Community Comment Mr. Richard Hellebrand, 5904 Olinger Boulevard, expressed concerns about the teardown of historic houses on Olinger Boulevard, citing low ceilings and narrow stairs as reasons given by the developer. Site Plan Review and Variance – 5036 France Avenue South Community Development Coordinator Lewis presented the request for a site plan and variance. Staff recommended denial of the site plan and variance, as detailed in the staff report. Appearing for the Applicant Mr. Ryan Burnett and Mr. Daniel Del Prado presented their vision for the Americana restaurant, emphasizing the need for a dynamic and unique concept to revitalize the neighborhood. The Commission asked staff and the applicants questions. Public Hearing Ms. Rebecca Sorenson, 4304 Eaton Place, voiced strong support for the proposed Americana restaurant, highlighting its potential to bring new energy and vitality to the district. Chair Bennett noted the positive feedback received on the City’s engagement website, BetterTogetherEdina.Org, indicating broad support for the project. Commissioner Padilla moved to close the public hearing. Commissioner Daye seconded the motion. Motion carried unanimously. The Commission discussed the site plan and variance request, and after thorough discussion, felt that the changes were warranted. Motion Commissioner Padilla moved that the Planning Commission recommend approval to the City Council of the site plan and variance, including bike or electric scooter parking, subject to the findings and conditions outlined in the staff report. Information/Background: A 7-foot front yard setback variance from the 42.7 foot setback is required to allow garage replacement with living space above at the same nonconforming setback of 35.7 feet as the existing garage location. Better Together Edina Report Page 8 of 52 The subject property, 8 Woodland Road, is approximately 18,938 square feet in area and is located northwest of the Woodland Road cul-de-sac. The existing structure is a two-story home built in 1941 with an attached structurally failing garage that is connected from the house by an elongated breezeway. The current home does not meet the required front yard setback in today’s code from the front street. The existing home’s attached garage is nonconforming and will be added to and remodeled to include a second- floor addition while maintaining the existing nonconforming setback to the cul-de-sac. The applicant is requesting a 7-foot front yard setback variance to the South lot line along the cul-de-sac. The required setback is 42.7 feet with the current setback to the S/E garage corner of 35.7 feet. Setback will be maintained at the existing nonconforming distance to the front lot line. The proposed addition include removal of a breezeway connection to the two-car garage by replacing it with living space in place of the breezeway and with living space above a new attached garage. The lower level will consist of a game room, 1st floor will have an office, mudroom, and the new 2nd floor will accommodate 2 new bedrooms and bath. The following is the current front yard setback requirement in the zoning ordinance: Sec. 36-439. - Special requirements. a. Established front street setback. When more than 25 percent of the lots on one side of a street between street intersections, on one side of a street that ends in a cul-de-sac, or on one side of a dead-end street, are occupied by dwelling units, the front street setback for any lot shall be determined as follows: 2. Minnesota Statues and Section 36-98 of the Edina Zoning Ordinance require that the following conditions must be satisfied affirmatively. The proposed variance will: 1) Relieve practical difficulties that prevent a reasonable use from complying with ordinance requirements. Reasonable use does not mean that the applicant must show the land cannot be put to any reasonable use without the variance. Rather, the applicant must show that there are practical difficulties in complying with the code and that the proposed use is reasonable. “Practical difficulties” may include functional and aesthetic concerns. The proposed use is permitted in the R-1 Single Dwelling Unit District and complies with zoning standards, with exception of the existing nonconforming south front yard setback. The practical difficulties are caused by the existing location of the home, the required average front yard setback from the ROW and the curvature of the cul-de-sac. 2) Correct extraordinary circumstances applicable to this property but not applicable to other property in the vicinity or zoning district. The proposed addition is reasonable due to the existing home’s non-conforming setback. The home will be remodeled and modified with existing/proposed setbacks consistent with existing conditions on the lot. Moving the garage to another location is impractical, given the current garage location and orientation of the house. 3) There are circumstances that are unique to the property, not common to every similarly zoned property, and that are not self-created? The existing garage has a non-conforming setback and was allowed to be built in the current position to the cul-de-sac. Only a small portion of the garage and room above will overlap the front yard setback requirement. The proposed additions will conform to all other zoning standards. The larger setback requirements (average abutting at cul-de-sac), limit the buildable area that has structure within currently. The average setback helps to negate a proposed structure from encroaching on an abutting neighbor's front yard. In this case, the neighbor to the east is minimally impacted if at all, as their structure is off set from the proposed addition. 4) Will the variance alter the essential character of the neighborhood? Granting variances will not alter the character of the neighborhood. The addition will match the existing home’s setback from the cul-de-sac. All other aspects of the home will conform to the ordinance requirements. The garage and living space above are of a similar design to the house with matching materials used. Page 11 of 52 STAFF REPORT Page 4 Recommended Action: Staff recommend approval of a 7-foot front yard setback variance for property at #8 Woodland Road. Approval is subject to the findings listed in the staff report above and following findings: 1) The practical difficulty is caused by the required average front yard setback requirement that is farther from the front lot line than the existing current structure setback. 2) There are circumstances that are unique to the subject property. Those unique circumstances include an existing nonconforming garage and having curved street frontage and setback around the cul-de-sac affecting the buildable area given the existing home and garage location. 3) Space isn’t available on the lot for a conforming expansion of the existing garage without the benefit of a setback variance. 4) The proposal would not alter the essential character of the neighborhood. The garage is of a similar design to the house with matching materials used. The additions will match the existing home’s setback from the cul-de-sac. Approval is subject to the following conditions: • Subject to the survey and plans date stamped August 26, 2025. • Compliance with the Environmental Engineer’s building permit requirements. • Compliance with the tree ordinance. The design intent is to maintain the existing garage's setback location to uphold the streetscape facade, while creating a modern, safe and inviting addition to the home and its surroundings. 3. The property owner proposes to use the property in a reasonable manner not permitted by the ordinance. o Yes, we believe this request represents a reasonable solution that balances the city's zoning goals with the practical needs of the property owner to use as their typical protected off-street parking and every day, modern living spaces. 4. The plight of the landowner is due to circumstances unique to the property not created by the landowner. o Yes, the current parcel is uniquely shaped due to its location and parcel division on a cul-de-sac street. o Additionally, a beautiful new home was recently constructed to the South (Left of home) which was placed further back from the street, thereby increasing the setback per city zoning codes. 5. The variance will not alter the essential character of the locality. o Yes, the proposed improvements maintain the home's historic shingle-style architecture, preserving the visual character and fabric of the neighborhood. o Neighboring homeowners have provided letters of support, confirming that the variance will not negatively affect the neighborhood's character.
