Dear Bob:
On December 22, 1969, the Village was served with a copy
of the Summons and Complaint in the above-captioned matter.
enclose herewith a copy of the Summons and Complaint, the answer to
which is due on or before January 12, 1970. The reason the Village
has been named as a defendant even though the road involved is a
county one is that the road reverts to the Village if the County
disclaims it as a county road.
Road, also known as Richfield and Bloomington Road, was never opened
and further that the plat showing the Blooming Road was never filed
with the auditor's office,
apparently runs across the land now owned by Metro U.S. Construction
Corporation. I am enclosing photocopies of the Journal of the Board
of County Commissioners as it relates to this road, together with
certain field notes and a survey which purports to show Blooming
Road as it crosses the now Metro U.S. property. Could you please
look into this matter and see if the Village has any interest in
asserting the existence of the county road. If the Village does not
have any such interest, then I recommend that we let the matter go
by default as that would be the simplest way of clearing title.
