MINUTES
OF THE REGULAR MEETING OF THE
EDINA CITY COUNCIL
FEBRUARY 21, 2023
7:00 P.M.
I. CALL TO ORDER
Mayor Hovland called the meeting to order at 7:03 p.m., then shared the procedure for public hearing and
community comment.
II. ROLLCALL
Answering rollcall were Members Agnew, Jackson, Pierce, Risser, Hovland.
Absent: None.

Member Jackson made a motion, seconded by Member Pierce, to approve the meeting agenda
as presented with the minor correction on Community Comment.

V. COMMUNITY COMMENT
Janey Westin, 6136 Brookview Avenue, inquired about the status of City ARPA fund use in completing City
Hall’s air filtration work.

VI. CONSENT AGENDA ADOPTED AS AMENDED
Member Jackson made a motion, seconded by Member Agnew, approving the consent agenda
as amended, removing VI.C, Arts and Culture Commission Advisory Communication;

VI.C. ARTS AND CULTURE COMMISSION ADVISORY COMMUNICATION; AMENDING 2023
WORK PLAN TO ESTABLISH A MICROGRANT PROCESS – APPROVED
The Council thanked the Commission for the microgrant idea that centered around community building,
which was much needed post-pandemic. The Council thanked the Commission members for their research
and bringing this forward then recognized the work of Chair Sorensen who was leaving the Commission.
Member Jackson made a motion, seconded by Member Pierce, to approve the Arts and
Culture Commission Advisory Communication; amending 2023 Work Plan to establish a
microgrant process.

VII. PUBLIC HEARINGS Affidavits of Notice presented and ordered placed on file.
VII.A. RESOLUTION NO. 2023-14; APPROVING PROPOSED APPLICATION FOR 2023 URBAN
HENNEPIN COUNTY COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM
FUNDS AND AUTHORIZING EXECUTION OF SUBGRANTEE AGREEMENT – ADOPTED
Affordable Housing Development Manager Hawkinson stated the Community Development Block Grant
(CDBG) Program was a federal entitlement program administered by the U.S. Department of Housing and
Urban Development (HUD) and managed by Hennepin County to oversee the distribution of funds to cities.
The funds are to be used for improvements of housing and providing a suitable living environment for persons
with low and moderate incomes. She said Edina’s estimated 2023 CDBG budget allotment was estimated
to be $146,622., which was a decrease to what was allocated in 2022 by $30,850. The amount allocated was
based on the 2023 Appropriations Act and the American Community Survey. When HUD established the
2023 CDBG budget later this spring, Edina would be notified of any changes to its allotment. If a change in
the budget occurred, the amount would be adjusted accordingly. Of the $146,622 total allocation, 15%
($21,993) was set aside for Public Services, which was administered by Hennepin County, and $124,629 was
available for the Community Development portion of the CDBG allocation, which was approved by the City
Council. Staff was seeking an action on February 21 rather than laying this item over until March 7 in order
to comply with Hennepin County timelines.

Member Jackson introduced and moved adoption of Resolution No. 2023-14 approving
proposed application for 2023 Urban Hennepin County Community Development Block Grant
(CDBG) Program Funds and authorizing execution of Subgrantee Agreement. Member Pierce
seconded the motion.

VII.B. RESOLUTION NO. 2023-16; SUBDIVISION – 4404 VALLEY VIEW ROAD – CONTINUED TO
MARCH 7, 2023
Community Development Director Teague stated City Homes was requesting a subdivision of 4404 Valley
View Road to establish individual lots for their four-unit townhome project that was approved for this site
in 2022. The proposal would simply create the lot for each unit so they could be sold off individually.
The Council asked questions and provided feedback.
Rebecca Remick, City Homes, shared their request for approval of the plans and just dividing through the
common wall and platting with Hennepin County to sell as individual townhomes.
Mayor Hovland opened the public hearing at 7:35 p.m.

Member Agnew made a motion, seconded by Member Jackson, to close the public hearing at
noon on February 27, 2023 and continue consideration of Resolution No. 2023-16, Subdivision
– 4404 Valley View Road, until March 7, 2023.

VII.C. RESOLUTION NO. 2023-17; PRELIMINARY DEVELOPMENT SITE PLAN REVIEW FOR 5146
EDEN AVENUE (FORMER PUBLIC WORKS SITE) – CONTINUED TO MARCH 7, 2023
Mr. Teague stated Jester Concepts was requesting preliminary site plan approval to build a 13,500-square-
foot restaurant with an outdoor dining area, outdoor bar and pizza oven at the former Public Works site
located at 5146 Eden Avenue. The plans included public restrooms attached to the restaurant but would be
available for users of the public park. This would be Phase 2 of the redevelopment of the site with Phase 1
an 86-unit senior cooperative housing project. He said the property was zoned PUD. Planned Unit
Development then reviewed the proposed narrative and plans in detail. He noted the proposed plans were
consistent with the approved overall development for this Planned Unit Development.

Brent Fredrick, Jester Concepts, shared his excitement for the restaurant for residents of the City as well
as its potential to attract from surrounding areas and said while the restaurant seemed large at 13,000 square
feet it would also serve as an event center. He said he was excited about the design that included the park
and pathways to walk from the senior coop to Grandview Yard and then spoke about filtration operations
for their woodfire grill which could be addressed if needed.

Member Jackson made a motion, seconded by Member Pierce, to close the public hearing at
noon on February 27, 2023 and continue consideration of Resolution No. 2023-17, approving
preliminary development site plan for the construction of a restaurant within PUD-24 at 5146
Eden Avenue, until March 7, 2023.

VIII. REPORTS/RECOMMENDATIONS
VIII.A. AGREEMENT WITH TREE TRUST FOR TREE SALE – APPROVED
Parks & Natural Resources Assistant Director Swenson introduced City Forester Overholt and Assistant
City Forester Beres then said Council was asked to approve the agreement with Tree Trust for a residential
tree sale. He reviewed the City’s climate action plan to increase tree canopy that increased home values,
attracted birds and bees, and was a gift to future generations then outlined the NexGen trees program for
a goal of planting 1,000 trees throughout the community. He said Tree Trust was a non-profit organization
and then outlined the plan to offer for sale 200 trees of 6-8 feet tall at $50 per tree.
City Forester Overholt explained more about the program and their goal to get trees on private property
and future options to provide installation or delivery to households at a cost.

Tree Trust for tree sale.

VIII.B. ORDINANCE NO. 2023-03; MULTI-FAMILY HOUSING IN THE CITY’S COMMERICAL
ZONING DISTRICTS - ADOPTED
Mr. Teague stated on December 8, 2022, the Edina Housing and Redevelopment Authority approved an
amendment to the City's affordable housing policy. The ordinance amended the Zoning Ordinance to be
consistent with the approved Affordable Housing Policy. The Planning Commission held a public hearing
and recommended approval as written.
The Council asked questions and provided feedback.
Member Agnew moved to waive Second Reading and adopt Ordinance No. 2023-03 an
ordinance amendment regarding housing in commercial districts and review the ordinance in
one year. Member Pierce seconded the motion.

VIII.C. 2023 BOARD AND COMMISSION APPOINTMENTS – APPROVED
Mr. Neal said interviews were conducted for 23 open Board & Commission seats and after consideration
the following members were recommended for appointment.

Member Jackson made a motion, seconded by Member Pierce, to appoint Arts & Culture
Commissioners Anne Curtin, Tim Scully, and Peter O’Shea; Community Health
Commissioners Andrea Leszko and Andrea Patineau; Energy & Environment Commissioner
LeAnn Weber; Heritage Preservation Commissioners Devon Nickels, Shawn Jarvinen, and
Elizabeth Turner; Human Rights & Relations Commissioner Bianca Dawkins, Jon Rogers, and
Daisy Khalifa; Parks & Recreation Commissioners Joseph Luangrath and Greg Ytterbo;
Planning Commissioners Will Bornstein, Meriwether Felt, Ryan Daye and Lou Miranda;
Transportation Commissioners Grant Wright and Roger Bildsten; Construction Board of

VIII.D. 2023 AGREEMENT BETWEEN THE CITY OF EDINA AND INDEPENDENT SCHOOL
DISTRICT NO. 273; GENERAL SCHOOL DISTRICT ELECTION – APPROVED
Mr. Neal said the City had provided election management services to the Edina Schools per the terms of a
general agreement since 1986. In 2022, the City Council canceled that agreement and asked the School
District to manage its own elections in the future. As part of that agreement, the City offered to conduct
the School District’s 2023 general election as part of a transition to the new system. Agenda item VIII, D,
was an agreement for the City to provide services to the Edina School District in which the City would
manage all aspects of the District’s 2023 general election. The agreement reflected the same customary
election management practices the City had provided to the District for the past 30+ years, with one material
exception. The exception from past practices that was incorporated in the proposed agreement was a cap
on the amount the District would pay the City for the services provided in the agreement. That cap was
$150,000. There was not a cap in the previous agreement. In previous agreements, the City billed the District
for services provided in the agreement. The District had always paid the full amount billed by the City. In
the proposed agreement, the City agreed to accept $150,000 as full payment for services provided under
the agreement and staff agreed $150,000 was likely to be sufficient to cover anticipated costs. The City and
School District staffs were going to work together this year to create a new elections management system
and the City would track its costs of providing the service and share that information with the School
District. He said the School Board approved the proposed agreement at their February 13 meeting and if
the City and School District were going to collaborate on the District’s 2023 elections, it was imperative
that the agreement be approved as soon as possible.

agreement between the City of Edina and Independent School District No. 273 for the General
School District Election.
