APPROVAL OF THE MINUTES: The minutes of the July 10, 1997, meeting were filed as submitted. 11. NEW BUSINESS: B-97-41 Curtis Wiehle & Rita Teres! 5609 Heather Lane Request: A 19 foot sidestreet setback variance for a garage addn. Ms. Aaker submitted her staff report noting the subject property is a corner lot located along Heather Lane. The home faces Heather Lane with the garage facing the cul-de-sac to the north. The homeowners are hoping to add onto the rear of the garage, convert the existing garage into living area, and attach a new garage. Ms. Aaker concluded it would appear the proposed addition would have minimal impact on surrounding neighbors. Staff supports the request as submitted. The proponents Mr. and Mrs. Teresi were present. Chair Runyan asked Ms. Aaker the distance from the street the proposed garage will maintain. Ms. Aaker said the garage will be 22 feet from the traveled portion of the road. Mr. Skallerud told the proponents, in his opinion their proposal is well done, adding he appreciates the fact neighbors were informed, and have submitted letters in support of the proposal. Mr. Skallerud stated he does not have a problem with the proposal as submitted. Mr. Skallerud moved variance approval subject to the plans presented, and the use of matching materials. Mr. Patton seconded the motion. All voted aye; motion carried. B-97-42 Jill M. Spain Yanish 4227 Scott Terrace North 51 feet of Lot 19, Morningside Request: A variance to construct a one car detached garage on a residential lot that requires a minimum two car garage Ms. Aaker informed the Board the subject property is located on the east side of Scott Terrace consisting of a 1 '/z story, 1 bedroom home with no garage. The homeowner would like to construct a detached one car garage to be located in the north side/rear yard of the property. The garage would conform to the setback, height and lot coverage requirements of City Ordinances. The homeowner has indicated a one car garage is proportionate given the size of the home, consistent with the neighborhood, and will meet her storage needs. The variance is needed, because City Ordinance requires a minimum two car garage per single dwelling units. Construction of any new garage needs to be a minimum 2 stall garage with permits issued usually no smaller in dimension than 20'X 20'. The homeowner was hoping for relief from the minimum two car requirement. Ms. Aaker concluded the homeowner will be improving the property from a no garage situation to a one stall garage addition. While the addition of a one stall garage does not satisfy the Ordinance requirements, it is an improvement to the property. Staff agrees with the applicant that a one car garage is consistent with the neighborhood, and is proportionate to the home. Staff supports the request as submitted. The proponent, Ms. Yahish was present. FA Chair Runyan asked Ms. Yahish if she plans to match the garage siding with the existing siding on the house. Ms. Yahish said all exterior materials will match, garage and house. Mr. John Heer, 4222 Scott Terrace, told Board Members he supports the garage. He said it is an improvement, not only for the proponent, but for the neighborhood. Mr. Skallerud questioned Ms. Aaker if in the future the proponent can connect the new garage to the house. Ms. Aaker said in reviewing the plans, and site, she believes in the future the garage can be attached in some fashion. Mr. Patton told the proponent she will enjoy having a garage, and is in full support of the request, pointing out in viewing the neighborhood it is not unusual to see one car garages. Mrs. Utne moved variance approval subject to the plans presented and the use of matching materials. Mr. Skallerud seconded the motion. All voted aye; motion carried. B-97-43 Mary Kay and Rusty Caschetta 5304 Brookview Avenue Request: A 1.5 foot sideyard setback variance for a dormer addition Ms. Aaker explained the subject property is located on the west side of Brookview Avenue consisting of a I Y2 story home. The homeowners submitted for building permit application to extend a dormer along the back side of the home. Upon building permit application it was determined that the dormer extension would increase the building wall height to require additional setback. Ms. Aaker pointed out the proposed dormer extension will not change the elevation of the existing roof peak. The addition will occur within the existing building footprint and will not reduce the existing setback. The homeowners have indicated that the extension of the dormer will add closet area in the second floor. Ms. Aaker asked the Board to note the front facade of the home will remain the same with no change in roof line height. Impact of the addition would be minimal. The most affected property is located north of the subject home and has had similar 3 improvements made. The addition will have matching materials to the existing structure. Ms. Aaker concluded staff believes the additional height introduced by the dormer will not negatively impact the adjacent neighbor. Staff supports the request as submitted. The proponents, Mr. and Mrs. Caschetta were present. Mr. Skallerud stated he can support the variance request as presented, and agrees with staff that the additional height of the dormer will not negatively impact adjacent neighbors. Mr. Patton asked Mr. and Mrs. Caschetta if they have a target date for completion of the project. He informed them the variance lapses after one year if construction has not begun. Mr. Caschetta said they plan to begin their project as soon as possible, and have it completed within the year. Mrs. Utne moved variance approval subject to the plans presented and the use of consistent materials. Mr. Patton seconded the motion. All voted aye; motion carried. B-97-44 Terry & Giovanna Ingram 6000 France Avenue South Lot 1, The Pines and that part of the west 15 feet of Lot 1, Block 1, Halifax Avenue Addition lying between the westerly extension of the N. & S. lot lines of Lot 1, the Pines Request: A 6 foot frontyard setback variance for an addition to home and a 3.35 foot rearyard setback variance to attach an existing detached garage. Ms. Aaker informed the Board the subject property is located in the southwest corner of West 60th Street and France Avenue consisting of a home with foot print area of approximately 670 square feet, and with a detached three stall garage. The homeowner has planned a substantial addition to the home to include attaching the garage. The lot is subjected to two frontyard setbacks, along France Avenue and West 60th Street which affects site improvements. Ms. Aaker pointed out the existing home is non -conforming in terms of sidestreet setback from West 60th Street. The existing north entry door is 19 feet to the lot line. 4 The average frontyard setback that is required to be maintained is approximately 35 feet. The new addition will maintain a setback of 29 feet. Ms. Aaker explained the homeowner is proposing to "fill in the gap" between the existing home and the detached garage by attaching it to the home. The garage fronts West 60`h Street with the side wall of the garage facing west to the rear lot line. The setback for a detached garage from the west property boundary is three feet. The garage provides, and would continue to provide a setback from the west property boundary of 21.65 feet. The minimum rearyard setback for an attached garage is 25 ' feet. Attaching the garage causes the need for variance. Ms. Aaker concluded the proposed addition will be a substantial improvement to the property, and will have little perceivable impact on adjacent homes . The new addition will be farther from the side street than the existing structure, and the garage will remain at the existing setback. Staff supports the request as submitted. The proponents, Mr. and Mrs. Ingram were present. Mr. Skallerud asked Mr. Ingram when the new three car garage was constructed. Mr. Ingram responded the three stall garage was constructed last year. Mrs. Utne said it appears the landscaping is new, and asked Mr. Ingram if any of the new plantings will be compromised by the new addition. Mr. Ingram stated he is in the landscaping business, and does not believe the new landscaping will be negatively impacted by the proposal. Mr. Ingram added they also plan more landscaping when the addition is completed, and if any landscaping is damaged as a result of construction, it will be replaced. Mr. Skallerud stated in his opinion this is a very ambitious project, adding what has occurred on the site over the last year has been well done, concluding he can support the proposal as presented. Mr. Skallerud moved variance approval subject to the plans submitted, and the use of matching materials throughout. Mr. Patton seconded the motion. All voted aye; motion carried. III.
