Hite reported that the Nine Mile Week Wataish& Board had instructed its engineer to contact the applicants and attempt to resolve the handling Do Nine Mile Creek thiough the Nelson Farm property. This maeting, it wcs zeported, had not yet been held. My. A! Godward, engineer fai the applicants, submitted a revised overall development plan for the Farm which incorporated many of mho changes previously suggested by the Commission and the State Highway Department. A petition by the Quanhorst Construction Co. for Planned induEtijej Distlict on the 40 acxe tract situated on the zcuth,26t norn= of Oust 76th Streot and France Avenue was accepted fuK consijoyation. Mr. Hite reported that the opplicants had submitted ievited p3titiow which requested that a spacial permit be issued for El gasoline service station foz those parts of Lots 23, 21, 22 and 209 And. SuK. 172, zoned Community Store District, which piopeyty, he reported, would h? a square on the northwest corner Of France Avenue end West 40 Street having frontages of 135 feet on both Fiance Avenue and Nast 49j Street. A second petition 2 xequosted that if the first petition weie appzoved that then the Council also Yezone the first 15 feet north of the pyopexty contKned in the fiyst petition, from Open Envelopment District to Community Store District with the gasoline service station permit also extended to cover this additional 15 feet. It was xeported that site plans as well as building plans had been submitted with the new petitione. These plans were viewed by the Commission. Haedpckw Side Yayd, 5524 West 70th Scree t41 -r. Haedecke requested permission to build living space over his existing garage, which garage now has an 8 foot side yard. Under current Zoning regulations, the side yard should be 15 feet. for. Hite reported that the 3 foot side yard was permissible when the hole was built and that the continued existance of the S foot side yard would nOt in any way interfere with the use of adjacent properties. Hite presented the request for IMr. McCampbell. He stated that Mir. McCarpbell wished to locate -the northwest corner of a proposed residents- 25`-0" from front property line at 6700 Point Drive, Lot 14, Block 1, Sout'rdale Third Addition. The topography of property limits the useable area. Mr. Hite suggested that a definite ha.dship existed and recommended approval. Mir. Lelaais moved for approval; fir.
