IN THE EDINA VILLAGE HALL Members Present: T. L. Todd, Chairman; William Lewis, David Griswold, John Foley, Leonard Odell; George Hite, Planning Director; Warren C. Hyde, Village Manager. The meeting was opened by Mr. T. L. Todd, Chairman. I. PrQposed T_e_mpQxayv Excavation D' riot Urdin n e 8mendment. Mr. Hite presented to the Commission a draft of a proposed amendment to Ordi- nance No. 262. This amendment had been considered by the Council on Monday, June 26, and referred to the Planning Commission for their recommendation. Mr. Hite indicated that the principal change in the ordinance as pre- sented was that it now required that any person mining, stripping, ex- tracting or excavating within the Village have a permit from the Coun- cil to do so. Under the old ordinance, it wa's only necessary to have the property on which any of those operations were to take place zoned Temporary Excavation District. It was suggested that this proposed amendment would be the first of many as the existing ordinances regulat - ing excavating within the Village were considered to be inadequate. During the discussion, considerable comment was made regarding the lack of clarity and the limit of scope evidenced in the proposed amendment. It was suggested that the ordinance be re -studied and to -drafted and that it include all of the proposed provision changes and that it be so drawn that it would stand by itself rather than continually referring to other ordinances, especially Ordinance No. 56o Mr. Lewis then moved that the ordinance be re -drawn and re -submitted to the Commission at its July 5th meeting for additional consideration. The motion carried following a second by Mr. Griswold. II. SPECIAL PERMIT REQUESTS P-61-13. Stow Develotiment Coloration. Excavation -Permit. Nelson Farm. ( See Minutes of July 6, and December 7, 1960). The request of the Stow Development Corporation for a permit to mine material on the Nelson Farm Property was presented for the Commission's consideration. Mr. Hite noted that this request was similar in many respects to a request submitted by the Stow Development Corporation early this year. The letter of application petitioned that a permit be granted to remove earth material from the areas designated south hill and north hill on an attached plan prepared by Mr. A. C. Godward, dated August 18, 1960. Enough material would be removed to reach the grade levels indicated on said plat, and the amount of said material would be approximately 1,500,000 conic yard;.;. Planning Commission Minutes - 2 June 27, 1961 Mr. Hite reviewed previous action taken on this request and recommended that a permit be granted to mine material under the provisions of the proposed Ordinance No. 262-A and that said permit be based upon a topo- graphy plan prepared by the Village and previously referred to as the "colored cross-sections". The cross-sections, as recommended by Mr. Hite, would result in a minimum ground slope of 5% in those areas which now had ground slopes in excess of that figure and that, based upon those cross-sections, approximately 1,000,000 cubic yards of material were available for mining. Mr. J. E. Brill, attorney representing Mr. Stow, upon the advice of Mr. Stow's engineer that Mr. Hite's figures were substantially correct, amended the Stow Corporation request so that it made reference to the cross-sections as developed by Mr. Hite and so that the amount of mater- ial to be mined represented about 1,100,000 cubic yards. Mr. Brill also asked that there be no requirement for a performance bond, but that in the event there was to be a bond required, it be a minimum amount. During the discussion, considerable attention was directed to the fact that the eventual land use of this property had not yet been determined and that,under existing circumstances, consideration of the excavating permit would have to be based on the assumption that the land was to be used for residential purposes. Mr. Lewis then moved that the excavating permit request under consideration be tabled until such time as Ordinance 262-A had been prepared for recom- mendation to the Council by the Commission and that,in the meantime, the Village staff and the applicant's engineer and attorney attempt to re- solve any points of conflict that may have special reference to the de- velopment of the finished topography survey discussed earlier. Mr. Odell seconded the motion which carried. III. OTHER BUSINESS Land Ule 1 2posal. tigrt21S2n Property and iyormandale Cent r. twr. coward Dahlgren, Planner representing the Rauenhorst Development Corporation and the Bertelsons, presented some preliminary land use proposals to the Commission for the development of most of the area lying along the south Village limits from Normandal.e Road east to the Oscar Roberts property. The plans include the establishment of a single and multiple family area within the 40 acre tract lying immediately southeast of South Garden Es- tates along with a proposal for a substantial enlargement of the Village park now located at approximately 76th Street and Kellogg Avenue. Mr. Dahlgren indicated that the proposals as presented conformed substantially with the land use plan for that area currently being developed by the Commission and that, in his opinion, such plan represented a satisfactory land use arrangement for that area* Planning Commission Minutes - 3 June 27, 1961 Members of the Commission expressed general concurrence with Mr. Dah1- gren`s presentation and accepted the proposal for additional study. Mr. Hite presented for the Commission's consideration a proposed procedure section for the establish- ment of an Industrial Park District and indicated that additional sections of the proposed ordinance were now being developed.
