Discussion was held regarding Mr. Hippe's proposal to rezone the westerly 200 feet of Lot 4, Block 1, Peacedale Acres from Open Development Dist- rict to Multiple Residence District for the purpose of erecting an eleven unit apartment building. Members of the Commission were in- formed that all property immediately adjacent to the subject pro- perty is either single family or two-family and that the nearest use of any other type was the five unit apartment at Valley View Road and Brookview A -venue. Mr. Hite explained that the 115 % 200 forst '-.)t p:rc,'ido_i �n -rele of '3,)0^ ;gl)a:re feet and that, according to our Ordinance, an area of 26,400 :,quare feet would be required for an 11 unit building. He also pointed out that the proposed building could not be placed upon this lot without an infringement upon the side yards required by ordinance. Mr. Odell seconded Mr, Lewis' motion to deny Mr. Hippe's request, which motion carried unanimously. III. SPECIAL PERMIT REQUESTS" P-61-1. J. A. Danens & Son. IRC. T a s E a District-- Mirth Hil_1. ,See Minutes of 3-B-61 . Mr. Danens' request to establish a Temporary Excavation District to mine material from the hill on the Marth property (Cow Hill), located north of Highway ##5 slightly east of the Hay' Farm Park, was discussed. Ms. Hite explained that computa- tions indicated that there are approximately 47.,500 cubic yards of ex- cess materi ' on the property and that considerable earth moving would be necessary before any residential development could occur. He point- ed out that the hill has slopes exceeding 30,E making it difficult to traverse even by foot and recommended that, ahould the permit be grant- ed, the developer be required to maintain at least 10% hill slopes. Mr. Odell questioned the advisability of continuing to establish Ex- cavation Districts stating he feared too much mining would cause ero- sion problems, fie explained that he felt the Planning Commission should cea a to permit these districts unless mining waa being done in accord- ar.Ce with a specific: plan for the area being mined. A motion was made by Mr. Odell to table the request until such time as Hr. Danens present- ed a development plan for the area. Motion carried following a second by Mr. Griswold,, P-61-5,6,7. Dick Andersorle Twee_ F.4mily Dwellings - -West 56th Street. (See Minutes of 3-€3-61). Mr�.�Hite presented Mr. Anderson's request for double bungalow permits on Lots 7, & & 9, Block 2, Mirror Lakes Meadow Ridge Second Addition to Edina Highlands. These double frontage lots are located 5ouath of 55th Street and north of Highway #169 between Chantrey Road and Dundee Road. Mr. Hite st�ted he felt these lots were ideally situated for two-family use, serving as a buffer between the highway to the south and the single family residential area to the north, and .rec.ommenaed -that the permit's be granted. Planning Commission Ntinutes - 3 April 12, 1961 Mr. Hyde informed the Commission that there was a drainage problem in connection with this property and suggested that approval be condition- ed on the applicant paying an advance assessment for storm sewer based upon an estimate made by the Engineering Department. Mr. Anderson ob- Jected, stating that such assessments should not be required in order to obtain a building permit on already platted property, but rather should be required at the time the land is subdivided. Following a lengthy discussion, Mr. Lewis moved to approve the permits for double bungalows with the stipulation that Mr. Anderson include in the purchase agreement a clause stating that there would be a storm sewer assessment against the property. Motion carried following a second by Mr. Odell. P-61-8. Randolph Hippe. Two -Family Dwelling - Brookview Avenue. Mr. Hippe presented a request for a permit to construct a two-family dwell- ing on Outlot 19 Hippe°s Pamela Terrace (southeast corner of Valley View Road and Brookview Avenue). It was explained to the Commission by Mr. Hite that the lot in question was triangular in shape and ill-suited for a two-family building site. He further indicated that it would be necessary for Mr. Hippe to obtain side yard variances in order to locate his proposed double on the lot. Members of the Commission indicated that they felt the lot was too small for a two-family dwelling and that any building which might be built on the lot should be not more than one story in height if it had to be located near the lots south line. Mr. Odell moved to deny the request, seconded by Mr. Lewis and carried. IV. PRELIMINARY PLATS 5-60-11. Southdale Acres. (See Minutes of 6-8-60). Mr. Hite presented a revision of the previously approved preliminary plat of Southdale Acres. The current plat, containing about 35 acres, includes all of Lot 4 and a portion of Lot 3, Cassin°s Outlots. The south 600 feet of the plat is zoned either Regional Medical or Office Building District while the north 1300 feet is zoned Multiple Residence. It was pointed out that the proposed road system will connect with West 66th Street on the south and with Heritage Drive at the north, but that no access is being provided at this time to either the Pearce property on the east or the Fairview Hospital property on the west as the location of road systems within these properties cannot now be determined. Mr. Hite suggested that if, at a later date, the Village determines that there is a need for access between these properties and the road system in this plat, the developers of Southdale Acres should be required to provide the necessary right-of-way at no cost to the Village. Planning Commission Minutes - 4 April 12, 1961 Mr. Hite also recommended that if on -street parking is to be permitted at all, it should be limited to one side of the street, thereby making a 30 foot pavement width sufficient. Mr. Odell stated that he felt the 30 foot width to be insufficient and suggested that 36 feet of pavement be required. Mr. Hite stated that drawings and data for the streets, sewer and water had been submitted and were currently being reviewed. Mr. Griswold, therefore, moved to recommend preliminary ap- proval subject to additional road right-of-way being provided by the developer at such time as deemed necessary by the Village. Motion se- conded by Mr. Lewis and carried. 5-61-17. Peacedale Acres - Booman Renlat. A proposed replat of Lots 5 and 6, Block 1, Peacedale Acres, into six 75 foot lots was presented for preliminary approval. Mr. Hite indicated that this plat was a con- tinuation of the lot pattern established in the area between France Avenue and Halifax Avenue from West 62nd Street south to the Cross -Town Highway and recommended approval. Mr. Lewis so moved, seconded by Mr. Odell and carried. S-61-18. Otto°S Third Addition. Mr. Hite presented this seventeen lot plat of the property located along the west side of Nine Mile Creek just north of West 70th Street. He indicated that Cul-de-sac streets are being recommended both in this plat and in the Fellman plat immediately to the east in order to add to the amount of land available for creek right-of-way. It was noted by the Commission that the advantages of Joining the two cul -desacs within the two plats by bridging the creek seemed to be outweighed by the problems presented in restricting creek flow and in bridge construction and maintenance costs. Following a brief discussion, Mr. Lewis moved to approve the plat in pre- liminary form subject to the following conditions= 1) All lots within this subdivision are to be brought up to an eleva- tion of 838 feet, which is the flood plain elevation established by the Nine Mile Creek Watershed Engineer. 2) Public easements of at least 50 feet are to be provided at the rear on all lots backing up to the creek. 3) Flood Plain easements are to be provided for all areas of the plat labled "Flood Plain". 4) The developer is required to install all sewer and water laterals in addition to street grading and graveling. The motion was seconded by Mr. Griswold and carried. S-61-19. Fellman°s Addition. This plat of the property immediately to the east of the Otto°s Third Addition (see S-61-18) was briefly discuss- ed. Since engineering plans and data for streets, sewer and water have not yet been submitted, no approval could be granted but there was .a general acceptance of the proposed cul-de-sac road system. Planning Commission Minutes - 5 April 12, 1961 5-61-20. Holland's Indian Hills, A 120 lot plat of the property lo- cated between Indian Hills and County Road #18 was presented for con- sideration. Mr. Hits informed members of the Commission that public sewer was not available to this property at the present time, but that public hearings on the trunk sanitary sewer servicing this area had been scheduled for September, 1961. Mr. Lewis moved to accept the plat for study until such time as plans for sewer installation had been made. Motion was seconded by Mr. Grriswold and carried. S-61-21. Codes Highview Park -Hawthorne Hawthorne Replan. This four lot replat of Lots 17 8 18 of Block 1, Codes Highview Park is located at the southeast corner of Benton Avenue and Bernard Place. The two existing lots have frontages of approximately 105 feet along Bernard Place and extend 308 feet to the east. The two new lots are at the rear of the 308 foot depth and front Benton Avenue. Mr. Hite explained that previous development within this block would make it impossible to extend Code Avenue through this proposed sub- division and that, therefore, no right-of-way need be set aside. All four of the proposed lots can be served by Village sewer and water. Mr. Odell moved to approve the plat in preliminary form, seconded by Mr. Lewis and carried. 5-61-22. Cosgrove Addition, A plat of the Cosgrove property located on Ridge Road just south of Interlachen Boulevard was recommended for both preliminary and final approval by Mr. Hite. He indicated that the property, which has a frontage of approximately 300 feet along Ridge Road and a depth of approximately 320 feet, would be divided into three lots with the existing house on the center lot. Members of the Com- mission noted that an additional 15 feet of Ridge Road right-of-way was being provided by the plat to provide the full 50 feet needed for road improvements. Mr. Odell moved to recommend approval of the plat in both preliminary and final form, which motion waa seconded by Mr. Lewis and carried. V. FINAL PLATS S-60-3. Rearrangemant of Lot 1, B Stow'Ed moor Addition, In presenting this plat, Mr. Hite indicated that it had been prepared to accommodate the multiple residence development proposed by Roy Peterson in Stow°s Edgemoor as approved by the Planning Commission on March 8, 1961, and that the final conformed in all respects to the preliminary. Mr. Lewis moved to recommend final approval of the plat with the stipu- lation that the rear wall of the garage unit for the 18 unit building be bricked in conformance with their plan. Motion carried after a second by Mr. Griswold. Planning Commission Minutes - 6 April 12, 1961 S-61-12. Sjrotz F.iZ:s& Addition. (See Minutes of 3-8-61). Final approval was recommended for this two lot plat of the property located at the Southeast corner of Ridge Road and Interlachen Boulevard. Mem- bers of the Commission were informed that this final plat was in con- formance with the previously approved preliminary. Mr. Lewis seconded Mr. Griswold's motion to recommend approval, which motion carried. S-61-15. Edit Parklands. (See ED LYNCH PLAT in Minutes of 4-8-59 and GARDEN PARK - GISSELBECK REPLAT in Minutes of 3-8-61). Mr. Hite in- dicated to the Commission that it had been impossible to secure any information from the Minnesota Highway Department regarding the pro- posed relocation of Highway #169 and stated that, although the possibi- lity was good that the highway would not be located as shown on the plat, there was no concrete evidence to support this contention. Due to the circumstances involved and since engineering for the streets, sewer and water had been approved, Mr. Griswold moved to approve the final plat. He included in his motion a stipulation that the names of the proposed streets be changed to eliminate the word "park" as a prefix word. Motion was,seconded by Mr. Odell and carried. S-61-16. The Heights Fourth Addition. This 33 lot plat is a continuation of the development around the Parker Stables on Valley View Road which was approved in preliminary form in 1958. Mr. Hite indicated that sewer and water are being installed by the developer and that all engineering work had been approved. Mr. Griswold seconded Mr. Lewis' motion to recommend final approval, which motion carried unanimously. VI. OTHER BUSINESS Mrs, MollyNewland. Non -Conforming _Use r 408 Griffit. Mr. Hite informed the Commission of a two-family use being carried on at 408 Griffit which property is located in a single family residential area. According to information submitted by Mrs. Newland's attorney, such use of this pro- perty was in effect prior to the adoption of the present Zoning Ordi- nance in 1931, and therefore, may legally be continued as a nonconform- ing land use. A motion was made by Mr. Lewis to classify the two-family use of 408 Griffit Avenue as a non -conforming use, which motionvas seconded by Mr. Odell and carried. Nine Mile Creek - Overall Plan. The Commission was informed that the Nine Mile Creek Watershed Board had published its first report consist- ing of an overall plan for the development of channels, storage areas and flood plains along the creek'a alignment. This report has been sub- mitted to the State Water Resources Board which body will hold public hearings on the report within the near future. Mr. Hite said that 4 itmary of the report would be prepared and sub- mitted to the Commission before the date of the hearing. Planning Commission Minutes - 7 April 12, 1961 Proposed Land Use Pisa. A number of resident:; from the South Garden Estates, Lake Edina, and Brookview Heights subdivisions appeared be- fore the Commission to discuss the possible use of the now vacant areas along the south boundary of the Village. They were particularly cone:erned about a proposal recently described in the newpaper for the property Jut north of Bloomington and immediately east of Highway #100. Mr. Todd informed the delegation that,the Planning Commission was only now receiving land use proposals from its consultants and that they had, therefore, not yet had an opportunity to give these proposals conuideration. The "Normandale Center" proposal described in the news- pape?r, Mr. Todd added, had not yet been presented to the Commission for revilew. He assured those present that before the Commission took final action on such proposals the residents of the area would be given an opportunity to express any convictions they might have. Mr. Hite described a proposal that was currently being developed for conisideration by the Commission. A general discussion followed as to the advantages and disadvantages of industrial development and how such development might be controlled if it were to be permitted within the Village. Normandale Center. Mr. Gerald Rauenhorst, Pre:,ident of Rauenhorst Con- struction Company, presented their proposal for an industrial - office - apartment development along the Edina - Bloomington boundary just east of Normandale Road. He stressed that they were not seeking any approv- als at this time, but that they did wish to keep the Commission inform- ed cof their }glans. Mr. Jim Hawks, the planning consultant for the pro- ject: described the details of the proposal to the Commission. No action taken. The meeting was adjourned at 11:4b P.
