THE EDINA PLANNING COMPNIIISSION HELD
WEDNESDAY, AUMST 7, 1963

Members Present: T. L. Todd, Chaixnian, Willi -am Lewis
Staff Present: George C. Hite, Planning Director
MIx. Hite advised that al hough there -..%las not a quorum present, that a
number of the Variance requests have already been scheduled for public heaxings
before the Council on August 12, and that he therefore requested that these
variances be considered tonight, and that if they mat- with approval that the
rest of the Planning Commission be so advised and i-1 they then met with their
approval, that the Council be advised that the Plan.-ning Commission had
recommended approval of the requests.
Both Ux. Todd and Mr. Lewis agreed that this would be the proper
procedure as long as ,he hearing dates had been set and the notice already sent.

Err-na Abbott Park into two pax Gals , the more westerly
one of which would have a fyontage along Division Street
of 164 feet and a depth of 100 feet. it t;,,,as noted that
the pioposed lot depth of only 100 feet was less than
the Oydinance xequizemient of 120 feet.

of all adjacent property owners and that although the lot
was 20 feet short, in depth, this was more than overcome

Mi. Hancock's request or a va-_rianco permitting a west side
yard of 10 feet was presented by Nix. Hite, who explained
that because of the extra heicht of the building, the

application indicated that there existed on the next
adjacent lot a 20 foot perpetual easement for sewer and

Mr. Hite presented a revised and enlarged draft of the
proposed Commercial Zoning District Oxdinance foi the Commission's
review. He noted in particular that the new draft omitted all
reference to conditional uses and substituted instead a new district
labeled C-4, intensive Commercial District. The uses which had been
conditional in the C-1, C-2 & C-3 Districts were now permitted as
principal uses in the new C-4 District. He advised that this had
been done because of recent court decisions in this state which,
in his opinion, indicated that the courts neither understood nor
desired the conditional use approach to handling these unique
land uses.
The meeting was adjourned at 9:30 P.M.
