FEIGHNER COMPANY. FREMONT, OHIO , Contractor,
for furnishing labor, materials and equipment necessary and required to
thoroughly clean and paint the Exterior Surfaces of the steel water
storage tank, tower and frost box located at W.50th Street and Wooddale
Avenue for the consideration of ONE THOUSAND ONE HUNDRED AND EIGHTY AND

in strict accordance with the requirements of the accompanying specifi-
cations which are made a part hereof.
Witnesseth, That the said Contractor has agreed and by these presents
does agree with the SAID VILLAGE OF EDINA for the
consideration named, to furnish all labor, materials, and equipment and
do all the work of whatever nature necessary to complete in a workmanlike.
manner and according to the specifications and subject to all the terms
and conditions of said specifications and to the approval of the
VILLAGE ENGINEER .
In case the Contractor shall be required to do any work of.a class
not provided for in the bid and this contract, said Contractor agrees that
the amount to be allowed him shall be fixed by written agreement between

the work is commenced, and in case of failure to agree, then by some party

That said Contractor agrees that the Superintendent, Engineer or any

any work or materials not in accordance with the specifications and the
contract.to be replaced at the expense of the contractor.
The VTT.T.AGF OF F�n-TDIA agrees and bids itself upon the completion
of the work to the approval of the Superintendent,-Engineer, or other
authorized agent to pay to said ,Contractor the amount of money due.under
this agreement. Full payment will be made upon the acceptance of the work,

GENERAL CONDITIONS. AND INSTRUCTIONS TO BIDDERS
Sealed proposals will be received by the EDINA VILLAGE COUNCIL
at theEDINA VILLAGE HALL,4801 W. 50th St until 7:30 ol'clock on Monday
March 10. 1952 , for furnishing all labor, materials and equipment
necessary and required to thoroughly clean and paint the exterior surface
of the 75,000 gallon -steel water storage tank, tower and frost box located.
at W.50th Street and Wooddale Avenue, all in accordance with the contract
and specifications covering this work.
Bidders must secure their information as to the condition of the tank
and all local.conditions affecting the work prior to submitting their
proposal.
Work must be begun promptly after the award of the contract and within
such time as stated by the successful bidder, and be completed by the time
named by said bidder.
Bidders are notified that. the price bid must include everything as
described in the specifications. No extras of any kind will be allowed
unless ordered in writing by the.Village Engineer.
The bidder must satisfy the Company of his practical and financial
ability to perform the work bid upon. The bidders must attach to his
proposal the names of the owners of three structures, of the same 'type,
for which the bidder has successfully completed work of the nature
outlined in the attached specifications, within the last 12 months.
Payment for this work will be made in cash, and in accordance with
the contract and specifications.
The right is reserved to reject any or all bids or to accept any bid
considered advantageous to the owner.

SPECIFICATIONS
DEF,�IONS
Whenever.the word "Owner" is used, it shall be held to mean the
Village,of Edina, its Superintendent, Engineer or other authorized agent.
Whenever the word "Contractor" is used, it shall be held to mean the
Contractor or Firm under contract to do the work herein specified.
SUSPENSION O
The Superintendent, or.Engineer, or authorized Agent, of the owner
shall have the right to stop or suspend the work at certain points if in
his opinion public need demands it. In case of any suspension, the time
within which the Contractor is required to complete the work shall be
extended by as many days as the same was thus suspended.
ALTERATION
Any: alterations or modifications of this work here contracted for
shall be made only by a written agreement between the Superintendent,
Engineer, or authorized agent and the Contractor before the alterations
or modifications have been started.'
EXTRA WORK AND MATERIAL
No claims for,any, extra work or materials will be allowed, unless it.
is, ordered in writing.by the owner and the.price to be paid is agreed
upon by a written agreement before the work is done'or material furnished.,
OWENSATION INSURANCE.
The Contractor shall provide adequate workmen's compensation insurance..
for. all labor employed by him on'the project, and shall comply with the
Workmen's Compensation Laws :of - the State of ;Minnesota, and; shall give proof;
of 'such insurance, satisfactory to the owner.
PUBLIC LIABILITY,INSURANCE;'
The Contractor shall properly protect`the work, and shall hold the..
owner harmless from all damages occurring in any way by his acts or
neglect, or that of his agents, employees or workmen, or for damages due,
to injury to his employees, or others during the progress of the work.;
He will also be required to furnish a-'certificate of insurance showing
the Contractor to have a policy of not less than $10,000 covering property
:damage and 850,000/$100,000 covering public liability. He will also . defend
in court by his own counsel any suit brought against the Village of Edina
for. any property damage or personal liability in connection with the work
covered by this _contract and outlined'in the sp®cificationo,:
The Contractor is hereby cautioned to.exercise precaution in protect-
ing all property owned by the Owner or adjacent thereto during the progress
of his, work.
PAYMENT
Payment-will be made in cash upon completion of:work following
inspection and acceptance of the work by the,Owner.
INSPECTION OF WORK
The work shall at all times be subject to inspection but such..
inspection shall not relieve the Contractor from any,obligation to
perform said work in accordance with the specifications.or any modi
fications.thereof; as herein provided, and work not.done strictly in.
accordance with the specifications shall;be .corrected „and made good,by,
the Contractor whenever so ordered by the,Superintendent, Engineer or
authorized agent of the owner,,without.reference.to any previous
oversight or error in inspection.
PREPARATION' OF SURFACES - EVERIOR .
If the old.paint is in good condition, adheres.tightly to,the steel,,.
and is hard and'not too thick, it may be,left on. All rust, loose mill
scale and loose paint shall be removed by means of scalers.or scrapers
and wire brushes (preferably power driven)' emery,cloth or sandpaper.
Special care shall be used to clean all.pits and roughened areas. In,
places where blisters or rust has occurred, the steel shall be cleaned
until it is bright', either by wire brushes,and scrapers or by the use of
hand or power sanders. All foreign material, rust.and.loose paint shall
be removed, and any old paint which has been allowed.to remain shall have
a clean surface and be tight to the steel.
Sandblast cleaning shall be done according to A.W.W.A. Specifications.
Paint shall not be applied when the temperature is below 400 F. The
surface shall be free of frost or dampness when paint is applied. No
paint shall be applied unless good weather prevails, nor shall such appli-
cations be started if inclement weather threatens.
All paint shall be evenly.spread and thoroughly brushed out. The
highest standards of workmanship shall prevail. In all instances, the
application of paint shall be satisfactory to.the.engineer.- in- charge.or
to the inspector delegated by him. Particular attention shall be given
to rivet heads, edges, welds, etc.
The paint shall be of the proper consistency for a brush application.
Thinner shall not be :added under normal: conditions. In the cooler weather
it may be necessary to thin the-paint. If so, not more than one pint per
gallon shall be added, For a spray application, thinner may be required
for the paint to pass through the spray equipment. Only enough thinner
shall be added to permit the paint to pass through the spray equipment.
In no case shall it exceed one pint of thinner. "Mineral Spirits!' is the
suggested thinner, when required.

REPAIRS
It shall be the duty and responsibility of the contractor to
notify the owner of any loose rivets, open seams, etc. before the
application of paint so that the owner can make the necessary repairs
with his.own employees, or to authorize the contractor in writing to
proceed'with.this,.work at a total price agreed upon in writing,
SANITARY REQUIREMENTS
The contractor and all workmen employed by him shall conduct all
operations in a clean and sanitr_ry manner. No nuisance, shall be
committed; the workmen shall either use proper waste receptacles or
leave the tank whenever necessity arises
INSPECTION
The owner shall inspect the painting ae it is being done. Payment
for painting done shall be made only after the owner has satisfied him-
self directly that the painting is satisfactory and in accordance with
the requirements'of the contract.
It is.in the mutual interest of the owner and the contractor that
such inspection be made promptly.
PAINT
-Paint-shall be delivered to the job site in factory- sealed containers..
with'the manufacturer's labels affixed to the containers showing the
manufacturer's name, brand, color, identification number, etc.
The paints used shall be recognized as being suitable for the
protection of water storage equipment. The contractor shall furnish
the owner with list of 5 water tanks painted with the paints the con
tractor proposes to use, from which not less than 6 years' protection
was secured on water tanks.
If the paint used has a graphite pigment, which is preferred, only
the use of natural flake silica graphite will be permitted.

City Council of the City of Minneapolis,' the Ordinances
pertaining t.o..the Water Works Department as they apply to new
water rates for water consumed were approved. At this meeting
the rates for metered water were increased in accordance with
an amendment to an existing o3� dihance on rates and charges for
use of water and services of the Water Works Department. The
official publication of the ordinances as revised is herewith.

Thi.s is to inform you that the- adopted rate
schedules as noted herein will apply and`be effective as of
January 1, 1953. The particular paragraph that applies to
your case is noted in pencil on the enclosed publication.
In the event bills rendered cover periods when
.water was consumed in this year as well as next year the cost
will be pro -rated on the basis of the old as well,as the new
rate for the time under consideration . This will apply for a
quarterly bill which includes time in this year as., well,as a
part of the 'ne;w year.

At the meeting of the council last night an opinion was re-
quested with respect to a bid submitted by- Phelps -Drake on a con -
struction.project for the water department. The bid submitted covered
certain hydrants, and the bid did not specify the make of hydrant to
be used. Since the bids were opened you have been advised verbally
that the contractor proposes to use Columbian hydrants. Inasmuch as
the village has no such hydrants in its present system and inasmuch as
the parts for the Columbian hydrants are not interchangeable with the
parts -for the hydrants now in use, you do not wish to have the con-
tractor use the hydrants proposed, and you have inquired as to whether
or not the village can require him to use hydrants, the parts for which
are interchangeable with those now in use in the village. It is your
understanding that the contractor obtained bids from several hydrant
manufacturers and proposes to use the Columbian bid because the quoted
price was about $500 less.
In connection with your inquiry you have furnished me with
a copy of the specifications which were the basis for the bid sub-
mitted by Phelps- Drake. On page D10 thereof it is provided:
"Hydrants of approved manufacture and design shall be
installed where shown on the plans or ordered by the
Engineer."
On page D11 the following statement appears:
"All parts of hydrants furnished must be interchange-
able for the hydrants proposed and for hydrants of
similar make now in use in village and failure to ful-
fill this requirement in any hydrant will cause said

hydrant to be unconditionally rejected and no pay -
went will be made for said hydrant."
It is not entirely clear as to whether the last quoted pro-
vision was intended to require the parts for the proposed hydrants
to be interchangeable with parts for hydrants.in use in the village
or whether the parts must be interchangeable with parts for hydrants
in use in the village manufactured by the same company. The reason
for this ambiguity arises primarily out of the phrase "similar make ".
I am inclined to believe that this language should, be interpreted so
as to require that the parts on the hydrants proposed must be inter-
changeable with parts on the hydrants in use in the village. I there-
fore believe that under the facts stated above you are justified in
refusing to accept the Columbian hydrants. This is the opinion that
I gave to you and to the council verbally last night. However, upon
giving the matter further consideration it seems to me that it may
be material in interpreting this.language to ascertain whether or not
the parts for hydrants manufactured by one company are ever inter-
changeable for parts for hydrants manufactured by another company.
If such parts are never interchangeable, the meaning which I have
proposed for the phrase "similar make" would not seem to be warranted.
In this event it would be necessary to ascertain whether or not the
contractor would be willing voluntarily to furnish a different type
of hydrant without additional charge to the village or at an additional
charge to the village of less than 9500.
If the contractor is willing to furnish the type of hydrant
desired by you but not covered by the assumed construction of the
specifications at an additional cost of 9500, it is my opinion that the
council would be permitted to make such an arrangement with him with-
out advertising for new bids. In this connection I understand that
the bid of Phelps -Drake was lower than the next lowest bid by about
$6,000. If the additional cost is in excess of $500, it is my opinion
that it would be necessary to reject all bids and to readvertise. In
this event I suggest that the specifications be clarified insofar as
the type of hydrant is concerned. I would be glad to.discuss the
exact nature of this revision with you.
In view of the fact that the opinion expressed herein differs
from the opinion verbally given the council last night, it may be that
you will wish to discuss this matter further or have me discuss it

time schedule is insofar as beginning work on this project is con-

Gentlemen;
You have requested my opinion as to the propriety of cer-
tain water and sewer charges which the Village desires to impose.
Briefly stated, the first question is whether the Village may cur-
rently bill owners of properties which are not served by the Vil-
lage water mains, but which are able to be connected, or which are
within 1,000 feet of a hydrant, on the theory that such owners are
presently being benefited by such availability of water, the benefit
arising from the increased fire protection furnished to such owners.
It is recognized that such owners benefit financially because of
the lower insurance rates made possible by the nearness of such
water supply. Apparently it is the feeling of the Council that an
inequitable situation arises from the fact that the;entire cost of
operating the municipal water system is borne by those owners who
are connected with the water system and pay water rates, so that,
in effect, fire protection service is furnished free by the users
to the non - users.
I have not been able to find any statutory authority for
the imposition of such charges on non - users, so the answer must rest
on general principles -and case - -law. Such charges cannot be supported
under the general taxing power, since the Constitution requires uni-
formity of taxation (Article 1X, Section 1), except that municipal
corporations may be authorized to levy and collect special assess-
ments for local improvements upon property benefited thereby. It
seems to me that such charges as previously described actually are
nothing else than special assessments, for the levy of which statu-
tory authority must be found. See In re Petition of City of Phila-
delphia (1940) 340 lea.. 17, 16 A. ( d 3 . In statutory proceedings
for e levy of special assessments for the construction of water
mains, it is commonly considered that one of the benefits which may
be taken into consideration in making the assessment is the increased
fire protection afforded to nearby property. Therefore, such property
as has already been assessed for the construction of such mains has
already paid for this benefit. On the other hand., property abutting
on water mains and never assessed for their construction may be

assessed for their construction now, if such mains were financed
by general obligation bonds and not by special assessment, as pro-
vided in Minn. Statutes, sec. 432.22. However, this procedure is
very likely not satisfactory, because
1) many mains were constructed by Thorpe Bros. (see 214
Minn. 26, 8 N. W. (2d) 321), and the Village probably
could not assess the cost of these mains,
2) hearings would have to be held under the procedure
required by section 432.22, and
3) the resulting charge would be permanently fixed as
to amount and number of installments.
There does not seem to be any other assessment procedure which
would be applicable to the situation described above.
If one attempts to regard the charge to non -users as being
in the nature not of an assessment, but of a water rental charge,
the question arises whether non -users may be billed because water is
kept constantly available to them for use in the event of a fire.
The nearest case in point I have found in this state is Gordon &
Ferguson v. Doran (1907) 100 Minn. 313, 111 N. W. 152, from v�ich
it appears that a person not connected to the water system may not
be made liable to pay for the value to him of the water system as
a protection against fire, the court saying that "so long as water
supplied for protection against fire is a purely public service,
under the control and management of municipal authorities generally
and under the fire department specifically, no direct charge to in-
dividuals is proper.it Such a-charge as the Village proposes to make
must therefore be illegal. The Pennsylvania court dealt with a
similar problem in the Pennsylvania case cited above, and held that
"annual rentals" for the use of sewers, imposed on non - users, were
not rents at all, but a tax. while the tax was illegal because it
exceeded constitutional limitations, it is apparent from the opinion
that the tax would have been held invalid because it was a form of
special assessment unauthorized by law. Colley v. Village of Engle-
wood (1917) 71 N.E. (2d) 521, an Ohio case, sustains such a charge,
and cannot be reconciled with the law of Minnesota.
In this state of the law, the best idea would appear to be
for the Village to lower the water rates to users, and include in
the annual Village levy an amount to be paid to the Fire Department
Fund, for fire protection, when collected, this amount could then
be paid by the fire department to the Waterworks Department, in pay-
ment for hydrant rental and water furnished by the latter for the
extinguishment of fires. A fire protection levy outside the maxi-
mum 20 -mill rate is authorized only in forest areas (Minn. Statutes,

sec. 412.251 (9), and could not be made by the Village of Edina.
It may be argued that hydrants are not generally available for
fire protection in all parts.of the Village, but all property in
the Village is better protected by the existence in some parts of
the Village of a water system with hydrants. See Village of Grand
Ridge v. Hayes. (1915) 271 Ill. 431,. 111 N. E. 289, and McCoy v.
City of Sistersville (1938) 199 S.;E. 260, a West Virginia case.
Less appealing al ernatives are
1) to pass an ordinance as authorized by Minn. Statutes,
section 412.221 (31), requiring owners of property
abutting on or adjacent to any street in which water
and sewer mains have been laid to install a toilet in
any dwelling or commercial establishment upon such
property and connect it with the sewer and water mains,
or
2) to establish higher connection charges to take effect
after a date to be determined, with the purpose in mind
of thereby compelling persons to connect with the water
system. This and the preceding alternative would of
course be ineffective as to.owners who could not be
connected.
The second question on which an opinion was requested is
whether owners of garbage disposalls (electric pigs) which discharge
waste matter.into the sewer system of the Village maybe compelled
to pay an extra monthly charge for sewer service. It is apparently
the feeling that such owners receive more benefit from the system
than other users, who have their garbage picked up by persons em-
ployed by the Village, and are charged for such garbage pick -up. I
think that there is no objection to making such a charge, the pro-
visions of Minnesota Statutes, section 443.09 being such that a
Village which has installed a.sewer system has authority to establish,
by ordinance, just and equitable rates tO users, which shall be 'tas
nearly as possible, equitable and in proportion to the service ren-
dered and shall take into consideration the quantity of sewage pro-
duced and its concentration, . . . pollution qualities in general,
and the cost of its disposal . . . In case of arrangements with
other municipalities, districts, or private parties.for the supplying
of sewers, aforesaid, such rates, charges or rentals may also be
levied the same as in independent operations.ft

annual operating statement of the above utility. We would

Dear Mr. Vesely:
In regard to our conversation regarding the changed
legal description and the payment of additional earnest money
for the right to commence immediate construction, we wish to
advise that the Village has agreed to pay an additional $1,000
earnest money for the right to commence immediate construction
pending receipt of new abstract of title and our examination
thereof.
We enclose herewith a Village of Edina draft No. 7180
drawn on the Village Treasurer payable to the order of Virgins
Stolaman in the amount of $1,000, together with claim slip cover-
ing said amount. We deliver this check to you for delivery to
Mrs. Stol$man only on the condition that she sign and return to
us the carbon copy of this letter which is attached hereto sig-
nifying her consent to the new conditions affecting the earnest
money contract. The following are said new conditions:
1. The new description shall be as follows: That
part of the Northwest Quarter of the Southwest Quarter (N} of
SW of Section Nineteen (29), Township Twenty -eight (28), Range
Twenty -Your (24). lying South of the North 15 acres thereof and
Borth of the South 20 acres thereof and West of a line drawn paral-
lel with and 689 feet West of the Fast line of said Northwest Quar-
ter of the Southwest Quarter (N* of S*) and East of a line drawn
parallel with and 839 feet West of the East line of said Northwest
Quarter of the Southwest Quarter (1* of S*), all according to
the United States Government survey thereof.
2. As soon as the'new abstract has been completed, it
will be delivered to us for examination. Any valid objections to
title raised by us shall be correated by the seller at her own ex-
pense as soon as is reasonably possible after title objections have
been received. The balance due on the contract ( ;1900.00) shall not
be payable until such title is found to be or is put in marketable
condition.

3. The Village of Edina shall have the right to commence
imme diate construction of its water facilities on the property.
4. in the event valid objections are made to title and
they are not corrected within one year from the date of such objec-
tions, the Village of Edina shall have the right to correct such
title and to apply as much of the purchase price as is necessary to
accomplish this purpose.
Upon the acceptance of these changes by Mrs. 3tolffiman
as above provideds the enclosed check may be delivered to her upon
the further condition that she sign the enclosed claim. It is
essential that.the Village have this signed claim in their files for
Inspection by the Public Examiner.

Your KW 9th letter,,addressed to Mayor Erickson, has been
referred to me for reply.
The recent. rapid growth of our Village has presented mangy
problems, and an adequate water supply is.considered by the
Council to be one-of the most important.
We are glad to be able to inform.you that the Council has
been aware of the increasing need for now capital equipment for
the Village Water Department and that, as the first step toward
insuring a more adequate water supply, . construction will go
forward this year on a new 5000000 gallon water tank and tower.
,Studies are now under way for a new pump to .serve the area
West of the Beltline, and for other pumps to serve the developing
areas South of 56th Street and thus alleviate the water shortage
in the Northern part of the Village.
It is' hoped that 1953 will see the end of the present
sprinkling restrictions. j

My dear Mayor Erickson:
The perennial notice restricting lawn sprinkling in the Village
of Edina to alternate days indicates once more that nothing
worthwhile has been done to improve the water supply during
the past year. This condition hasprevailed for some twenty
years now but during the same period the Village of Edina has
spent hundreds of thousands of dollars for schools even though
an adequate water supply would not cost a tenth as much. Our
taxes are increasing at a disturbing rate and in addition we pay
a substantial sum for water consumed but still we have no
water on alternate days for lawn watering.
Of all the municipalities in the State of Minnesota, Edina
should be the last one to have an insufficient water supply.
There are two basic reasons for this.
1. The people in Edina comprise a remarkably
homogeneous population in the middle and
higher income levels. It seems incongruous
to deny them an adequate supply of water.
2. Water is so readily available in Edina. It is
essentially that of providing sufficient wells
and pumps. There is no need for expensive
filtration and treatment plants. .
Some constructive leadership by yourself as the elected ad-
ministrative head of the Village of Edina, and by the members
of the council, toward an improved water supply would most
certainly be appreciated by the people. There seems to be no
group of citizens actively promoting a better water supply, as
contrasted to the several organizations constantly agitating for
the schools. Consequently there is an open opportunity for
you and the members of the council to improve the situation.
The reference to the large sums of money spent on schools
was made simply to show that the people will approve expenditures
that are convincingly presented. It is not suggested or intended
that school appropriations be reduced and the corresponding

amount be assigned to the water department. Instead the
financial needs of the water department to provide good
service should be determined and the people informed.
They will respond with approval since in this instance they
will receive vastly better service for a relatively modest
expenditure.
Now is the time to start a program leading to an improved
water. supply for the Village of Edina and to avoid a
continuation of the humiliating sprinkling restriction in
1953.

NOTIBE IS HEREBY GIVEN that the Edina Village Council will
accept bids until 700 P.M., Monday, March 10, 1952, at which
time said bids will be opened and read at the Edina Village Hall,
4801 W. 50th Street, for the cleaning, painting and repairing of
the Village water tank and tower. Specifications will be on file
at the office of the Village Clerk.
Each bid is to be accompanied by a certified check of at
least ten percent of the amount bid. Bid to be securely sealed
and endorsed with the name of the project. Payment to be on
basis of cash on acceptance of work.

GENERAL CONDITIONS. AND INSTRUCTIONS TO BIDDERS
Sealed proposals will be received -by the EDINA VILLAGE COUNCIL
at theEDINA VILLAGE ULL,,4801 W.50th Stuntil 7:30 of clock on Monday,
.arch 10, 1952 , for furnishing all - labor, materials and equipment
necessary and required to thoroughly clean and paint the exterior surface
of the 75,000 gallon steel water storage tank, tower and frost box located
at W.50th Street and Wooddale Avenue, all in accordance with the contract
and specifications covering this work•
Bidders must secure their information as to the condition of the tank
and all local conditions affecting the work prior to submitting their
proposal,
Work must be begun promptly after the award of the contract and within
such time as stated by the successful bidder, and be completed by the time
named by said bidder.
Bidders are notified that the price bid must include everything as
described in the specifications. No extras of any kind will be allowed
unless ordered in writing by the Village Engineer.
The bidder must satisfy the Company of his practical and financial
ability to perform the work bid upon. The bidders must attach to his
proposal the names of the owners of three structures, of the same type,
for which the bidder has successfully completed work of the nature
outlined in the attached specifications, within the last 12 months.
Payment for this work will be made in cash, and in accordance with
the contract and specifications.
The right is reserved to reject any or all bids or to accept any bid
considered advantageous to the owner.

SPECIFICATIONS
Whenever the word "Owner" is used, it shall be held to mean the
Village of Edina, its Superintendent, Engineer or other authorized agent.
Whenever the word "Contractor" is used, it shall be held to mean the
Contractor or Firm under contract to do the work herein specified.
SUSPENSION OF WORK
The Superintendent, or Engineer, or

EXTRA WORK AND MATERIAL

OWENSATION INSURANCE.
The Contractor shall provide adequate worlcnen's compensation insurance
for all labor employed by him on the project, and shall comply with the
Workmen's Compensation Laws of the State of Minnesota, and shall give proof
of such insurance, satisfactory to the owner.
PUBLIC LIABILITY INSURANCE
The Contractor shall properly protect the work, and shall hold the
owner harmless from all damages occurring in any way by his acts or
neglect, or that of his agents, employees or workmen, or for damages due
to injury to his employees, or others during the progress of the work.
He will also be required to furnish a certificate of insurance showing
the Contractor to have a- policy of not less than $10,000 covering property
damage and 650,000/$100,000 covering public liability. He will also defend
in court by his own counsel any suit brought against the Village of Edina
for any property damage or personal liability in connection with the work
covered by this contract and outlined in the specifications.
The Contractor is hereby cautioned to exercise precaution in protect-
ing all property owned by the Owner or adjacent thereto during the progress
of his work.

PAYMENT
Payment will be made in cash upon completion of work following
inspection and acceptance of the work by the Owner.
INSPECTION OF WORK
The work shall at all times be subject to inspection but such
inspection shall not relieve the Contractor from any obligation to
perform said work in accordance with the specifications or any modi-
fications thereof, as herein provided, and work not done strictly in
accordance with the specifications shall be corrected and made good.by
the Contractor whenever so ordered by the Superintendent, Engineer or
authorized agent of the owner, without reference to any previous
oversight or error in inspection.
PREPARATION OF SURFACES •- EVERIOR
If the old paint is in good condition, adheres tightly to the steel
and is.hard and not too thick, it may be left on. All rust, loose mill
scale and loose paint shall be removed by means of scalers or scrapers
and wire brushes (preferably power driven), emery cloth or sandpaper.
Special care shall be used to clean all pits and roughened areas. In
places where blisters or rust ::as oc (-ur.°r.ed; the steel shall be cleaned
until it is bright, either by wire brushes and scrapers or by the.use of
hand or power sanders. All foreign material, rust and loose paint shall
be removed, and any old paint which has been allowed to remain shall have
a clean surface and be tight to the steel.
Sandblast cleaning shall.be done according to A.W.W.A. Specifications,
Paint shall not be applied when the temperature is below 400 F. The
surface shall be free of frost or dampness when paint is applied. No
paint shall be applied unless good weather prevails, nor shall such appli-
cations be started if inclement weather threatens.
All paint shall be evenly spread and thoroughly brushed out. The
highest standards of workmanship shall prevail, In all instances, the
.application of paint shall be satisfactory to the engineer -in- charge or
to the inspector delegated by him. Particular attention shall be given
to rivet heads, edges, welds, etc.
WORKMANSHIP
The paint shall be of the proper consistency for a brush application.
Thinner shall not be added under normal conditions. In the cooler weather
it may be necessary to thin the paint. If so, nct more than one pint per
gallon shall be added, For a spray application, thinner may be repaired
for the paint to pass through the spray equipment. Only enough thinner
shall be added to permit the paint to pass through the spray equipment.
In no case shall it exceed one pint of thinner„ "Mineral Spirits" is the
suggested thinner, when required.

REPAIRS
It shall be.the duty and responsibility of the contractor to
aotify'the owner of any loose rivets, 'open seams, etc. .before the
application of paint so that the owner can make the necessary repairs
with his own employees, or to authorize the contractor in. writing to
proceed with this work at a total price agreed upon in writing;
SANITARY REQUIREMNTS
The contractor and all workmen employed by him shall conduct all
operations in a clean and'sanitary manner. No nuisance shall be
committed; the workmen shall either use proper waste receptacles or
leave the tank whenever necessity arises.
INSPECTION
The owner shall inspect the painting as it is being done. Payment
for painting done shall be made only after the owner has satisfied him-
self directly that the painting is satisfactory and in accordance with
the requirements of the contract.
It is in the mutual interest of the owner and the contractor that
such inspection be made promptly.
PAINT
Paint shall be delivered to the job site in factory - sealed containers,
with the manufacturer's labels affixed to the containers showing the
manufacturer's name, brand, color, identification.number, etc.
The paints used shall be recognized as being suitable for the
protection ofwater storage equipment. The contractor shall furnish
the owner with list of 5 water tanks painted with the paints the con-
tractor proposes to use, from which not less than 6 years' protection
was secured on water tanks.
If the paint used has a graphite pigment, which is preferred, only
the use of natural flake silica graphite will be permitted.
EXTERIOR
Prime Coat - No. 101 Dixon Red Lead Graphite Primer or equal.
Intermediate
Coat - No. 111 Dixon Aluminum_ Graphite Paint or equal.
Finish Ooat- No. 109 Dixon Aluminium Graphite Paint or equal.
FROST BOX
First Coat - No. 111 Dixon Aluminum Graphite Paint or equal.

SPECIFICATIONS
DEFINITIONS

of the 75,000 gallon steel water storage tank, tower and frost box located

Bidders must secure their information as to the condition of the tank
and all local conditions affecting the work prior to submitting their
proposal.
Work must be begun promptly after the award of the contract and within
such time as stated by the successful bidder, and be completed by the time
named by said bidder.
Bidders are notified that the price bid must include everything as
described in the specifications. No extras of any kind will be allowed
unless ordered in writing by the Village Engineer.
The bidder must satisfy the Company of his practical and financial
ability to perform the work bid upon. The bidders must attach to his
proposal the names of the owners of three structures, of the same type,
for which the bidder has successfully completed work of the nature
outlined in the attached specifications, within the last 12 months.
Payment for this work will be made in cash, and in accordance with

Gentlemen:
Having inspected your water storage tank, tower and frost box
located at Vilest 50th. Street and Woodale Avenue and studied the
specifications covering the cleaning and painting of this structure.
Our alternate proposal enclosed on proper form furnished with
specifications in accordance with general conditions, contract
and specifications.
We will sandblast the entire structure as follows. All surfaces
where loose paint and rust prevail will be sandblasted down to bare
metal and all other surfaces will be sandblasted lightly to etch
the surface assuring the best possible bond for paint. The supe-
riority of a sandblasted surface is a recognised fact both by Govern-
ment and private business. Sandblasting can reach into crevices and
seams and around rivet heads, where other types of cleaning tools fail.
Painting will be done as per specifications using Rustoleum Rust
Preventive Coating. We propose to paint the entire structure exclud-
ing the frost box with #769 Rustoleum rust preventive damp - proof,
primer by brushing. Over which we will apply one intermediate and
one finish coat of #470 Rustoleum high lustre aluminum by spray method.
On the frost box will be applied one coat of #2764 Rustoleum Eggshell
White cut with 15% #540 thinning oil for deep penetration by brushing,
over which we will apply one coat of #470 aluminum.by spray method.
On completion of this work we will furnish a five (5) year guarantee
covering'workmanship and materials used.
Under conditions of specifications we are submitting the following
list of owners of similar structures on which we have completed this
type of work in the last twelve (12) months.
