INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter upon the easement premises during non -peak traffic periods (the peak traffic periods are defined below), after providing reasonable notice to Grantor to construct, reconstruct, inspect, repair, and maintain said public watermain and storm sewer systems over, across, on, under, and through the easement premises, together with the right to grade, level, fill, drain and excavate the easement premises, and the further right to remove trees, bushes, undergrowth, and other obstructions interfering with the location, construction, and maintenance of said public watermain and storm sewer systems. The peak traffic periods for bus and car traffic to and from the Grantor property during which the City shall not enter the Easement, except in the event of an emergency, are the following time periods that occur Monday through Friday during the months of January, February, March, April, May, June 1 through June 15, and the months of September, October, November and December of each calendar year during the term of this Easement: a. 6:30 a.m. — 7:30 a.m. b. 9:00 a.m. —10:00 a.m. 189598v1 1 C. 2:00 p.m. — 3:00 p.m. d. 4:00 p.m. — 5:00 p.m. The above named Grantor, for itself, its successors and assigns, does covenant with the City, its successors and assigns, that it is well seized in fee title of the above described easement premises; that it has the sole right to grant and convey the easements to the City; that there are no unrecorded interests in the easement premises. 4-1 IN TESTIMONY WHEREOF, the Grantor hereto has signed this agreement this -a4 day of (.t-fl�� , 2016.
