HomeMy WebLinkAbout1958 02-05 Planning Commission Meeting Minutes RegularMINUTES OF THE REGULAR MkgTING OF THE EDINA PLANNING COMMISSION HELD WEDNESDAY, FEBRUARY 59 1958 AT 7:30 P.M. IN EDINA VILLAGE HALL Members present: T. L. Todd, Chairman, Leonard Odell, Wm. W. Lewis, John Foley, Wm. Wilkinson; C. Edward Swanson, Planning Director. I - Minutes of the meeting of January 8th, 1958, were approved on motion, seconded and carried. II - Subdivision Approval Requests PRELIMINARY APPROVAL: A. Hanson's Addition, being the frontage on Maloney adjacent to Grandview Cemetery and opposite to the block between Harrison and Tyler Streets, was presented by Mr. Halvorsen, Surveyor. Discussion on width of the street was had and it was suggested that a letter from the owner of pro- perty on the East be obtained, signifying his intent to dedicate the remaining width required for street. Motion was then made by Lewis, seconded and carried to approve this as a preliminary, subject to increasing the frontage of the corner lot to 79.54 feet, and subject to the receipt of the letter. B. Mr. Anderson of Anderson Millwork requested permission to replat lots 91 10 and 11, Block 1, Brookside, into two lots 83 feet by 186.3 feet. Motion was made, seconded and carried to recommend approval of this replat. (see III -2.) C. Resubdivision of Block 109 Mendelssohn, by Mr. Kresse, was submitted and discussed, especially with regard to the/cul-de-sac,, which members did not approve. Mr. Swanson was asked to investigate the possibilities of running the road through to Belmore. Motion was made by Lewis, seconded by Foley and carried to table this plat until members have a chance to look at the property in question. D. Request for condemnation of 64th Street across K. Pearce property was presented by Mr. Robert Crabb, who explained that the Village Engineer had suggested this as one possible route for extension of the Edina - Richfield Trunk Sewer to serve the apartment building, provided Dayton's agree to the recommendations suggested by the Village Attorney regarding drainage. Mr. Todd suggested that Miss Pearce be notified by letter that the request is made to dedicate this portion of land. Motion was made, seconded and carried to recommend approval of this request. FINAL APPROVAL: A. MUIR WOODS, Block 19 which is being developed by George Harsh, was discussed and Mr. Swanson said that Outlot 1 will be dedicated. Motion was then made by Lewis, seconded by Foley and carried to recommend approval of this as a Final Plat subject to receipt of the deed for Outlot 1 and park dedication of 5%, or approximately $720. B. ROGER FINDELL'S Final Plat of the west 75 feet of Lot 20, Block 2, Peacedale Acres, was presented by Mr. Swanson, who explained that the preliminary was approved at the last meeting and that the Final plat agrees with it. Motion was made, seconded and carried to recommend approval of this plat. 1-8-1958 Zoning Change Requests - C. Z-58-3, Jack Sims (conzt6d) In the absence of a quorum:, the members present (Todd, Wilkinson and Odell) reaffirmed the position taken by a majority of the Planning Commission on September 4, 1957, that they are in favor of continuance of Open Development on France Avenue south of 51st Street, and not in favor of any commercial development, and this would include the property at 5102 France. The con- sensus of opinion was that they would look with disfavor on azar rezoning and that this matter be brought up at the next regular meeting of the Planning Commission. IV - OLD BUSINESS A. Pederson Dairy - request to rezone to Commercial. Mr. Todd read the petitie_i requesting the change from Open Development to Commercial Zoning. Mx-. Harlan Perbix, Attorney representing the Pederson Dairy, spoke briefly requesting the rezoning of the dairy, stating that it had been in operation for about 10 or 11 years as a pasteurization plant. He mentioned that Pederson Dairy owns about 70 acres of land, of which the dairy is actually just a. small portion. That the Honeywell Research is across the street and that there is a Rest Home to the south of it, also that the Grandview Cemetery is just to the north of the Dairy. Mr. Todd said it was essentially residential territory and that he felt it should be kept that way. Other members of the Planning Commission agreed with this. 4x. Perbix stated that a --'U" the time the Pederson got their permit, they did not have amy cows, but were operating as a pasteurization plant only. Mr. windhorst, representing the Village, stated that our ordinance permits farming and any work incidental thereto, and that he felt that the operation at the time the first Building permit was issued, might have come under this category. After further discussion, it was suggested that Mr. Perbix and Mr. Windhorst get together and work out an agreement to present to the Planning Commisoion, whereby the requested Building Permit could be issued providing Mr. Pedersonos 70 acre tract would not be divided, after which Planning Commission will make a recommendation to the Council. B. Muir Woods - Although a quorum was not present at the discussion of this plat, those members present, Mr. Todd, Mr. Odell and Mr. Wilkinson, agreed that Block I of Muir Woods would be favorably considered if the south 143' of Lot 5 were to be dedicated to the Village and Mr. Swanson was instructed to convey this information to the land planners so they could prepare a final plat for presentation at the February Planning Commission meeting. Meeting adjourned at 9:45 P.M. Respectfully submitted, L. M. Berry, Secretary Pro Tem Planning Commission Minutes of 2-5-58 III - ZONING CHANGE REQUESTS page 2 1. SHELL OIL STATION, 50th and Halifax, from -Open Development to Community Store. Mr. Vern Moss, Attorney, representing Shell Oil Company, presented this request, stating that since the present building is about 30 years old, the Shell Co. would like to construct a new building. They would like to erect a building about the same size as the one now on the site, to be set back about 18 feet, which would give an overall setback of from 57 to 60 feet from 50th Street. This would still allow about 30 feet on the back of the lot and would also enable the'Shell Station to retain driveways on both 50th and on Halifax. It would also enable them to remove the present sign which is on Village property and put it on -the station property. Mr. Adams was asked when he built the present structure and stated that the first building was in June of 1927, and was rebuilt in 1942 or 1943. After discussion on the non -conforming use of this property,.the traffic congestion --at the intersection, and •the• effect on'rthe comnuni'ty, motion was made by Mr. Odell, who stated he was in favor of the rezoning and improving of the present use. Mr. Wilkinson agreed and said he felt it would alleviate some of the congestion at the intersection if access to Halifax were provided. Mx. Lewis agreed. On vote, there were three in favor of approving the Zoning Change Request, and two opposed. Motion carried. 2. Anderson Millwork, request to erect 2 double bungalows on Division and Rutledge (Item II -B, replat of lots 9, 10 and 11, Block 1, Brookside into 2 lots.) Mr. Todd explained that Planning Commission has a policy of allowing double bungalows only where they would serve as a buffer between residential and a less desirable land use. Since these double bungalows would not serve such a purpose, motion was made by Mr. Odell, seconded by Mr. Foley and carried, to recommend denial of this request. In view of the fact that the request for double bungalows was denied, Mr. Anderson, the petitioner, withdrew his request for approval of the replat of lots 9, 10 and ll, Block 1, Brookside, into two lots 83' by 186.31. 3. Nevins, 50th and Highway 100 (old pumpkin farm) from Open Development to Commercial. Mr. Geimer, attorney representing owner Nevins, stated the request to rezone was for the purpose of erecting a Service Station. He said that his client was willing to put the station any place that Planning Commission felt would be consistent with the plans of the Highway Department for highway 100 and the spin off for highway 169. He said the Highway Dept. has indicated that there will be a service road, therefore no traffic con- gestion. Planning Commission members informed Mr. Geimer that they did not approve and therefore could not recommend this rezoning request for use as a service station but might look with favor on a low type office building, where traffic would not be increased. Motion to deny this request was made by Mr. Odell, seconded by Mr. Foley and carried. 4. Jack Sims Photo Studio, 5102 France, request to rezone to Community Store. Mr. Nat Johnson, Attorney, represented Mr. Sims, said he felt that with the present traffic on France Avenue south, it was only a matter of time until France Avenue, on both sides, would be commercial development, and that he thought that at this time the west side from 50th to 54th should all be zoned commercial. Mr. Todd explained that Planning Commission has no intention of recommending the extension of commercial development from 51st Street south because they are not in favor of strip zoning. Motion was made by Mr. Wilkinson, seconded by Mr. Odell and carried to deny this petition. All in favor. r Id.. Planning Commission moved to recommend to the Council that Eden Prairie Road be vacated as rollows: From Blake Road wrest to U. S. 169, from U.S. 169 to Gleason Road and from Gleason Road to U.S. 169; and that Blake Road be extended 169, Motion was made by Mr. Lewis, seconded by Mr. Odell, and carried.
