VACATING UTILITY EASEMENT
WHEREAS, a petition was received on July 28, 2014, from Mesaba Capital requesting vacation
of a 10 foot utility easement per document number 1033725, item number 6; and
WHEREAS, two weeks published and posted notice was given and the hearing was held on
September 16, 2014, at which time all persons desiring to be heard were given an opportunity to be
heard thereon; and
WHEREAS, the City Council deems it to be in the best interest of the City and of the public that
said vacation be made; and
WHEREAS, the City Council has determined that the easement is not needed for public
purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edina, Hennepin
County, Minnesota:
1. That the following described easement is vacated:
An easement for utility purposes over under and across the east 10 feet of the west 30 feet
• of Lot 2, Block 3, Yorktown, according to the recorded plat thereof, Hennepin County,
Minnesota.
2. That the Mayor and the City Manager are authorized to execut all documents necessary, in
the opinion of the City Attorney, to effect the transfer of this pro erty.
