HomeMy WebLinkAboutResolution No. 2023-31 Calling for a Public Hearing on an Ordinace Edina West HIA RESOLUTION NO. 2023-31 CALLING FOR A PUBLIC HEARING JUNE 6, 2023, ON AN ORDINANCE TO ESTABLISH THE EDINA WEST HOUSING IMPROVEMENT AREA WHEREAS, the City of Edina, Minnesota (the “City”), is authorized under Minnesota Statutes, Sections 428A.11-428A.21 (the “Housing Improvement Act”), to establish, by ordinance, housing improvement areas (“HIA”) within which housing improvements are made or constructed and the costs of those improvements are financed in whole or in part by the City which is repaid by fees imposed, by resolution, upon the owners of the housing units within the HIA; and WHEREAS, the City has received an application (the “Application”) from Edina West Housing Association (“the Association”) requesting HIA financing; and WHEREAS, pursuant to the Housing Improvement Act, no action may be taken to establish a HIA or impose fees unless owners of 50 percent or more of the housing units that would be subject to fees in the proposed HIA file a petition requesting a public hearing on the proposed action with the City Clerk; and WHEREAS, on May 27, 2021, the City adopted a HIA Policy that requires that no action may be taken to establish a HIA or impose fees unless owners of 70 percent or more of the housing units that would be subject to fees in the proposed HIA file a petition requesting a public hearing on the proposed action with the City Clerk; and WHEREAS, the Association has submitted, and this Council has received a petition signed by at least 50 percent of the owners that would be subject to fees in the proposed housing improvement area. NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Edina, Minnesota (the “City”) as follows: Section 1. Public Hearing. This Council shall meet on June 6, 2023, at approximately 7:00 P.M., to hold a public hearing on the proposed (i) adoption of an ordinance to establish the Edina West Housing Improvement Area (the “HIA”) and (ii) adoption of a resolution imposing fees on housing units within the HIA, all pursuant to and in accordance with the Housing Improvement Act, to allow for financing for private townhome and condominium housing improvements; and Section 2. Notice of Public Hearing, Filing of Plans. City staff is authorized and directed to work with Ehlers & Associates, Inc., and Dorsey & Whitney LLP. to prepare the Ordinance and a Resolution establishing the fees and forward the Ordinance and Resolution to the Commissioner of Revenue. The City Clerk is authorized and directed to: (a) cause notice of the hearing, together with an appropriate map as required by law, to be published at least once in the official newspaper of the City at least seven days prior to June 6, 2023, and to place a copy of the Ordinance and Resolution on file in the City Manager’s office at City Hall and to make such copy available for inspection by the public. (b) cause notice of the hearing to be mailed (i) not less than ten days before June 6, 2023, to the owner of each housing unit within the HIA and (ii) not less than seven days before June 6, 2023, to any housing unit owner subject to a fee in the HIA.
