6800 Brook Drive Edina, Minnesota November 4, 1959 -1. I Mr. Hyde City Manager Edina, Minnesota Dear Mr. Hyde: I would like to call two problems that I have to your attention and for your consideration as to possible solutions. I live at 6800 Brook Drive. I moved in in August; 1959. During the time of construction and to the present time, the city has been valiantly trying to maintain Brook Drive by adding fill and grading. At the present time the road.is in good condition except for the amount of clay and mud present when it rains. - During the fall, hardly a day goes by that my children can walk -to the Cahill School without being ankle deep in mud. It necessitated my having mud tires on my automobile in order to navigate in and out. I have requested from the Street.Department, by petition, oiling which was turned down as they felt the road had to settle. I then proceeded to see if I could obtain some gravel.so that the road could be maintained and was referred -to you•for possible solution. I am sure you understand that if the road could be graveled it would mean much easier maintenance during the winter months for plowing and also would make it passible in the spring, which I am positive it will not be in its present condition. Graveling would also eliminate the possibilities of washouts, which have been frequent with every rain and thus -cut your maintenance costs. My other problem is that this spring you extended,68th Street east of Limerick Lane. During the - rains - -of_ summer and fall, it has proceeded to wash this road out and down into-Nine Mile Creek. This -creek used _ to form the west boundary of my lawn. The washout material has completely filled a'large pool that was in the creek and has rerouted the creek over my property plus backing the, creek up and flooding along the north side'of my property. I don't know what the possible solution is to this, except that I believe the creek should be routed back to its natural path and possibly something could be done to prevent additional washing of 68th Street. I would appreciate it if you could give these matters your consideration and inform me as to .what action you could take to correct.them. Sincer ly o s B.C.. Cof- December 2, 1959 INFORP:1ATION TO: Mr. Warren C. Hyde Edina Village Manager ON: Leslee Lane Gravelling After the council meeting of November 9, 1959, the field engineer, Mr. Jonas, had the surveying crew check the elevation of the existing street to determine the amount of material needed to bring this road to grade. After the draftsman had the quantities figured, Mr. Jonas, contacted Walt Terry Excavating-Co. to see if they could do this job and also Blacktop Service, but neither was producing the type of material needed since they had slut down their plants for the winter. I got in touch with Mr. Sonny Danens, and he told me that they were working on some large project, but that he would possibly work it in late some evenings during the week of December 1, 1959. (Mr. Danens agreed that it would be impossible to finish it this year because of the cold weather, but that possibly 200 cubic yards of the 300 cubic yards could be done now and the remainder next spring.) Mr. Frank Cardarelle came in on Friday, November 27, 1959, and said that they had no notification of the Council action and that they were planning to finish it up. He contacted Les Anderson and told him that the Village was going to proceed unless he got in right away. Mr. Anderson came in to talk to me and he said that Cardarelle has said it was finished previous- ly. He said he should have a chance to finish since he had heard nothing further that it was not finished. I told him that he had until Wednesday to get most of it in, and that it would have to be completed immediately in the spring. While I was at the meeting you called on the Katter - Erickson plats utility financing at 3:00 P.M., December 1, 1959, Mr. Fred Jonas took a message from Mr. Les Anderson that he would be in working on Wednesday, December 2, 1959. I spoke to Mr. Howard Lindow on the progress of the project and the fact that Les Anderson would be doing some of the gravelling, but due to weather (frost) it, would be impossible to finish this project until next spring. On Wednesday morning Mr. Fred Jonas and I checked the work being done on Leslee Lane and informed Mr. Anderson that his contractor should check the specifications as the material being placed would meet the sub -base specification but not the regular base specification. osep ikan illage Engineer JZ:rh i Deceir 3, 1959 Too JOSEPH Z1 9M RE: GRAVELI G OF LESLIE LANS About two weeks ago, after i had received calls from Ur. Faward Lindow, who has purchased a new home an Leslie Lane, concerning the fact that the street had never been properly graveled up to specifications, we decided that the approximately $700-which Les Anderson had deposited here in lieu of a bond would be used and that you would have a.contractor come in and do the work. At that time we discussed-the fact that the street cry was unable to do it, and you advised me that the cost of the job should be around $700. 11r. Landow was so advised. \ Yesterday I got another call from itr. Lindor4, in which he advised me that in a conversation with you an December 1 you advised bias that Mr. Anderson had been in and had given you a hard luck story and that he promised to do the work himself by Wednesday, December 2. Apparently you had acceded to.Nr. Anderson and without consultingme had cancelled the idea.of having s contractor do the work. Once a decision has been reached on matters of this kind I expect you to carry out -the-decision. If circumstances absolutely warrant'a change, 1 expect you to advise me as to why. It is certainly -embarrassing for me 'not to know what you are doing, particular- ly when you change your mind, as you do frequently after is decision hie been made. Were any bids taken from contractors, wearre, any contractors contacted.on the matter? .In his telephone - conversation of yesterday Mr. Liudow advised me that there is some.work being done. What are yaxu doing to cheek the gravel to see that it is up to specifications and to see that the job'is done properly? This is another example of a lack of follow -up inasmuch as the job should have been done quite ewhile.ego, and of a; lack of good.administration on your part. - t3CA RE: DANDY'S DRIVE -IN T0: MR. HYDE Mr. James.Streit called yesterday. He says he has called the street crew several times, asking that they clean up the two exits to Dandy's. He says the sand and gravel washes.down these•inclmnes. and that the cars "squeal their tires" when leaving the place. He asked that this be brought to your personal attention, stating he felt sure that "you would understand "! Crew has done nothing to date, he said. In rosponse. to your teleph"e,;requqqt of yesterday g, I _pm. enclosing a sketch off -the, property' in the vicinity, of Chriht, :Dresbyteriam Church's Mich shows the situation with, regard to the statuz of rest 6.9th;Street from Brittany to "q;mandale. You will note that from' Brittany;Road.west.to the west line of the Brost Additibn, and;off' Wiley',s Addition, that 60 feet has been dedicated for street- purposes., From the east ,'line of the original Church property to the west line& 30 feet has beemdedlicated for road purposes. In other words,we have a full width street for about half the distance between Brittany and Normotrdale and a half width street the balance of the way. tie require 60 feet of right of.way before we.isaue building permits or allow a street to be openedn,,, Thia means that if 69th Street Is to be openedo an additional 30 feet would be necessary along the north edge of the original Church.- propertyp gnd:the Church would be expected to dedicate this 30 foot strip inasmuch as,the other 30 feet was dedicated from the property to the north. You will also note that.we have_e 25 foot dedication of a strip running fry 69th 'street north along the west side of the Brost.Addition. This was secured because of the -depth of the lots betvieen Noamandale and Brittany being of such dimension that it would be possible to have a new street run - ning north and south between Brittany and Normandaleo and it is possible that sometime in the future an additional 35 feet might be- secured from the property to the west of the Brost Addition, if the owners desire'to split their lots and have some facing the'new street and come Normandale. My ran personal hunch would be that for future planning, the Church should seriously consider dedicating the additional 30 feet to make 69th'street a full width road* I say this because there will be a grade separation be- tween nest 70th street and Normandale Road,,and I think you would find that having access directly to the north might result in a better traffic flog than if you depended entirely upon access to the service drive.and west 70th street* If you have any questions, or.if there is any other - information We can furnish, please -let us know. BODIEN CITY ENGINEER July 24, 1959 Mr. Warren Hyde Village Manager Edina Village Hall 4801 West 50th Street Minneapolis 24, Minnesota Dear Mr, Hyde :. During the current construction season the City of Minneapolis will pave Xerxes Avenue South between West 50th Street and West 54th Street under a cooperative agreement with the'County of Hennepin. The portion of Xerxes Avenue between West 54th Street and West 62nd Street is also badly in need of paving as you are well aware I am sure. Because this street is a County-State-Aid highway and - because this particular portion is also the boundary between Minneapolis and Edina, any paving project must of course require the agreement and participation of both municipalities and the County as well. We have discussed this matter with Mr. L. P. Pederson, Hennepin County Highway Engineer. He is of the opinion that it is not pos- sible during 1960 but.could probably be done in.1961.. Our purpose in writing to you is to ascertain your feeling as to when this proj- ect might be accomplished. We are most anxious to have this street paved and will do our best to tailor our program to fit your program and that of the County as well. We would appreciate hearing.from you regarding the timing of this project from the Edina standpoint. CAS /em cc: Bill Clark L. P. Pederson Very truly yours, Gordon E Bodien, Cit En eer By Cla n A. Sorenson Planner III November 9, 1959 TO THE HONORABLE MAYOR$ VILLAGE COUNCIL AND VILLAGE MANAGER RECOMMENDATION #1 - RE: PETITION CUT -OFF DATE OF NOVEMBER 23, 1959, FOR PETITIONS TO RECEIVE CONSIDERATION IN THE 1960 CONSTRUCTION SEASONO Because the Village to date has spent none of its construction funds for Municipal State Aid Streets, and there will be available in 1960 approxcimately $250,000.00 from gasoline tax moneys, I recommend that the cut -off date for petitions for work in 1960 be set for November 23, 1959e That every effort be made to utilize the gas tax money available before costs increase further, and before the legislature meets in 1961-at which time a re- apportionment will be made, and as has happened with the Federal program a reduction in the moneys available might mean that Edina would lose a portion now allocated to them. RECOMMENDATION #2 - RE: CONCRETE AND BLACKTOP CONTRACT EXTENSIONS OF TINE TO BE COMPLETED BY THE MIDDLE OF JUNE 19600 Because of the exceptional amount of rain during the months of August, September, and October 1959, the operations of the Blacktop Contractor and the Concrete Paving Contractor have been stopped in order to assure that good work would be donee Since weather has been beyond the control of the Contractors they have requested that extension of the completion dates be given* I recommend that these extensions of time be given with the following stipulationss A. That all work necessary to provide a surface on which .vehicles can travel safely and on which snow plows can remove the snow be provided temporarily, and that any additional costs in providing this material or in its removal be done at the Contractors expense* Bo That any construction work which has been installed or any work on the roads be protected by the Contractor, and any defects or faults which occur during the winter be repaired by the Contractor at his expense* Cal That all work be completed by June 15, 19609 and that the work completed to date is not considered for acceptance until all of the work has been completed, inspected, and approved* D* If a major fault occurs during the winter which requires extensive repairs to the road, it will be the Contractor's responsibility to provide the labor and materials to correct this situation until the permanent surfacing is completed at no cost to the Villagee r = E, The guarantee period of one year will commence from the date of final acceptance (sometime during 1960) on the entire project* RECOMNENDATION ##3 - RE: COMPLETION OF SHANNON DRIVE FROM THE SOUTH LINE OF PROSPECT HILLS SECOND ADDITION TO DEY -EY HILL ROAD. Over one.year ago Mr, and Mrs* Fjeldheim appeared before the Council and requested that they be permitted to hire their oven Engineer and Contractor to construct.Shannon Drive across their land, They agreed that this work would be done before school began in 1958, A portion of the road has been completed but because the Fjeldheims are suing each other for divorce% and the parties do not know what action the court will take in dividing the property$ neither Plc, Fjeldheim or Mrs. Fjeldheim' will spend the money on completing this project. I recommend that the Council authorize us to determine what work is necessary to complete this road and that the,Council set a hearing on their.own motion when the estimate of cost'is completed, The residents.in the area% the school buses, police, fire, and street departments all need this road because of the terrain and it is in the best interests of the Village that it be completed, - RESPECTFULLY SUBMITTED , VilX§o Engineer MRS. Subjects Patching Oiled Streets. f On Monday afternoon, August.39 Zikan and I called your attention over radio to the- patching on Tingdale on 64th and an 65th. A memo on this is attached. Today we observed that you are doing about the same thing on Griffit Street In the block.just north of Maloney, There is apparently a lack of understanding as to what are do on oiled streets. Attached is a copy of the petition for oil. Please note the conditions we lay down as to oiling. Effective immediately, there is to be no more patching of oiled streets except within one year of the last oiling. The.Enginsering department will furnish you, if you do not already have ones an up to date copy of a map showing oiled streets. I&en a block which is hied • requires patching, it is your responsibility'to notify the office and a form notice, (rough draft attached)# will be sent to the property on the block, advising there of the date when oiling was last done and that within a period of times perhaps two weeks we will scarify the street and that it will be necessary for them to re- petition for new oiling or for permanent blacktopping. I realize that you are trying to do a good job of keeping the streets smooths but at the same time, if we continue to keep oiled streets, which have paid no real assessment for street Improvementso in good shapes we are going to be faced with tremendous costs. - Incidentally, inspection of the work done-on Griffit indicated that the crew was doing a good job where they were hatching. but it was the same story as on Tingdale • patches were being put In some spots but not in others. Also$ on the west side of the streets there was a rather deep washout which should have been filled with -gravel before any patching efforts were shade. If you have any questions on.thiss please see me or'Zikan. Let's stop immediately piece-meal-patching of temporary oiled surfaces. Parkwood Road, west of Schaefer, which is an asphalt streets has needed patching for at least three weeks and I called it to your attention at least twice before today's radio.call. WCH 0 Oct Ralph Iselin Gretchen Alden Joe Man Jerry Dalen George Hite i ,. 8 -4 -59 To .Residents on Street between and -Your street was oiled in 19__._ as a result of a petition.. In accordance with State Statutes, the Village's assessment.proceduare on oiling can provide only a dust coating. At approximately 204 per front foot-cost as of this year, it is impossible. to provide a long lasting surface. At the present time there are many hol#Q In your street and it will be necessary for us to scarify the present oil coating within-the very near future. Unless we receive a petition from the majority of the property owners# requesting re- 611ings asphalt surfacing,.or concrete surfacing, it will be impossible for us to provide a dust free surface. May we suggest that you and the rest of your neighbors discuss the situation and have-two or three act as your spokesmen and Contact your Village offices for estimated costs.and procedures in .securing permanent-or another temporary solution to the problem. In the 16% of your general property taxes which the Village raises, there .19 no money provided for patching and re- oiling of oiled streets. A re- oiling will cost about 200 per assessable front fo6t, a medium asphalt surfac- ing will cost about $3.50 per foot and conerste.would.cost about 3540 per foot. These estimates are based on average costs and your particular area might be more or less, depending upon base.conditions. Oiling is payable with your general taxes. the year after the work -is d) e, asphalt is payable over a 5 year period unless curb and gutter is put in at the pame time, in which case the total assessment is spread .over 10 years. Concrete pav! g costs are spread over 15 years. Your interest in this prolem is appreciated and we will be happy to work with ! you toward a solution. June 27, 1958 TO ALL PETITIONERS FOR L1.66TH STREET OROSStUOLKo Thank you for your ;petition, Aich was prasentcd and considered at the Village Council Meeting of June 230 The Council has previously discussed the matter of pedestrian traffic on W.66th Street, and has also considered the possibility of constructing the walk for which you ask. However, bocause of the expense involved (between $69400 and $10,000). it is felt that some ihforration on pedestrian travel pattern shOuld be secured before definite places are.made for 66th Street. We will install "Careful-Pedestrian' along the street in the near future, to make motorists aware of pedestrian traffic; and our Police Department has been asked to check pedestrian traffi' at frequent intervals, especially at such times as children will be using the pool, to ascertain just how much root traffic the street a6tually takes and to make certain the speed limit is strictly enforced. ! if it is found that pedestrian use does warrantla walkway, further consideration will be given to ;onstauction for nextisUmmer °s use. in the meantime we ask those of you who have c4il::r &n walking or riding bicycles along W -66th Street to instruct them.to be careful at all times to obey safety rules; to hug the side of the road, walk against traffic, ride bicycles with traffic; to ride single - ile, and not to "buck others on their bicycles. Has Adam been given instructions on "Careful-Pedestrians" Signs. 2. Should this go into the "Budget" file for consideration? GSA Mr. Arthur M. Swift# 4816 Dunberry Lane# Edina 249 Minnesota. Dear Mr. Swift o ,41_14, VILLAGE OF EDINA 4801 West 50th Street Edina 24, Minnesota . June 309 1959 Your comments of June 26th concerning the conditions on Brittany Road and Dunberry Lane are most welcomes inasmuch as they are the first tangible. expression of interest vie have received from your immediate neighborhood as to the need for - additional im- provements. We are well aware of the situation and I trust you will-beer with me while I explain the improvement procedure in Villages in Minnesota. You state that "I have talked to the neighbors around there who have constantly tried to get action and find they have been very unsuccessful." This vie do not quite understand, inasmuch es.we have no petitions whatsoever for curb and gutters for blacktoppings or for storm drainage from your immediate vicinity. Neither has the engineering department any recollection as to requests for petitions for secur- ing improvements. You further state that you think that the city government should be "more interested in providing adequate services" and that it seems peculiar to you that the residents have to go out and do all the viork to get the city fathers to take any aggressive action. I tend to agree with your thinking but unfortunately9 in a rapidly groutingg develop- ing area such as Edina# where we are operating with a limited number of personnels where the volume of petitioned requests for improvements has been exceedingly great# and where special assessments are costly# it is difficult for us to initiate the necessary action and force through to a completion public improvement projects where there is very little indication of neighborhood desire for the improvements. The basic problems of courses in your particular situation is the storm drainage. Your Village government has been attempting for some three years now to got a per- manent solution to the drainage problems of'the entire southeast area and vie have brought the matter to formal public hearings on two separate occasions. Two differ- ent bases of assessment of the costs were presented and both of them were vociferous- ly and overwhelmingly opposed and rejected by the great majority of the property owners who attended the hearing. The storm drainage from your particular corner must be taken care of by a storm levier running between lot lines a few lots east of the corner of Dunberry and Brittany* straight south to 70th street and then west across Highway 100 to Nine Mile Creek. This.is the major improvement necessary. We have now scheduled a hearing on the storm drainage problems of the land north# east and south of your particular area for August 3rd. Previously we had combined your area storm sewer problems with this larger# so- called Lake Cornelia# drainage basin. This times however, roe have decided that it would be best to separate the two projects and we will schedule a hearing on the storm sewer to serve your area soon after the larger area is settled. <'1e eaYJift -2 5-3p-59 .Because of-the grade of Brittany Road, concrete curb and gutter is an absolute necessity, as well as an asphalt -or blacktop surfacing. I air, therefore,.enclosing petition forms for these two improvements, which we would appreciate your having your.neighbors on / Brittany and Dunberry sign. After they are signed, preferably by a majority of the owners, if you will return them-to us, we will schedule them for-an estimate as.io cost and for a public hearing, which is required by statute. You and all of your affected neighbors will be notified as to the date of the public hearings -at which time you may express your opinions to the Village Council. Actually, petitions re- ceived now would normally not be- engineered and estimated until this winter for con - .s15truction during 19600 Rowever, because of the urgency of your situation,-Wo will attempt to getthe work done this year. Soon after I came to Edina, just a little over four•years ago, I was amazed.at the..' procedures for getting improvements done, just as you are.. l was also concerned about the Village policy of financing through special assessments of benefited property all of the. improvements required in new subdivisions. After about two years of work on the problem, the•Council decided to have the subdividers finance their own improvements, so the last year and a half all now subdivisions were under that arrangement. Recently,: however, at the insistence of a few subdividers and builders, we have modified the policy slightly to where we are now back In-the special assessment business, on a Somewhat more limited basis than we previously were, as.for as the amount of financing,. Is-concerned., The Woodhill subdivision was approved at one of-the first first meetings I atteWed here, and it was the -one which brought the financing and scheduling problems into the limelight. Mile it is true that if the Village were to force through more improvements, we would have better physical condition®, I am not so sure that we would be operating in -as democratic.a manner as most of our citizens want us to operate.. I am sure you agree that democracy depends primarily upon the efforts of the.individual citizen. Here in Edina, we have a very intelligent vocal citizenry.who want to decide their own local yes, even block, problems for themselves. Sometimes, however, it is necessary for the Council to .force through projects which do not meet public acceptance because of their coat* In the meantime, I have asked the Public Works department to do everything they can to clean up the results of the last washout and to take whatever-temporary, Inexpensive steps can be taken to make your situation somewhat more livable until we can get the' necessary permanent- improvements done., Very little of the 16% of your general property • .taxes for which the Village to responsible is budgeted for maintenance of.unimprove_d. streets or storm drainage.. We will do the best -we can under the circumstances. Many persons proposed to be assessed by some of the mahy Village initiated projects. for storm sewers, trunk sanitary sewers, or trunk dater mains, have rather pointedly insisted we were far left of center for daring to propose needed improvements on a logical schedule,.-rather than being on midcenter, as you allege.. One of our crying. •needs, In common with all tho.suburbs, is better and more available channels of communication. Ore receive relatively little attention from thca metropolitan press, radio and television except for live, spot news. Our local weekly is understaffed and consequently it is difficult for -us.to get'our basic, behind- the - scenes, stories across to the public. -In view of your position, and in view of the fact that I know of no effort by any radio-or television station to do anything.of a continuing nature on. this, how would you like to sit down.with me-and two or three other-suburban managers fora brainstorming session'as to t7hat sort of a program could.be developed? This, of courses ties its with the Highway 100 improvement proposalp so far as getting right of way from the club. e probably should- drop any thought of_.getting this widened_ and resurfaced this.year. Brookview Heights -116 should do everything possible to have bids and hearing on concrete and blacktop..at July 13 meeting of Council. If this is not possibles then vie should have it at a special meeting on July 20.E Proppect Hills - The 7 year old blacktop in Prospect Hills is very bad in several stretches. When the reservoir is completed in August, the 70th from Antrim to Dublin, Dublin from 70th to south of the reservoir should be resurfaced as -part of the watermain and reservoir jobs.. Also, the stretch on Antrim from 70th to Dublin is breaking .up badly, and there are several pieces in the valley which need considerable attention. This is an example, I think9 of where blacktop was put in on good gravel but without real base preparation. As you, know, the Village Street Crew is kept more than busy plawing and sanding streets; and, because of the tight labor market it is almost impossible for us to hire temporary crews for snow shoveling work. For these reasons, we urge you to make arrangements to have your snow shoveled. We feel that the expense involved in having the Village crew - -who are working at union wages --do this work would be considerably more than a high school boy or snow shoveling service would charge. Because of the amount of pedestrian traffic along West 50th Street a clear and unobstructed sidewalk is an absolute necessity; and wo must ask that you comply with our ordinance.
