INTRODUCTION: Council and staff will discuss potential issuance of a curfew order as authorized by the Governor. ATTACHMENTS: Description Curfew Declaration CITY OF EDINA, MINNESOTA MAYOR’S PROCLAMATION DECLARING A LOCAL EMERGENCY AND NIGHTTIME CURFEW WHEREAS, the Mayor of Edina finds the following factual situation exists: 1. The cities of Minneapolis and St. Paul, Minnesota, have experienced widespread civil unrest since at least May 26, 2020. 2. Said civil unrest has included violent and destructive acts that have placed public safety at risk and resulted in near catastrophic property damage. 3. The City of Edina geographically borders Minneapolis. 4. Law enforcement personnel and emergency first responders for the City of Edina expect violent and destructive acts of civil unrest to continue and escalate without invocation of certain portions of the City’s emergency management plan. WHEREAS, the Mayor finds that the factual situation is sudden, unforeseen and could not have been reasonably anticipated as it currently exists; and WHEREAS, the Mayor finds that the factual situation threatens the health, safety and welfare of the residents of and the property within the City of Edina; and WHEREAS, the Mayor finds that conditions within the City of Edina have the potential to worsen quickly and without notice due to the factual situation; and WHEREAS, the Mayor finds that the traditional governmental processes are unable to appropriately protect the safety and property of the general public. NOW, THEREFORE BE IT RESOLVED, that pursuant to Minnesota Statutes Section 12.29, the Mayor of Edina proclaims and declares a local emergency effective 6 p.m. on May 29, 2020. Under state law, this declaration shall last no longer than three days unless extended by and through the consent of the Edina City Council. This declaration immediately invokes the establishment of a City-wide nighttime curfew, consistent with Gov. Walz’s Executive Order 20-65, for all persons within the City of Edina from 8 p.m. through 6 a.m., effective 8 p.m. on May 29, 2020 and ending at 6 a.m. on May 31, 2020.
