GRANT OF PERMANENT AND TEMPORARY EASEMENT
KATHLEEN L. LEBARRON, widowed and remarried ("Grantor"), in consideration of
One Dollar ($1.00) and other good and valuable consideration, the receipt and sufficiency of which
is hereby acknowledged, does hereby grant unto the CITY OF EDINA, a Minnesota municipal
corporation, the Grantee, hereinafter referred to as the "City", its successors and assigns,
I. A permanent easement for public right-of-way purposes and a permanent easement
for public drainage and utility purposes over, on, across, under and through the land situated in the
County of Hennepin, State of Minnesota, legally described on the attached Exhibit "A" and
depicted on the attached Exhibit "B" (the "Permanent Easement Area"), including the rights of the
City, its contractors, agents, servants, and assigns, to enter upon the Permanent Easement Area at
all reasonable times to construct, reconstruct, inspect, repair, and maintain said public right-of-
way and public drainage and utility systems over, across, on, under, and through the Permanent
Easement Area, together with the right to grade, level, fill, drain, pave, and excavate the Permanent
Easement Area, and the further right to remove trees, bushes, undergrowth, and other obstructions

interfering with the location, construction, and maintenance of said public right-of-way and public
drainage and utility systems.
2. A temporary construction easement over, across, on, under and through the land
situated in the County of Hennepin, State of Minnesota, as legally described on the attached Exhibit
"A" and depicted on the attached Exhibit "B" (the "Temporary Easement Area"). To have and to
hold the same, unto the City, its contractors, agents, servants and assigns, commencing on April 1,
2024 and expiring June 30, 2026 together with the right of ingress to and egress from the Temporary
Easement Area, for the purpose of constructing, reconstructing, inspecting, repairing, and
maintaining the property of the City, at the will of the City, its successors and assigns. Grantor hereby
grants the uses herein specified without divesting herself of the right to use and enjoy the above
described Temporary Easement Area, subject only to the right of the City to use the same for the
purposes herein expressed.
The above-named Grantor, for herself, her successors and assigns, does covenant with the
City, its successors and assigns, that she is well seized in fee title of the Easement Property; that
she has the sole right to grant and convey the easement to the City; that there are no unrecorded
interests in the Easement Property; and that she will indemnify and hold the City harmless for any
breach of the foregoing covenants.

A permanent right-of-way easement over, on, across, under and through:
Lot 8, Block 5, Sunny Slope Section, Country Club District,
Reserving easements (conditions and restrictions terminated per Document No, T6002698) Said
easement being southwesterly of the following line:
Commencing at the Southeast Corner of Lot 8, Block 5, SUNNY SLOPE SECTION
COUNTRY CLUB DISTRICT; thence North 76 degrees 09 minutes 19 seconds West for
52.52 feet to a tangential 741.00 foot radius curve that is concave to the northeast; thence
northwesterly along said curve for 104.03 feet to a tangential 1150.00 foot radius curve
that is concave to the southwest; thence northwesterly along said curve for 20.61 feet to a
tangential 2309.56 foot radius curve that is concave to the northeast; thence northwesterly
along said curve for 228.40 feet to a point that is South 49 degrees 22 minutes 21 seconds
for 272.53 feet from the West Quarter Corner of Section 18, Township 24, Range 23 and
there terminating.
TOGETHER WITH A permanent 4.00 foot wide Right Of Way easement over, under, and across
the westerly 35.50 feet of said property, running northerly of and congruently with the above
easement.
TOGETHER WITH A utility easement over, under, and across the southerly 21.00 feet of the
westerly 3.00 feet of said property.
TOGETHER WITH A 5.00 foot wide temporary construction easement over, under, and across
that part laying easterly of the westerly 37.50 feet of said property, running northerly of and
congruently with the above Right Of Way easements,
TOGETHER WITH A 6.50 foot wide temporary construction easement over, under, and across
the westerly 37.50 feet of said property, running northerly of and congruently with the second
above Right Of Way easement and its easterly extension.
