MANAGERS CONFERENCE ROOM MEMBERS PRESENT: Chair Helen McClelland, Gordon Johnson, David Byron MEMBERS ABSENT: Don Patton, Mike Lewis, Geof Workinger I. APPROVAL OF THE MINUTES: Mr. Byron moved approval of the December 16, 1994, meeting minutes. Mrs. McClelland seconded the motion. All voted aye; motion carried. II. NEW BUSINESS• B-94-2 John Trelstad/Nola Johnson 4530 Arden Avenue Lot 15, Block 3, Country Club District Fairway Section Zoning: R-1, Single Dwelling Unit District Request: A 1.5 foot sideyard setback variance for building height Ms. Aaker informed the Board the subject property is located in the northwest quadrant of the intersection of Arden Avenue and Bridge Street within the historic country club district. The property is developed with a two story American Colonial Revival style home built in 1940. The house faces Arden Avenue with an attached three car garage facing Bridge Street. Ms. Aaker explained the homeowners are proposing to add onto their kitchen by "filling in the gap" between the subject home and the attached garage. The plan also includes a master bedroom addition above the new kitchen and over a portion of the existing garage. The current interior side yard setback is 5 feet which is the minimum allowed for lot widths less than 75 feet. The height of the second floor addition will match the existing height of the home of 18 feet. Building height greater than 15 feet requires additional sideyard setback. City ordinance requires that 6 inches be added to this setback for each one foot building height exceeds 15 feet. A 1.5 foot variance is required for the 18 foot building height. Ms. Aaker concluded staff acknowledges that given the existing conditions occurring on the site, design options are limited. Staff supports the request as submitted. The proponent, Ms. Johnson was present. Mr. Johnson asked what is under the master bedroom suite. Ms. Aaker said garage. She pointed out they are proposing to fill in the "empty" area to the garage with a kitchen expansion, and the proposed master bedroom suite will be above the garage. Mr. Johnson asked if materials used will match the existing structure. Ms. Johnson stated materials will match. Mrs. McClelland asked if the proponents will retain the same roof line. Ms. Aaker said the roof line will remain as is. Mr. Johnson moved approval of the 1.5 foot sideyard setback variance subject to matching materials. Mr. Byron seconded the motion. All voted aye; motion carried. B-94-4 Charles and Liberta Ledder 6709 Cheyenne Trail Lot 6, lying south of a corner to a point on the from the northeast corner Indian Hills line from the northwest east line 55 feet south thereof all in Block 3, Request: a 4 foot sideyard setback variance Ms. Aaker informed the Board the subject property is located on the east side of Cheyenne Trail, south of Blackfoot Pass and north of Valley View Road. The property is a little over one half an acre and consists of a front walkout home built in 1945. Ms. Aaker explained the homeowners are in the process of remodeling their home to include an expanded family room, dinette and piano nook with the addition of a new master bedroom above. The project also includes a remodeled kitchen and the addition of a formal dining room off of the south side of the home with a bedroom below. The homeowners discovered upon building permit application that the dining- room/bedroom addition does not conform to the ordinance setback requirements and therefore requires a variance. Ms. Aaker concluded given the limitations with regard to the site it would appear that a variance can be supported. The proponent, Mrs. Ledder was present. Mr. Johnson questioned if the addition was constructed flush with the corner of the home would the addition still encroach into the setback. Ms. Aaker said the addition would still encroach, but the variance would be reduced. Mrs. McClelland asked Ms. Aaker if the bay windows encroach. Ms. Aaker said if bay windows have footings they count when calculating setback. If bay windows do not have footings, and are cantilevered they are not calculated for setback purposes if they encroach less than three feet into the setback. Mrs. McClelland asked Mrs. Ledder if any attempt was made to purchase property from the neighbors to the immediate south. Mrs. Ledder pointed out the site is heavily wooded, and they did not consider contacting the neighbors regarding purchasing property. Mrs. McClelland commented that she cannot find a hardship to support the request. Mr. Johnson pointed out the house when constructed was not centered on the lot, and that could be regarded as a hardship. Mrs. McClelland agreed, adding the terrain creates a hardship in this instance. Mr. Byron pointed out the impact to the adjoining property owner is minimal. The site is heavily wooded, and the addition may not even been seen from the street during the summer months. Mr. Byron moved approval subject to the use of matching materials to the existing dwelling, noting the garage and house are mis-centered on the site, the site contains steep terrain, and because of the terrain a southerly addition is required, concluding any impact will be minimal because of dense vegetation. Mr. Johnson seconded the motion. All voted aye; motion carried. III. ADJOURNMENT• The meeting was adjourned at 6:05 p.m.
