APPROVAL OF THE MINUTES: The minutes of the were filed as submitted II. NEW BUSINESS: B-09-28 Korukoules/David and Shannon Keller 6108 Ryan Avenue, Edina Request: 1.75 foot driveway width variance Planner Presentation Planner Aaker informed the Board the subject property is located on the west side of Ryan Ave., consisting of a one and one half story home with an attached one-car/front loading garage built in 1947. The property owners had submitted a building permit application to construct a detached two car garage in their rear yard. An existing driveway would be extended along the north lot line to access the proposed garage. The distance between the north wall of the house and the lot line is 10.6 feet with the ordinance requiring at least a 12 foot wide driveway to access the new garage. The homeowner is proposing a driveway width of 10.25 feet requiring a variance of 1.75 feet. The variance would allow the extension of an existing nonconforming driveway into the rear yard to access a two car detached garage. The proposed garage conforms to all of the ordinance requirements. Planner Aaker explained the ordinance requires a minimum 12 foot wide driveway for all new or relocated driveways. There are no setbacks required for driveways and driveways may be installed next to buildings or up to/on a property line. The subject property has improved driveway surface along the north side of the garage falling short of the lean-to addition on the back of the garage. The lean-to addition on the back of the garage will be removed to allow access to a new 26 x 26 foot garage. The zoning ordinance requires a minimum two car garage per single dwelling unit. The home currently has an attached one car garage, with no opportunity, to accomplish a two car garage by widening the existing one car garage. The one car attached garage would remain. Planner Teague concluded staff recommends approval of the requested 1.75 foot driveway width variance based on the following findings: 1) There is a unique hardship to the property caused by: a. The existing property currently has a driveway along the north side of the home. The driveway is slightly narrower than allowed by ordinance. b. The inability to provide a driveway less than 12 feet adjacent to the north wall of the garage without the benefit of a variance. c. There are many cases of narrower driveways throughout the city in the R-1 zoning district similar to the proposed driveway that perhaps predates the current code. 2) The variance would meet the intent of the ordinance since: a. The property would be properly accessed given site conditions. b. The improvements would be consistent with existing nonconforming conditions. c. The driveway width would maintain neighborhood character without compromising the intent of the ordinance to provide adequate driveway access on a property. Approval is also based on the following conditions: 1) The proposed driveway must be constructed as per the submitted plan dated. 2) The variance will expire on November 19, 2010, unless the city has Issued a building permit for the project covered by this variance or approved a time extension. Discussion Member Carpenter asked Planner Aaker if adjacent neighbors were notified of the request. Planner Aaker responded in the affirmative. Motion Member Adiyia moved variance approval based on staff findings and subject to staff conditions. Member Carpenter seconded the motion. All voted aye; motion carried. III.
