I. Call To Order
Chair Arseneault called the December 8, 2016 Human Rights and Relations Commission
meeting to order at 7:02pm.
II. Roll Call
Answering roll call were Chair Arseneault, Commissioner Beringer, Edwards, Kennedy, Meek,
Nelson, and Vecchio-Smith. Student Commissioner Chao and Sinha.
Staff present: HRRC Staff Liaison MJ Lamon and City Management Fellow Kelly Dumais.
Absent Members: Commissioners Edelson and Martin
III. Approval Of Meeting Agenda
Motion by Kennedy to approve the Human Rights and Relations December 8, 2016
meeting agenda. Motion seconded by Vecchio-Smith. Motion carried.
IV. Approval Of Meeting Minutes
Motion by Nelson to approve the November 15, 2016 meeting minutes. Motion
seconded by Kennedy. Motion carried.
V. Special Presentations
Minnesota Department of Human Rights Commissioner Kevin Lindsey presented an overview
of the work and priorities of the Minnesota Department of Human Rights, including the
department’s role in overseeing state contract compliance, enforcement of the Human Rights
Act, and education outreach. Regarding enforcement of the Human Rights Act, Commissioner
Lindsey noted that the Minnesota Department of Human Rights has improved significantly
the processing times and numbers of cases for which determinations are issued for
discrimination complaints filed with the department, since he began his term in 2011. The
Commissioner also discussed the department’s recent voter educational endeavors
surrounding two constitutional amendments that were proposed to the Minnesota State
Constitution on voter ID and same sex marriage, as well as the department’s work on
numerous executive orders from the Governor’s office. Currently, the Commission is working
on the issues of homelessness and recidivism reduction. The Commissioner observed that the
Minnesota Department of Human Rights benefits greatly from partnerships with local Human

Rights Commissions. In response to HRRC inquiries partnership opportunities, Commissioner
Lindsey advised that Local Commissions should pursue issues that they are passionate about
and look for opportunities to leverage work occurring at the State and Federal Level for
support and partnership.
VI. Community Comment
Leslie Lagerstrom, 4548 Oxford Ave., provided an update for the Human Rights and Relations
Commission about the work of a grassroots community group that formed to promote the
effort for Edina to be a Human Rights city called Edina Citizens Human Rights Committee.
VII. Reports and Recommendation:
A. 2016 Workplan Updates:
a. Community Conversations: Chair Arseneault and Commissioner Vecchio-Smith
attended the City Council Meeting on December 6 when the HRRC’s Community
Conversations Report was presented to Council. Ties between the Report and
other items that were already included in the 2017 HRRC workplan were noted. No
further directions for HRRC were provided regarding the Report.
b. Affordable Housing: At the December 6 meeting, City Council also adopted a
revision to the affordable housing policy that strengthens the policy by
eliminating a loophole.
B. 2017 Workplan Items
a. The City Council approved the 2017 HRRC workplan with some changes from the
commission’s proposed draft workplan. The changes align the work of the HRRC
with work of other commissions and of the City as a whole. Some of the HRRC’s
proposed 2017 initiatives were restructured into other work plan items. Large
workplan initiatives for 2017 include the City’s Race and Equity Taskforce and the
Comprehensive Plan. The Age Friendly Cities initiative was dropped; it was likely
viewed as too large of an undertaking in addition to the other work assigned.
HRRC will have a liaison from the planning commission to help with the work for
the comprehensive plan.
b. Workplan assignments:
1. Race and Equity Taskforce: We are not going to assign commission members
to this initiative until the work assignment has been better defined.
2. Tom Oye Award: This initiative will develop an annual theme for the award
that will go into effect for the 2018 award. The 2017 award will be announced
in April. We will be looking at the applications during our February meeting.

3. Bias Offense Response Plan: Review the plan to make any recommendations
for changes during the Summer of 2017. Commissioners Kennedy, Meek,

Edelson, Student Commissioners Chao and Sinha assigned.
5. Sharing Values, Sharing Community: Commissioners Vecchio-Smith, Meek,

6. Human Rights Essay: Commissioners Kennedy, Edelson, Edwards and

Chair Arseneault commented that it makes sense that we start working on the
Human Rights Essay Contest as well as Days of Remembrance. In addition, she
recommended we touch base with the HRRC Planning Commission representative
to get a timeline set up.
VIII. Chair and Member Comments
Commissioner Edwards commented that she is still processing the results of the election.
Commissioner Kennedy shared an event on December 12th at 1:00pm that discusses the topic
of ISIS, Minnesota, and Discrimination against Somali people and how to address this
challenge.
Student Commissioner Chao reported that there has been more response to bias incidents at
Edina High School from the administration. There have been assemblies, classroom
activities, and a new school creed. She, as well as her fellow Student Commissioner Sinha
expressed frustration that their fellow students continue to show disrespect as they work
to engage issues of discrimination in their school. They also expressed a desire for the
administration to do more to make students respectfully engage in these events.
The Commission reflected on whether or not they should move forward with their initiative to
write a letter to the school regarding these incidents. The HRRC held off on their initial
decision to develop a letter asking for a response from the school to the incidents after
there was a response.
Commissioner Vecchio-Smith commented that the middle schools and elementary schools
were working with a prominent consultant on issues of race and equity. She was not sure
if they were also working with the high school, but she was going to follow up to find
out.
Commissioner Meek expressed concern that these issues are not being taken seriously.

Commissioner Kennedy expressed concern that the administration was not doing more to
challenge student microagressions and wanted the HRRC to go on the record opposing
it; Kennedy volunteered to work on a draft letter.
Chair Arseneault requested that we bring this item back for consideration in January at our
next meeting.

annual event to acknowledge April as Holocaust
Remembrance and Genocide Awareness and Prevention
month.

the event(s), identify a venue and guest speakers /
presenters, schedule the day(s), help to publicize, and
assist with event logistics, including securing
refreshments and room set-up /clean-up.

indicated audience.
An educational event/events free and open to the public
that will be planned and scheduled for a day/days in
April, to be held at a location in Edina.
Community Benefit
How does this project benefit the Edina
community?
The Days of Remembrance event provides an
opportunity for us to remember and honor, as a
community, victims of the Holocaust and genocides, and
to share experiences of survivors of the Holocaust. The
event serves to educate us on how the Holocaust and
genocide impacts the lives of survivors and affects us as
a community, and what we can do to make a difference
on these issues.

Several planning meetings to be scheduled in March and
April (evenings or weekend hours); event(s) to be
scheduled in late April; one final meeting in May to
prepare / issue notes of appreciation for presenters,
collect event feedback and prepare a report for the May

The event will be promoted through regular media
channels utilized by the city, including social media, and
working group members will be asked to help promote
the event in neighborhoods and through personal

After much agitation, the Library of Congress in March 2016 announced
that it intended to cancel the subject heading, "Illegal aliens,"
replacing it by two new rubrics, "Noncitizens" and "Unauthorized
immigration." The broader descriptor, "Aliens," would also be
dropped, in favor of "Noncitizens."
The ALA Subject Analysis Committee (SAC) created an "Illegal aliens"
Working Group, chaired by Tina Gross, which reviewed LC's proposed
changes and on July 13 issued a report that supported substituting
"Noncitizens" for "Aliens," but compellingly argued that "Illegal
aliens" itself should be transformed into one new form only:
"Undocumented immigrants." The report included detailed proposals
for new and revised heading entries, feuturing precise scope notes and
extensive cross-references.
In the meantime, LC's intended changes aroused opposition among
several Republican House members, who attached a rider to the FY 2017
House Legislative Branch Appropriations Act (H.R. 5325), instructing
LC to retain its current terminology, That bill passed on June l0.
Subsequently, Rep. Diane Black (Tennessee) introduced separate
legislation, the Stopping Partisan Policy at the Library of Congress
Act (H.R. 4926), which specifically requires that "Aliens," "Illegal
aliens," and related headings be kept "in the same manner as the
headings were in effect during 2015." Black's bill has been referred
to the Committee on House Administration.
Treading warily, LC invited comments on its plan "from the library
community and the general public." Its online survey concluded on
July 20, 2016, the comments to be reviewed by the Policy and Standards
Division and "final disposition of the proposals...announced later
this year."

Right now (12-8-16) there has been no formaa implementation of LC's
'original plan, nor has LC either accepted or rejected the SAC
revisions. In any event, it seems unlikely that "illegal aliens"
will soon be replaced with anything, especially given the Congressional objection:
and pending bill. So perhaps it's time to stop whining and hand-wringing
about the House know-nothings who may have thwarted the "illegal aliens"
reform and instead defy and outwit them. How? By individual library
systems and consortia implementing the superbly-crafted SAC recommendations
themselves. Congress has no direct control or dominion over non-federal
public, school, and academic libraries. And most of those entities
already have automated authority control, making it relatively easy,
for instance, to flip "illegal ali„,As" to "undocumented immigrants,"
thus both scrapping an anachronistic, pejorative heading and improving
topical access by employing widely familiar terminology.
The SAC workups can be efficiently used as templates for local revision.
We can wallow in a mix of sorrow, fury, helplessness, and cynicism
at the Congressional interference or we can exert our own professional
autonomy, expertise, social commitment, and initiative to do what's
right and helpfyl euon if LC itself can't or won't (or does so
awkwardly -and inoft ctually),

Proposal to Change the LC Subject Headings Aliens and Illegal aliens. In response to requests from constituents
who consider the phrase illegal aliens to be pejorative and disappearing from common use, the Policy and
Standards Division of the Library of Congress, which maintains Library of Congress Subject Headings, has proposed
that the headings Aliens and Illegal aliens both be 'replaced.
If approved, the heading Aliens will be replaced by Noncitizens, which is currently a Used For (UF) reference
to Aliens. Illegal aliens will be replaced by two headings: Noncitizens and Unauthorized immigration. Other
headings that include the word aliens or the phrase illegal aliens (e.g., Church work with aliens; Children of illegal
aliens) will also be revised.
Proposals to revise Aliens, Illegal aliens, and all of the related headings appear on Tentative List 1606a, which
may be accessed at https://classificationweb.net/tentative-subjects/1606a.html.
The Library of Congress is accepting comments from the library community and the general public through
July 20, 2016. Because of the high volume of comments that is expected, comments will be accepted only through
an online survey, the link to which is available at the top of Tentative List 1606a.
Review of the comments by the Policy and Standards Division will begin after July 20, 2016. Final disposition of
the proposals will be announced later this year.
These proposals have generated interest in the United States Congress. The FY2017 House Legislative Branch
Appropriations Act (H.R. 5325) report includes the following instruction: To the extent practicable, the Committee
instructs the Library to maintain certain subject headings that reflect terminology used in title 8, United States
Code. The terms "illegal" and "alien" are frequently used together in title 8.
The issue was a key point of debate in consideration of the fiscal 2017 appropriations bill in the House.
Several Members suggested amendments, raised points of order, and offered other motions to remove the
language or prevent the legislation from moving forward. None of these suggestions were accepted by the House,
and the bill passed on June 10.
Separate legislation has been introduced by Rep. Diane Black of Tennessee to retain the headings in the
current form. H.R.4926, the Stopping Partisan Policy at the Library of Congress Act, states, "The Librarian of
Congress shall retain the headings 'Aliens' and 'Illegal aliens', as well as related headings, in the Library of Congress
Subject Headings in the same manner as the headings were in effect during 2015." The bill has been referred to
the Committee on House Administration.

A BILL
To direct the Librarian of Congress to retain the headings "Aliens" and "Illegal aliens" in the Library of Congress Subject Headings.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the "Stopping Partisan Policy at the Library of Congress Act".
SEC. 2. RETENTION OF "ALIENS" AND "ILLEGAL ALIENS" IN LIBRARY OF CONGRESS SUBJECT HEADINGS.
The Librarian of Congress shall retain the headings "Aliens" and "Illegal aliens", as well as related headings, in the Library of Congress
Subject Headings in the same manner as the headings were in effect during 2015.

La Crosse mayors acknowledge city's inequitable past
They say admission will
help improve conditions
for minority residents.

The mayors of La Crosse,
Wis., past and present came
together last week to work on
healing old divisions.
Mayor Tim Kabat and for-
mer Mayor John Medinger met
at City Hall to sign a proclama-
tion acknowledging a history
of discrimination that strained
relationships between the city
and its minority citizens and
pledging to work harder to
ensure equality for all.
"When there are strained
relationships, we look for
words to help us deal with
them," Kabat said. "The way
we use language and commu-
nicate with each other is really
that first step. I can't think
of any more powerful three
words for rebuilding relation-
ships than 'I am sorry."
The proclamation came a
little over a month after Kabat
apologized for La Crosse's
history as a "sundown town,"
a city or village with either
formal or informal codes that
pushed black people out ofthe
community after sundown,
after a presentation from
sociologist James Loewen at
La Crosse City Hall. Loewen
was invited by the University
of Wisconsin-La Crosse and
the city's Human Rights Com-
mission.
'We had a great crowd, and
it was fantastic as far as being
able to get a sense of what La
Crosse's past is," commission
Chairman Fabio Burgos said.
'We're never going to be able
to change the future of this city
and really make it the city that
it can be without acknowledg-
ing what had gone on in the
past."
Kabat and Medinger took
that message to heart in the
proclamation, which reads,
"Healthy people and healthy
communities are able to rec-
ognize their past mistakes,
admit when they have been
wrong and resolve to ensure
equality for all people."
It further includes a pledge
"to work toward the com-
mon good in building a warm
and welcoming community"
for everyone, regardless of
race, color, gender identity or
expression, religion, sexual
orientation, national origin,
age, ability, marital status,
physical appearance, political
activity or familial status.
The proclamation, which
had garnered 33 signatures
by Thursday afternoon,
will remain up at City Hall
throughout the holiday season
withparticipants encouraging
community members to sign.

Subject: Board/Commission Chair Term Feedback Requested
City Council has been reviewing Board and Commission practices at both January work sessions.
One topic in discussion has been protocol and City Code around Board and Commission chair term
limits. Currently Board and Commission chairs are limited to 2 one-year consecutive terms. This is
outlined in City Code, Section 2-83 – Organization and Bylaws:
Sec. 2-83. - Organization and bylaws.
(a) Bylaws. Each board or commission will be governed by such bylaws as approved by the city
council.
(b) Chairperson and vice-chairperson. Each board or commission annually shall elect from its
members a chairperson and vice-chairperson to serve a term of one year. No person shall serve
more than two consecutive one-year terms as chairperson of a particular board or commission. A
chairperson elected to fill a vacancy shall be eligible to serve two full terms in addition to the
remainder of the vacated term. There are no term limits for the position of vice-chairperson.
The Council would like Board and Commissions to respond to the questions below. The Liaisons
will record a summary in the minutes which will be shared with Council when they review the
protocol. When providing feedback consider the balance between experience and efficiency of
running a meeting vs leadership change and opening opportunities.
1) Is the term limit of two consecutive years to short?
2) Would a longer term limit better balance chair experience and leadership change?
3) If so, what is the right number (3 years, 4 years, no limit)?
