For -these reasons, Mr. Hite stated that he had informed all persons inquiring about the property that the application of the zoning to their particular proposed use would be questionable. Mr. Bill Lewis agreed with Mr. Todd that the Western Meat rezoning was improper in that it iL.ywfa4 ;-coi,cs :BaiIveness, but he did not see how the Village could possibly rezone the property now. He felt that the Village lva certainly mos ally buund to pewit a purchaser of the pro- perty all the property rights for which he had paid.. Mr. Griswold agreed .vitt Kro Lewi:5 and pointed out that this was just the kind of a mess we can get ourselves into with spot zoning. He ask- ed that the Commission proceed as rapidly as possible with its compre- hensive land use planning program. The general consensus reached by the Commission was -that this matter should be brought to the a4tention of the Council at their next meeting, Mr. Hite vas asked to give the Council a complete account of the Commis- nion°s deliberations. Z-59-19. E. . islcke . (See minutes of 10-7-59, 3-9-609 and 8-3-60.) Mr. Todd read to the Comrri.ssion as letter written by Mr. Wilcken°s at- torney/, Mr. Howmer Erown. The letter stated that Mr. Brown had promised a number of the neighbors who oppose the project that he would not ap- pear before the Planning Comani8sion to discuss this matter unless they had been notified of -the meeting. Her 'therefore, asked that the matter be tabled until the next regularly scheduled meeting of which the neigh - fors would receive notification,, 'three of the neighbors were present at the meeting and stated th,2t they would be able to be present at the next meeting. Mr. Harmon Ogdahl°ss request to re -zone Outlots 29 3, and 4, 'Town Realty's Edina Terrace from Open Development District to Multiple Residence District was once again considered by the Cc;rniission. In addition to the information which he furnished to the Ccm, ission at its last meeting, Mr. Hite also recommended that the proposed rezoning be extended to include all of the property south of the Cross -Town Highway and west of Xerxes Avenue. Mro Lewis moved that the Planning Commission recommend to the Council that the area described by Mr. Hite be se zoned from Open Development to Mul- tiple Residence. After Mr. Griswold°s second the motion carried unani- mously. LaVarre,o(See minutes of 8-3-600 ) Mr. Gri�;widId explained to the members of the Commission who had not been at the previous meeting that Mr3. LaVarre°s request for a 5 foot side yard vzrianee on Lot 1, Block 11, West Minneapolis Heights (400 Madison Avebue) for an addition to her home, was only a continuation of her preaent side yaTd and, that, theseforer he would more to recommend approval of the �ariance. Mr. Lewis seconded the motion which carried unanimouzly. V-60-18. Miltur Ea_Adam- (See �ninuteb of 8-3-60.) Mr. Adams re- quest for a 2 foot side yard var'ance for the purpose of re -locating his garage on Lot 27, Block 9, Country Club District (4621 Casco Ave- nue), was reviewed by the Commission. Following a brief discussion with Mr. Adams, 14r. Lewis moved to recommend approval of the variance, seconded by Mr. Foley and carried. V-60-19. D. D. Fet.tviohn. (See Minutes of 8-3-60.) Mr. Pettyjohn°s request for an 10 foot garage setback on a corner lot at 5620 Wooddale Avenue (Lot 6, Block 49 Littel Park) was considered by the Commission. Mr. Hite explained for the benefit of those who were not at the pre- vious meeting, that if he were to build the required 20 feet from the Tower Avenue tide of his property, he would be in violation of the re- quired 5 feet from the north lot line. Since some type of variance was necessary, the Commission felt the 18 foot setback would be accept- able and Mr. Lewii; so moved. Mr. Griswold seconded the motion which carried unanimously. V-60-21. M=;, _kxel.and. (See minutes of 8-3-60.) Mr. Phillip Neville, Attorney, presented Mrs. Meland°s request for permission to divide her property at 4617 Townes Circle (Lot 3, Auditor's Subdivision Noo 319) into two lots , one of which would have an average depth of 76 feet and an area of 9,000 square feet. He said that the extreme depth of the lot (over 300 feet) and its topography were ideally suited for the di- vision as propozed. He pointed o3,t that the street boulevard adjacent to the smaller lot was almost 30 feet In depth, which condition would seem to add to the'apparent depth of the lot. Mrs. Meland said that she had received the consent of her neighbors to the proposed division. Mr. Todd was of the opinion that it would he detr:hnental to the White Oaks neighborhood to permit the division of existing lots. He said that the area waac; charact:eriyed by large homes on large lots and that in permitting this lot to be divided there could be no valid reason for not permitting other lots in the neighborhood to be similarly di- vided. Mr. Warren Hyde pointed out that there was neither sewer nor water in this area and until, it wds available a minimum lot area of 159000 square feet wculu be required. Mr. Griswold added that he could see some justification for a second lot, but that in his opinion the degree of variance.required to create this second ldt was unreasonable. He then Lioved to deny the request, which notion wzaG seconded by Lewis and carried unanimously. Planning Comission Minutes - 5 V-60-22. M & Coy_ (See ruinutes of 8-3-60.) Mr. Hite explained for the benefit of those who had not been present at the previous meeting, the request of McCall and Co. to construct a house at 6005 Abbott Avenue Saith with 6 foot side yards. Mr. Lewis moved to deny the request in conformance with the action taken at the August 3 meet- ing, seconded by Niro Foley and carried. V-60-236 Harvey T. Ardr son. (See minutes of 8-3-60.) Mr. Hite pre- tented the request of Mr. Andreson for the platting of a 70 foot lot at 5309 West 60th Street. He explained that Mr. Andreson was proposing to plat a 150 foot tract on Vest 66th Street into two lots. Because there is already a home on the proposed 70 foot lot which would still have side yards of 15 and 30 feet, Mr. Hite had suggested an 80 - 70 split rather than 75 - 75. Following a brief discussion, Mr. Lewis moved to approve the platting of the 70 foot lot, seconded by Mr. Foley and carried. `IV. PRELIMINARY PLATS S-60-25. Andreson Addition. (See minutes of 8-3-609) It was explained by Va. Hite that the proposed plat of a parcel on gest 66th Street into -two lots had been tabled at the last meting for the considerafion of the full Commission. In re -commend -Ing approval of the 70 foot lot (see &ove -Zoning Variance V-60-23), Mr. Lewis also moved to approve the preliminarl plat, secondod by Kc. Foley and carried.
