Anderson had intended to custom build units on this property to satis-
fy the desires and demands of the potential owner -occupants and has,
therefore, no plans to present at this time.
Following Mr. Hite°s presentation, Mr. Todd called for comments from
members of the Edina Highlands delegation present.
Mr. Donald L. Rudgist, 5517 Mirror Lakes Drive, requested an explana-
ti(,n of the present zoning or the property in question. Mr. Hite in-
dic3ted than it was presently zoned Open Development and that, accord-
ing to Village Ordir,�nce; two-family dwellings were allowed in Open
Dea;elepmens District by special permit. Mr. Riidquist then stated that,
due to the elevation of the hightivayt he felt the property was just as
vr:llu;able fur single family purposes as it would be for doubles. He in-
dicated that. at the time their homes were purchased, the residents in
this; area had all been led to believe that there were :restrictions
against �inything other than single family dwelling,. Mr. Hite explain-
ed, that at the time �Mr. Anderson initialed his request, he had been
told -to check with the County for deed restrictions on the property
and that, according to Mr. Anderson, there had been no single-family
restriction,
Mr. Allan Peyer. 5516 Dundee Road, tasked who w -_a:; required to be noti-
fied in ca8es of public; hearing, stating 'that very few uuf the delega-
tion present had received notice from the Vill,i9e. Mr. Hite indicated
that, apecial permit hearings; required notific ition of junly the Adja-
cent property ocirers and ihat, in this Inst.-ance. much of the property
wa vacant and that many of the notices, therevore, were sent to people
who did not live in the area. Mr. Odell added that the Planning Com-
mis�Aun wa actually not required to c-undurt public hearings and that,
legally.only Council hearing:, were necessary. Mr. Peyer noted that he
felt that two-f��Jnlly dwellings wuuld change the character of the neigh-

Mrs,., Peyer asked what plans were being made to tike care of the drain-
age from these two lets and Mr. Hite explained that a storm sewer pro-
ject way now underway.
Mr. Todd noted that the Pl inning Convaission had considered the use of

Mrs. Walter Lindsley, 5525 Chznt-rey Road, indicated than: his objection
to the xequest was to the effect that, once a lesser than single-fam-
ily use was permitted, it was Po;;sible that in time it could go so
far as to even be re -zoned for commercial purposes. He stated, how-
ever, trate he felt specific plans should be presented and that, if
said plats were of a desirable character, the residents of -the area
might be more willing to apprc•.,e of the request.
Mr. Dick Anderson stated that his plans t�3ere to build -very attractive
two-f,imily units of a character similar to he one -family residences
in the area. He pointed out that he telt i;wo-ild not be economically
fey+Sible to build desirable or attractive a single-family home on
the property.
Kr. Wilkinson expressed the fact that the duty of the Planning Com-
mission wa:� to do -the best joie pussiblc 'Co protect the interest of
bots: the developer and the Village. fie stated that he felt that two-
family units on this property would enhance the value of the single-
family property to a greater extent than singles of poorer quality
and 6uggeated that residents of the area take a look at some of the
nearer doubles or, Friance Avenue.
&'fir. Griswold indicated that at the time the permit approval was record-
ed, it hid 6eermad to be an entirely logical transition between the high-
wmy and the residential area, but that he ws not so :;fare now that
Angle-f,,Tnily dwelling,,a, Jould be entirely unreasonable.
h`.r. Todd stated that, so far as he was concerned, the special permit
had been approved with the conviction that this wa;; the hest use of

Mr. Griswold questioned whether there was any other two-family develop-
ment in this: area. Mr. Hite stated that there was not and explained
that this was a lot which had been made somewhat undesirable because
of the traffic movements on adjacent roadways. He informed members
of the Commis:�ion that Tracy Avenue is being paved to a width of over
40 feet and will :accommodate a large volume of traffic.
It was pointed out that, in requesting the permit, Mr. Adelson had stated
that he proposed to build a one-story double, each unit including two
bed 'rooms, two baths, two fireplaces and a wallcout lower level. He had
indicated the t the garage and driveway ar4,ongement would be so design-
ed as to allca>n.= for adequate off-street parking.
A discussion followed during which Mr. Griswold stated he felt that this
property would be no more urdesirable -han other lot_ on both Highway
"169 and Tracy Avenue which now contained single family residences, and
binge there were no other two-family dwellings in the immediate area.

?Aar. Foley. blotion failed to carry with Wilkinson, Lewis and Todd cast-
ing negative votes and Foley and Griswold, affirmative votes. Mr.
Odell abstained from, voting,

Mr. Hite pointed out that the lot dimensions at present were approxi-
rnately 90' X 1315', but that 27 feet would be taken from the lot for

S-61-2.3. R120qct Hills III 6ddition '. Mr. Hite explained that this
one lot subdivision at the northeast: corner of Lee Valley Road and
Shannon Drive had been necessitated by the application for a builfing
permit. It was indicated that lot size was 1509 x 1910 and that lot
frontage would be on Lee Valley Road when it is extended into the M.
Johnson property to the east.
According to Mr. Hite, no improvements were required for subdividing
thi3 property and said plat conformed in all respects to ordinance re-
quirements. Mr. C-a-iswold mo-vred to recommend approval of the plat in
both preliminary and final form, which motion was seconded by Mr.
Foley and carried.
V. FINAL PLATS
5-59-53. F"cedale Acres -Johnson Repeat. (See Minutes of 10-5-60).
These five lots are located on the west side of Halifax Avenue, immedi-
ately :south of West 62nd Street �replat of Lot 17. Block It Peacedale
Acres). Mr. Hite noted that the plat had been previously approved in
prelimin=ary fcrm ,ubject to lot depths being increased by acquisition
of Outlot 1, McClelllan's Peacedale acres and indicated that said Out -
lot had now been acquired. Mr. Lewis seconded Mr. Wilkinson's motion
to recommend appruval and motion carried.
5-59-62. P. at of Part of Broadmore Addition. (See Minutes of
12-9-59). This replat of Lots 1-4, Block 1, Broadmore Addition, Mr.
Hite e,iplained, had previously been approved in preliminary form with
the stipulation that lot depths were not to be lessened. It was point-
ed out that the depth change had not been approved due to the fact that
it was based on a relocation of Highway #169 which was, and Is now, sub-
ject to change and that if the highway were not located in the area set
aside by Mr. Fridlund's replat, there would be no need to shorten t -se
lot,c
hr. Hite informed members of the Commission chit Mr. Fridlund has now,
propo6ed to enter into an agreement with both the Village and the pro-
specti,.>e b--jyer!s of the rapla-' 'ted lots to the effect that, if the high-
way is not relocated into the area outlined in his preliminary plat, the
lot;, will be restored to their normal 160 foot depth.
Mr. Levis moved to recommend final approval of the plat, which motion
was seconded by Mr. Foley and carried.
5-60-11. Siouthdale Acre (See Minutes of 6-8-60 and 4-12-61). The
final plat of the Southdaie rioperty lucited north of 66th Street was
presented for Lonsiideratian, It conformed In all respects with the
preliminary apprG-ved at ii6-h& April meeting. Mr. Hite recommended th4t

1) A temporary turn -around easement to be furnished for the
north end of Drew Avenue.
2) Developer to make available, upon request by the Village
and at no cost to the Village, additional. right-of-way
for access to properties to the east of the Southdale Acres
plat.
:3) Developer to enter into agreement with the Village regarding
installation of roads:
Mr. Griswold moved to recommend final approval of the plat, subject
to the above mentioned condition;. Motion was seconded by Mr. Wil-
kinson and carried.
S-50-29. Stow', De.,angy Addition - Mc02y R-pL See Minutes of
10-5-51). Mr. Hite explained that no improvements were required in
this hive lot subdivision located on the south gide of West 70th Street
between the Cornelia School and Heatherton Trail, which had previously
been approved in preliminary form. He recommended approval of the final
plat subject to the granting of an easement for road purposes over the
north 7 feet of Lots 1-4 and indicated that this 7 feet adckd to the 33
feet already available will produce the needed 40 feet for improvement
of West '70th Street. Motion c:ar: ied following a recommendation for ap-
proval by Mr. Wilkinson and a secind by Mr. Lewis.
S-51-18. Otto°s Third Addition.See Minutes of 4-12-61a. This seven-
teen lot plat of the property located along the west side of Nine Mile
Creek just north of & st 70th Street conformed in all respects to the
Previously approved preliminary.
Mr. Wilkinson movod to recommend final approval subject to the following
conditi ons, s
1) All lots to ha'va surface drainage to either Creekview Lane or
Nine Mile Creek.
2) All lttt; to be graded to an elevation of not less than 838
feet..
3> Outlots 1 and 2 to be either deeded to or made available to
the Village of Edina for Nine Mile Creek flowage and flood
plain.
4) Sanitary GOe.er lateral and watermain lateral to be installed
by developer to service all lots in this addition. Watermain
is to be looped from Lirexic:k Lane to Brook Drive.
5 ) Creekview Lane is to be graded and gra4-elad by developer.

6) Catch basins and storm serer pipe to be installed to trans-
port storm flow from low point in cul-de-sac to Nine Mile
Creek.
!) The rear of Lets 1-7 in Block I is -co ba so graded that exist-
ing storm water surface flow across these properties may be
safely transported to Nine Mile Creek.
5-61-25. Prospect Hills Third Addition. See Prospect Hills Third
Addition under PRELIMINARY PLATS - these minutes. Both preliminary
and final approved in one motion.
S-60-41. ReAlat of Lots 9-& 1.0, Brookside TeSracg. (See Minutes of
10-5-60). Since the final conformed in all re3pects to the previously
approved preliminary and no improvements were required, Mr. Lewis moved
to :recommend approval, which motion was seconded by Mr. Wilkinson and
carried.
5-60-46. Chanel Hill ConGrecaationtl„ (See Minutes of 12-7-60, 1-4-61
and 2-4-61T. A final of the plat of the Chapel Hili Congregational
property located north of Highway #169 at Gleeson Road was presented
for consideration. It was indicated that the final conformed to the
block outlines in the previously approved preliminary, but that lots
and streets were not being included. qtr. Hite noted that, before build-
ing permits civ+jld be issued, addi-iional platting would be required.
Mr. Lewis moved to recomend approval subject to the granting of a 30
f00%, road easement along the east side of Lots i and 3. Motion carried
following a second by Kr. Grisraold.
