HomeMy WebLinkAboutResolution No. 2024-38 Acquisition of Real PropertyRESOLUTION NO. 2024-38 RESOLUTION APPROVING THE ACQUISITION OF REAL PROPERTY AND DISPENSING WITH STATUTORY REQUIREMENTS FOR REVIEW BY PLANNING COMMISSION OF ACQUISITION OF PROPERTY WHEREAS, the owners of the property ("Sellers") are proposing to convey to the City the property legally described as follows: Outlot A, D. C. I. Addition, according to the recorded plat thereof, Hennepin County, Minnesota ("Subject Property"); and WHEREAS, Sellers propose to convey the Subject Property by quit claim deed to the City for a purchase price of $1,300.00, provided the City pays the real estate taxes and all costs associated with the conveyance, and; WHEREAS, the City desires to acquire the Subject Property under the proposed terms, conditioned upon Sellers providing a release of any and all mortgages against the Subject Property, providing all information and documents necessary to record the quit claim deed, and executing all forms necessary to record the quit claim deed and the conveyance occurs on or before March I, 2024; and, WHEREAS, acquiring ownership of the Subject Property by the City would serve the public interest; WHEREAS, Minn. Stat. § 462.356, subd. 2 requires that the Planning Commission review the City's proposed acquisitions and dispositions of property; and WHEREAS, Minn. Stat. § 462.356, subd. 2 provides for an exception from the Planning Commission review requirement upon 2/3 vote of the City Council dispensing with the requirement and finding that the acquisition or disposal of the property has no relationship to the comprehensive municipal plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edina: I. The City Council finds that the acquisition of the Subject Property has no relationship to the comprehensive municipal plan. 2. Review by the Planning Commission of the acquisition of the Subject Property is hereby dispensed with. 3. The proposed transaction is hereby approved under the terms proposed by Sellers and conditions stated in this Resolution, and the Mayor and City Manager are authorized and directed to execute all documents, and take all appropriate measures to acquire the Subject Property.
