As of July 29, the required number of signatures to authorize a lakewide algae treatment has not arrived. Before a lakewide algae treatment can be authorized for the 2016 season, five more signatures are required. Therefore, your request for lakewide algae control on Hyde Park Pond has been respectfully denied. The DNR considers the relevant criteria listed in Minnesota Rule 6280.0450 subpart la to allow treatment of an entire basin, "Before issuing an APM permit, ... for lakewide control of algae, the commissioner shall require dated signatures from a majority of landowners on the lake. The signatures may be provided in an electronic format." Five more signatures are required to reach the threshold needed to permit lakewide algae control on Hyde Park Pond. This type of treatment has occurred in this basin. Thus, your request for lakewide algae control can be authorized once at least five more signatures are received. The fee submitted with your original application is sufficient; no additional fee is required. Please be advised, "If an APM permit is granted with conditions or denied, the applicant may file with the commissioner a written request for review. The commissioner shall review the permit application and render a decision within 15 days of the request for review" (Minnesota Rule 6280). Correspondence for Commissioner Landwehr may be sent to 500 Lafayette Road St. Paul, MN 55155-4040.
