I N TR O D U C TI O N: T he subject property, 5119 Wooddale Glen, is approximately 27,237 square feet in area and located on the north side of Wooddale Glen, and south of M innehaha C reek. T he existing home on the lot is a newly constructed, two story home. T he initial survey that was submitted with the building permit for the home did not include a patio or fireplace in the rear yard. I t was found, with the submittal of an as-built survey, that the patio and fireplace that were added do not meet the 50 foot setback requirement from the creek. AT TAC HME N T S: Description Staff Report Aerial Map Engineering Memo Applicant Submittal September 12, 2018 PLANNING COMMISSION Emily Bodeker, AICP, Assistant City Planner A 14-foot setback variance from the 50 foot setback requirement from a pond for an existing patio and fireplace at 5119 Wooddale Glen Information / Background: The subject property, 5119 Wooddale Glen, is approximately 27,237 square feet in area and located on the north side of Wooddale Glen, and south of Minnehaha Creek. The existing home on the lot is a newly constructed, two-story home. The initial survey that was submitted with the building permit for the home did not include a patio or fireplace in the rear yard. It was found, with the submittal of an as-built survey, that the patio and fireplace that were added do not meet the 50-foot setback requirement from the creek. The patio and fireplace requiring the variance do not meet the required 50 foot setback from Minnehaha Creek. The patio and fireplace are currently setback 36 feet. Surrounding Land Uses Northerly: Single Unit residential homes; zoned and guided low-density residential. Easterly: Single Unit residential homes; zoned and guided low-density residential. Southerly: Single Unit residential homes; zoned and guided low-density residential. Westerly: Single Unit residential homes; zoned and guided low-density residential. Existing Site Features 5119 Wooddale Glen is a newly constructed two-story home. The building permit for the home was approved April, 2017. These structures do not meet the required 50 foot setback from Minnehaha Creek. The patio and fireplace are currently setback 36 feet. Staff has not received any complaints in regard to the location of the fireplace. STAFF REPORT Page 2 Planning Guide Plan designation: Low-Density Residential Zoning: R-1, Single-Dwelling District Grading & Drainage The Environmental Engineer has reviewed the application and submitted comments as attached in the memorandum dated September 6, 2018. The drainage closely matches the approved stormwater plan. The applicant will need to work with the Minnehaha Creek Watershed District to obtain any required permits. No. Staff does not believe the variance is justified. Minnesota Statues and Section 36-98 of the Edina Zoning Ordinance require that the following conditions must be satisfied affirmatively. The proposed variance will: 1) Relieve practical difficulties that prevent a reasonable use from complying with ordinance requirements. Reasonable use does not mean that the applicant must show the land cannot be put to any reasonable use without the variance. Rather, the applicant must show that there are practical difficulties in complying with the code and that the proposed use is reasonable. “Practical difficulties” may include functional and aesthetic concerns. Staff does not believe there is a practical difficulty that prevents reasonable use. The fireplace and patio could have been constructed to meet the required setback. There is adequate area on the flat portion of the lot in front of the home outside of the 50-foot setback requirement. (See attached.) STAFF REPORT Page 3 The applicant built the patio and fireplace without city approval. If the variance were denied reasonable use of the property would not be denied, as the patio and fireplace could be relocated on the site. 2) There are circumstances that are unique to the property, not common to every similarly zoned property, and that are not self-created? The circumstances were created by the applicant by locating the patio and fireplace within the required setback. 3) Will the variance alter the essential character of the neighborhood? Granting the variance would not alter the character of the neighborhood. This area is heavily wooded and the proposed fireplace and patio would not be very visible from surrounding properties. Recommended Action: Deny the 14-foot setback variance to the required 50 foot setback from Minnehaha Creek at 5119 Wooddale Glen. Denial is based on the following finding: 1. A building permit for this home was approved in April of 2017. The initial survey that was submitted with the building permit for the home did not include a patio or fireplace in the rear yard. 2. There is not a practical difficulty that would prevent reasonable use of the property. The fireplace and patio could be relocated/reconstructed on the site meet the required setback. There is adequate area on the flat portion of the lot in front of the home outside of the 50-foot setback requirement. 3. If the variance were denied reasonable use of the property would not be denied, as the patio and fireplace could be relocated on the site. If the Planning Commission believes the request is reasonable, the following findings could be made: 1. The practical difficulty is the location of the home and the existing slope toward the creek. The fireplace could be relocated to meet the required setback to the creek, however the site would have to be regraded, and the fireplace would be located just 10-15 feet from the home and would be in front of the basement windows 2. There is roughly 10 feet of elevation change from the end of the patio/fireplace to the lot line. 3. The patio and fireplace are well screened by existing vegetation and would not have a visual impact in the area. Approval would be subject to the following conditions: 1. Survey dated August 10, 2018 2. Compliance with the conditions and comments listed in the Environmental Engineer’s memo. STAFF REPORT Page 4 3. The patio may not be expanded. 4. This review was performed at the request of the Planning Department. Since the work is already complete, and this is a retroactive review, documents reviewed include the as-built survey dated 7/16/2018 and the approved stormwater management plan dated 3/1/2017. Grading and Drainage The final grading for this site closely matches the approved stormwater plan. The run-off from the patio drains directly to Minnehaha Creek. The encroaching portion of the patio is approximately 200 SF. Current and previous Engineering Policies would not require stormwater mitigation for the new impervious cover as it does not drain to a neighboring private property or to a public storm sewer that is over capacity. Erosion and Sediment Control No Comments Floodplain The lot is adjacent to Minnehaha Creek and is encroached by the 1% annual chance flood, which is modeled at 867.5’. There is no encroachment into the floodplain by this or any other work completed on the site. A variance request would have been applied for prior to installation if there had been awareness of the 50' setback. The area into the setback measures 36' from the creek to the back of the fireplace on plan view. There is a 10' grade change from the creek which results in a 40' ground distance. The gradients at the patio location have not been altered from the previous conditions prior to the new home being constructed. The position of the fireplace is heavily screened with larger trees and shrubbery resulting in minimal to no visibility from neighboring properties. The location of the patio area coincides with the lower level walk out area. The location also happens to be the most level space at the back of the home. Any other areas inside the setback would have required significant grade changes and retaining walls.
