The meeting was called to order at 7:30 p.m. by Mayor Van Valkenburg.
The following were in attendance: Dr. Duane Engstrom, Dr. Walter Krafft,
Dr. Richard Simmons, Mrs. Mary Bang, Mrs. Linda Bjerke, Mrs. Beverly Harris,
Dr. James Cardle, Mr. Verne W. Moss, Jr. , Mrs. June Schmidt, Mr. Kenneth Esse,
Dr. C. V. Rockwell , Mrs. Tully Stoppel , Mrs. LaVonne Hargens and Mayor Van
Valkenburg.
The Mayor explained how commissions in the City of Edina, under Plan B
Government, work and indicated that the commissions are advisory in nature
and that the ultimate decisions and responsibility rest with the Council .
The procedure is for the commission to make recommendations to the Council,
either personally or through minutes and to then have the decision made by
the Council .
All meetings of the commission must be open to the public and minutes must
be kept.
Mrs. June Schmidt then discussed the history of the Act and Edina's involve-
ment therein and some of the public hearings held in connection with the
creation of the Health Board and the need for the same.
Mrs. LaVonne Hargens, from the Bloomington Health Clinic, discussed how it
operates and answered questions from the members.
Dr. C. V. Rockwell was named as Acting Chairman of the Commission.
Meetings are to be held on the first Tuesday of each month.
The meeting was adjourned at approximately 9:15 p.m.

Ladies and Gentlemen:
For your information, I am enclosing the following documents:
1. Roster of the Health Board.
2. A copy of.the booklet that was presented to the Council outlining the
entire program and the contracts executed at that time.
3. Budget overview.
4. Copy of the Ordinance.
5. Some of the monthly printouts that we have received since the plan has
been in operation.
6. Some background on the program prepared by Ken Esse and June Schmidt.
As I have indicated, by Statute and the City Ordinance, your group is advisory to
the City Council . We want your advice and recommendations. Some of the areas that
I am concerned with would be as follows:
1. Is the Ordinance as drawn adequate?
2. Is the Program and Contract with Bloomington advantageous to the City of
Edina? properly and are we getting value
3. Is our present Paramedic Program working pro p Y
received?
4. Do you have any reaction to Senate File• l?
5. Do you have any comments as to the present Contract, thru Bloomington,
which is funded by Federal money serving the parochial schools nursing
functions and only as a liasion to the public schools. I am not suggest-
ing we get into the church-state argument, but rather to be concerned
about the lack of assistance to the public schools.
I hope that you will review the entire health situation within the city of directed toEina
if there are any comments on any part of it that you have, Y
the Council . Actually, I would rather have the Advisory Health Board determine its
direction and its recommendations for work in investigation and advise us of those
preferences so they can be incorporated in an ordinance.

of the meetings, and will together with Ken Essee serve as Staff for this Commission.

If at any time the Council can be of help to you or you have any concerns tat you
�- would like to discuss with them or with me, we are available for such meeti igs at
your request.
We want to thank all of you for your willingness to serve on this commission and I
might indicate to you that the members selected on this commission were determined
by analysis to attempt to obtain a fair representation of the City. Everyone of you
cabled indicated a willingness to serve and I received no turn-downs to my requests
for appointments to this commission. I appreciate that.

P.S. It is my understanding that Dr. Rockwell is going to serve as Chairman of the
commission, although it was agreed that if either he tires of it or if you
people have another suggestion for the long range, that is certainly agreeable.
Incidentially, I have marked on the roster the length of term for eac of the
members of this commission and, of course, at the end of that time they are
always subject to reappointment with your consent and that of the Cou cil .
Since the meeting, I have discussed with Dr. Rockwell the advisability and
request of the Council that the Health Board determine somewhat its own scope
of operation and I would request that they look into the health matters within
the City and by that I refer to not only paramedic training and performance,
but the Health and Sanitation Department, the Health Lab and, of course, the
expenses in connection therewith.
Since the meeting, I have also attended a meeting with officials from Fairview
-Southdale and Methodists Hospitals, as well as Smith Ambulance. They are asking
for financial support from the municipalities served and that was discussed and
will be further analyzed. Bob Buresh and Craig Swanson were also in attendance
and they will delve further into it with Warren Hyde and be back to the com-
mission with comments and some information for your analysis and reco endation.

Mrs. Schmidt moved for approval of the May 24, 1977, Advisory Board of
Health minutes. Mrs. Bang seconded. All voted aye. Motion carried.
III. Announcements, Reports:
A. Reservation of meeting room for monthly meetings.
Dr. Rockwell said the meetings would be held in the City Hall Conference
Room.
B. Announcement of two new consumer members.
Dr. Rockwell reported only one additional consumer member had been appointed
at present, whose name was Barbara Kresoya. A second consumer member would be
appointed at a later date.
C. Report of meetings attended:
(1) Bloomington Legislative Meeting, Tues. , June 28. Tully Stoppel, Dr.
Simmons.
Tully Stoppel and Dr. Simmons were not present and no report was given of the'
Bloomington Legislative meeting.
(2) Staff meeting, Tues. , June 28. Dr. Rockwell.
Dr. Rockwell recalled Mayor VanValkenburg, Arlin Waelti, Administrative
Assistant, June Schmidt, David Velde, and himself had met on June 28, 1977, and
discussed the purpose of the Board and how it would function.
(3) County Survey Meeting, Thurs. , June 30. June Schmidt.
Mrs. Schmidt reported she had not attended the County Survey meeting but
that someone whom she felt was more qualified than herself in the area attended.
The report she received on the meeting was basically that the City could be used
as a sampling group with Hennepin County preparing a questionnaire.
Regarding House File 1, Mrs. Schmidt said there was an attempt to abolish
the Health Board at the State level which would allow Hennepin County to have
more control over the distribution of funds to the municipalities. Dr. Krafft said
this was the result of inadequate accountability of DPW funds.

IV. organization of Advisory Board.
A. Review of materials sent to members.
Dr. Rockwell reviewed the materials sent to the Board members and answered
questions as to the types of materials.
B. Internal organizational structure of Board.
Dr. Rockwell appointed Dr. Cardle, Dr. Krafft, and Mrs. Bjerke for the
By-laws Committee. Mr. Velde said the Board's by-laws should be set up as soon
as possible and, in response to Dr. Cardle, said he would obtain a copy of Blooming-
ton's by-laws. Dr. Rockwell recalled that he had been selected as Chairman of
the Advisory Board of Health and suggested Mr. Esse be chosen as Vice-chairman.
Mr. Esse felt that it may be best if the Vice-chairman was not a staff member.
Discussion followed as to whether officers should be elected or chosen. No
further action taken.
C. Function of Board.
(1) Responsibility of Council/Health Board.
Dr. Rockwell said the responsibility of the Advisory Board of Health was
to make recommendations to the City Council as to health matters, which the City
Council would either approve or deny.
(2) Relationship to Council, other cities, Hennepin County, State.
Dr. Rockwell explained that the relationship of the Board to the City
Council was that the Board operated primarily as an advisory board.
(3) Subject areas of endeavor: Legislative; Needs study; Program; others.
Dr. Rockwell announced a meeting would be held Thursday, July 7, on
House File 1 with Mr. McCarren. Mrs. Schmidt said the needs study had already
been prepared but that future needs studies would be prepared by the Board.
Dr. Engstrom was curious as to the controversey regarding a subsidy to
Smith Ambulance Services. Mr. Esse said it might be advisable to have the Fire
Department explain to the Board the functions and costs of Smith Ambulance in Edina.
In response to Dr. Krafft, Mr. Velde gave a general breakdown of ambulance runs
in Edina.
Dr. Krafft asked if there were any comments from the Board in regard to the
Edina Sun article concerning the Edina Advisory Board of Health, and said it was
disillusioning by listing services provided by them rather than Nursing Services
itself. Mrs. SciLmidt also said she had said there was a charge for these services
rather than a minimal charge as stated in the article.
V. Discussion of Budget.
A. Review of Present Budget and Sources of Funding.

- Regarding the budget, Dr. Rockwell asked if there were any questions
and if the Board would like to recommend to the City Council acceptance of the
budget. Following brief discussion, Mr. Cardle moved and Mrs. Bang seconded
the motion that the budget be approved as presented. All voted aye. Motion
carried.
B. Community Health Services report deadline - July 9th. f
Dr. Rockwell asked if the Board wished to keep as is the Nursing Services
with Bloomington or if they desired any changes. The Board generally agreed
that the Nursing Services were feasible and required no present changes.
C. Suggestions to Budgetary study.
None.

EDINA ADVISORY HEALTH COMMITTEE
ARTICLE Z
Name
The name of this City Commission is the Edina Advisory Health Committee.

ARTICLE II
i
Duties
The duties of this Committee are:
A. To research, study, and evaluate the needs concerning the health and
environment of the City of Edina.
B. To advise the City Council (Board of Health) of its findings relating
to the needs of the health and environment of the residents of the City of
Edina.
ARTICLE III
Officers
A. The Committee shall elect officers including a Chairman and a Vice
Chairman with terms of one year.
B. The election of Chairman and Vice Chairman shall take place in January
of each year.
C. If the office of Chairman is vacated by resignation, the Vice Chair-
man shall become Chairman and a new Vice Chairman shall be elected by a
majority vote of the members of' the Committee.
ARTICLE IV
Membership
A. The Committee shall consist of (9) to (12) voting members.
B. Members of the Committee shall be appointed by the Mayor, with approval
of the City Council (Board of Health) . The Committee may submit to the City

Council (Board of Health) names.,for appointment to the Committee. Members
of the Committee must be residents of the City of Edina.
C. First appointment may be for less than two years; thereafter, all
terms shall be two years and no member shall serve more than three consequ-
tive terms.
D. The membership of the Advisory Committee shall be as follows: at
least one third providers of health services, including at least three licensed
professionals; and at least one third consumers selected to represent con-
sumers organizations or constituencies within the community.
E. Edina Health Department personnel, and a designated member of the
City Council (Board of Health) shall be ex-officio, nonvoting members of the
Committee. The Chairman may appoint additional ex-officio, nonvoting members.
ARTICLE V
Organization
A. The Committee shall meet at least six times a year and at the call of
the Chairman or a majority of the members.
B. Members shall be notified of the place and time of each meeting. All
meetings.-Shall be open to the public.
C. Greater than 50 percent of the voting members will constitute a quorum.
D. The organizational meeting shall be held at the first meeting in Jan-
uary each year.
E. The Chairman may appoint committees, including special committees
and ad hoc committees.

HELD AUGUST 2, 1977, AT 7:30 P.M.

II. Approval of the July 5, 1977, Edina Advisory Health Committee Minutes.
Mrs. Schmidt wished to correct the second sentence of the first paragraph
under No. 3, page 1 (County Survey Meeting, Thurs. June 30) to read as follows:
The report she received on the meeting was basically that they could use jurors
as a sampling group and Hennepin County would assist us in preparing a question-
naire which their staff would administer.
Dr. Krafft wished to correct the minutes by rescinding the last sentence on,
page 1 and also by changing the last paragraph of page 2 to read: Dr. Krafft
asked if there were any comments from the Board in regard to the Edina Sun article
concerning the Edina Advisory Board of Health. Dr. Krafft took exception to the
listing of the number of public services with the insinuation that the Edina
Advisory Health Board would recommend all services to the Edina City Council.
III. Announcements and Reports:
A. Bloomington Advisory Board Meeting, speaker Senator Kirchner.
Dr. Simmons reported the meeting was held at Normandale Community College
and House File No. 1 was discussed.
B. Status of 1978 Community Health Services Report.
There was no discussion of this report as the report had just been received.
C. Public Meeting for the Community Health Services, August 24.
Mr. Velde reported the County would be making flyers for this hearing to
be held at the Southdale Hennepin County Library with Bloomington, Richfield, Eden
Prairie, and Edina on August 24, 1977. He said the City of Edina was requested
to contact WWTC radio to promote it.
D. Others:
1. Letter from David C. Olsen.
Dr. Rockwell said that David C. Olsen, 4242 Alden Drive, had sent a letter
addressed to him indicating interest in becoming a member of the Board. fie said
the Mayor appointed members of the Board and that the letter would be placed on file.
IV. Edina's Emergency Medical Services, Bob Buresh, Director of Public Safety.
Mr. Bob Buresh said Craig Swanson, Chief of Police, was also present and
explained the program was operated jointly between the Police and Fire Departments.

He proceded to hand out information explaining the program as well as case studies
., and graphs showing its success. He said they had expanded the services in 1975 to
include paramedics. Presently, there are two paramedics for each shift who
have received training by Hennepin County Medical Center. Mr. Buresh briefly I
explained the information given out which included breakdowns of the types of med-
ical emergencies and who assisted as well as services offered by them to citizens
of Edina, such as blood pressure checks.
Mr. Buresh explained the individual case studies. The Board commented that
in the future names should be deleted in such studies because they included the
personal health records.
In response to Dr. Krafft, Mr. Buresh said the City has decided not to
help subsidize Smith Ambulance but will continue their own services independently.
He further said they will only rely upon outside help in extreme cases.
In response to Dr. Rockwell, Mr. Buresh said they could not determine the
exact percentage of the budget used for EMS because the paramedics were also fire
fighters. He then explained the operation of the new-911 emergency number.
Mr. Craig Swanson said he felt the EMS operation was a timely one. Mr. Buresh
said the procedures taken on each call are reviewed monthly by Hennepin County,
which sessions are used for training.
V. Election of Chairman of the Advisory Board of Health.
Dr. Rockwell said the Nominating Committee had decided to wait until Nov-
ember or December to elect another chairman.
VI. Discussion and Adoption of the By-laws of the Advisory Board of Health.
Dr. Cardle read over the proposed by-laws prepared by the By-laws Committee.
Following short discussion, Dr. Moss moved they be approved as written. Dr.
Simmons seconded. All voted aye. Motion carried.
V. Adjournment.

AN ORDINANCE AMENDING ORDINANCE NO. 162 TO PROVIDE
THAT FAILURE TO ATTEND REGULAR OR SPECIAL MEETINGS
OF BOARDS AND CO.B•1ISSIONS WILL RESULT IN
REMOVAL FROM OFFICE
THE CITY COUNCIL OF THE CITY OF EDINA, MINNESOTA, ORDAINS:
Section 1. Section 2 of Ordinance No. 162 is hereby amended to
read as follows:
"Sec. 2. Removal. Any public member of either the Edina Park
Board, Edina Human Relations Commission, Edina Environmental
Quality Commission, Teen Recreation Board, Building Construction
Appeals Board, Board of Appeals and Adjustment, the Planning
Commission, or any other board or commission hereafter created
or approved by the City Council, who fails to attend three (3)
consecutive meetings thereof, whether regular or special, or
who fails to attend any four (4) meetings, whether regular or
special, in the span of twelve consecutive months, shall auto-
matically be removed from office."
Sec. 2. This ordinance shall be in full force and effect immediately
upon its passage and publication.

Mrs. Schmidt moved for approval of the August 2, 1977 Advisory Board of
Health Minutes. Mrs. Harris seconded. All Voted Aye. Motion Carried.
III. Announcements and Reports:

A. Community Health Services Hearing. June Schmidt and B. Harris.
Mrs. Schmidt stated that Mrs. Harris would give the report on the hearing.
Mrs. Harris reported that the information given was on the County level. The
comments of the people testifying were interesting. The hearing was held at the
Southdale Library and most of the discussion centered around care concepts and
life support. The University Life Care Center Committee was against abortion.
Representatives hoped there would be support from the County and from non-profit
organizations for health education.
B. South Hennepin Human Services Council. Linda Bjerke.
Jason Wiley, Hennepin County Office of Planning and Development and
Yvonne Hargens, Director of Nursing Services, for Richfield, Bloomington and Edina,
gave a detailed report. The main point which is made in the final draft of the
proposed CHA profiled that the major age group being served is 65 and over. Edina
has 11% in this age group. Each group does receive many services from Bloomington
Health Services. The projections made had been very accurate. Other areas for
discussion was the pre-school screening of all four year olds. There would be
additional funding from the State Legislature.
C. House File #1 Forum, Minneapolis and Senate File #459. D. Velde.
The public forum for the Community Health and Social Services Bill was
held at the Northwestern National Life Building on August 25, 1977.
Members of the panel included Dr. James Kimmey from Madison, Wisconsin,
Mr. Dirkschweiger, with the Minnesota Department of Welfare, Mr. Bob Hiller
with the Minnesota Department of Health, Mr. Phil Cohen with the League of
Municipalities, Lester Anderson, a County Commissioner from Blue Earth, Minnesota,
and Senator Nelson from Austin, Minnesota.
The differences between Health Services and Social Services were
discussed. The panelists raised several questions regarding how decisions will be
made for funding the various programs that are presently in operation. House
File No. 1 does mandate the following services: Adoption Services; Child

Protective Services; Detoxification Services; Foster Care Services; Mental Health .�
Services; Disease Prevention and Control Services; and Community Nursing Services.
Other health services are eligible for funding with this bill, but they are not
mandated.
Mr. Cohen raised the objection that House File No. 1 will provide
funding for the counties, but does not address the fact that several municipalities
are providing health services and have been since the early 1960's. He felt
that House File No. 1 should include provisions for dealing with existing
municipal health agencies.
It was felt that the bill does presuppose some sophisticated planning
and technical information on the counties part. Also, it was felt that the decisions
would be more political thereby allowing advocacy groups a better position in
gaining funding for their interests.
CHS does not require all counties to submit plans. One county has
indicated that they are not interested.
Mr. Werges noted that the history of health services and social services
are running parallel and serving the same people.
Mrs. Schmidt reported that the Bill does not mandate environmental
health services.
Dr. Krafft noted that the bill applies to counties with 30,000 population

and stated that he would think certain communities would not want it.
D. Message from Mayor, Attendance Ordinance, Ken Esse.
Mr. Esse presented Ordinance No. 162-Al to the Committee for their
review and explained that this amendment related to the attendance of meetings.
The Council passed this Ordinance in March, 1975. No action taken.
IV. Adoption of Resolution for Final Draft of CHS Proposal.

WHEREAS, the Advisory Board of Health of the City of Edina is an official
advisory body to the City Council, which is the official local Board of Health; and
WHEREAS, the Advisory Board of Health is charged by the City Council to study
public health needs in the City and recommend to the Council policies and
ordinances and programs necessary to meet these needs; and
WHEREAS, The Advisory Board of Health has reviewed the plan and application
for the 1978 Community Health Services Act subsidy funds prepared by the staff of tht-
j City of Edina and finds it thoroughly consistent with the needs and priorities of
j the community as determined by this Advisory Board and as expressed in citizen
participation;

V. Agreement Allowing City Licensing of Hotels/Motels
Mr. Esse reported that the State Health Department will no longer
continue to license or inspect hotels/motels/boarding houses. An agreement has
now been obtained between the City and the State *that allows the City to enact
ordinances with more stringent requirements than contained in State Law. The
agreement has been tentatively approved by the State Department of Health and the
City will be responsible financially for the cost of inspection, but will also
license and collect the licensing fee for the inspection.
Dr. Rockwell stated that the Committee recommend that the Agreement
be approved.
VI. Request for Hearing on House File 1/Senate File 459 in Edina Area.
There haven't been any hearings in the Metropolitan Area and no date
has been set for any hearings. Nothing will be done until the next Legislature
meets. The City has requested a hearing to include the communities of Bloomington,
Richfield and Edina and surrounding communities.

The pending legislation known as the Community Health and Social Services Act
(SF 459) has generated considerable interest on the part of both the citizens
and City Council of Edina as to the impact this legislation will have on the

health services in the Edina community. This interest is evidenced by the '1
resolution passed by the Council last March concerning House File 1. It is
the desire of several members of the Health Advisory Board and of those in the
community to express their concerns to your committee regarding this legislation.
It is requested that a hearing on the bill be held in the South Hennepin Human
Services region to afford those from Edina and surrounding municipalities the
opportunity to testify, particularly Bloomington and Richfield, who together
with Edina provide health services to all three communities through the Blooming-
ton Public Health Services. In the alternative, if establishment of such a
hearing is not feasible, it is requested that the City be notified at least two
weeks in advance of any hearings on the bill at the Capitol so that those in-
terested in testifying will be able to arrange their schedules so that they can
attend.
Your cooperation and consideration in this matter will be appreciated.

VII. Other Business
A. Immunization Clinic. Dr. Rockwell.
Dr. Rockwell reported that Dr. A. K. Brill, Bloomington Public Health
Nursing Services, contacted him about the possibility of conducting a flu immunization
clinic this Fall for the elderly. Dr. Rockwell asked for comments from, the
Committee members. Dr. Rockwell stated that because of the suits pending on the
Swine Flu immunization, he was not in favor of supporting a clinic. He also noted
that most of the medical profession members were leaving the decision regarding
flu shots up to the patient and were not, in their private practices, encouraging
or discouraging the flu immunizations.
Dr. Rockwell stated that the Committee recommend to the City Council
that they do not favor this clinic because of controversy over flu immunizations.
VIII. Adjournment
Dr. Engstrom moved for adjournment. Chairman Rockwell noted that the
Committee would have to meet twice more this year in order to comply with the
Ordinance regulating the Committee. The Committee decided to wait and see if
there would be a response to the Senator Solon letter before a decision will be
made on the next meeting date. There will be a meeting in December at which time
the nominating committee will present its slate of candidates.
Mr. Werges seconded the motion for adjournment. All Voted Aye. Motion
Carried.

EDINA ADVISORY HEALTH COMMITTEE
ARTICLE I
Name
The name of this City Commission is the Edina Advisory Health Committee.
ARTICLE II
Duties
The duties of this Committee are:
A. To research, study, and evaluate the needs concerning the health
and environment of the City of Edina.
B. To advise the City Council (Board of Health) of its findings relating
to the needs of the health and environment of the residents of the City of
Edina.
ARTICLE III
Officers
A. The Committee shall elect officers including a Chairman and a Vice
Chairman with terms of one year.
B. The election of Chairman and Vice Chairman shall take place in
January of each year.
C. If the office of Chairman is vacated by resignation, the Vice Chair-
man shall become Chairman and a new Vice Chairman shall be elected by a
majority vote of the members of the Committee.
ARTICLE IV
Membership
A. The Committee shall consist of (9) to (12) voting members.
B. Members of the Committee shall be appointed by the Mayor, with approval
of the City Council (Board of Health) . The Committee may submit to the City

Council (Board of Health) names for appointment to the Committee. Members
of the Committee must be residents of the City of Edina.
C. First appointment may be for less than two years; thereafter, all
terms shall be two years and no member shall serve more than three consequ-
tive terms.
D. The membership of the Advisory Committee shall be as follows: at
least one third providers of health services, including at least three licensed
professionals; and at least one third consumers selected to represent con-
sumers organizations or constituencies within the community.
E. Edina Health Department personnel, and a designated member of the
City Council (Board of Health) shall be ex-officio, nonvoting members of the
Committee. The Chairman may appoint additional ex-officio, nonvoting members.
ARTICLE V
Organization
A. The Committee shall meet at least six times a year and at the call of
the Chairman or a majority of the members.
B. Members shall be notified of the place and time of each meeting. All
meetings shall be open to the public.
C. Greater than 50 percent of the voting members will constitute a quorum.
D. The organizational meeting shall be held at the first meeting in
January each year.
E. The Chairman may appoint committees, including special committees
and ad hoc committees.

459 , 1978 MINNESOTA LEGISLATURE
WHEREAS, the City Council of the City of Bloomington is the
official governing body of the City of Bloomington; and
WHEREAS, the City Council fully supports prior legislation,
including the Community Health Services Act , which provides for the
establishment and funding of municipal, boards of health and health
departments and the delivery of community health services ; and
WHEREAS, the City of Bloomington Advisory Board of Health has
enthusiastically endorsed the Community Health Services Act because
the law has been effective in (1) facilitating full community par-
ticipation in the planning and development of local health services ,
(2) implementing sound environmental and preventive health techniques ,
(3) improving the over-all quality of community health services , and
(4) achieving the consolidation of public health authority at the
local level while promoting the organization of multi-county boards
of health; and
WHEREAS, the City Council firmly believes that the City of
Bloomington's Division of Public Health and Environmental Services
Section should continue to provide a full range of community health
services including home-care services ; adult health services ; chil-
dren's health services ; information and education; school support
services ; health promotion and counseling for individuals , families ,
and groups ; nutritional services; disease prevention and control
services ; housing maintenance ; food service inspection; community
sanitation; and environmental pollution control to residents of
Bloomington; and

WHEREAS, the City Council acknowledges and supports the City
of Bloomington's delivery of personal public health services to the
`- residents of Edina and Richfield; and
WHEREAS, the City Council is aware of the highly competent and
professional manner in which the City of Bloomington' s Division of
Public Health and Environmental Services Section have performed these
community health services ; and
WHEREAS, the City Council has reviewed that certain law proposed
to the Legislature during the 1977 legislative session, filed as
Senate File No. 459 ; and
WHEREAS, the City Council is cognizant of the fact that the
adoption of Senate File No. 459 as presently drafted would repeal
the Community Health Services Act and other existing laws granting
the City of Bloomington authority for the planning, funding, and
provision of community health services ; and
WHEREAS, the City Council is further aware that Senate File
No. 459 would transfer the authority for the planning, funding, and
provision of community health services to the Hennepin County Board
Of Commissioners , thereby seriously jeopardizing the viability of
the City' s Division of Public Health and Environmental Services
Section; and
WHEREAS, the City Council endorses the provisions of Senate
File No. 459 relating to the planning, financing, and delivery of
social services other than community health services ;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF BLOOMINGTON . IN REGULAR MEETING ASSEMBLED, that the City Council
hereby urges the Minnesota Legislature to amend Senate File No. 459
by deleting all references to community health services ;

Mrs. Harris moved for approval of the September 6, 1977 Advisory Board of

III. Announcements and Reports
A. Report on 1977 and 1978 Activities. Yvonne Hargens
Mrs. Hargens reported that the Community Health Services Act was
passed in February, 1976. Every county in the State of Minnesota is participating
in some way at this time. Over 60 counties out of 87 are fully funded. All
but one county is in the planning process and has already secured a grant for
planning or is in the process. One county has not yet written their grant, but
it is expected that they will do so soon in order to secure the monies.
The Community Health Services Act has six categories. Two of them
are provided in Edina; the Emergency Medical Services and the Environmental
Health Services. The other categories are Home Health, Community Nursing,
Disease Prevention and Control, and Education. - In our personal public health
budget, we have delinated the seven activities in which we participate.
The Home Health area involves home nursing visits. Physical therapy,
speech therapy and occupational therapy are also available. Other home services
can be provided as prescribed by the Act. Home health aides are also available
for home services.
Community Nursing deals with non-ill persons to provide health
promotion. The counseling area addresses emotional traumas.
Disease Prevention and Control deals with all adult clinic services,
children clinic services and senior citizen center services as prescribed by
the Act.
Health Education coordinates all formal education processes and
is funded by the United Way.

Sixty percent of the direct serving time (nurse time only) in the
home is providing personal services to people with chronic diseases. Ninety-five
percent of all patients admitted with chronic diseases need home care services and
95% of the patients are over 65 years of age.
The write-off factor in Edina is very high which means the nursing
service is giving services particularly to older Americans in Edina who do not
' have a third party pay; they are not eligible for Medicare and do not have the
resources to pay for their needs. We are serving people with real needs.
The City of Edina has one of the highest per capita older American age population
in the metropolitan area.
In the home health area, the University of Minnesota has a grant from
HEW to do a research project on the child with cancer. The child is released
by the physician to be cared for at home. A nurse is assigned to the case and
is delegated a great deal of responsibility. She is on call 24 hours a day, 7
days a week. After her regular 5 day, 40 hour week, the nurse is paid through the
grant funds. The nurse helps the family through the illness and supervises the
case until the child expires. It is also her duty to help the family adjust
after the child has expired.
In the health promotion area, a project on child abuse is being
conducted, particularly with mothers who have little or no parenting skills.
There is an aide with the department who works with the mother to help her develop
these mothering skills. There is a possibility of a grant for this project.
In the children's health. area, the staff is working with the day -
care/nursery program in the three communities and working with them to be in
compliance with the health regulations of the Welfare Department. We are working
with the Minneapolis Day Care Association on this project.
Pre school screening is another project area. The community is
obligated to offer the screening to the pre-schooler and we are working with the
Edina_School_District_¢a_tltis_-Program,

Mr. Esse reported that Senator Solon stated in a letter to Mayor
Van Valkenburg that there would be no hearings in Edina and all hearings would
be in the St. Paul Metropolitan area. We would be notified of the meetings.
C. Report on Senate File #459. Dave Velde
Mr. Velde reported that there will be hearings held on December 3,
1977 at 1:30 P.M., at the State Capitol, but there will be no public testimony.
Mrs. Hargens reported that she attended the hearings in Duluth
regarding this Bill and all people testified against it. She also mentioned
that the City of Bloomington had offered a resolution urging the Minnesota
Legislature to amend Senate File No. 459 by deleting all references to
community health services.
Mrs. Bank offered the following Resolution to be sent to the City

Dr. Rockwell stated that the committee could meet after adjournment to
discuss the matter again.
V. Unfinished Business
Mrs. Stoppel reported that she would like a member of the Committee,
particularly one of the medical members to meet with her and her committee to
help set up the standards for the pre-school screening. Dr.- Cardle agreed to
help with the standards.

Dear Dick:
We do believe that HF 1 and SF 459 if addressed exclusively to the delivery '
of social services would be of benefit to the county in its planning,
implementation and delivery of social services. The philosophy of the
community health services act is very similar to HF 1 and SF 459. This act
can accomplish the goals of local control over the delivery ofssocial services
in much the same way that the Community Health Services Act cemented the
role of local control in the determination of community health services. We
stand firm in our belief that social services must be kept separate from
community health services and that these two areas can be legislated separately
without detracting from the quality of service of either program.
Presently, we have developed a sophisticated system for the delivery of
community nursing services, home health care, disease_prevention and control,
family planning, nutritional services, children's health services, emergency
medical services, ,health education and environmental health services. This
system was initiated in the early 1950's and has evolved over the years.
Through the years, the programs have been streamlined and expanded to accommodate'
the changing complexion of the local, area. With the advent of the Community
Health Services Act, additional funds were used to up-grade the quality of
t programs,
these ro rams namely the Bloomington Public Health Nursing Service. Also,
in light of the fact that the Minnesota Department of Health is phasing out
of the delivery of health services, the City has entered into a contract with
the Minnesota Department of Health agreeing to provide environmental health
services. j
The key feature of our program is the ability of Edina to determine itsown
needs and priorities. We feel that the needs are being addressed in a very
economical and accountable manner. This belief is reflected by the approval
of our Ccmmunity Health Services Plan by both Hennepin County and the
Minnesota Department of health.
With the passage and implementation of HF 1 a."d SF 459 we fear the ability
of the local community to respond to the needs of the community will be
severely jeopardized.

HF 1 and SF 459 mandate the delivery of certain health and social services.
Not included in the mandated services are emergency medical services, health
education, and environmental health services. Even within the mandated services,
questions will arise as to the priorities for preventative type programs, and
it is conceivable that the urgency of social programs will cause a reduction
in the quality of community health programs because of inadequate funding.
'Through the preventative health programs, dependency on social service programs
can be reduced by avoiding crippling and disabling diseases. Indeed, through
the early detection of disease, the expeditious delivery of injuries, and
education of good health habits, many serious problems can be avoided.
Another question that has not been answered is what happens to local programs
such as emergency medical services and environmental health after the passage
of HF 1 and SF 459. Will they be transferred to the County or will the
municipalities retain the programs? If the municipalities retain the programs,
in effect they will be taxed doubly for eligible programs. If the programs
are transferred to the County, what input will the municipality have in the
determinations of priorities and quality of community health services? Will
the municipality be required to transfer its funding sources to the county and
hope to receive a reasonable degree of service in return?
Presently, the expenditures for the delivery of community health services in
Hennepin County total $8,867,007. The,Community Health Services Act subsidizes
the county with $2,071, 191. The remainder of the funding is generated by
local effort. Hennepin County participates with $1,123,476 and, the remaining
$5,672,340 is generated from the participating municipalities. Under HF l and
SF 459, the county would receive $28,826,000, of which $14,926,000 would be
Title XX Federal funds.
The remaining $13,900,000 would be used for funding other community health and
social service programs which are not eligible for Title XX funding. To main-
tain the current community health services will cost $8,867,000, leaving
$5,032,993 for the support of the other social service programs which are not
eligible for the Title XX funding. We question whether this $5,032,993 will
be adequate to fund the remaining programs, or will the funding for the
community health services programs be reduced and the balance transferred to
the social service programs?
We are not convinced that we can relinquish our programs to the county and
justify it economically nor beneficially. If we retain the programs, we are
taxed doubly. If we relinquish the programs we may not benefit with the
delivery of similar services. Either way, the municipalities will most likely
expend more money to maintain the services that we now have, or we will receive.

If, on the other hand, the county elects to contract with existing local
programs, how will the needs and priorities of the area be addressed? The
structure and planning for the delivery of community health services will be
determined by the county advisory committee and the county commissioners will
act on these recommendations. In HF l and SF 459, there are no provisions
for separate advisory boards within the various localities, only the community
health services advisory committee which shall include representation_ from
cities within the county. Here, again, the county will determine our needs
and priorities because of the lack of legitimate local advisory bodies.
We do not oppose change, but to change a program that is still in its infancy
and doing well does not seem to be a wise course of action. The programs
which have been implemented are very viable and effective. Instead of repealing
the Community Health Services Act, one should commend this type of progressive
legislation and hope that it can be applied to other programs that are
inefficient and unable to contend with local problems on a local basis.
Dick, why does anyone gain by less local control and supervision. This is
now an excellent program let's work to keep it, not hang it.

JOINT POWERS AGREEMENT
(Community Health Services)
THIS AGREEMENT, made and entered into this day of
1977, by and between the CITY OF BLOOMINGTON, a Minnesota
municipal corporation, in the County of Hennepin, -State of Minnesota
("Bloomington"), and the CITY OF EDINA, a Minnesota municipal corporation,
in the County of Hennepin, State of Minnesota ("Edina"),
WITNESSETH•
WHEREAS, Bloomington warrants and represents that its Division of
Public Health is a duly certified public health agency operating in accordance
with all applicable federal and state requirements; and
WHEREAS, Bloomington's Division of Public Health provides community
health services, including, but not limited to, nursing services, home health
services, disease prevention and control services, family planning services,
early detection of health problems, nutritional services, and health education;
and
WHEREAS, Edina desires to promote, support, and maintain the health
of its residents by providing community health services, including education,
disease prevention, early detection of health problems, and nursing care, at
a nominal fee to those making use of such services, and to contract with
Bloomington for Bloomington, through its Division of Public Health, to provide
such services to residents of Edina; and
WHEREAS, the governing bodies of Bloomington and Edina are authorized
by Minnesota Statutes, Section 145.914, Subdivision 5, Section 145.917,

Subdivision 3, and by Minnesota Statutes, Section 471.59, to provide community
health services and to enter into agreements with each other for the providing
by Bloomington of community health services to residents of Edina.
NOW, THEREFORE, the parties hereto, for and in consideration of the
covenants hereinafter set forth, agree as follows:
1. Bloomington, through its Division of Public Health, agrees to
provide residents of Edina with the following community health services
("Health Services") :
A. Home care services involving intermittent home visits by
nurses, aides, or therapists for individuals or families suffering illness,
with treatment to be provided in accordance with a medical plan of care deter-
mined either by Bloomington or by a qualified physician acceptable to Blooming-
ton, and periodic home visits for assessment, observation, evaluation, preventive

health techniques, and follow-up of clinical findings.
B. Adult health services consisting of clinical sessions in the
areas of family planning, venereal disease and communicable disease prevention,
and clinical services for well women dealing with gynecologic health screening,
teaching, and counseling on female health issues.
C. Children health services comprising clinical sessions for
well children, early and periodic screening, and communicable disease testing
and immunization.
D. Public health informational and educational services,
including providing any and all groups requesting the same with speakers on
health-related topics, and assisting such groups in developing health programs.
E. School health support services involving screening, teaching,
and counseling of students.

�- F. Senior citizen health services, including clinical screening,
therapeutic visits, outreach contacts, counseling, teaching, nutritional
services, and well-adult visits.
G. Counseling on any or all of the foregoing health services,
with individuals, couples, families, and groups requesting the same, including
chemical dependency counseling.
2. The Health Services shall be provided and rendered hereunder to
the residents of Edina in the same manner, to at least the same extent, and
with at least the same quality and kind of personnel, equipment, and facilities
as the Health Services are provided and rendered to residents of Bloomington,
it being the intent and purpose of this Agreement to provide and render the
Health Services equally to residents of Bloomington and Edina, without dis-
crimination in any way. In addition, Bloomington agrees (i) to provide the
Health Services at paragraph 1.F. at such senior citizen centers D
from
time to time designated by Edina, and (ii) to provide mobile mini
for special uses such as blood pressure testing and immunizations
six (6) times during the term of this Agreement, at appropriate l
Edina, including but not limited to Edina City Hall, 4801 West 50
and the Edina Senior Center, 7151 York Avenue South. The mobile mini-clinics
shall be set up on such days, and for such hours during such days, as Bloom-
ington shall determine, and need not be set up at the same time in all of said
locations, but during the term of this Agreement a mobile mini-clinic shall be
set up at least six (6) times, for a reasonable period of time, at each such
location. Bloomington shall give a schedule of dates and times when such
mobile mini-clinics shall be established at leas ten (10) days n advance
of the scheduled dates, except in emergency situations.

3. Bloomington shall provide the Health Services pursuant hereto
on a confidential basis, using capable, trained professionals.
4. All Health Services to be rendered hereunder by Bloomington
shall be rendered pursuant to and subject to public health policies, rules,
and procedures now or hereafter, from time to time, adopted by the Bloomington
City Council, and in full compliance with all applicable state and federal laws,
provided however, that (i) no such policy, rule, or procedure hereafter adopted
by the Bloomington City Council shall in any way affect, modify, or change the
obligations, duties, liabilities, or rights of the parties hereto as set out
in this Agreement, or reduce or detract from the kind, quality, and quantity of
Health Services to be provided hereunder by Bloomington to residents of Edina,
and, (ii) all such policies, rules and procedures shall be uniformly applied
to all persons receiving Health Services from Bloomington, whether residents
of Edina, Bloomington, or any other municipality. Edina agrees to adopt the
same policies, rules, and procedures as are from time to time adopted by
Bloomington, if determined by Edina to be necessary or desirable to facilitate
or regulate the provision of Health Services by Bloomington to residents of
Edina pursuant hereto.
5. Edina agrees to pay to Bloomington, for the provision of Health
Services pursuant hereto, amounts and on terms as follows:
A. The annual sum of $79,692.28 ($1.76 per capita times 1975
county population estimate of 45,290) shall be paid in quarterly payments
of-$19,923.07 to Bloomington within fifteen (15) days of the receipt by Edina
of each of the reports to be given pursuant to paragraph 5.B. hereof, subject,
however, to the provisions of paragraph 5.C. hereof.

B. .,On April 15, July 15, and October 15, 1978 and on
January 15, 1979, Bloomington shall send to Edina a statement, certified by
the person in charge of Bloomington's Division of Public Health as being
true and correct, and covering the period of the three (3) calendar months
preceding the month in which the report is given, and setting forth, in such
detail as Edina from time to time shall reasonably require, the number of
persons served, the kinds of Health Services delivered, the locations where
such services were delivered, and such other information as Edina shall
reasonably request.
C. No payment or payments need be made by Edina under this
Agreement while Bloomington is in default under any of the terms and conditions
hereof to be by Bloomington performed.
6. ' In the event Edina desires to inspect the financial books and
records of Bloomington relating to the providing of Health Services hereunder
by Bloomington, Bloomingtom shall make its financial books and records avail-
able at the Bloomington City Hall for inspection and copying by Edina, or any
agent, employee, or representative of Edina, at reasonable business hours.
7. It shall be the sole responsibility of Bloomington to determine
the qualifications, functions, training, and performance standards for all
health service personnel who render Health Services under this Agreement;

provided, however, that Bloomington agrees that all such p rsonnel shall be
capable, trained professionals.
8. Bloomington's Division of Public Health will communicate with
the Edina Health Department, Edina Department of Safety, and Edina Department
of Parks and Recreation relative to Health Services to be performed hereunder
by Bloomington, such communication to be in the form of reports, conferences,

or consultations, as the respective Edina departments from time to time shall
request. Also, all reports relating to the providing of Health Services that
are given by Bloomington's Division of Public Health to the Bloomington City'
Council or to the City Manager during the term of this Agreement shall also,
and at the same time, be given to Edina.
9. Bloomington also agrees to send to Edina an annual report
describing the activities performed and Health Services rendered pursuant to
this Agreement. Such report shall be in such detail and form as Edina may
reasonably from time to time request. The annual report shall be sent with
and in addition to the last quarterly report required by paragraph 5.B. hereof.
Also, at Edina's request, made not more than two (2) times during the term of
this Agreement, responsible administrative officers of Bloomington's Division
of Public Health shall attend meetings of the Edina City Council or appropriate
\... board or commission to answer questions and give further information relative
to the activities performed and Health Services rendered under this Agreement.
10. Bloomington hereby agrees to maintain in force its present
policy of comprehensive liability insurance and medical malpractice insurance
in the minimum amount of five hundred thousand dollars ($500,000) , for the
term of this contract. A copy of the policy or policies issued shall be
furnished to Edina. Said policy shall be with an insurance company authorized
to do business- in Minnesota.
11. This Agreement shall be for a period from January 1, 1978 to
December 31, 1978, provided that either party may terminate the same by
thirty (30) days' written novice to the other. Upon such termination, all
obligations and liabilities of the parties hereunder shall cease and terminate,
except that the provisions of paragraph 11 hereof shall continue and survive

such termination. Also, in the event of termination pursuant hereto, the
quarterly payment next due shall be prorated and paid for only the period
ended on the date of termination, and Bloomington shall send to Edina, within
thirty (30) days after such termination, a report in the form required by
paragraph 5.B. , and shall also then send a final report in the form of, and in
lieu of, the annual report required by paragraph 10 hereof, and Edina shall pay
such reduced quarterly payment for the period ended on the date of termination,
within fifteen (15) days after receipt of both of such reports.
12. Bloomington and Edina understand and agree that each of them
shall apply and qualify, independently and separately, for any and all grants,
matching funds, and payments of all kinds from state, federal, and other
governmental bodies relating to, or for the provision of, any or all of the
Health Services, and any and all such grants, matching funds, and payments
shall belong to the recipient and be used and applied as the recipient thereof
shall determine, without regard to this Agreement.
13. All notices, reports, or demands required or permitted to be
given under this Agreement shall be in writing and shall be deemed to be given
when delivered personally to any officer of the party to which notice is being
given, or when deposited in the United States mail in a sealed envelope, with
registered or certified mail, postage prepaid thereon, addressed to the
parties at the following addresses:

II. Approval of November 1, 1977 Edina Advisory Health Committee Minutes
Chairman Rockwell moved for approval of the November 1, 1977 Advisory Board
Minutes with one correction. On page 6 under Proposed Meeting Day Change, the
word "second" Tuesday should be changed to "first" Tuesday. Mrs. Kresoya
seconded the motion. All Voted Aye. Motion Carried. Mr. Esse noted that the
Resolution sent to the City Council by the Advisory Board relating to Senate
File No. 459, was adopted by the Council at its November 21, 1977 meeting.
�.- III. Announcements and Reports: -
A. Presentation of 1978 Slate of Officers
Chairman Rockwell noted that the nominating committee met after the
November 1, 1977 meeting to review candidates for 1978 Chairperson and Vice Chair-
person. The name submitted for Chairperson is Linda Bjerke and for Vice Chair-
person is Bev Harris. Dr. Cardle moved that the Board unanimously nominate these
ladies to the positions specified. Mr. Moss seconded the motion. All Voted Aye.
Motion Carried.
B. Bloomington Contract 6% above 1977 Contract
Edina has contracted with Bloomington again to provide our nursing
and clinic services. There is a 6% increase over the 1977 contract and the cost
is about $1.76 per capita.
Mrs. Bjerke asked if there was some way the Board could get any feed-
back on home nursing or any care received. Dr. Cardle stated that we contract for
the services but we have no way of knowing how the residents feel about the service.
After some additional discussion, Mr. Moss moved that the Board
recommend approval of the Joint Powers Agreement with the following change found
on page 3. ". . .and (ii) to provide mobile mini-clinics at least six (6) times
during the term of this Agreement for special uses such as blood pressure testing
and immunizations, at appropriate locations". Mrs. Harris seconded the motion.
All Voted Aye. Motion Carried.

C. Report on House File 1 and Senate File 459. D. Velde.
Chairman Rockwell noted that Mayor Van Valkenberg had written a
letter to Commissioner Richard Kremer regarding HF 1 and SF 459 in which he
stated that "we feel that social services must be kept separate,from community
health services and that these two areas can be legislated separately without
detracting from the quality of service of either program."
The Senate meeting on December 3, 1977, was an interim hearing on
SF 459 and HF 1. The Committee was headed by Senator Solon and the purpose of
the meeting was for the State agencies to offer their testimony, namely, the
Department of Public Welfare, The Minnesota Department of Health and the
Department of Finance. Arthur Naftalin, University of Minnesota School of Public
Health, gave a summary of the different state grant categories. SF 459 and
HF 1 is a block grant program. Ed Dirkswager, Department of Public Welfare,
gave his testimony on the legislation. He indicated that he was not in favor
of the passage of HF 1. In the past, the Department of Public Welfare has been
in favor of this legislation, but has since changed its mind. He stated that
the DPW is becoming more accountable by implementing programs to coordinate
activities. They have started several pilot projects where they will try new
procedures and improve their facilities. They also feel that with this change
in accountability and coordination, there should be more confidence in DPW
by the State. DPW spends nearly l million dollars each year in services they
provide for the State. Under HF 1, there would be increased funding, however,
not all of that money would be earmarked for social services. The counties will
be coerced into forming human services boards because of the 10% increase subsidy
from the State.
Mr. Dirkswager also described Rule 36 which is a program requirement
under certain social service programs or activities in relation to mental health
programs. Under Rule 36, people in this category are eligible for certain
activity programs and it would amount to another $10 per day per person increase
in cost. Presently, they do not enforce Rule 36 because there is no money for
it. He stated that under HF 1, they would elect to enforce that rule.
Mr. Hiller, Minnesota Department of Health questioned the validity
of the planning process under HF l because if you develop a plan you will get
funding and if you don't develop a plan, you still get funding. He didn't like
the negative funding formula of HF 1. The formula for funding is based on the
counties AFDC load. The higher the AFDC case load, the higher the state
subsidy. Also, he did not like the idea of mandating specific services.
In general, the Department of Health is in opposition to the lack of
focus in the health services.

D. Report on Evaluation Clinic. D. Velde.
Mr. Velde reported that he and Karen Sorensen were attending an
evaluation clinic sponsored by the OPD of Hennepin County. The purpose of the
clinic was to present evaluation tools to the health departments for help in
evaluating the CHS Act which has completed its first year. Mr. Velde reported
that it was an educational experience and would be helpful in the evaluation of
the Act.
IV. Next Meeting Date
The Board set January 24, 1978 at 7:30 P.M. as the next meeting date.
