Members Presents T. L. Todd, Chairman, A. H. Hiatt, Wo W. Lewis, Harry Gustafson, John T. Foley and Wm. A. Wilkinson; Warren C. Hyde, Village Manager and C. Edward Swenson, Director of Planning. I - Approval of the Minutes of the August 6th meeting was had on motion, seconded and carried., !I- Zoning Change Requests 1. Z-58-199 BILTMORE MOTEL request for extension of Community Store zoning to the south along Highway 3.69 to allow addition of 52 units to the existing Motel was discussed and plan studied. M's. Wilkinson then moved to recommend approval ofthis request subject to approval of State Highway Department for access roads and subject to approval of plans for restaurant and other pertinent buildings. Motion seconded and carried, with Gustafson abstaining from voting. 2. Z -58-23Q OLGA LARSON again requested Multiple Residence Zoning of her 7 acre tract on County Road 18 between Pederson Dairy and the Grandview Park Cemetery. Members of the Planning Commission had studied this request in the field and told Mrs. Larson they would recommend approval of double bungalows on County Road 18 on 90 foot lots and single family residences on the remainder of her land. Mars. Larson said she has had difficulty selling her land for single family homes and is now offering the entire 7 acres for $12,000. Lotion was then made by Lewis, :seconded by Foley and carried to recommend approval of that portion of Airs,, Larson°s property fronting on County Road 18 for double bungalows9 providing a plat is filed for the entire area which will provide for road access to County Road 18. Also, provided lots zoned for doubles contain at least 15,000 square feet and are at least 90 feet wide, the remainder of property to be zoned Open Development (single family dwellings). 3. Z-58-269 JACOBSON, request for Multiple Zoning on east side of France at 63rd„ north of Evans Addition, to allow erection of two buildings containing 11 units each. Mr. Jacobson was not present. Inasmuch as Planning Commission has set a pattern for France Avenue of double bungalows, and since under the new ordinance, the area would not allow a building containing more than 7 units even if it were rezoned, motion was made by Wilkinson, seconded and carried to deny this request. Members agreed, however, that they would look with favor on double bungalows. 4. Z-58-28, RALPH OVERHOLT requested rezoning to Community Store zoning Lot 4, Block 3, Edenmoor, which is the triangular shaped lot bounded by #169 and Sherwood Road across the street from the Biltmore Motel, Cities Service and Standard Oil Filling Stations at the intersection of k169, Eden Avenue and Sherwood Road. Mr. Overholt presented a sketch of the office building he proposes to build and Plan- ning Commission members agreed that such a building would be in order at this location. Mr. Overholt said he plans a one story building with a maximum of 10 or 12,000 feet of floor space to be used as a home office for his insurance busi- ness and perhaps one or two tenants of similar business nature. He agreed to the necessary setbacks and said there would be plenty of parking space. He was asked to bring in a maximum space plan and also something more definite on use of the building. Mir. Wilkinson moved, seconded by Lewis, to approve this request subject to satisfactory plan layout, setbacks in conformance with Office Building District zoning, and access roads. Motion carried. J ,;s C? �:. .� <:'• 1. 21RELE�IINARY APPROVAL A. S-58-33, FLO'S ADDITION, being the of lots 3 and 49 block i, • Pezcadale Acres. Motion was made by Kilkinsoc, _•�conded by Hiatt and carried to recommend approval subject to deed restrictions requiring a 7* foot side yard on lots fronting on France Avenue., on which double bungalows are approved„ and subject to agreement that building permits for lots fronting on Halifax not be requested until the full 60 foot width has been dedicated. B. S-58-349 LORRAINE'S ADDITION, being the wrest 123 feet of Tract D. White Investment Compt.ny's Hidden Valley (55th and Beard), to be subdivided into 3 lots. Letter from Mr. Russell Smith, 5419 Abbott Place, objecting to the plat, was read by Mir. Todd, as was a letter from Mir. Simpson, the developer. Lawrence Olson, representing Xx". Simpson, said there were no deed restrictions and to his knowledge, no reason why Mr. Simpson could not build houses on all three of the lots. After discussion., this matter was tabled to allow members to inspect the location before ,making a recommendation. Paul Johnson, 3509 West 55th Street, stated he thought it would be advisable to look at the propertyl regardless of the type of house that is built, since the corner lot is only 60 feet wide. Mr. Johnson asked to be advised when the next meeting of the Planning Commission would be held. C. S-58-359 GILrA= REPLAT, being a portion of a lot in Gilwood Addition, Rolling Green. Mr. Thompson, attoxney for Mr. Gilster, said he knew of no reason why this could not be platted. Mr. Gilster:. who was also present, was advised to get in touch with Frank 'Tracy, President of the Rolling Green Association. Motion was then made by Mair. Hiatt, seconded by Wilkinson, and carried to approve this pre- liminary subject to waiver of deed restrictions. D. S-58-36, I�RAHL'S ADDITION, a subdivision of parcels of land north of the cross- town adjacent to Xerxes Avenue. Two of the lots are 74 by 135 feet in size and one is 76 by 135. After discussion, motion was made by Wilkinson, seconded by Lewis and carried, to reconimend approval subject to receipt of road and sewer profiles, an engineering check, and subject to lot 3 not being shown as a lot on the final plat unless it is combined with Outiot 1. E. S-58-37, REGISTERED LAW SLEVEY of Tract B in R.L.S. 249, which is on Olinger Road, approximately 1000 feet south of tz169 on the west side. Mr. Halvorsen, surveyor, was present and was told that the developer should submit a plat for the entire plot. Mr. Wilkinson then moved, seconded by Foley, to deny this re- quest. Notion carried. F. S-58-38, LYLE'S II ADDITION and G. S-58-39, LYLE'S III ADDITION, the sub- division of lots 14, 15, the N. z of lot 17, 18, 19, 20 and 42 in Warden Acres. Mr. Lewis moved to recommend approval of this plat with cul-de-sac subject to road profiles and sewer profiles, an engineering check, :satisfactory park dedi- cation, the readjustment of Benton Avenue where it is a one way street, and the vacation of Grove Street between Tracy and Johnson. hlbcion seconded by Wilkinson and carried. H. S-58-27, DALE JOHNSON'S Resubdivision of lots 24 thru 30, Willard's Subdivision of Block l7, Mendelssohn. This plat was given approval last month for two lots fronting north on Maloney and two fronting on Tyler Avenue extended. Mr. Johnson and Mr. Holly, a builder, were present. Mr. Johnson said that the two lots fronting on Maloney would require expensive fill and asked that his original plat be considered again and approval recommended. Planning Commission members decided to look at the subdivision again before deciding and matter was tabled until the next regular meeting. ti 1 A P.C. Rir uctes of, 9-10-53 Page 3 III 2. FINAL PLATS A. S-58-309 CODE AVENUE ADDITION, a Resubdivision of lots 1 and 29 block 19 of Code's Highview Park, was presented by Mr. Swanson with approval recommended subject to letter of agreement that a building permit will not be sought on lot 3 until such time as Code Avenue is widened to its full width. He also recommended that the house on lots 1 and 4 be allowed to face north, provided all required setbacks are complied with. Motion was made by Wilkinson, seconded by Hiatt and carried, to recommend approval of this plat subject to the conditions set down by Mr. Swanson. IV -- DOUBLE BLMALOW APPROVALS A. Plans for double bungalows on lots 1 and 2 of Gary Addition, 6216-18 France and 6220-22 France, by Hippe Construction Company, were reviewed and approval recommended. B. Plans for double bungalows at 6157-59 Frances 6201-03 France, 6207-09 France and 6213-15 France, by Holly Construction Company, were not ready at this time and request for approval was withdrawn. C. Plan for double bungalow on lot 2, Everth Addition (E. G. Thernell, builder) at 6017-19 France Avenue, was presented and approval recommended. V - NEW BUSINESS. Mr. Parnell asked approval of Planning Commission to m ve his garage to within 3 feet of the lot line. He had the written permission of his neighbor on the side where the garage would go, After consideration, Planning Commission re- commended approval on motion of Hiatt, seconded by Lewis, and carried. Members were given copies of the Office Building District amendment to the Ordinance and were asked to study it, as well as the Gasoline Station amendment to the Zoning Ordinance, and to meet again on September 17 at 7c30 P.M., if a quorum is had, otherwise on the 23rd. They also decided to get together and look at the 55th and Beard tract and the Maloney -Tyler lots on Saturday morning at 8:30 A.M. There being no further business, meeting adjourned at 10:50 P.M.
