Swcndseen. CommWrci Zoning Eden Avenue.- (See minutes 7-11-639 10-2-53).M Mr. Hite briefly reviewed the surrounding land uses and zoning. He stated that the adjacent single family residential area had developed subsequent to the establishment of the commercial zoning on the Swendseen property. Mx. Roy 6aerg2s, 5241 Edenmoor Avenue, representing the Richmond Hills Association, stated that his group had met with Tom and Jexry Swendseen and that both parties felt that an agreement had been reached as to "Che futuxe use of the Swendseen property. MIr. .Terry Swendseen indicated that he objected to a rezoning of the property, but that he mould be willing to follow any setback regulations that the Vi -lege a,,ould request. His letter of reply dated October 9, stated that the lots too the wept of 'Che proposed apartment project, 17, 18 and 19, tae e not being considered at this time for any usage because of their wet nature, but that at some future date, the area may be filled and used for single family residential home site,.. Mr. Dietrich°s letter also stated that he hoped to complete the development of the multiple site in approximately vwo years from the date of initial building permit issuance. M.. Hite presented a written report on the proposal which generally •reccm.mended that the property be rezoned to R-3 District and that all of the land o°, ncd by the applicant, be included in the project at this time. M . Leonard Par'<er, architect, once again explained the proposal in some detail noting particularly the presence of the 2-J story buildings which Mould not be permitted by the R-3 zoning suggested by Mr. Hite. He indicated that in his opinion, the presence of a group of 2-•J story buildings on the site in conjunction with the other proposed two story and to -an house apartments would be entirely at:p opriate. Mi . Dietrich stated that he had no objection to including Lots 17, lig?, znd 19 in the proposal and that he, too, felt that 2-1 story nits ware a logical part of the overall development. He further indicated that the first s•cage of the proposal would include a ,mall grouping of the torn mouses as ::tell as a number of the 2--w story buildings. The two lower levels open to the read and contain parking for 122 cars, storage rooms, recreation Booms, etc., but no dwelling units. A 22,500 square foot patio area containing a pool is situated between the lower level and'the pond. The seventh level contains 4 three bedroom units. All units exceed the ordinance requirements for minimum floor area. The Eschitect, Mz . Uldis Treibergs, presented photographs of the property and also presented very complete site and bui'ding plans. He stated that he felt that this proposal was a gGod one for the area znd the site. Pyr. Nordstrom indicated that Financial backing was, at hand and that their corporation was anxious to prcceed as quickly as possible as they would like to !start constxuction in the Spring of 1964. After considerable discussion, fir. Hyde suggested that Air. Andahazy, the Village Attorney and he meet together with Rev. Polson was asking permission to project an eave overhang to within two feet of this sar;e property line. The .zoning ordinance, he added, would require that the eaves be Tour feet back from this same line. The building itself, it was rioted, was back the required five feet from the property line. ;i .
