ENTERING INTO AGREEMENT NO. PW 23-11-24
CONSTRUCTION COOPERATIVE AGREEMENT
FOR VERNON AVE & SOT" ST INTERCHANGE PROJECT
WHEREAS, the City, in coordination with the Minnesota Department of Transportation (MnDOT) and the
County, desire to replace bridge No. 4510 ("Vernon Avenue Bridge") and Trunk Highway (TH) 100 bridge No.
27102 ("TH 100 Bridge"), carrying County State Aid Highway (CSAH) 158 (Vernon Avenue) over the Canadian
Pacific Railroad (CP Rail) tracks and TH 100, and improve intersections along CSAH 158 at Interlachen Boulevard,
Gus Young Lane, Arcadia Avenue and the TH 100 ramps; which the contemplated improvements include realignment
TH 100 Bridge access points, creating new separated pedestrian routes, improving safety and mobility for all users,
enhancing traffic operations, pedestrian ramps upgrades to the current Americans with disabilities Act (ADA)
standards, traffic signal upgrades with Accessible Pedestrian Signal (APS), construction of curb, gutters and concrete
sidewalks, and other improvements within the corporate limits of the City, as shown in plans for County Project (CP)
No. 2176600, all of which shall hereinafter be referred to as the "Project".; and,
WHEREAS, the Parties and MnDOT collaborated to enter into a separate Construction Cooperative
Agreement (MnDOT Contract No. I 055580)/(Hennepin County Agreement No. PW 22-40-24) for cost participation
in the Project construction, and maintenance responsibilities of the Project elements within MnDOT's right of way.
(the "Construction Cooperative Agreement" or the "CCA"). The CCA addresses only those Project components
related to the TH 100 Bridge.; and,
WHEREAS, the Parties have agreed to enter into this Agreement to memorialize the partnership and to
outline each party's ownership and financial responsibilities, maintenance responsibilities for the portions of the
Project within the County's right of way and which are not addressed by the CCA.; and,
WHEREAS, the County has hired and will be responsible for work performed by the consulting firm of Toltz,
King, Duvall, Anderson and Associates, Inc (TKDA) to complete the Project design work associated with the Vernon
Avenue Bridge. The City will be responsible for the Project design associated with the TH 100 Bridge. The Parties
understand that that the final design plans for the Vernon Avenue Bridge and the TH 100 Bridge will be combined into
one set of plans, and will be bid and constructed as part of a single construction contract (the Project).; and,
WHEREAS, the County will be responsible for acquiring the necessary right of way, permanent easements, and
temporary easements necessary to construct the Project. The City will be responsible for construction of the Project as
described in this Agreement.; and,
WHEREAS, the Project will be carried out by MnDOT and the Parties under the provisions of Minnesota
Statutes, Section 162.17, Subdivision I, and Section 471.59.
NOW THEREFORE, BE IT RESOLVED, the Mayor and the City Manager are hereby authorized and
directed for and on behalf of the City of Edina to execute and enter into an agreement with Hennepin County prescribing
the terms and conditions as set forth and contained in Hennepin County Agreement Number PW 23-11-24 to
memorialize the partnership and to outline each party's ownership and financial responsibilities, maintenance
responsibilities for the portions of the Project within the County's right of way.
