Mr,, Shwj moved that the August 20, 1970, .Beard Minutes be approved as

Affidavits of Publication in the Edina Sun on September 3, 1970,
and of Mailing Notice September 4, 1970, were submitted, approved and ordered
placed on ftle,,
Mr. Iloisington stated that the house in question already exists.
Ile indicated that a wall, supporting the garage overhang, has been built which
extends three feet into the required 30 foot front yard setback. lie further
indicated that the problem is to either grant the variance so that ::he wall
can remain or deny the variance and have it removed.
Mr. Hoisington stated that althou-,gh Title Insurance has expressed
concern, he feels that the minor encroachment involved need not warrant the
removal of the wall, as such roof encroachments are normally permitted.
Mr. Shaii moved that a variance be approved in the amount of three
feet or the existing encroachment, whichever is svnlalleT, for the following
reasons:
1. acne variance is a minor one and thus will not be detriment .l
to other properties in the area.
2. Denial of the varianc,2 would cause the wall to be removed,
thus imposing a hardship on the property.
3. There is some quas�.ion as to whct-her a variance is even
needed, since such roof cucreachments are normally permitted
without vagi nee Carried.
