HomeMy WebLinkAbout1996 08-15 Zoning Board of Appeals Meeting Minutes RegularMINUTES OF THE REGULAR MEETING OF THE EDINA ZONING BOARD OF APPEALS HELD ON THURSDAY, AUGUST 15, 1996 5:30 P.M., MANAGER'S CONFERENCE ROOM MEMBERS PRESENT: Acting Chairman Mike Lewis, Don Patton, David Byron MEMBERS ABSENT: Helen McClelland and Lorelei Bergman STAFF PRESENT: Kris Aaker, Jackie Hoogenakker I. APPROVAL OF THE MINUTES The minutes of the June 20, 1996, meeting were filed as submitted II. NEW BUSINESS: B-96-45 Ron Clark Construction Ken and Nancy Woodrow 23 Circle West Lot 1, Block 1, Hilldale Request: A 14 foot frontyard setback variance request Ms. Aaker informed the board the subject property is located on the west side of Circle West and is currently a vacant lot. The lot had been improved with a home, however it has been recently removed. The former home had been located 15 feet from the front property boundary. The proposed home will provide a 30 foot frontyard setback from the front property boundary. Ms. Aaker concluded given the variety of setbacks occurring within the neighborhood and immediately adjacent to the property and given that the proposed setback is greater than the previous home, staff supports the request as submitted. The proponent, Mr. Ron Clark was present to respond to questions. Mr. Byron asked Ms. Aaker if the proposed house is within the Citys' lot coverage requirement. Ms. Aaker responded the structure is well within the City's lot coverage requirements. Ms. Aaker pointed out the subject lot is large, but buildable area minimal. Mr. Clark interjected this lot is difficult to work with because of the topography, and the allowable building area of the lot is relatively small when one compares it with the size of the lot. Mr. Byron asked Ms. Aaker if the only variance required for this property is for a frontyard. Ms. Aaker responded that is correct. The proposed house will actually be setback farther from the street than the previous house. Mr. Byron moved variance approval subject to the plans presented, noting a hardship exists on this lot because of its shape, and topography. Mr. Patton seconded the motion. All voted aye; motion carried. B-96-46 Thomas and Mary Seitz 6320 Interlachen Boulevard Lot 2, Block 1 Request: A 23 foot setback variance from a water body Ms. Aaker informed the board the subject property is located north of Interlachen Boulevard and west of Blake Road and backs up to a ponding area. There are two decks that are attached to the back of the home that need replacing. Ms. Aaker stated it appears there is no opportunity for conforming expansions, and it would also appear the increase in the upper deck will still be four feet farther from the pond than the replaced lower deck. Ms. Aaker concluded given the hardships regarding the existing conditions staff supports the variance request. The proponents, Mr. and Mrs. Seitz were present. Mr. Byron asked if the lower deck requires a variance. Ms. Aaker said the lower deck can be repaired and maintained without the need for a variance. A variance is required for the upper deck because its' repair and maintenance also includes enlargement. The enlargement of the deck creates the need for a variance. Mr. Byron asked if the elevation of the upper deck remains the same. Mr. Seitz stated the elevation remains the same. A brief discussion ensued with Board Members in agreement the existing decks need to be repaired/replaced, and will be an improvement to the rear of the property. Mr. Patton moved variance approval subject to the plans presented. Mr. Byron seconded the motion. All voted aye; motion carried. III. ADJOURNMENT The meeting was adjourned at 5:45 p.m.
