GRANT OF PERMANENT AND TEMPORARY EASEMENT
DAVID WILLIAM RUSS and ANNE ELIZABETH THOMAS, spouses married to
each other ("Grantors"), in consideration of One Dollar ($1,00) and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby grant
unto the CITY OF EDINA, a Minnesota municipal corporation, the Grantee, hereinafter referred
to as the "City", its successors and assigns,
1. A permanent easement for public right-of-way purposes and a permanent easement
for public drainage and utility purposes over, on, across, under and through the land situated in the
County of Hennepin, State of Minnesota, legally described on the attached Exhibit "A" and
depicted on the attached Exhibit "B" (the "Permanent Easement Area"), including the rights of the
City, its contractors, agents, servants, and assigns, to enter upon the Permanent Easement Area at
all reasonable times to construct, reconstruct, inspect, repair, and maintain said public right-of-
way and public drainage and utility systems over, across, on, under, and through the Permanent
Easement Area, together with the right to grade, level, fill, drain, pave, and excavate the Permanent
Easement Area, and the further right to remove trees, bushes, undergrowth, and other obstructions

interfering with the location, construction, and maintenance of said public right-of-way and public
drainage and utility systems.
2. A temporary construction easement over, across, on, under and through the land
situated in the County of Hennepin, State of Minnesota, as legally described on the attached Exhibit
"A" and depicted on the attached Exhibit "B" (the "Temporary Easement Area"). To have and to
hold the same, unto the City, its contractors, agents, servants and assigns, commencing on April I,
2024 and expiring June 30,2026 together with the right of ingress to and egress from the Temporary
Easement Area, for the purpose of constructing, reconstructing, inspecting, repairing, and
maintaining the property of the City, at the will of the City, its successors and assigns. Grantors
hereby grants the uses herein specified without divesting themselves of the right to use and enjoy the
above described Temporary Easement Area, subject only to the right of the City to use the same for
the purposes herein expressed.
The above-named Grantors, for themselves, their heirs, successors and assigns, does
covenant with the City, its successors and assigns, that they are well seized in fee title of the above
described Permanent Easement Area and Temporary Easement Area; that they have the sole right
to grant and convey the easements to the City; that there are no unrecorded interests in the
Permanent Easement Area; that there are no unrecorded interests in the Temporary Easement Area;
and that they will indemnify and hold the City harmless for any breach of the foregoing covenants,

TO
GRANT OF PERMANENT AND TEMPORARY EASEMENT
A permanent right-of-way easement over, on, across, under and through:
Lot 9, Block 5, Sunny Slope Section, Country Club District, except that part which lies
Southwesterly of the following described line:
From a point on Line A described below, distant 300.33 feet Northwesterly of its point of
termination, run Northeasterly at right angles with said Line A to an intersection with the
North line of West 50th Street; thence run Northwesterly to a point distant 50 feet
Northeasterly (measured at right angles) of a point on said Line A, distant 540.33 feet
Northwesterly of its point of termination and there terminating;
Line A: From a point on the East and West Quarter line of Section 28, Township 117 North,
Range 21 West, distant 201.86 feet West of the East Quarter corner thereof; nm Southwesterly at
an angle of 96 degrees 39 minutes 13 seconds with said East and West Quarter line for 288.46
feet to the point of beginning of the line to be described; thence deflect to the left at an angle of
72 degrees 15 minutes 30 seconds for 541.02 feet; thence deflect to the left on a 3 degrees 37
minutes 29 seconds curve (delta angle 12 degrees 24 minutes 27 seconds) for 342.31 feet and
there terminating.

Said easement being southwesterly of a line that is parallel to and 4.00 feet, as measured
perpendicularly, northeasterly of the following line:
Commencing at the Southeast Corner of Lot 8, Block 5, SUNNY SLOPE SECTION
COUNTRY CLUB DISTRICT; thence North 76 degrees 09 minutes 19 seconds West for
52.52 feet to a tangential 741.00 foot radius curve that is concave to the northeast; thence
northwesterly along said curve for 104.03 feet to a tangential 1150.00 foot radius curve that
is concave to the southwest; thence northwesterly along said curve for 20.61 feet to a
tangential 2309.56 foot radius curve that is concave to the northeast; thence northwesterly
along said curve for 228.40 feet to a point that is South 49 degrees 22 minutes 21 seconds for
272.53 feet from the West Quarter Corner of Section 18, Township 24, Range 23 and there
terminating.
TOGETHER WITH A utility easement over, under, and across the southerly 21.00 feet of the
easterly 3.00 feet of said property.
