RESOLUTION VACATING A PORTION OF
WEST 49TH STREET
WHEREAS, two weeks' published, posted and mailed notice of a hearing
to be held on May 7, 1973, at 7:.00 p.m. on the proposed street vacation
hereinafter described has been given and made and a hearing has been
held thereon by the Village Council:
NOW, THEREFORE, BE'IT RESOLVED by the Village Council of the Village of
Edina, County of Hennepin, Minnesota, that the following described
portion of West 49th Street, all as platGed and of record in the office
of the Register of Deeds in and for Hennepin County, Minnesota, be and
is hereby vacated:
That portion of W. 49th Street as platted in Tingdale Bros,
Brookside, lying West of Lot 17, Block 6, Sunnyslope Section
Country Club District and East of a line lying 40' West of
and parallel to the West line of Lot 17, Block 6, Sunnyslope
Section Country Club.

J. R. RITCHAY, being duly sworn, on oath says he is and during all times here stated has
been the vice president and printer of the newspaper know as The Edina Sun and has full
knowledge of the facts herein stated as follows: (1) Said newspaper has 50% of its news columns
devoted to news of local interest to the community which it purports to serve and does not
wholly duplicate any other publication and is not made up entirely of patents, plate matter and
advertisements. (4) Said newspaper is circulated in and near the municipality which it purports
to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of
at least 75% of its total circulation currently paid or no more than three months in arrears
and has entry as second-class matter in its local post-office. (5) Said newspaper purports to
serve the City of Edina in the County of Hennepin and it has its known office of issue in the
City of Bloomington in said county, established and open during its regular business hours €or
the gathering of news, sale of advertisements and sale of subscriptions and maintained by the
managing officer or persons in its employ and subject to his direction and control during all
such regular business hours and devoted exclusively during such regular business hours to the
business of the newspaper and business related thereto. (6) Said newspaper 61es a copy of each
issue immediately with the State Historical Society. (7) Said newspaper has complied With all the
foregoing conditions for at least two years preceding the day or dates of publication mentioned
below. (8) Said newsppper has filed with the Secretary of State of Minnesota prior to January 1,
1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State
and signed by the publisher of said newspaper and sworn to before a notary public stating
that the newspaper is a legal newspaper.

I am writing at this timt9 1 request the vacation of the Easterly portion
of West 49th Street, vest,bP Highway 100 and abutting Lot 17, Block 6,
Sunnyslope Section, Cotdry Club District, according to the Plat thereof
on file and of record in the Office of the Register of Deeds in and for
Hennepin County, Minnesota.
The road is no longer accessible to any party and is surrounded on the
North, and the East and on the South by property owned by myself. I am
enclosing herein two maps showing the property in question. I have
cross-hatched the property to be vacated in blue and indicated the
property owned by myself in red.
Some time ago, I spoke with George Hite, Village Planner, and was
informed that such a vacation would be acceptable to the Village of Edina.
However, at that time, Mr. Hite suggested that I delay my request for
vacation until I had secured title to the property immediately North of
the property to be vacated. Since that time, I have'acquired the title
to said property and would like to proceed with the vacation.
I hope that this letter along with the accompanying maps are sufficient
to initiate the vacation procedure and adequately explain my position.
If additional information is desired, I will be more than happy to assist.
