GRANT OF PERMANENT EASEMENT
FOR PUBLIC DRAINAGE AND UTILITY PURPOSES
DAVID MELANDER and SARAH MELANDER, spouses married to each other
("Grantors"), in consideration of One Dollar ($1.00) and other good and valuable consideration,
the receipt and sufficiency of which is hereby acknowledged, do hereby grant unto the CITY OF
EDINA, a Minnesota municipal corporation, the Grantee, hereinafter referred to as the "City", its
successors and assigns, forever, a permanent easement for public drainage and utility purposes
over, on, across, under and through the land situated in the County of Hennepin, State of
Minnesota, as legally described on the attached Exhibit “A” and depicted on the attached Exhibit
“B” (the "Easement Property").
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter
upon the Easement Property at all reasonable times to construct, reconstruct, inspect, repair, and
maintain said public drainage and utility systems over, across, on, under, and through the Easement
Property, together with the right to grade, level, fill, drain, pave, and excavate the Easement
Property, and the further right to remove trees, bushes, undergrowth, and other obstructions

interfering with the location, construction, and maintenance of said public drainage and utility
systems.
The above-named Grantors, for themselves, their heirs, successors and assigns, do
covenant with the City, its successors and assigns, that they are well seized in fee title of the
Easement Property; that they have the sole right to grant and convey the easement to the City; that
there are no unrecorded interests in the Easement Property; and they will indemnify and hold the
City harmless for any breach of the foregoing covenants.

A permanent drainage and utility easement lying over, on, across, under and through that part of
Northeast Quarter Section 30, Township 28, Range 24. Beginning at a point in the West line of
said Northeast Quarter a distance of 301.6 feet South of Northwest corner, thence South 578.4 feet,
thence East 140.8 feet, thence North parallel with West line a distance of 567.7 feet, thence
Northeastwardly to point of beginning, PID 3002824120031, according to the recorded plat
thereof, Hennepin County Minnesota. Said easement is described as follows.
EASEMENT 1:
A permanent easement to be herein described; Beginning from the Northeast corner South along
property line, a distance of 164.31 feet to point of beginning; thence continuing North 89 degrees
56 minutes 21 seconds East, a distance of 50.00 feet: thence South 0 degrees 3 minutes 39 seconds
