Block 1, _... Clifton Terrace. Refer to: Planning Cinrmiasion Minutes dated 1-6-65 and 8-2-67; Council Mintuea dated 2-1-65, 9-18-67 and 12-4-67; and enclosed map (Bach case). This is actunlly the fifth rezoning request for Lot 3 which is located on the northeast corner of West 64th Street and Brook- viea Avenue. The first two requests in 1962 and 1964 were for R-3 atoning and both were denied by the Coutteil Lt the recommendation of the Planning Co-�-mis:ion. The third requeSL in 1965 :raa for R-2 zoning; which was recommended for approval by the Planning Commission and was denied by the Council oii a 3 to I £al~orab.le. vote. Approval required 4 votes .and only four medoer:s of the Council were present with one voting nay. The fourth request was made in 1907 for R-2 zoning. Lester Hughes, 6237 Brookview Avenue, spoke against the rezoning, indicating that when he purchased his property in 1961, the Planning Commissioa acou--d hire that, to the beast of thein knowledge, their® would be no multiple. BACH R-1 District to R72 Multiple District 6329 Brookview Avenue PLANNING COMMISSION. AUGUST 2, 1967 Mr. Hite reported that the Planning Commission has, in the past, considered a double bungalow to be the most appropriate use of this lot. The area of the lot is 12,375 square feet and is less than the 18,000 square feet required for R-2 lots. If the zoning is approved, the Board of Appeals would need to grant a lot area variance before a permit could be issued. Mr. Hite suggested that it would be appropriate to ask the petitioner to face one of the units toward Brookview Avenue and one toward the Crosstown Highway. Mr. Tom Doughterty, represented Mr. Bach, stated that at the present time his client has no specific building plan, as he first wanted to get the zoning established. He stated that his client will develop the land as requested by the Commission and Council. He also noted that he and his client are aware that they will have to obtain a lot area variance. Mr. Hiatt moved that the Commission recommend approval of the R-2 zoning request subject to Board of Appeals approval of lot area variance and the facing of one unit toward Brookview Avenue and one unit toward the Crosstown Highway. Mr. Nugent seconded.the motion. All Voted Aye. Motion Carried. VILLAGE COUNCIL. SEPTEMBER 18, 1967 Mr. Hyde presented the request of Mr. H. J. Bach for R-2 zoning for property at 6329 Brookview Avenue, the hearing for which had been continued from September 5, 1967. Mr. Hite pointed out that Planning Commission has recommended approval of the zoning change which is opposed by a number of property owners in the area. If the request is, approved, the matter will go to the Board of Appeals on September 21 for consideration of a variance. Mr. Bach advised that because his architect had not submitted pians for the proposed double dwelling, he would request an additional continuation of the hearing. Mr. Donald Johnson presented a petition requesting that the zoning be denied at this meeting so that it would not be necessary for them to come to an additional meeting. Mayor Bredesen stated that inasmuch as the hearing had been continued in order that Mr. Bach could submit his plans for the building, and in order to determine if Hennepin County would release the right-of-way adjacent to the property as it had agreed to do in 1962, it would seem that an additional continuation would be in order. Discussion ensued as to whether Mr. Bach could obtain permanent access or an easement to construct his driveway over the right-of-way. Mr. J. R. Otto, 6324 Brookview Avenue, suggested that the hearing be -continued until November in order that all information would be available as to building plans and the easement. Trustee Johnson advised that it should be noted that Council is not implying approval of the zoning change by continuing the matter. Mr. Bach was assured by Mayor Bredesen that Board of Appeals would also continue the variance hearing until Council has reached a decision. Trustee Johnson then moved that the hearing be continued to November 20, 1967, which motion was seconded by Trustee Van Valkenburg and unanimously carried. Z-67-15 H. J. Bach Page -2 VILLAGE COUNCIL. NOVEM3ER 20, 1967 Mr. Hite advised Council that the hearing on rezoning property of Mr. H. J. Bach, located at 6329 Brookview Avenue, should be cancelled because Mr. Bach had failed to, submit plans as he had agreed on September 18. Mr. Bach advised that he now has building plans for the property in question and requested that the hearing be conducted as soon as possible. Turstee Courtney's motion was then seconded by Trustee MacMillan and carried that hearing date for the zoning request be set for December 4, 1967. VILLAGE COUNCIL. DECEMBER 4, 1967. Affidavits of Notice were presented by Clerk, approved as to form and ordered placed on file. Mr. Hoisington presented the request of Mr. H. J. Bach for rezoning of property at 6329 Brookview Avenue from Residential District R-1 to Multiple Residence District R-2, stating that this hearing has been continued from September 18, 1967. Mr. Hoisington pointed out that this zoning would be contingent upon the granting of a variance by the Board of Appeals, inasmuch as this lot is 12,375 square feet, and, therefore, less than the 18,000 square feet required for R-2 lots. This variance would not be necessary if the ordinance revising multiple district requirements currently being contemplated should be adopted. The property is bounded by the Crosstown Highway right-of-way on the south, R-3 Multiple Residence zoning on the east and Single Family District R-1 on the west and north. Mr. Thomas Dougherty, attorney representing Mr. Bach, advised Council that the County Highway Department had indicated that it had no' intention of revoking the license issued to Mr. Bach which would permit construction of a driveway over County right-of-way to the south of the property. This right-of-way would cause the lot to appear to be considerably larger. Mr. Hite pointed out that the Planning Commission has considered this property suitable for either a single family dwelling or a double bungalow but that because of the proximity of the highway and the R-3 zoning, it is possible that the property would be developed more favorably if a -double bungalow were constructed on the site. Messrs. James Otto, E. P. Lamphere, N. L. Alpers, and John Keprios, all residents of the 6300 block of Brookview Avenue spoke in opposition to the proposed zoning, stating that this is a single family neighborhood and that they objected to the R=2 zoning on the grounds that the construction of a double would attract a less permanent type of resident and would have a negative effect on the value of single family dwellings in the area. Mr. Folke Victorsen, 6220 Brookview Avenue, advised that at the time he built the first double bungalow on the Crosstown Highway, he was advised that while four plexes would not be permitted, all lots along the highway would be considered R-2 building sites. Mayor Bredesen advised that it. is possible -that Mr. Bach purchased the property for speculative purposes and that a double bungalow might have an adverse effect -on Brookview Avenue property in future years. He also advised that if this zoning, 'were approved, requests for the same zoning might be received for 'Other -vacant lots in the area. Trustee Van Valkenburg stated that, based on the size of the lot, he doubted if the Board of Appeals would grant a variance to the degree requested which reduces the lot size to one-third of the required R-2 lot.
