MOORE (1894-1969) Re: Vernon Woods High Density Rezoning Pro osal Ladies and Gentlemen: This letter is written to outline the concerns of our clients, Wilma Smith, 5304 Glenbrae Circle, and Mr. and Mrs. L. J. Jonason, 5300 Glenbrae Circle. These two single family residences are the closest homes to the proposed high density rezoning. Mrs. Smith's property is only 140 feet west of it. Jonasons' is 50 feet further west. Both homes were oriented to the easterly view over Glenbrae pond and park. They will be severely impacted by the enormous loss of natural screening the proposed high density project will entail. The topography is such that the Glenbrae pond and park area is so low that it cannot practically be used for developing screening of the nearly 50 foot high structure proposed to be built on the artificially created floor and natural easterly rim of the prop- erty that is the subject of the rezoning application. Loss of the present screening would be the result of the proposed substantial changes in the natural topography. These changes appear to be primarily due to the high density of use proposed. Single or double family, or even low rise townhouse residences, should not effect the terrain and tree cover so drastically and would not impose such a visual change in the character of our clients' residential neighborhood. This type of less dense development is more typical of the buffering found for established homes designed, paid for, taxed, and lived in for their aesthetic quality. MACKALL, CROUNSE & MOORE The Honorable Mayol Edina City Council Page 2 April 20, 1987 The buffering by distance from such an abrupt change in character (from large single family to an over four-story high density apartment project) is minimal under the circumstances. There is no guaranty that the 50 foot NSP right-of-way will remain natural. The park is only about 30 feet in width across from Mrs. Smith's home. The Glenbrae Circle road easement is an additional 60 feet. In this regard, we have determined that nearly all property owners abutting Glenbrae Circle would like to have it vacated just east of the Smith and Jonason driveways to increase the permanent buffer and reduce the problems of beer cans and vehicles in the interior park areas. The severe impact of rezoning upon the value and enjoyment of my clients' homes and the several additional families on the east side of Duncraig Road who are even closer to the proposed 50 building, are not the only critical considerations. There will be increased traffic problems caused by this development for the Highland residents exiting to Vernon from Ayrshire. Those traffic problems will be compounded because of the previously unexpected increase in apartment units from the Biltmore motel site (Grandview) change in use and other contemplated intensification of apartment and commercial development in the area of Jerry's Shopping Center. This rapid increase of apartment units and developments should be fully reviewed by the City Council before this project is finally considered. The questions as to change of direction from the emphasis on maintaining the strong single family residential characteristics of Edina should be carefully examined and weighed before departing from the goals of the 1980 Comprehensive Plan which espoused them. Such a change would undoubtedly have a negative impact on the quality and need for the present fine school system and plant. That in turn will probably lead to long term changes in the nature of our community that this council and the present Edina citizens would not want to have happen. MOORE (I894-1969) The Edina Planning Commission, at its meeting on April 29, 1987, gave little or no indication of an intent to reexamine any of the factors, old or new, which bear upon the question of degree of density. The chairman began by announcing that the Planning Commission would hear anything which was "new."' Opponents and proponents had a little over an hour to present their respective positions. Upon behalf of Wilma Smith and Mr. and Mrs. L. J. Jonason, I attempted to have a number of factors considered. Many of these factors are set forth in the attached petition. The petition with many other signatures was presented to the staff and made available to the Planning Commission through staff prior to the meeting. All the matters related in the petition were "'new" as concerns Wilma Smith, because she was not given notice of the initial August, 1986, hearing. It seems apparent from the plan- ning file and the fact that neither Ms. Smith nor the L. J. Jonasons received notice of the August, 1986, City Council public hearing that the requirement of notice was not met. Ms. Smith has long been on the tax rolls at her home address as the taxpayer. The fact that Ms. Smith and the Jonasons have unlisted telephone numbers would appear to indicate that the notices were based upon the Edina telephone directory, rather than on the assessor's rolls, as required. During the course of the presentation, it appeared clear that the Planning Commission was not aware of the true building height of 49 feet at the entrance ends, one of which (the south MACKALL, CROUNSE & MOORE Edina City Council Page 2 May 12, 1987 end) will be facing toward my client's property. It was further pointed out for the first time and apparently "'new"' to the Plan- ning Commission that the drawings submitted by the proponent did not meet the specific requirement of the zoning ordinance that the developer show the property within 100 feet of the borders of the property to be rezoned. Such a showing would have given the Planning Commission a much clearer picture of the potential impact of the site to be rezoned upon the surrounding property. The plans also, it should be noted, did not clearly point out the height of the building. All that was given was the floor levels up to the bottom of the second floor. Nothing was mentioned on the readable large scale plans about the height of the bottom of the third floor, the bottom of the roof, or the height of the roof on top of that. Similarly, the only elevation diagram made available to the Planning Commission and the Council apparently does not iden- tify the sections through which it was drawn. An intelligent evaluation of the elevation diagram, which may be deceptive, would require knowledge as to where the sections were located and whether the trees at those unidentified section points are real or merely an artist's conception, so that the true relationship can be examined and understood. A request of one of the opponents or some sort of model, which would enable the Planning Commission and the Council, as well as the affected residents, to understand and visualize what will be happening seems very reasonable. That request was unheeded by the Planning Commission, which seemed bent upon acting immediately without further study. Other new factors which would seem not to have been fully considered at the time of preliminary approval by the Plan- ning Commission in the summer of 1986 were the initiation or progress of the planning and/or construction with regard to the Biltmore site, the Lewis Engineering site, and Jerry's site. Intensification of apartment and other commercial development and use as significant contributors to both traffic and density prob- lems in the general proximity of the proposed rezoning are ex- tremely important. They should be reexamined. No member of the Planning Commission commented upon or seemed to acknowledge impact of the irregular site's irregular boundary. The proposed development does not utilize the triangu- lar shape at the south end of the site to be rezoned. This creates more density visually than the same building would create on a more -regularly shaped piece, such as the 18 unit per acre density Villa Way has. MACKALL, CROUNSE & MOORE Edina City Council Page 3 May 12, 1987 The chairman's comment that "in two years you won't even notice it"' certainly tends to indicate that the Planning Commis- sion did not intend to and did not give full and adequate con- sideration and review to the question of density. All in all, the Planning Commission appears to have accepted, without examination or meaningful comparison, the staff's report, which merely cited other densities without any comparative analysis as to context. No consideration or examination appears to have been given to the principle of buffering by stepping down densities in areas which approach single family residential areas. The enclosed signed copies of the petition reflects the reaction of a single family resident who reluctantly permitted a slightly reduced high density to abut the rear portion of her home. This occurred on France Avenue in the 4600 block. An examination of the comprehensive plan or the Edina zoning maps will reflect that greater distances and better variation of den- sity has normally been achieved between high density use and single family residential areas and between high density and park areas. No such comparative considerations were set forth in the staff report nor discussed in the reasoning or explanation of the Planning Commission. Also, there may well have been some misunderstanding of what the developer is "'doing" for the City. At the Planning Commission meeting, it was discovered that the developer is not doing a "million dollars" worth of landscaping as a large part of the residents present apparently and the undersigned had under- stood. A careful examination of the plans shows that little original mature tree cover will be left. Also, the developer's storm water drainage "'benefits"' are the necessary results of the acceleration of flow and substantial diminishing of natural ground absorption due to the development. The ponding in Glenbrae Park and even on the lower Glenbrae Circle is not a real problem. No homes are threatened by that. As the recent municipal well prob- lems indicate, the ponding for ground water absorption is desir- able, if not critical. We urge the City Council members, upon whose sole dis- cretion the final responsibility for this decision rests, to give this matter a reasoned independent reconsideration. A review of the concern of the Highlands residents and other single family Edina residents who can recognize and will be impacted by the problems is well deserved. We further urge the City Council to act within its powers to at the very least limit the density to 12 units per MACKALL, CROUNSE & MOORE Edina City Council Page 4 May 12, 1987 acre, so that the building's roof height can be reduced or setbacks increased or moved so the fragile park buffering area is afforded a proper scaled down density. In weighing the respective merits and potential economic impact as between residents and developer, nowhere has there been any proof that development is not feasible at the lower density, which will help reduce the harm to immediately abutting neighbors and the neighborhood as a whole. The initial 10 percent reduction in the initial review was merely a token. There was an indication by Mr. Bjorness at the Planning Commission meeting that he had communicated to Mr. Smith that $500,000 in expenses had gone into the project since the prelimi- nary approval by the City Council. Other than this reference, which may have been suggested as a veiled threat to the City of Edina, there has been no apparent other public disclosure of the nature and timing of these alleged costs. Certainly, the Highlands residents have not had an opportunity to examine and test the credibility or relevance of the alleged expenses. Fur- ther, it is our understanding that a developer does not have any right to rely upon a preliminary approval where the public body has asked the developer to make a further modification and re- quires re -presentation of the proposed use in the modified form. If a developer were so entitled to rely, the further final public hearing before the Council would be meaningless. We hope the City Council will not be coerced by any such communication (if it was intended to be a threat) into an action which the Highland residents have good reason to believe is clearly contrary to the spirit and intent of the comprehensive plants basic goal in protecting single family residences by com- monly accepted and utilized sound land use and planning princi- ples. Yesterday, May 14, at approximately 10:45 a.m., I was advised by Norm Bjornnes, Jr., the developer of Vernon Oaks, that he had been notified that one of our construction trailers was parked on city land near the Vernon Oaks development. We had the trailer re- moved by noon. We made two mistakes. First, the trailer was parked without a "go ahead" authorization from the developer. The project is listed in our records as "pending." Second, the trailer was unknowingly parked on city property. This trailer was moved from a recently completed job by one of our foremen without authorization by me. This foreman acted on his own initiative. We regret this error and any inconvenience to your residents. Business operations commenced in December 1970. The partnership's offices are located at 401 Groveland Avenue, Minneapolis, Minnesota 55403. Its telephone number is (612) 874-1102. The partnership consists of Dr. Norman P. Bjornnes, senior partner, and Norman P. Bjornnes, Jr., managing partner. Description of Principals Dr. Norman P. Bjornnes practiced dentistry in Minneapolis from 1947 to 1980 (B.A. St. Olaf College, 1938; Pre -dental, Stanford University, 1944; D.D.S. University of Minnesota, 1947). He has been actively involved in personal investments and residential real estate acquisition, develop- ment and management with Norman, Jr. and others since 1970. Dr. Bjornnes has been an Edina resident since 1948 and currently resides at 5628 Chowen Avenue. Norman P. Bjornnes, Jr. is in private law practice in Minneapolis as a partner in the firm of Mulligan & Bjornnes. He is a 1970 graduate of Edina High School and a graduate of the University of Minnesota (B.S.B. with distinction, 1972; J.D., 1976). Norman has been involved with the acquisition, financing, management and operation of all properties in which he and/or Dr. Bjornnes have an interest. Prior to entering private practice, Mr. Bjornnes was a tax supervisor in the Minneapolis office of Coopers & Lybrand, CPA's. Norman currently resides at 6016 Birchcrest Drive, Edina. n10p091 1 As of January 1, 1985, Dr. Bjornnes was the owner of 67.2% of the partnership and Norman, Jr. held a 32.8% owner- ship share. Under the terms of a 1982 agreement between the partners, Norman, Jr. is committed to purchase an additional 18.2% ownership in the partnership to raise his ownership level to 51% by 1991. This increased ownership will be achieved through additional capital contributions by Norman, Jr. Current financial statements of the principals are avail- able upon request. In December 1970, the partnership acquired its first residential property, a 15 unit apartment building at 3541 13th Avenue South, in Minneapolis. In 1971 and 1972, Messrs. Bjornnes individually acquired ownership in a joint venture in Apple Valley, Minnesota. Subsequently, a 48 unit apart- ment complex was constructed on a portion of the acquired land. In 1973, Namron Company acquired a 29 unit building at 3912 Minnehaha Avenue, Minneapolis. In 1976, the partners, with a third individual, acquired a 26 unit apartment property at 3729 Snelling Avenue South in Minneapolis. This property is now wholly owned by Messrs. Bjornnes and Jon D. Bjornnes, son and brother, respectively, of the principals. In 1979 and 1980, Namron Company developed Apple Villa South, a 56 unit subsidized apartment project in Apple Valley, Minnesota. This property was syndicated to 11 inves- tors, with Messrs. Bjornnes together retaining a 25% owner- ship interest. In 1982, the general partners participated in the acqui- sition of the office building at 401 Groveland Avenue, Minneapolis. This office building was rehabilitated as first class office space in the fall of 1982 and is presently 100% leased. Messrs. Bjornnes together hold a 70% ownership interest in the building. In 1983, Namron Company acquired and rehabilitated for syndication as Spectrum Property Partners II, 108 apartment units in St. Paul, Minnesota, known as the California Drive Apartments. This property was syndicated to 22 investors with Messrs. Bjornnes together retaining a 20% ownership interest. 2 n10p091 The Company initiated development of the remaining Apple Valley land in 1984. Construction of Whitney Pines, a 72 unit apartment building, was commenced in May 1985 and completed in January 1986. Whitney Pines was syndicated to 36 investors. In 1985, the Company purchased and rehabili- tated a rental unit adjacent to the 3729 Snelling property. Additional activities of the Company include property management of all acquired properties, investment land in Idaho, Florida and Minnesota, and equipment leasing. Current Operations With the completion of Whitney Pines, Namron Company manages 307 rental units and the commercial office building. These properties have a total market value in excess of 12 million dollars. The firm has a policy of managing only properties in which it or its principals have material equity position. Namron Company and/or its partners intend to con- tinue as the largest equity holder in its projects. The part- ners take great pride in the ownership and operation of the properties in the portfolio. Present staff includes Norman P. Bjornnes, Jr. as manag- ing partner, along with the following staff members: Mary E. McDowell - Property Supervisor, Thomas Metzler - Maintenance Manager, and Barbara Clausen - Data Processing and Accounting Manager. In addition, on -site managers are present at all properties except the office structure. Namron Company maintains its own maintenance vehicles - including a 1984 Ford van, 1983 and 1985 Ford pickup trucks and a Clark Bobcat used for snow removal. Inventories of spare parts are maintained on -site and in the maintenance vehicles. Virtually all maintenance functions are handled by company personnel. The Company utilizes a computerized property management and accounting system to track all financial and tenant data information. Regular maintenance reviews and scheduling is accomplished through a monthly, quarterly and annual main- tenance review process. Al Hipps of Natural Green, Inc., our landscape contrac- tor, explained that only four foot plantings were available in sufficient quantity and quality at the time the screening was installed. That supply situation is true today. Further, Al has explained that the plantings were sited at locations after consultation with staff in what he understood were appropriate locations. We understand that interested neighbors would like to see additional screening. We further understand that Mr. Hipps may have misunderstood or misinterpreted staff recommendations. In accordance with our discussion, we agree to stake out additional screening plantings in the fall after consultation with interested neighbors and the City of Edina. Mr. Hipps has advised us that the best time to plant the sites staked in the fall would be in the spring of 1989. I will attempt to meet with interested neighbors over the next week to re- view this proposed method of addressing the screening issue. Please advise if you have further requirements.
