Attention: Mr. Fred Hoisincton Gentlemen: Better Child Care, Inc. would like to request an amendment to the R-3 Multiple District Zoning Ordinance to allow child care as a permitted use. This request is being made to allow Better Child Care to construct and operate an experimental Model Day Care Center on Cahill Road across from the Cahill Shopping Center. The business'of Better Child Care shall be to plan and manage a day care program sponsored by major corporations for the benefit of their employees. The Center to be located in Edina will function as the company's experimen- tal laboratory and training facility for its staff. The location is ideally suited since it is adjacent to a combined industrial and office park.and also adjacent to a residential environment which has traditionally been the focus for child care and/or nursery school programs. We have been asked to remind the Planning Commission that a similar request for an amendment to the Commercial Zoning Ordinance was requested at the April meeting in conjunction with the site in the Edina interchange park. Better Child Care feels that the new location is in many ways preferable from the standpoint of both parent and child utilizing the Day Care Center. It is our hope that this matter be considered at the July 6th council meeting and that, should circumstances warrent, a second hearing of the proposed amend- ment be waived. This would greatly facilitate the company's plans to begin construction immediately, allowing the Center to open in the early Fall of this year.' Company Gentlemen: We understand that .the Village.Planning Commission intends to meet on Wednesday, July 1, 1970 at .7:30 P.M.'to.review the plan .for the Oscar Roberts Company property at France Avenue and West .72nd Street.. We assume that .this meeting has been called in response to our suggestion, made .in the course'of negotiations with the Village Attorney and others, that the Oscar Roberts Company would accept the Village's proposal that .the ready mix plant would be removed, within ten years, provided that the Village :would agree to two changes in the proposed replatting of the Roberts property previously discussed, namely that the R-3 segment be rezoned R-4.and that the R -3/R-4. segmentsbe provided with an exit to West ,72nd Street.. I enclose a photocopy of a drawing which was furnished to me by the Village Attorney so that there will be no misunderstanding of,the intention of our proposal. We hope that the Planning Commission will be able to respond to this proposal immediately following the hearing. We do not intend tomake any presentation or to become involved in any discussion at the hearing although we recognize that, if the Planning Commission believes that the suggestion and proposal have merit, definitive plans and agreements will have to be prepared and proper procedures followed to carry out the understanding and formalize the agreement. Briefly, however, it is Mr. Roberts'. view that R-3 zoning would not allow him to dispose of the property at a fair price, particularly in light of the response of developers to his past efforts to dispose of the property. The sooner that he can dispose of the property, of course,. the sooner he will be in a position to: remove the ready mix plant .and related operations. Village. of Edina Page Two June .26, 1970. In previous discussions with the Village,.Atto.rney and others, we .indicated that Mr. Roberts.would be willing to remove the block plant within five .years and to remove`or otherwise improve the hill from the.southern part of the property, adjacent .to Parklawn Avenue. Mr.' Roberts. has already taken steps to dismantle the sand and wash plant.'. In these discussions, also, we :understood that .the Village would be willing to permit Mr. Roberts to defer.the installa- tion of utilities until the property is actually developed, and not . require installation as a condition of plat approval, and would also give the "Oscar.Roberts.Company the necessary permit to make permanent repairs to. the premises damaged by fire. If the. Village Planning Commission is not .able to give us a def.initive:response',to the proposalupon conclusion of the hearing on July 1, we must insist that the Board of Appeals and Adjustment. set an immediate hearing date .for a determination of the appeal respecting the extent of.damage.to the .ready mix plant and the related question of whether the plant is a permitted nonconforming use,and therefore whether the Village has grounds to withhold a building permit for repair of the .fire.damage, Ias formally requested by .our letters and notices of appeal to. the .Board of Appeals and Adjustment dated March 18, 1970 and March 5, 1970. We _share the hope of the Village Attorney and others that all problems between the Oscar Roberts. Company and the Village of Edina can be resolved, and it is to. that end that we made the proposal referred to. in the '.early part of this letter over one month ago. It it is not .possible .to. dispose.of all controversies in this manner, it important that .the matter of the building permit be resolved so that the Oscar Roberts. Company will have time.to provide the, permanent repairs before cold weather and make.commitments to its customers and suppliers on that basis. [students together for the elimination of pollution] we are writing this letter to inform the.planning commision of our ideas concerning the urgent problem of pollution. We would like tp commend you on the new burning ordinance and for moving the enforcement of the law from September to July. We feel this was a much needed ordinance, and,we appreciate your work on it. We also feel a need for no -dumping laws, and enforcement of these laws. There are several vacant lots and natural drainage areas that citizens of Edina treat as an extra garbage can. We feel that if these areas..were.cleaned.up there would be less temptation to throw wastes in there. S.T.E.P. would like to.offer it's services in cleaning �. up these areasif and only if you would promise.to keep these areas clean by strict law enforcement.
