CALL TO ORDER Mayor Hovland called the meeting to order at 7:0I p.m. then shared the procedure for public hearing and community comment. II. ROLLCALL Answering rollcall were Members Agnew, Jackson, Pierce, Risser, Hovland. Absent: None. III. PLEDGE OF ALLEGIANCE IV. MEETING AGENDA APPROVED AS PRESENTED Member Jackson made a motion, seconded by Member Pierce, to approve the meeting agenda as presented. Rollcall: Ayes: Agnew, Jackson, Pierce, Risser, Hovland Motion carried. V. COMMUNITY COMMENT Sue Nissen, 4408 West 58th Street, thanked the Council for posting the snowplowing and ice control policy on the City's website and including commercial applicator limited liability legislation in the City's legislative priorities as these actions were important for sustainability in Edina then asked the Council to consider increased chloride trends as part of the City's clean water management plan. David Frenkel, 4510 Lakeview Drive, thanked the Council for their discussions regarding fire department mutual aid with Minneapolis as well as reviewing community policing but said he was not pleased with the city manager's comments at a recent work session where he referred to some residents as bad faith actors. He said requesting City information was allowed under State law and it should not be the privy of staff to provide editorial comments on State law. V.A. CITY MANAGER'S RESPONSE TO COMMUNITY COMMENTS Manager Neal and Fire Chief Slama responded to Community Comments at the last meeting. VI. ITEMS REMOVED FROM CONSENT AGENDA VI.D. RESOLUTION NO. 2023-11 AND ORDINANCE NO. 2022-13; SECOND READING ZONING ORDINANCE AMENDMENT/REZONING, REVISED OVERALL DEVELOPMENT PLAN, SITE PLAN APPROVAL FOR PHASE 1 AND SITE IMPROVEMENT PLAN AGREEMENT FOR 7200 AND 7250 FRANCE AVENUE — ADOPTED Page 2 Minutes/Edina City Council/February 7, 2023 Member Risser explained that since she was not a member of Council at the time of approval, she wanted to ensure the sidewalk remained open or clear for pedestrian detours around the development and the need to ensure safety during construction for pedestrians and bicyclists accessing the area with the added construction traffic. Member Jackson introduced and moved adoption of Resolution No. 2023-11 and to grant Second Reading adopting Ordinance No. 2022-13; Zoning Ordinance Amendment/Rezoning, Revised Overall Development Plan, Site Plan Approval for Phase I and Site Improvement Plan Agreement for 7200 and 7250 France Avenue. Member Pierce seconded the motion. Roll call: Ayes: Agnew, Jackson, Pierce, Hovland Abstain: Risser VI.Z. EDINA HOUSING FOUNDATION APPOINTMENTS — APPROVED The Council inquired about the Edina Housing Foundation's structure and whether term limits were in effect. Mr. Neal outlined the structure of the Foundation as different than other City commissions. He noted appointments did not occur often in the Foundation as the members had much knowledge of programs but said vacancies were advertised within the City and an interview process occurred. He said at the Council's request staff would invite members of the Foundation to speak before the Council. Member Risser made a motion, seconded by Member Pierce, to approve Edina Housing Foundation appointments Jerome Gilligan and Jeff Huggett to terms ending March I, 2024. Rollcall: Ayes: Agnew, Jackson, Pierce, Risser, Hovland Motion carried. VII. PUBLIC HEARINGS Affidavits of Notice presented and ordered placed on file. VII.A. ORDINANCE NO. 2023-03; MULTI-FAMILY HOUSING IN THE CITY'S COMMERICAL ZONING DISTRICTS — CONTINUED TO FEBRUARY 21, 2023 Community Development Director Teague stated on December 8, 2022, the Edina Housing and Redevelopment Authority approved an amendment to the City's affordable housing policy. The ordinance would amend the Zoning Ordinance to be consistent with the Affordable Housing Policy approved last year. He outlined two changes in the ordinance that included the buy-in fee of $ I 75,000 and specifying clarity around density requirements then noted the Planning Commission held a public hearing and recommend approval as written. Affordable Housing Development Manager Hawkinson responded to questions of Council that when the policy was written it included a density bonus but that the zoning and policy exceeded guidelines so the concept was changed that if a developer requested maximum density that required affordable units would be required. The Council asked questions and provided feedback. Mayor Hovland opened the public hearing at 7:32 p.m. Public Testimony No one appeared. Member Jackson moved to close the public hearing at noon on February 13 and continue consideration of Ordinance No. 2023-03 approving amendment regarding housing in commercial districts until February 21, 2023. REPORTS/RECOMMENDATIONS RESOLUTION NO. 2023-15; ACCEPTED DONATIONS — ADOPTED Member Jackson introduced and moved adoption of Resolution No. 2023-15 accepting donations. Member Pierce seconded the motion. Roll call: Ayes: Agnew, Jackson, Pierce, Risser, Hovland Motion carried. VIII.B. MEMBER TO EDINA SCHOOL DISTRICT COMMUNITY EDUCATION SERVICES ADVISORY COUNCIL — APPOINTED Mr. Neal said the Community Education Services Program of the Edina School District served the entire community in responding to educational, recreational, cultural, and social needs. He outlined the purpose of the Edina Community Education Services Board and the CESA Council structure included a member of the Edina City Council. He said the term of the office was limited to three consecutive years and meetings were traditionally held the first Wednesday morning of the month. The Council asked questions and provided feedback. Member Risser made a motion, seconded by Member Pierce, to appoint Member Agnew to the Edina School District Community Education Services Advisory Council. Rollcall: Ayes: Agnew, Jackson, Pierce, Risser, Hovland Motion carried. VIII.C. ENERGY & ENVIRONMENT COMMISSION REPORT AND RECOMMENDATION; SINGLE- USE BAG REGULATION — REVIEWED — DIRECTION TO STAFF Sustainability Manager Hancock said in 2022, the Council approved a work plan initiative for EEC to revise and update EEC's 2017 report on possible recommendations for a plastic bag ordinance with a deliverable of an updated report with recommendation. Vice Chair Horan introduced members of the EEC then shared the Commission's report and recommendations that included recommendations for an ordinance that required businesses charge $0.05 bag fee to be kept by the retailer and not as a tax and create a robust education and outreach program before June 2024 to generate awareness before and after any ordinance took effect. She reviewed goals to reduce the use of fossil fuels and greenhouse gas emissions as recycling programs were inconvenient and resulted in less than 10% recycling. She said ultimately all plastic bags end up in landfills or incinerated. She outlined the merchant and customer exceptions and stakeholder feedback from residents, merchants, and Minneapolis businesses. Vice Chair Horan shared work on this topic from other cities around the country which had been successful as well as in Minneapolis, Duluth, and companies such as Best Buy and Target. She shared the timeline and said the EEC recommended Council direct staff to draft an ordinance to update City Code to include this requirement and implement an outreach plan to inform residents and businesses of this requirement. The Council asked questions and provided feedback. Commissioner Meehan responded to Council questions that included options on point of sale systems for customers who bring their own bags to stores. Commissioner Curry explained there would be no restriction on the use of funds collected and would be used for education or other sustainable programs. Member Jackson made a motion, seconded by Member Pierce, to direct staff to write an ordinance that updates City Code that merchants charge a $.05 fee to customers for carryout Page 4 Minutes/Edina City Council/February 7, 2023 bags and implement an outreach plan to inform residents and businesses of this requirement to take effect in 2024. PLANNING COMMISSION REPORT AND RECOMMENDATION; ACCESSORY DWELLING UNITS (ADU) — RECEIVED — DIRECTION TO STAFF The Council suggested this topic be included at an upcoming work session for more detailed review prior to formal consideration. Council consensus was to have the report presented and scheduled for further review at a work session. Community Development Coordinator Lewis stated the Planning Commission approved an advisory communication that recommended the City move forward with the development of an ordinance allowing ADUs. He said a subcommittee of the Planning Commission met regularly with various City department staff in 2022 to research ADUs and understand how they were regulated in other communities and that information was presented to the Planning Commission at their November work session and approved in January. Commissioner Smith presented the recommendation to draft ordinance that would allow independent housing units in the City, either attached or detached, to assist homeowners in reducing permitting fees, provide architectural designs to help reduce costs, and address the need for additional housing options for families in the City. He spoke about the current requirements then examples of ADUs and outlined the benefits that included increased supply of a more affordable housing type, help a variety of homeowners seeking a wider range of housing options, increase housing diversity, and provide homeowners with extra income to meet rising costs. He outlined points of discussion such as sewer capacity, size, and affordability as well as the maximum number of ADUs allowed to be recommended as one per single family residence then shared neighboring cities' ADU comparisons and said the Planning Commission recommended moving forward. The Council asked questions and provided feedback then directed staff to schedule the topic for further discussion at the May 16, 2023, work session. IX.
