HomeMy WebLinkAboutSunnyslope PH Notice to ResidentsCITY OF EDINA 4801 WEST 50TH STREET EDINA, MINNESOTA 55424 NOTICE OF PUBLIC HEARING ON VACATION OF PUBLIC RIGHT-OF-WAY EASEMENT IN THE CITY OF EDINA HENNEPIN COUNTY MINNESOTA NOTICE IS HEREBY GIVEN that the City Council of the City of Edina, Minnesota will hold a virtual public hearing on, Tuesday, July 21, 2020 at 7:00 p.m. to consider the requested vacation of the following public right-of-way easement located at 4805 Sunnyslope Road Pursuant to Minnesota Statutes section 13D.021, and the current state of emergency declared by the Governor of Minnesota and the Mayor-declared local emergency due to the COVID-19 pandemic, the City Council have determined that it is not prudent to conduct in-person meetings of the City Council or a meeting under section 13D.02, nor is it feasible to allow any member of the public to be present at the regular meeting location or any remote sites of any council members in order to attend the meeting. All members will participate by electronic means. The public will not be given an opportunity to be heard in person at this meeting. Please see attached document with ways to participate. PROPOSED DESCRIPTION A strip of land 10 feet in width, the entire centerline of which is described as follows: Commencing at a point on the East line of Lot 13, Block 1, Sunnyslope Section, Country Club District, said point being 48.5 feet South of the Northeast corner of said Lot 13; thence Southwesterly a distance of 80 feet to a point 40 feet North of the South line of said lot and there terminating. All persons who desire to be heard with respect to the question of whether the above proposed street right of way and utility and drainage vacation is in the public interest and should be made shall be heard at said time and place. The Council shall consider the extent to which such proposed street vacation affects existing easements within the area of the proposed vacation and the extent to which the vacation affects the authority of any person, corporation, or municipality owning or controlling electric, telephone or cable television poles and lines, gas and sewer lines, or water pipes, mains, and hydrants on or under the area of the proposed vacation, to continue maintaining the same or to enter upon such easement area or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereto, for the purpose of specifying, in any such vacation resolution, the extent to which any or all of such easement, and such authority to maintain, and to enter upon the area of the proposed vacation, shall continue. Because of the health pandemic, it has been determined that physical presence at the regular meeting location by members of the public is not feasible. Because of the health pandemic, it has been determined that physical presence at the regular meeting location by at least one member of the body, chief legal counsel or chief administrative officer is not feasible. Therefore, the City Council will be participating in the meeting remotely. HOW TO PARTICIPATE: Public hearing input can be provided in a variety of ways to the City Council.
