MANAGER'S CONFERENCE ROOM MEMBERS PRESENT: Chair, Rose Mary Utne, Ann Swenson, Len Olson, Nan Faust, Meg Mannix STAFF PRESENT: Kris Aaker, Jackie Onischuk I. APPROVAL OF THE MINUTES: The minutes from the April 4, 1996, meeting were filed as submitted. II. NEW BUSINESS: B-96-22 John B and Pamela A Gustafson 6924 Dawson Lane Lot 7, Block 6, Southdale Ist Addition Request: A 4.09 foot sideyard setback variance for a deck Ms. Aaker informed the Board the subject property is located on the west side of Dawson Lane, just north of West 70th Street. The home is a rambler with a detached two car garage. The homeowners are hoping to add a deck to the north side of their home. Ms. Aaker concluded generally, the Zoning Board has not allowed any structure closer than three feet to the sideyard. Staff is supportive of the reasoning behind that policy, and therefore can only recommend a two foot variance maximum. The proponents, Mr. and Mrs. Gustafson were present. Mrs. Swenson said in her experience the Board is uncomfortable granting variances that allow a structure to be constructed two feet from a common lot line. Ms. Swenson said she can support the variance request if the deck remains three feet from Board of Appeals Minutes/June 6. 1996 the common lot line. Mr. Olson agreed, he pointed out if one builds closer than three feet to a property line trespass can become an issue during routine maintenance of the deck, or mowing the grass. Mr. Olson moved to grant a 3.09 foot sideyard setback variance. Mrs. Faust seconded the motion. All voted aye; motion carried. B-96-23 Wendy Donovan 317 John Street Lot 5, Block 6, Mendelssohn Addition Request: An 18 foot sidestreet setback variance Ms. Aaker told the Board the subject property is located on the north east quadrant of John Street and Belmore Lane. The property consists of a 1 '/ story home facing John Street and a detached two car garage facing Belmore Lane. The current sidewall of the home parallel to Belmore Lane is setback 20 feet from the lot line. The homeowners are hoping to construct a 28'X 40' addition to the back of their home. Ms. Aaker concluded given the hardship caused by the depth of the required sidestreet setback and given the adequate spacing provided between the addition and neighboring property, staff supports the request as submitted. The proponent, Ms. Donovan was present to respond to questions. Mrs. Mannix questioned if the exterior will be finished with the same materials. Ms. Donovan responded that materials will match the existing structure. Mrs. Swenson moved approval of an 18 foot sidestreet setback variance. Mr. Olson seconded the motion. All voted aye; motion carried. B-96-24 Robert and Elle Lucas 4500 Edina Boulevard Lot 18, Block 6, Country Club District Browndale Section 2 Board of Appeals Minutes/June 6. 1996 Request: A two foot rearyard setback variance Ms. Aaker informed the Board the subject property is located on the west side of Edina Boulevard just south of Sunnyside Road. The home is a Mediterranean style two story home with an attached two car garage. The homeowners have planned an extensive remodeling of the home to include a number of additions. Ms. Aaker concluded given the hardships associated with a pie -shaped lot and given the minimal encroachment proposed, staff supports the request. The proponents, Mr. and Mrs. Lucas were present. Mrs. Swenson moved variance approval subject to the plans presented, and the use of like materials. Mrs. Swenson also asked the proponents to note the City has an Ordinance regarding recreational vehicles, and where they can legally be stored. Mrs. Swenson suggested to the proponents that they obtain a copy of the Ordinance pertaining to recreational vehicles. Mrs. Mannix seconded the motion. All voted aye; motion carried. B-96-25 Elwood McVeety 5616 Kellogg Avenue Lot 4, Block 2, & West 32' of Lot 3 Request: A five foot frontyard setback variance for a front stoop Ms. Aaker informed the Board the subject property is located on the southside of Kellogg Place just south of West 56th Street. The property consists of a one and one-half story cape cod style home. The property owner is hoping to add a front overhang with posts as part of rebuilding their front stoop. The Zoning Ordinance requires that an overhang with posts or pillars be included in the frontyard requirements. Ms. Aaker explained the property owner has indicated that safety concerns are a priority. An uncovered stoop has a tendency to allow ice to build up creating a potentially dangerous situation. In addition, the applicant has indicated that there are no railings currently on the steps. 3 Board of Appeals Minutes/June 6. 1996 Ms. Aaker concluded given the limited impact of the request on neighboring properties, staff supports the variance. The proponent, Mr. McVeety was present to respond to questions. Mr. Olson commented he believes "dressing up" the front of the house by adding this stoop is a plus for the proponents, as well as the neighborhood. Mrs. Swenson moved approval subject to the stoop remaining unenclosed. Mr. Olson seconded the motion. All voted aye; motion carried. B-96-26 Terry and Sheldon Fleck 4611 Browndale Avenue Lot 6, Block 12, Country Club Brown Section Request: A 1.28% lot coverage variance and a height/setback variance Ms. Aaker explained the subject property is located on the east side of Browndale just south of Sunnyside Road. The property owners are planning an extensive remodel of the home to include two small additions. The modifications include a 21 square foot addition to the back of the home for a powder room which requires a lot coverage variance and a sideyard setback variance for a solarium addition above the existing garage. Ms. Aaker concluded that it would appear a powder room could be accommodated within the existing building footprint, therefore staff cannot support a lot coverage variance. Staff does support the variance for the solarium given the existing setbacks provided by the home. The proponents, Mr. and Mrs. Fleck were present. Mr. Fleck presented letters in support of the proposal from adjacent property owners to the rear and across the street. A discussion ensued with Board Members in agreement with staff's recommendation of supporting construction of a solarium, but not the powder room. Mrs. Faust moved approval of a 5.25 foot sideyard setback for height to allow a solarium to be constructed. Mr. Olson seconded the motion. All voted aye; motion 4 Board of Appeals Minutes/June 6. 1996 carried. Mr. Olson moved to deny the lot coverage variance. Mrs. Mannix seconded the motion. All voted aye; motion carried. III. ADJOURNMENT: The meeting adjourned at 6:05 p.m.
