Old Business: 1. Subdivision Wallace B. Kenneth. Generally located east of Lincoln S-77-2 Drive and west of Malibu Drive extended. R-4 Multiple and Family Residential District and R-1 Single Family Resi- Rezoning dential District to R-4 and R-2 Multiple Residential z-77-4 Districts and R-1 Single Family Residential District. Mr. G. Hughes recalled the Planning Commission had reviewed this request, as modified by Wallace Kenneth, for subdivision and rezoning of Interlachen Hills 3rd Addition and for a special flood plain permit on April 19, 1977, and had previously reviewed and approved this request on March 2, 1977, prior to its modification. He proceeded to explain the location of the area in question. Mr. G. Hughes said when the Planning Commission reviewed the request on March 2, 1977, the original plan consisted of 40 single family and two-family lots along the east side of Lincoln Drive, two large R-4 apartment lots on the west side of Lincoln Drive, and two outlots. The Planning Commission recom- mended approval of the proposed subdivision, rezoning, and flood plain permit requests with the recommendation to the City Council for dedication of Outlots A and B, because of their location in the flood plain, for open space, park purposes, and water storage. Mr. G. Hughes recalled the City Council heard the original request on March 21, 1977, and after considerable deliberation, adopted a motion recommend- ing approval of the proposed subdivision, rezoning, and the issuance of a flood plain permit for Interlachen Hills 3rd Addition. This recommendation was based on the agreement by Mr. Kenneth to deed to the City Outlots A and B for open space, park purposes, and water storage areas. The City Council had further advised Mr. Kenneth that if he came back with the necessary hardshells and linens, developer's agreement, and the deeds for Outlots A and B for final approvals, they would consider granting preliminary and final subdivison, re- zoning, and flood plain permit approvals. Mr. G. Hughes said, however, that following the March 21, 1977, City Council meeting, Mr. Kenneth modified his proposed plat because at the time he originally presented his proposal, he had not known the dedication of both Outlots A and B would be required for final approval. He had thus proceeded to review his plan once again with the desire to use the maximum 20 percent flood plain encroachment allowed by the Nine Mile Creek Watershed District and asked to add eight additional R-2 dwelling lots on the west side of Lincoln Drive so as to obtain the full use and benefit of Lincoln Drive. Mr. 'Kennet: was agreeable to providing a 60 -foot access point be- tween the apartment sites and R-2 lots for public access. Mr. G. Hughes indicated all other features of the subdivision were identical to what was previously re- viewed including the road alignment and location of other lots. He said this modification, however, would reduce the size of the outlot Mr. Kenneth would 5-11-77 Planning Commission Minutes, Page 2 deed to the City from 59 percent to 36 percent of the total. He noted that on April 19, 1977, the modified request was considered by the Planning Com- mission, who continued the request until June 1, 1977, for furthcr review of the road alignment of Lincoln Drive and Malibu Drive, the location of the additional R-2 dwelling lots, and the advisability of eliminating the proposed cul-de-sacs on Lincoln Drive and Malibu Drive to create a through street. a Mr. G. Hughes said that following the April 19, 1977, Planning Commission meeting, however, Mr. Kenneth stated that he felt he had received assurance from the City Council regarding the possibility of receiving both preliminary and final approvals at the same meeting with no further delays and felt that the proposed modifications were not substantial ones. Zh'us, on May 2, 1977, at the proponent's request the City Council set a hearing date for May 16, 1977, for both final and preliminary approvals. Mr. G. Hughes said the City Council considered the action of the Planning Commission on April 19, 1977, but felt that because of the history of this property, they wished to move as rapidly as possible witrput any undue delays. City Council indicated that if the Planning, Commission wished to make further comments, they should do so prior to the May 16,1977, City Council meeting so they could be heard at that time. Mr. G. Hughes continued by explaining the road alignment of Malibu and Lincoln Drives and pointed out that when Mr. Kenneth first presented his play, for approval, staff did advise him of past City Council action regarding the Western Edina Circulation Plan which was prepared by a task force made up of residents in the western Edina area in 1974. This plan indicated no connec- tion of Malibu Drive and Lincoln Drive, and thus staff recommended Mr. Kenneth provide a cul-de-sac at the south terminus of Lincoln Drive and at the north terminus of Malibu Drive. Staff recommended approval of the proposed modifications to the subdivi- sion, rezoning, and flood plain permit requests in that: 1. Net flood plain encroachment remains at 20 percent. 2. The eight additional R=2 lots will allow the proponent to utilize Lincoln Drive to the fullest possible extent and will relieve the City of financial participation in the construction of Lincoln Drive. 3. The proposed roadway alignment is in conformance with the Western Edina Circulation Plan. Approval is contingent on: 1. The proponent must remove fill from the two R-4 multiple lots such that the net flood plain encroachment does not exceed 20 percent_ 2. Lots 1 through 13 should be identified as an outlot .in that access is not available. 3. Acquisition by the City of Edina of the remaining portion of Outlots A and B. t 5-11-77 Planning Commission Minutes, Page 3 Mr. Kenneth said the basic purpose of this road planvas to prevent unneces- sary traffic to and from the apartment sites through the res?.dential areas. He also stated that his intent was to conform with the City's traffic plans. Mr. Bob Dunn, City Engineer, proceeded to explain the proposed circula- tion plan as designed for that area. Mrs. McClelland said the Western Edina Circulation Plan showed Lincoln Drive as an extension in the northwest corner of the site to allow access from the Park -wood Knolls area. Thus, this plan was in conformance with the Western Edina Circulation Pian as prepared by the residents of western Edina. Following discussion, Mr. S. Hughes moved for approval of the proposed plat and rezonings of Interlachen Hills 3rd Addition and for approval of the special flood plain permit with the recommendation to the City Council that further consideration be given in regard to connecting the cul-de-sacs, to form a through street. He said, however, that either theproposed plan or a revised one with connecting cul-de-sacs would be acceptable. Mrs. McClelland seconded. All voted aye. Motion carried. III. Adjournment.
