EDINA CITY HALL MANAGER'S CONFERENCE ROOM MEMBERS PRESENT: Chair, D. Runyan, C. Ingwalson, A. Swenson MEMBERS ABSENT: Rose Mary Utne, Len Olson STAFF PRESENT: Kris Aaker, Jackie Hoogenakker I. NEW BUSINESS• B-94-6 Larry and Barb Demos 4200 Lynn Avenue South Lots 1 & 2, except the west 10 feet of said Lot 2, Wooddale Heights 2nd Addition, together with the southerly 5 feet of Learry Street Request: A 10 foot frontyard setback variance to extend an existing porch Ms. Aaker presented her staff report noting the subject property is located in the southwest quadrant of 42nd Street and Lynn Avenue. The homeowners are in the process of remodeling their two story home. The home was constructed in 1947 and has had no improvements as listed in our building permit data with the exception of enclosing a porch in 1978. As part of their remodeling process the proponents are hoping to replace and expand an existing front entry porch facing Lynn Avenue. Ms. Aaker concluded the Board has always been protective of maintaining a consistent streetscape. The very purpose of the ordinance is to promote a harmonious frontyard setback standard. Given that a porch is already existing and given the limitations existing with a corner lot staff is of the opinion that the porch will not compromise the intent of the ordinance. Ms. Aaker added any approval should be subject to the following conditions: 1. Any approval is tied to the plans submitted. 2. The porch remain unenclosed. 3. Consistent materials are used throughout the addition. Mr. Demos, proponent was present. Mr. Ingwalson requested a clarification regarding the frontyard setback request. Ms. Aaker explained because the house is on a corner lot it must maintain two frontyard setbacks, that is the reason the variance appears so extreme. Mr. Demos told the board he is only improving what is existing. Mr. Demos stated he believes the proposal enhances the property. Mr. Runyan agreed with comments from Mr. Demos. Mrs. Swenson moved variance approval subject to the condition that the porch remain unenclosed, subject to plans presented, and use of consistent materials. Mr. Ingwalson seconded the motion. All voted aye; motion carried. B-94-7 Nell Bean 6301 Maloney Avenue East 50 feet of the north 300 feet of Block 22, Mendelssohn and the west 20 feet of Lot 2, Rearrangement of Block 23, Mendelssohn, Hennepin County Ms. Aaker presented her staff report noting the subject property is located on the south side of Maloney Avenue just east of Blake Road. The home consists of a small one and one half story home with a detached one stall garage. The assessing card has no date listed for when the home was constructed, and the only improvement listed is a detached garage built in 1954. A previous homeowner believed the home was built around 1898. Mr. Aaker explained the proponents are hoping to add to the second story of the home. Edina city code indicates that the minimum sideyard setback for lot widths less than 75 feet is five feet. In addition, six inches for each one foot average the building height exceeds fifteen feet must be added to the required sideyard setback. The proponents had a survey done of the property on February 14, 1994. The survey indicates that the home is located between 2.9-3.3 feet away from the west property boundary. The existing home is non -conforming in terms of sideyard setback encroaching 2.1 feet into the required five feet sideyard minimum. The increase in proposed building height requires an additional 2.5 feet be required for sideyard setback. Ms. Aaker concluded staff sympathizes with the applicant given the existing conditions present on the site, the structure's condition and given that few options are available to remodel the second story. It is difficult however to support an increase in living area at a setback of less than three feet to the side lot line. Ms. Bean, proponent was present. Interested neighbors were present. Ms. Bean explained the house is very old and has settled. She added she is trying to improve the house and noted it is difficult since the house at present is non -conforming. Mrs. Cunningham, 6305 Maloney, told Board Members she has a concern with water run-off. Mr. Runyan, explained any water run-off as a result of this proposal must be directed away from your property (6305 Maloney) and contained on site (6301 Maloney). Mrs. Cunningham said she also has a concern with construction debris, adding she wants assurance that no debris is thrown onto her property. She explained she has a number of plantings along the property line, and reiterated she does not want any debris falling on them. Ms. Bean explained construction materials, and debris would be kept to the east, away from her property. Mr. Runyan asked Ms. Bean to take extra care during construction because the subject home is so close to the property line. Mr. Ingwalson asked Mrs. Cunningham if water run-off is controlled, and construction materials and debris are kept off her property, does she have a problem with what Ms. Bean is proposing. Mrs. Cunningham said she has no problem, the house needs to be fixed up, adding she really can't see the subject house from inside her house. Mrs. Cunningham reiterated her concerns. Mr. Runyan said this is a difficult situation. We cannot ask the property owner to move the house to a conforming location. He pointed out the house on the property most impacted by this proposal is off -set, and spacing between the houses is reasonable. Mr. Runyan said in his opinion this is a hardship situation. Mr. F. Thomas, 505 John Street, said his property abuts the subject property to the rear, adding he has a concern with water run-off. Mr. Runyan explained the subject house will have gutters, and water run-off should not be an issue for your property. Mr. Runyan pointed out the Thomas property is quite far from the subject house. Mrs. Swenson asked Ms. Bean what materials will be used for the house siding. Ms. Bean responded the siding will be a vinyl narrow skirt board. Mrs. Swenson asked Ms. Bean if the bathroom will be re- finished. Ms. Bean said the bathroom is being refinished. Mr. Runyan asked if the trees will remain. Ms. Bean said all trees will remain, but the large spruce tree will be trimmed. Mr. Ingwalson moved approval of the variance subject to staff conditions, and additional conditions that the overhang remain at 1 foot, drainage be contained on site, construction debris cleaned up, and all materials match.
