GRANT OF PERMANENT EASEMENT
FOR PUBLIC DRAINAGE AND UTILITY PURPOSES
CALVIN CHRISTIAN SCHOOL OF MINNEAPOLIS, a Minnesota nonprofit
corporation ("Grantor"), in consideration of One Dollar ($1.00) and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby grant
unto the CITY OF EDINA, a Minnesota municipal corporation, the Grantee, hereinafter referred
to as the "City", its successors and assigns, forever, a permanent easement modifying an existing
easement alignment for public drainage and utility purposes over, on, across, under and through
the land situated in the County of Hennepin, State of Minnesota, as legally described on the
attached Exhibit "A" and depicted on the attached Exhibit "B" (the "Easement Property").
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter
upon the Easement Property at all reasonable times to construct, reconstruct, inspect, repair, and
maintain said public drainage and utility systems over, across, on, under, and through the Easement
Property, together with the right to grade, level, fill, drain, pave, and excavate the Easement
Property, and the further right to remove trees, bushes, undergrowth, and other obstructions

interfering with the location, construction, and maintenance of said public drainage and utility
systems,
The above-named Grantor, for itself, its successors and assigns, does covenant with the
City, its successors and assigns, that it is well seized in fee title of the Easement Property; that it
has the sole right to grant and convey the easement to the City; that there are no unrecorded
interests in the Easement Property; and it will indemnify and hold the City harmless for any breach
of the foregoing covenants.
IN TESTIMONY WHEREOF, the Grantor hereto has signed this Grant of Permanent

1. A Mortgage executed by Calvin Christian Schools of Minneapolis, as Mortgagor, to
Highland Bank, as Mortgagee, dated December 4, 2008, filed December 10, 2008, in
the Office of the Registrar of Titles, Hennepin County, Minnesota, as Document No.
T4550371, securing the amount of $250,000.00;
AND
2. An Amended and Restated Mortgage, Security Agreement, Fixture Financing
Statement and Assignment of Leases and Rents dated April 25,2013, filed April 25,
2013, in the Office of the Registrar of Titles, Hennepin County, Minnesota, as
Document No. 705069877, providing for an increase in the amount of debt secured by
the Prior Mortgage, securing the amount of $ 1,054,907.38;

GRANT OF PERMANENT EASEMENT
A permanent utility casement over, under, and across Tract "A" Registered Land Survey 567, as
recoded at the Registrar's Office in Hennepin County, Minnesota; lying easterly and southeasterly
of the following line:
Beginning at the point on the North Line of said Tract "A", said point being 10.00 feet west,
as drawn along said North Line, of the Northeast Corner thereof; thence southerly parallel to
and 10.00 feet westerly of East Line of said Tract "A" a distance of 634.73 feet; thence
Southwesterly deflect to the right 45' 00' 00" for 21.00 feet, more or less, to the South Line
of said Tract "A" and there terminating.
A variable width permanent utility easement over, under, and across Tract "A" Registered Land
Survey 567, as recoded at the Registrar's Office in Hennepin County, Minnesota; said width being
15.00 feet from the centerlines point of beginning to POINT A and 20.00 feet in width from said
