Nolen°s request for the rezoning of Lot 20, Auditor's Subdivision No. 172 (Southwest corner of France Avenue and West 49th Street) from Open Development to Compunity Store District. It was explained that this request had been previously considered by the Commission and denied as it vaa!� felt that the property could he more favorably zoned for Multiple Residenco. Motion seconded by Mr. Levji and carried. Planning Com: insion Miinu-tes - 2 July 6, 1960 III, ZONING VARIANCE REQUESTS V-60-13. He _ -T. Sparrow. Mrs. Sparrow's request for permission to build an addition on her home at 6620 Cheyenne Trail (Lot 159, Block 5, Indian Hills Addition) having a front yard setback of 24.5 feet was considered by the Commission. Mrs Hite informed the Commission that he had asked Mrs. Sparrow to check her property deed restrictions to see if such a setback would be permitted and that he had been informed by her that it would be. Fie also pointed out that the lots in this area were quite large and that the projection into the required front yard would noir be notic- able to the neighboring property because of the lot topography. Mr. Wil- kinson moved to approve the variance, soconded by Mr. Lewis and carried. V-60-14. Robert L. Fkxtrand. Mr. Hike presented Mr. Ekstrand°s request to construct a garage with a -three foot side yard on Lot 11, Block 3, West Minneapolis Heights (318 Van Buren Avenue). He explained that this was a 46 foot lot and that Mr. 24trand wished to connect the house and garage with a breezeway. Motion, was made by Mr. Foley to approve, seconded by Mr. Wilkinson and carried. V-60-15. Okerrnvin & Hunstad. This was a request of Okerman & Hunstad for a 6 foot side yard for a house on Lot 9, Block 69 Brookview Heights First Addition (5109 Meador. Ridge). It was explained that this lot was one of the few remaining vacant lots within this addition and that the homes previously built in the addition were permitted to be located within 8 feet of thein side property lines, Because the ordinance requirement would prohibit the owner of this property from enjoying a privilege previously granted for the neighboring properties, Mr. Wilkinson moved that an 8 foo side yard be permitted., Motion seconded by fir. Lewis and carried. V--60-16. Laurence Brooms Vir. Frank Illguth appeared on behalf of Mr. Broom to present a request for a 3 foot side yard adjacent to a proposed garage on Lot 7, Block. 3, Harriet Lawn Addition (5621 Abbott Avenue). Mr. Wilkinson inquired as to why the garnge hod to be constructed that close to the line and was informed Ly P:r. Illguth that the owner had two other possibilities, one of vinich was to move, the garage iurthar back and the second of which Mould be to move the garage toward the center of the lot. This second alternative was not possible because of a large tree which -the owner wanted to save and the othcar alternative was difficult be- cause of a change in lot elevation. -Mr. Wilkinson moved that the Planning Commission table this roquest until such time as it had had an opportunity to visit the property, seconded b;. MIr. Lewis and carried. IV. PRELIMINARY PLATS S-60-20. N�rmandale Addition - Wicklund Rnpllai. This replat of Lot 1, 2, and 3 in Block 19, Normandale Addition, into eight 90 x 122 foot lots was approved upon motion by Mrs Wilkinson, seconded by Mr., Lewis and carried. Miller's proposed plat of his property immediately north of the Cross -Town Highway and between St. John's Avenue and Wooddale Avenue vias approved upon motion of Mr. Lewis, seconded by ,fir. Foley and carried. S-60-22. Broadmorg Addition - Eliason Renlat. 11-r. John B. Eliason"s proposed replat of Lots 1, 25 and 3 of Block 31, Broadmore Addition, into four 95 x 125 foot lots was approved upon motion by Mr. Wilkinson, seconded by fir. Foley and carried. S-60-23. Normandale Second Addition - Wiltz Aeat. Mr. nick Wiltz°3 replat of Lots 20, 211, and 22, Block 175 Normandale Second Addition, in- to one 80 foot and one 70 foot lot was approved on motion by Mr. Foley, seconded by Mr. Wilkinson and carried. S-60-24. Indian Hills - Thomoson Reolat. Mr. Helge Thompson's replat of Lots 6, 7, and f, Block 1, Indian Hills, was approved on motion by Mr. Wilkinson, seconded by Mr. Levis and carried. V. FINAL PLATS S-58-10. Fridl.und°s Addition, (Preliminary Plat approved at Meeting of January 7, 1959.) Motion tto approve was made by Mr. Lewis, seconded by Mar. Wilkinson and carried. S-59-60. Koh ridge Addition: (Preliminary Plat approved at Meeting of December 9, 1959.) Final plat approved on motion by Mr, Wilkinson, seconded by Mr. Foley and carried. 5-59-62. Approval of the final plat %,as granted on motion by Mr. Lewis, seconded by fir. Foley and carried. S-60-13. Gavin°s Addixion. (Preliminary Plat approved at Meeting of May 4, 1960.) OTHER BUSINESS "Planned Bui.ldif,d Groups" P;mendr'wnt to Zoning Gdiner)ce, fir. Robert Crabb, Mr. Al Godward. and Katherine Pearce appeared before the Commission to discuss the proposed Planned Building Groups Amendment to the Zoning Ordinance. Por. Hite presented to the Commission a letter which he had received from Wir. Brill, attorney for Miss Pearce. Vir. Brill's letter expressed his opinion that rpuch of the language of the ordinance "dealing with so-called standards does not constitute standards at all but broad objectives and that the language of the proposed ordinance gives the Planning Commission, and ultimately the Village Council, great room for the exercise of arbit- rary powar in a manner which may he very un.oasonable and beyond the scope of authority conferred by statute or villages like Edina." Mr. Brill's letter further pointed out some specific objections no had to the content of the proposed ordinance. Mr. Robert Crabb expressed some concern about the lack of detail in the section of the ordinanca which required certain development plans to be submitted to the Village for approval. He requested that the plans requir- ed be more specifically deiced. He also requested that a provision be included in the ordinance requiring that the application be processed with- in a certain defined period of time. Mr. Al Godward expressed general agreement with the purpose of the ordi- nance, but agreed with Rr. Crabb that certain parts of the ordinance should be more specific. Mr. Hite expl�iined that the purpose of the proposed ordinance was to give both the developer and the Village more flexibility in the development of site plan for a project containing more than one building. He pointed out that the ordinance would not permit the developer of a piece of pro- perty to deviate from any of the existing ;ordinance provisions in any district other than the .restriction noir existing which requires a platted lot for each building. After considerable discussion; Mr. Foley moved that the Planning Commission delay action upon this ordinance until -iheir Augu.S`c meeting and that, in the intervening time, Mr,; Hide consult with the pexsonz present tonight and than; he attempt to revisa the ordinance mn line with some of the sug- gestions presented. Motion seconded by Mr. dilkinson and carried. AsgT1alt Concrete Mix Fling The request of Mr. D. E. Riegger, President of Rieggei Roadways, Inc., for permission to install and operate a Hot Asphaltic Concrete h1lix-Plant in Edina was briefly discussed by the Com- mission. Because of the nature of this type of opera -Lion, Mr. Wilkinson moved that the Planning Commission deny the request. Motion seconded by' - Mr. Lewis and carried.
