the proposed release and will continue to provide wildlife habitat and filtering
of storm water run off. The areas released from the Conservation Restriction
have not been maintained in a natural condition, but have been maintained and
mowed as open lawn /yard area by the previous property owner.
B. The remaining area subject to the Conservation Restriction will provide for
building setbacks from the pond which will exceed setbacks recommended by
the DNR.
C. The proposed release will not adversely impact the existing character and
symmetry of the neighborhood but promotes good planning and orderly
development of the subject lots. The proposed release will allow the
construction of a new dwelling that will be consistent with the size and scale
of the existing dwellings in the neighborhood, which would not be possible
without the proposed release. The present area subject to the Conservation
Restriction provides a buildable area which is too shallow to design and build
a functional dwelling which would be in keeping with the size and scale of
existing dwellings in the neighborhood.

Dear City Council:
I oppose release of the conservation easement to Mr. Clark because it sets a bad
precedent, is unfair, has no public purpose or reason and is offered in bad faith.
Release of the conservation easement sets a public, permanent and dangerous
precedent for future variance requests on all land adjoining water.
If this proposal passes, Edina will go on public record as favoring the release of
conservation easements solely for economic reasons to speed the sale of
undeveloped property. This release will become a large green light to all future
developers who own slowly selling lots to request variances to increase their
profits by making their lots more attractive and marketable. At the same time,
this release will diminish the city's natural assets in water with all of its benefits
of flood control, water purification, wildlife and scenery. It also hurts
surrounding home owner's property values and the city itself because of the loss
of these benefits.
Edina is blessed with many water resources that require the mandatory
minimum conservation restriction. Therefore, the question is not if similar
situations will present themselves in the future; but, when these problems will
arise. First, there are 3 more lots in the Dalquist subdivision. If the Council grants
this proposal it will be hard pressed to say no to future requests for variances
within this subdivision. What will the Council do in 6 months when Mr. Clark
comes back and asks for yet another 700 sq. ' release from Lot 3, ... and later on
Lot 5,... and later on Lot 2? How can the Council say no to a variance on these
other lots within the same subdivisions after it granted this one for this reason?

Next, there will be at least 10 lots on the soon to be subdivided Boos property
that also has ponds on it less than 500' feet East of the lot in question. What will
the Council do in 12 months when the developer of this property asks for a small
680 sq. ' release from each of these lots next to the pond? How can the city
release the easement on the Dalquist Subdivision and not release it on the Boos
Subdivision that is so close and so similar? There will also be at least 5 more lots
on the Weiner property that is also less than 500' South of the lot in question and
has water requiring the mandatory conservation easement. What will the
Council do in 24 months when the developer asks for a small release on each of
these lots? Therefore, a vote to release this particular conservation easement is
effectively a vote to release all easements on water whenever development stalls.
Release of the conservation easement for this developer and for these reasons is
both unfair and a classic example of selective enforcement of the rules.
Many other neighbors have lived by the variance rules and accepted them when
they were enforced. Ted Pier and Betsy Robinson of 5021 Ridge Road wanted to
build a screened in porch and were denied a variance of 5 ". Peggy Carlisle of
5013 Ridge Road wanted to enlarge her home and was denied a variance of a
couple of feet. Patrick and Ingrid Mantyh of 6413 Interlachen wanted to add.
another stall to their garage and were denied under similar circumstances. What
is different between these situations and Mr. Clarks? How do you explain why
individual homeowners got no relief for their property improvements and a
commercial developer is rewarded handsomely? Does the City want to
encourage new home building over homeowner improvements on existing
homes?
Unequal enforcement of the city's own ordinances causes public distrust and a
lack of respect for authority from residents outside looking in and conflict within
the city government itself. If this proposal is granted, it will cast a shadow on all
of your prior decisions and complicate future deliberations. The Planning
Commission opposes the release so strongly that it sent three of its members to
the August 17, 1994; November 7, 1994 and presumably January 3, 1995 hearings
on this matter. For example, Planning Commissioner, Helen McClelland, at the
November 7, 1994 hearing on this matter testified that the Planning Commission
unanimously voted on,two different occasions that the development go through
without any exceptions to the existing ordinances. If the Council releases the
easement at this point it will undermine its own advisory board and make
coherent rule enforcement difficult. How can the council over rule two prior
unanimous decisions of the Planning Commission? What has changed since the
Council unanimously imposed the easement without comment or debate in
January, 1993?

Setting up reasonable, known boundary's and carrying out the consequences of
crossing them is the primary function of government. As such, a vote to release
the easement violates this function and belittles the Council because it
unnecessarily invites costly negative public response and insults its own
advisory board.
There is no reason whatsoever to grant the release and no possible public
purpose served by reducing the conservation easement.
Edina Codes, law on this subject and common sense all dictate that there must be
a reason that serves a public purpose for the release of a valuable easement
without consideration. The Council does not meet to maximize Mr. Clark's profit
or speed his sales. Neither does it meet to cater to the Doglinow's design plans.
Mr. Clark's reason for requesting the variance does not stand under examination.
Self imposed economic hardship is not an excuse for a variance and should not
be a precedent for release of an easement. The city code on this subject under the
interpretation's section says the standards are minimums not to be tampered
with. Mr. Clark's failure to sell may have to do with many things other than the
size of the lots. For example, he may have mismarketed the lots by setting the
price too high. He may be flying into the face of higher mortgage rates causing a
bad market in general. Unlike the neighbors he has alternatives to encroaching
on the easement. He could either lower his price or wait for more favorable
market conditions.
The Doglinow's reasons for wanting the release are equally thin. They also have
alternatives. They could build a smaller home or build on a different lot that can
accommodate their plan. In spite of this, they offer no justification for the release
other than they "want" the 6,000 sq. foot home and two decks and a patio and
part of the public easement. The citizens of Edina "need" the conservation
easements specifically mandated in their Codes as minimums upheld as well.
They need to know that the rules of the city will be applied equally and without
preferential treatment. They also need to believe that their elected official
represesentatives are. looking after the best interests of the community at large. If
these opposing desires are put to test as they are here, the common good must be
above the individual citizen. All one has to do is ask who will benefit from the
release and it becomes quite evident that there is no possible justification for the
request.
Mr. Clark does not qualify for a favor and the city does not qualify to give him
one because both Mr. Clark and Mr. Smith are acting in bad faith.

There is a long standing axiom that those who seek equity must do equity.
Sometimes this is called the "clean hands" doctrine. Mr. Clark is not innocently
seeking relief. He is a seasoned and sophisticated commercial developer who
was fully aware of the restrictions on the land long before he bought. Mr. Clark
started his path of misdirection even before seeking relief from the rules. He
brought a straw man into the development to buy an outlot first so this first lot
would not be subject to the set back rules. In the next step of his plan, Mr. Clark
misled the Planning Commission when seeking a variance from the set back rule
when he said that he could build 4 houses on these lots. He misstated the facts
several times at these meetings in October and December of 1992 when he told
them that the lot sizes would be sufficient to build and sell. This was the issue all
along in the seven Planning Commission meetings on the variance subject during
the summer and fall of 1992. Mr. Clark misguided the City Council when he
stated that he could build and sell 4 houses on these lots. This is the issue that the
council has faced in 4 prior meetings during 1994. He told the Council that the
homes would be 4,500 sq. feet now they are 6,000 sq. feet. First, Mr. Clark stated
he needed a band of 50 foot release,... then 25 feet, ... then a foot print with a
1,200 sq. foot encroachment and finally now 680 sq. feet. A person is entitled to
one mistake; however, a series of mistakes can lead to a different conclusion.
Council Member Smith has equally questionable actions. Mr. Smith heard more
than 1 hour of discussion and debate on this exact same matter with full
opportunity for questions from all the parties that were present and voted to
deny this proposal on the day before his election for Council and changed his
vote less than 12 days after his reelection. His request for rehearing was
approved even though his changed his vote on the measure would not have
affected its passage. To pass this measure based upon the double "mistakes" of
Mr. Clark and Mr. Smith defies logic and equitable principals.
The proposal must fail because it is flawed, inequitable, baseless, contrary to city
policy and ordinances, open ended and without qualification or restrictions to
provide guidance in future situations.

RECOMMMMATION: Approve a resolution seeking repeal-of Dimler
Amendment (MS 171.12 subd. 6) and discuss "Process" portion of
each traffic safety request.
BACKGROUND: The City Council directed staff to develop a
resolution supporting repeal of the Dimler Amendment. (See
attached proposed resolution.)
Additionally, Council directed staff to develop additional policy
language as it relates to the traffic safety process. The
current process reads as follows:
PROCESS: Your traffic safety concern or request will be
formalized by the staff member you have contracted. That
person will work with you and gather the pertinent facts and
help clearly define the problem and seek a solution. Those
facts will be reviewed by the City Engineer, the Police
Chief, and the Assistant City Manager. That group will make
a recommendation to the City Council regarding the matter.
Their recommendation will be shared with you and if you
disagree with it or can bring forth additional facts you can
appear at the next regularly scheduled Council meeting and
present your viewpoint. In all cases the City Council is
the final authority on traffic safety matters.
This process was developed with the idea that staff would meet
the day after the first council meeting of the month.
The proposed language change would be to the last two sentences
(in bold type) and add two additional sentences.
A

on traffic safety matters. Any subsequent review of the
same or similar request is at the discretion of the City
Council."
RESOLUTION REPEALING
DEMLER AMENDMENT
WHEREAS, M.S. 171.12 Subd. 6, the Dimler Amendment, exempts a citation
from a driver's record if the speeding offense is less than 10
MPH above the 55 MPH limit set by M.S. 169.14; and
WHEREAS, although the Dimler Amendment does not apply to local streets,
it may promote an attitude that speeding is condoned on all
streets and roadways "within reasonable limits"; and
WHEREAS, the mixture of vehicles, pedestrians and bicyclists on local
streets contributes to potentially dangerous conflicts involving
speeding vehicles and
WHEREAS, a uniform enforcement and penalty pattern is more likely to
improve compliance on all roads ways including local streets;
NOW, THEREFORE, BE IT RESOLVED, The City of Edina supports
legislation to repeal the Dimler Amendment.

Approve arbitration award and authorize execution of 1994 contract.
hdo/Background:
On September 30, 1994, representatives of the City and the International Association of
Firefighters Local #1275 appeared before arbitrator Sharon Imes for the purpose of
conducting a binding arbitration with respect to the 1994 contract. On December 22, 1994,
the arbitration award was delivered to the City and the bargaining unit. The following are
the elements of the award:
WAGES The arbitrator awarded a 2 1/2 percent wage increase for all
bargaining unit employees for 1994.
SHIFT BIDDING The arbitrator amended our current contract as follows:
"Senior Qualified Shift Employees shall be given shift preference after
eighteen months of continuous full-time employment with this department."
Based on this language, bargaining unit employees may select their preferred
workshift on a seniority basis. This is similar to contract provisions which have
existed for several years in the Police Department.
HOLIDAYS Bargaining unit employees working a 24 hour shift presently
receive five shifts off as floating holidays. The arbitrator awarded an
additional floating holiday bringing the total to six.
VACATION The arbitrator awarded an additional 1/2 day per year of
vacation leave for bargaining unit employees working 24 hour shifts.
Five additional issues were also the subject of the arbitration. These issues included; call
back time, compensation for unused sick leave, longevity pay, compounding of overtime, and
working out of classification. No changes to existing contract language were awarded by the
arbitrator for any of these five issues.
Staff recommends that the City Council accept the award and authorize execution of the
1994 contract with IAFF Local #1275.

RE: Designation of National City Bank as Depository of City Funds
At its meeting on January 3, 1995 the City Council will be requested to
designate banks to act as the depositories of City funds for 1995. Councilmember
Elect Maetzold is an officer of National City Bank /Southdale, which is one of the
banks proposed for designation as a depository. The City is presently using National
City Bank as a depository.
Minnesota law contains an exception for the designation of banks as
depository of public funds from the conflict of interest prohibition contained in
Minnesota Statutes, Section 471.87. This exception is contained in Minnesota
Statutes, Section 471.88, subdivisions 1 and 2, and permits the City to designate a
bank in which a Councilmember is interested as a depository of City funds if the
following conditions are met:
1. The interested Councilmember makes a disclosure that he is a
director or employee of the bank and this disclosure is entered on the
minutes of the Council meeting;
2. The disclosure is made when the bank is first designated as
depository or when the Councilmember is elected, whichever is later;
and
3. The designation of the bank as a depository is approved by
unanimous vote.
As noted above, the designation of the depository is required to be by
unanimous vote. Since the language in the statute requiring a unanimous vote
does not contain the additional phrase "by all members of the council" as is used in
certain other instances in Minnesota law when referencing a vote by the Council
(i.e. two - thirds vote of all members is required by Minnesota Statutes, Section
462.355 for approval of comprehensive plan amendments and is required by
Minnesota Statutes, Section 462.357 to approve a rezoning), I would interpret this
provision to require a unanimous vote by all members voting on the question.

Therefore, I would recommend that when the question of designation of National
City Bank as a depository is considered Councilmember Maetzold make a statement
at that time disclosing his relationship with National City Bank then abstain from
voting on the question. Because of the special requirements required to be followed
in considering the designation of National City Bank as a depository, the City
Council should consider this designation separately from the designation of other
banks as depositories.
